Introduction
1. "Weather Lottery", "we", "us" and "our", are references to Weather Lottery, the trading name of Plus Connect (NT) Pty Ltd ACN 148 004 344, a company registered in Australia under the Corporations Act 2001 (Cth).
2. Weather Lottery is licensed by the Government of the Northern Territory ("NT Government") under the Racing and Betting Act 1983 (NT) to accept wagers by telephone and via the website at www.weatherlottery.com.au ("Website").
3. These terms and conditions ("Conditions") shall be governed by and construed in accordance with the laws of the Northern Territory and each member of the Website ("Client") irrevocably submits to the non-exclusive jurisdiction of the courts of the Northern Territory in respect of any dispute or matter arising from, or out of, these Conditions.
4. The regulatory authority is the Northern Territory Racing Commission, or such other authorized by the Racing and Betting Act 1983 (NT) for that purpose.
5. Any concerns in relation to a bet between a Client and Weather Lottery ("Bet") should be brought to Weather Lottery's attention by emailing complaints@weatherlottery.com.au.
6. You are entitled to bring a dispute you have in relation to a Bet to the Northern Territory Racing Commission. The email address for lodging disputes with the Northern Territory Racing Commission is gamblingdisputes@nt.gov.au. The decision of the Northern Territory Racing Commission is final and binding on both parties.
7. Weather Lottery participation and creation of a betting account is only open to individuals who are 18 years of age or older and legally entitled to participate in legal activity with an Australian licenced betting operator. Clients must satisfy themselves (and assume full responsibility) for the legality of, applying to Weather Lottery for a Weather Lottery Account, remitting funds by credit card or other permitted means to a Weather Lottery Account, placement of bets with Weather Lottery, and receiving winnings from Weather Lottery.
8. The following people are prohibited from creating an account or betting with Weather Lottery:
a. employees and directors of Weather Lottery and its related bodies corporate (as that term is defined in section 50 of the Corporations Act 2001 (Cth));
b. employees of the Bureau of Meteorology ABN 92 637 533 532 ("BOM"); and
c. those excluded by the Northern Territory Racing Commission.
9. Weather Lottery does not represent or warrant that Internet betting on this site complies with the legal requirements of any jurisdiction, except those of the Northern Territory.
10. Weather Lottery reserves the right to amend these Conditions and the Weather Lottery Privacy Policy, located on the site, ("Privacy Policy") and will post such changes on the site. Continued use of Weather Lottery, is taken as agreement to these changes.
11. Weather Lottery reserves the right to amend these Conditions and the Weather Lottery Privacy Policy, located on the site, ("Privacy Policy") and will post such changes on the site. Changes will be notified to each Client via the email address that is associated with each Client's respective account. If, after the email has been transmitted, a Client continues to use Weather Lottery, the Client is taken to have agreed to these changes.
12. "Sydney Time" means the time in Sydney, Australia. The time in Sydney may be subject to daylight saving and Clients should check to ensure they are aware of the time in Sydney when a relevant event occurs.
Charities
13. A portion of each bet on Weather Lottery is allocated to a donation pool that is distributed to our partner charities.
14. Weather Lottery uses Clients' charity preferences provided with each bet (and stored in their account) to determine allocation proportions to individual charities.
15. A Client may edit his or her charity preferences at any time. The values stored in the Client's account at the point at which betting on an event closes will be used in all allocations.
16. If a charity ceases to be a partner of or associated with Weather Lottery, Weather Lottery reserves the right to reassign Client's preferences from that charity to another charity/charities until edited by the Client.
Account and Password
17. It is a requirement that, in order to place Bets, a Client must have an active account. A person can open a Client account via the Website at www.weatherlottery.com.au.
18. It is the Client's responsibility to keep his or her login details confidential and safe.
19. An account is personal to the individual who opened that account and cannot be transferred. A Client is not permitted to share an account with another person and must not use his or her account to place Bets on another person's behalf.
20. A Client may close his Account at any time. The Client should indicate his desire to close his account in writing, via email or post using the contact details in the 'Contact Us' section of our Website.
21. A Client is only permitted to have one account. The Account is for his own personal use and the Client must not permit another person to access the Account and you must not use the Account on behalf of or for the benefit of another person.
22. A Client is responsible for all Bets made validly through his or her account. A Bet is made validly if the person who placed the Bet, did so by logging into their Client account, selecting the numbers and successfully paying for that Bet through the selected payment method available on the site.
23. Any accounts with no betting activity for 26 consecutive weeks will be subject to a dormant account servicing fee of AUD $5 for each calendar month beginning from the end of the 26th consecutive week period of inactivity. The fee will be debited directly from the balance of this account. The dormant account-servicing fee will apply until the balance in the dormant account has been exhausted or the account is reactivated to betting activity.
24. Should a Clients Account become dormant through inactivity, Weather Lottery may contact the Client periodically to advise of any available Client Account balance. After a dormant period of no less than 26 weeks of inactivity Weather Lottery reserve the right to close dormant Client Accounts and to remove any funds. Notice via email will be given at least 30 (thirty) days before a Clients Account is closed and funds are removed. Any funds removed from dormant Clients Accounts will be donated to the Clients selected charity.
25. Should Weather Lottery consider a deposit or withdrawal of funds into or from a Client's account to be potentially fraudulent, it reserves the right to request reasonable proof from the Client to verify that the information given was true and correct prior to permitting funds to be withdrawn from the account.
26. Weather Lottery does not allow individuals that share a bank account or credit card with a person that is a Client to use the Client's account. Those individuals shall create Client accounts in their respective names if they wish to place Bets.
27. If a Client has been paid winnings or received funds from Weather Lottery in error, Weather Lottery shall be entitled to seek repayment of incorrectly paid funds and will provide supporting documentary evidence to prove that amount to be repaid is correct. In such occurrences, a Client will be notified by email of the error and any amount payable. Weather Lottery may request documents from the Client to assist in investigating such errors.
28. Weather Lottery reserves the right to close a Client's account and refund the balance of their account without further explanation. In this event, any outstanding Bets will be honoured, unless the Client's account has been used for any fraudulent transaction or purpose in which case the outstanding Bets will be void.
29. Weather Lottery reserves the right to withhold the classification of received funds as "cleared funds" until such time that it is satisfied that the deposit was not fraudulent.
30. The minimum deposit amount to an account is $1.00.
31. When a Client withdraws Winnings from his/her Client Account, such amounts will be transferred to the Client's Bank Account, and (when introduced by Weather Lottery) the Client's Credit Card (other than any form of Credit Card for which this option is unavailable, as specified on the Web Site). A Client can only withdraw funds in his/her Client Account that have been won. Funds deposited into a Client Account can only be used to finance bets. A Client cannot withdraw money deposited to his/her Client Account from his/her Credit Card/Bank Account other than by closing his/her Client Account in accordance with these Terms. Weather Lottery will not charge any transaction fees for withdrawals, however banking institutions may do so under their terms and conditions. Minimum Withdrawal amount is $10.00.
32. The time taken to transfer funds from a Client's Client Account (or otherwise) to the Client's Bank Account is approximately 5 working days.
33. Each Client must keep his/her Username and Password secure and take all steps to prevent unauthorised use of these details. Each Client is responsible for all activity conducted through his/her account. The Client shall not allow anyone else to use his/her Password or Username. The Client is not authorised to use third parties' Passwords or Usernames.
34. A Client may change his/her Password at any time through the relevant Client Account.
35. Any and all unclaimed Winnings will be retained by Weather Lottery for 12 months. If Weather Lottery, having endeavoured to contact the Client by means of any email address and phone number specified in his/her Client Account, is unable to transfer the relevant Winnings to the relevant Client's Credit Card or Bank Account within such 12 month period, then the relevant Client shall cease to be entitled to claim such Winnings.
The Subscription Service
36. Weather Lottery enables you to automatically participate in a specific bet for a specific period of time.
37. A Client agrees that the subscription, and related payment obligations will remain active until such time as the Client uses the site tools to suspend or deactivate the Clients participation in the subscription service, which you may do at any time (the Client may also use the site tools to reactivate participation in the subscription service).
38. For such time as the Client is participating in the subscription service, the Client will be debited the bet price for each Event that is entered.
39. The Client agrees that we may automatically debit your account in connection with your participation in the subscription service. If the Clients account does not contain adequate funds to pay for participation in the subscription service then (i) we will charge your payment method (for example, the credit card that you have designated in your Account), and you hereby authorise us to do so; or (ii) we will not purchase your bet, in which event we will send an email to you designated email address notifying you that the transaction was not carried out due to insufficient funds.
Single Ticket Option
40. The Single Ticket option allows clients to purchase single weekly tickets for up to 20 weeks in one purchase.
41. Single ticket option can only be purchased when opening a new account.
42. Clients are restricted to one weekly ticket per account. A client can buy additional tickets when all previous tickets have been finalised.
43. Picks for single tickets can only be changed at the time of purchase. Single tickets do not have the options to change picks in between events. Once all the events on a single ticket have been finalised a client can renew weekly tickets or choose to change to the subscription service.
44. Once a client chooses the subscription service, the single ticket option is no longer available to that client.
45. Single tickets are not auto renewed. To buy more tickets a client must log in to their account and choose to Buy More tickets from their account. Eligible funds can be used to fully or partially purchase more tickets.
46. By signing up to the Single ticket option, Weather Lottery will not charge your credit card automatically unless you opt to change to the subscription service.
Weather Lottery
47. The following terms are defined as:
a. "Weather Lottery Bet"; means each ticket is a fixed odds bet based upon the temperature in degrees Celsius recorded at 12 Noon on the day of the event in the designated weather station of each city in the Weather Lottery City List.
b. "Weather Lottery City List" means the 7 cities that are the subject of a particular week's Weather Lottery Bet as listed at secure.weatherlottery.com.au/cities.
c. "Weather Lottery Subscription" means the entitlement of a particular Client to place a Weather Lottery Bet.
d. "Weather Lottery Bet Close" is 11pm (Sydney time) - the day before the event. This is the time that Weather Lottery ceases accepting new bets or cancelations of bets in a particular event prior to commencement of that event.
48. A Client may play Weather Lottery by visiting www.weatherlottery.com.au.
49. A Client may only have 1 Weather Lottery account.
50. By electing to participate in Weather Lottery, a Client is granting Weather Lottery permission to:
51. debit that Client's account each month according to the terms of their subscription agreement.
52. use the numbers saved in the "Picks" section of the Client's account to form the selection of the Weather Lottery Bet.
53. The minimum period for a Weather Lottery Subscription is 1 month. A Client is free to cancel his or her Weather Lottery Subscription at any time. Upon cancelling the Weather Lottery subscription, any outstanding bets in the Clients account shall stand.
54. In order to place a Weather Lottery Bet, a Client selects 7 values, between 0-9. Each number represents the first number to the immediate right of the decimal point for the temperature in degrees Celsius recorded at 12 Noon on the day of the event at the designated weather station of each city in the Weather Lottery City List.

55. Weather Lottery reserves the right to change the Weather Lottery City List for new events in its sole discretion. If the Weather Lottery City List is amended, notice will be posted on the Weather Lottery website.
56. It is a Client's responsibility to check the Weather Lottery website regularly and familiarise himself or herself with the City List to which his or her Weather Lottery Bets for the following weeks relate.
57. A Client can edit his or her 7 selected numbers at any time up until the Weather Lottery Event Close via the "Edit Picks" page within a Clients account. Editing picks will cancel and then re-lodge all outstanding bets with the new picks as selected and confirmed by the Client. All future bets shall be made with the new picks unless further changes of picks are made, in which case those new picks shall be used.
58. A Client may only bet on a unique 7-number combination. In other words, 2 Clients may not have a Weather Lottery Bet in respect of the same 7 numbers in the same order. This unique entry requirement means that in some instances a Client may not be able to select his or her first choice of 7 numbers.
59. If a Client wishes to pick a 7-number combination already selected by another Client, Weather Lottery will endeavour to advise the Client of the inability to proceed with the selection and Weather Lottery will not accept the selection for that combination.
60. In the event that a system fault occurs and the same numbers are selected by more than one Client in a single Weather Lottery event resulting in a tie for the same place (payout) on 7/7, all applicable tickets will be paid at face value of the ticket divided by the number of Clients tying for that placing (payout).
61. A 7-number combination is secured by a Client for the period that:
a. the numbers are stored by the Client in the Client's account; and
b. b. the Client's Weather Lottery Subscription status is Pending, Active.
62. A Client's 7-number combination will be released and available for other Clients to bet on upon the following instances:
a. the Client changes his or her numbers to a new combination; or
b. the Client's Weather Lottery Subscription is cancelled and no further outstanding bets exist in their account with that combination.
63. If the Client selects the correct value for 2 or more cities, the Client wins a payout subject to the following payout table:

64. If a Client's 7-number combination is capable of being correct in more than one way, the Client will win a payout in respect of which result results in the most number of correct cities only. For example, if the Client picks the numbers 1-2-3-4-5-6-7 and the numbers 1, 1-2 and 1-2-3 are correct for 1, 2 and 3 cities respectively, the payout will only be awarded in respect of 3 cities.
65. Weather Lottery reserves the right to change the Weather Lottery payout table in clause 62 in its sole discretion for new events. If the payout table is amended, notice will be posted on the Weather Lottery website.
66. Each week, Weather Lottery will select 2 alternative weather stations for every designated weather station. If:
a. designated weather station in the Weather Lottery City List does not report any temperature for a particular day of the event at 12 Noon in that city, Weather Lottery will use the temperature reported at 12 Noon in that city at the first alternative weather station.
b. the first alternative weather station does not report any temperature for a particular day of the event at 12 Noon in that city, Weather Lottery will use the temperature reported at 12 Noon in that city at the second alternative weather station.
c. the second alternative weather station does not report any temperature for a particular day of the event at 12 Noon in that city, Weather Lottery will reschedule the event to another day before the next week's event, in which case the temperatures will be determined with reference to the temperatures recorded at the designated weather stations for that day (using the procedure in this clause 65a to determine the temperature in a situation where a designated weather station does not report).
d. if for any reason there is a variance between the official BOM datadase observations and the BOM website, the temperatures published on the BOM website at the time of the draw will be deemed to be the correct numbers for the purposes of a Weather Lottery event.
Bet Activity
67. Weather Lottery does not operate a lottery, nor does it sell or resell lottery tickets - the Bets are sports bets. Weather Lottery is licensed by the Northern Territory Racing Commission as a sports bookmaker.
68. All Bets are considered to be placed and received in the Northern Territory.
69. Weather Lottery reserves the right to decline, or limit, any Bet a Client attempts to place. No Bet stands until Weather Lottery has issued a Ticket Reference Number within the client's account.
70. No subscription Bet may be cancelled by a Client unless the cancellation is done so via the "Edit Picks" page and the cancelled bets are replaced by bets of an equal value in the same Weather Lottery event(s). The Edit Picks functionality can be found within a client's account at secure.weatherlottery.com.au/editsubscription
71. A Bet is deemed void (even if accepted) if it's submitted after the official closing time of an event.
72. Bets can only be made via the Website and will not be accepted via any other means - this includes email, phone, fax and post.
73. Bets may only be placed using cleared funds making up the "Available Balance" within a Client's account. Deposits via methods such as credit cards and bank transfers do not constitute cleared funds until such time as Weather Lottery has received notification by its relevant bank/payment facility of acceptance of the funds and Weather Lottery has approved the funds for use within the Clients account. Weather Lottery do not charge credit card fees however some credit card deposits may be subjected to a 'cash advance' fee as enforced by individual banks. Please check with your bank to see if your deposit will be treated as a 'cash advance'.
74. Weather Lottery does not offer users credit for betting.
Results
75. The BOM ("Bureau of Meteorology") website at www.bom.gov.au is the authoritative source of results for Weather Lottery events.
76. Results are as published by BOM at the time of settlement of a Bet. If at any time the BOM updates or changes observations on its website after the settlement of a Bet, the results published by Weather Lottery shall remain in effect as the official result.
77. Should a Client be proven to, or be associated with someone who has undertaken to, alter the results published by BOM or the results collection process through fraudulent methods, Weather Lottery retains the right to recoup all winnings plus interest from Client.
78. Weather Lottery gathers all results as soon as possible after each event. Winnings are then credited to a Client's account as soon as practicable. The availability to withdraw amounts or use these amounts to place a Bet are usually:
a. Less than $25,000: Immediately
b. $25,001 and above: Up to 21 Days
Customer Identification Requirements
79. To comply with Weather Lottery's obligations under the Anti-Money Laundering and Counter-Terrorism Financing Act 2006 (Cth), we require all newly registered Clients to provide us with adequate identification for the purposes of conducting identity verification.
80. A person seeking to become a Client is required to provide that her/his name, address and date of birth upon registration.
81. Weather Lottery provides Clients two methods to verify identity:
a. (electronic) a link to a third party electronic identity checking service will be provided during the registration process and the person registering should complete the necessary steps;
b. (paper based) or Email 2 current documents to verification@weatherlottery.com.au, we require 2 legal documents. One must confirm your name and D.O.B and one must confirm your name and address.
82. If a person's identity has not been verified within 45 days of opening his or her account, that account will be suspended and any balance in the account frozen.
83. Under the terms of our NT License and notwithstanding any other term of this Agreement, if a Client's account is, all Bets placed up to that point will stand.

85. Weather Lottery is not permitted to allow the withdrawal of any amount from a Client's account until the identity of the Client has been verified. Any amount will be released as soon as this process has been completed.
Bonuses
86. If a Client is granted a bonus from Weather Lottery, the Client is not permitted to withdraw these funds until the total bonus amount is wagered 1x its value on one or more Bets.
87. Weather Lottery reserves the right to cancel and/or not award a bonus to a Client if it becomes apparent that an individual alone or together in concert is attempting to take undue advantage or manipulate the spirit of the bonus. The decision of whether an action is an attempt to take undue advantage or manipulate the spirit of the bonus is at the sole discretion of Weather Lottery.
88. Weather Lottery reserves the right to make changes to or end a bonus without notice. Any decision to change a bonus will not affect those Clients that have already received the bonus.
89. Weather Lottery reserves the right, in its absolute discretion, to refuse to allow a Client to participate in Bonus Promotions. Weather Lottery will provide written notification to any such Client whom Weather Lottery determines will not be eligible to participate in Bonus Promotions from notification.
90. Bonus Promotions may include specific terms and conditions related to when a Bonus can be used, i.e. restricted to use on specific events, or with a specific expiry date and Clients should read the restrictions, if any, disclosed in any additional terms and conditions.
91. All deposited funds and their associated bonuses must both be used in full to renew your subscriptions at least once before a withdrawal is permitted.
Self Exclusion
92. A Client may exclude themselves from further betting by contacting the Weather Lottery support department via our contact form on site or directly via email at support@weatherlottery.com.au. Alternatively, the Client can reach us at 1300 780 782 during office hours, but we must receive your request in writing to validate your information.
93. A Client may request a cool off period during which he will be excluded from using his or her account and/or creating an account. The cool off period must be no less than 30 days and the Client may request this period to be extended or renewed. Unless specified otherwise, the Weather Lottery will exclude the person indefinitely.
94. A person considering exclusion, or having requested exclusion, is also encouraged to read our Responsible Gambling policy which can be found at secure.weatherlottery.com.au/help#Bet-Responsibly.
95. A person may request reversal of his or her exclusion by emailing our support department. The reversal will be subject to the requirements at Northern Territory law and the licence granted to Weather Lottery. Subsequent to completing those requirements, the person will be advised of any remaining steps to complete the removal of exclusion. Weather Lottery reserves the right to refuse to revoke any exclusion.
96. In respect of a person that excludes themselves:
a. all Bets on events that have yet to occur will be still stand,
b. b. any subscription (such as the Weather Lottery Subscription) will be cancelled subject to the terms of this Agreement.
Marketing
97. Weather Lottery handles data and tracks activity of Clients and visitors to the Website in accordance with our Privacy Policy at secure.weatherlottery.com.au/privacy.
98. A Client may elect to receive promotional email related to Weather Lottery, its products and other products supplied by third parties.
Miscellaneous
99. A Client's use of Weather Lottery may be subject to the consumer guarantees of the Competition and Consumer Act 2010 (Cth). Nothing in this Agreement is intended to exclude, restrict or modify these guarantees or any remedies which you may have in respect of these guarantees. To the extent permitted, we restrict our obligations under these guarantees to the minimum and any damages to the minimum amount.
100. Weather Lottery has made considerable efforts to ensure its business operates in a fair, prompt and accurate manner. Save to the extent permitted by law (and only to such an extent), Weather Lottery excludes all warranties (express or implied) relating to its business and shall not have any liability for direct, indirect, special, incidental, consequential or exemplary loss, damage, expense or injury suffered by any Client.
101. To the extent permitted by law (and only to such an extent), Weather Lottery's liability in respect of any claim or loss shall be limited in amount to the stake of the Bet placed.
102. To the extent permitted by law (and only to such an extent), Weather Lottery accepts no liability for any damages or losses arising from, or caused by, the Website or site's content, including any person's inability to access the site or any delays in transmission.
103. Where a Client has been referred to Weather Lottery by a third party including by a third party operated website and where that third party is an affiliate or agent of Weather Lottery, Clients acknowledge that Weather Lottery may make commission payments to that third party. Payments to agents or affiliates are unrelated to the odds or prize money offered to Clients by Weather Lottery. Details of Weather Lottery's affiliate program are located at www.pluspartners.com.au.
104. This Agreement represents the entire understanding and agreement between the Client and us on this subject matter and supersedes all other previous agreements.

If, after the email has been transmitted, a Client continues to use Weather Lottery, the Client is taken to have agreed to these changes.
12. "Sydney Time" means the time in Sydney, Australia. The time in Sydney may be subject to daylight saving and Clients should check to ensure they are aware of the time in Sydney when a relevant event occurs.
Charities
13. A portion of each bet on Weather Lottery is allocated to a donation pool that is distributed to our partner charities.
14. Weather Lottery uses Clients' charity preferences provided with each bet (and stored in their account) to determine allocation proportions to individual charities.
15. A Client may edit his or her charity preferences at any time. The values stored in the Client's account at the point at which betting on an event closes will be used in all allocations.
16. If a charity ceases to be a partner of or associated with Weather Lottery, Weather Lottery reserves the right to reassign Client's preferences from that charity to another charity/charities until edited by the Client.
Account and Password
17. It is a requirement that, in order to place Bets, a Client must have an active account. A person can open a Client account via the Website at www.weatherlottery.com.au.
18. It is the Client's responsibility to keep his or her login details confidential and safe.
19. An account is personal to the individual who opened that account and cannot be transferred. A Client is not permitted to share an account with another person and must not use his or her account to place Bets on another person's behalf.
20. A Client may close his Account at any time. The Client should indicate his desire to close his account in writing, via email or post using the contact details in the 'Contact Us' section of our Website.
21. A Client is only permitted to have one account. The Account is for his own personal use and the Client must not permit another person to access the Account and you must not use the Account on behalf of or for the benefit of another person.
22. A Client is responsible for all Bets made validly through his or her account. A Bet is made validly if the person who placed the Bet, did so by logging into their Client account, selecting the numbers and successfully paying for that Bet through the selected payment method available on the site.
23. Any accounts with no betting activity for 26 consecutive weeks will be subject to a dormant account servicing fee of AUD $5 for each calendar month beginning from the end of the 26th consecutive week period of inactivity. The fee will be debited directly from the balance of this account. The dormant account-servicing fee will apply until the balance in the dormant account has been exhausted or the account is reactivated to betting activity.
24. Should a Clients Account become dormant through inactivity, Weather Lottery may contact the Client periodically to advise of any available Client Account balance. After a dormant period of no less than 26 weeks of inactivity Weather Lottery reserve the right to close dormant Client Accounts and to remove any funds. Notice via email will be given at least 30 (thirty) days before a Clients Account is closed and funds are removed. Any funds removed from dormant Clients Accounts will be donated to the Clients selected charity.
25. Should Weather Lottery consider a deposit or withdrawal of funds into or from a Client's account to be potentially fraudulent, it reserves the right to request reasonable proof from the Client to verify that the information given was true and correct prior to permitting funds to be withdrawn from the account.
26. Weather Lottery does not allow individuals that share a bank account or credit card with a person that is a Client to use the Client's account. Those individuals shall create Client accounts in their respective names if they wish to place Bets.
27. If a Client has been paid winnings or received funds from Weather Lottery in error, Weather Lottery shall be entitled to seek repayment of incorrectly paid funds and will provide supporting documentary evidence to prove that amount to be repaid is correct. In such occurrences, a Client will be notified by email of the error and any amount payable. Weather Lottery may request documents from the Client to assist in investigating such errors.
28. Weather Lottery reserves the right to close a Client's account and refund the balance of their account without further explanation. In this event, any outstanding Bets will be honoured, unless the Client's account has been used for any fraudulent transaction or purpose in which case the outstanding Bets will be void.
29. Weather Lottery reserves the right to withhold the classification of received funds as "cleared funds" until such time that it is satisfied that the deposit was not fraudulent.
30. The minimum deposit amount to an account is $1.00.
31. When a Client withdraws Winnings from his/her Client Account, such amounts will be transferred to the Client's Bank Account, and (when introduced by Weather Lottery) the Client's Credit Card (other than any form of Credit Card for which this option is unavailable, as specified on the Web Site). A Client can only withdraw funds in his/her Client Account that have been won. Funds deposited into a Client Account can only be used to finance bets. A Client cannot withdraw money deposited to his/her Client Account from his/her Credit Card/Bank Account other than by closing his/her Client Account in accordance with these Terms. Weather Lottery will not charge any transaction fees for withdrawals, however banking institutions may do so under their terms and conditions. Minimum Withdrawal amount is $10.00.
32. The time taken to transfer funds from a Client's Client Account (or otherwise) to the Client's Bank Account is approximately 5 working days.
33. Each Client must keep his/her Username and Password secure and take all steps to prevent unauthorised use of these details. Each Client is responsible for all activity conducted through his/her account. The Client shall not allow anyone else to use his/her Password or Username. The Client is not authorised to use third parties' Passwords or Usernames.
34. A Client may change his/her Password at any time through the relevant Client Account.
35. Any and all unclaimed Winnings will be retained by Weather Lottery for 12 months. If Weather Lottery, having endeavoured to contact the Client by means of any email address and phone number specified in his/her Client Account, is unable to transfer the relevant Winnings to the relevant Client's Credit Card or Bank Account within such 12 month period, then the relevant Client shall cease to be entitled to claim such Winnings.
The Subscription Service
36. Weather Lottery enables you to automatically participate in a specific bet for a specific period of time.
37. A Client agrees that the subscription, and related payment obligations will remain active until such time as the Client uses the site tools to suspend or deactivate the Clients participation in the subscription service, which you may do at any time (the Client may also use the site tools to reactivate participation in the subscription service).
38. For such time as the Client is participating in the subscription service, the Client will be debited the bet price for each Event that is entered.
39. The Client agrees that we may automatically debit your account in connection with your participation in the subscription service. If the Clients account does not contain adequate funds to pay for participation in the subscription service then (i) we will charge your payment method (for example, the credit card that you have designated in your Account), and you hereby authorise us to do so; or (ii) we will not purchase your bet, in which event we will send an email to you designated email address notifying you that the transaction was not carried out due to insufficient funds.
Single Ticket Option
40. The Single Ticket option allows clients to purchase single weekly tickets for up to 20 weeks in one purchase.
41. Single ticket option can only be purchased when opening a new account.
42. Clients are restricted to one weekly ticket per account. A client can buy additional tickets when all previous tickets have been finalised.
43. Picks for single tickets can only be changed at the time of purchase. Single tickets do not have the options to change picks in between events. Once all the events on a single ticket have been finalised a client can renew weekly tickets or choose to change to the subscription service.
44. Once a client chooses the subscription service, the single ticket option is no longer available to that client.
45. Single tickets are not auto renewed. To buy more tickets a client must log in to their account and choose to Buy More tickets from their account. Eligible funds can be used to fully or partially purchase more tickets.
46. By signing up to the Single ticket option, Weather Lottery will not charge your credit card automatically unless you opt to change to the subscription service.
Weather Lottery
47. The following terms are defined as:
a. "Weather Lottery Bet"; means each ticket is a fixed odds bet based upon the temperature in degrees Celsius recorded at 12 Noon on the day of the event in the designated weather station of each city in the Weather Lottery City List.
b. "Weather Lottery City List" means the 7 cities that are the subject of a particular week's Weather Lottery Bet as listed at secure.weatherlottery.com.au/cities.
c. "Weather Lottery Subscription" means the entitlement of a particular Client to place a Weather Lottery Bet.
d. "Weather Lottery Bet Close" is 11pm (Sydney time) - the day before the event. This is the time that Weather Lottery ceases accepting new bets or cancelations of bets in a particular event prior to commencement of that event.
48. A Client may play Weather Lottery by visiting www.weatherlottery.com.au.
49. A Client may only have 1 Weather Lottery account.
50. By electing to participate in Weather Lottery, a Client is granting Weather Lottery permission to:
51. debit that Client's account each month according to the terms of their subscription agreement.
52. use the numbers saved in the "Picks" section of the Client's account to form the selection of the Weather Lottery Bet.
53. The minimum period for a Weather Lottery Subscription is 1 month. A Client is free to cancel his or her Weather Lottery Subscription at any time. Upon cancelling the Weather Lottery subscription, any outstanding bets in the Clients account shall stand.
54. In order to place a Weather Lottery Bet, a Client selects 7 values, between 0-9. Each number represents the first number to the immediate right of the decimal point for the temperature in degrees Celsius recorded at 12 Noon on the day of the event at the designated weather station of each city in the Weather Lottery City List.

55. Weather Lottery reserves the right to change the Weather Lottery City List for new events in its sole discretion. If the Weather Lottery City List is amended, notice will be posted on the Weather Lottery website.
56. It is a Client's responsibility to check the Weather Lottery website regularly and familiarise himself or herself with the City List to which his or her Weather Lottery Bets for the following weeks relate.
57. A Client can edit his or her 7 selected numbers at any time up until the Weather Lottery Event Close via the "Edit Picks" page within a Clients account. Editing picks will cancel and then re-lodge all outstanding bets with the new picks as selected and confirmed by the Client. All future bets shall be made with the new picks unless further changes of picks are made, in which case those new picks shall be used.
58. A Client may only bet on a unique 7-number combination. In other words, 2 Clients may not have a Weather Lottery Bet in respect of the same 7 numbers in the same order. This unique entry requirement means that in some instances a Client may not be able to select his or her first choice of 7 numbers.
59. If a Client wishes to pick a 7-number combination already selected by another Client, Weather Lottery will endeavour to advise the Client of the inability to proceed with the selection and Weather Lottery will not accept the selection for that combination.
60. In the event that a system fault occurs and the same numbers are selected by more than one Client in a single Weather Lottery event resulting in a tie for the same place (payout) on 7/7, all applicable tickets will be paid at face value of the ticket divided by the number of Clients tying for that placing (payout).
61. A 7-number combination is secured by a Client for the period that:
a. the numbers are stored by the Client in the Client's account; and
b. b. the Client's Weather Lottery Subscription status is Pending, Active.
62. A Client's 7-number combination will be released and available for other Clients to bet on upon the following instances:
a. the Client changes his or her numbers to a new combination; or
b. the Client's Weather Lottery Subscription is cancelled and no further outstanding bets exist in their account with that combination.
63. If the Client selects the correct value for 2 or more cities, the Client wins a payout subject to the following payout table:

64. If a Client's 7-number combination is capable of being correct in more than one way, the Client will win a payout in respect of which result results in the most number of correct cities only. For example, if the Client picks the numbers 1-2-3-4-5-6-7 and the numbers 1, 1-2 and 1-2-3 are correct for 1, 2 and 3 cities respectively, the payout will only be awarded in respect of 3 cities.
65. Weather Lottery reserves the right to change the Weather Lottery payout table in clause 62 in its sole discretion for new events. If the payout table is amended, notice will be posted on the Weather Lottery website.
66. Each week, Weather Lottery will select 2 alternative weather stations for every designated weather station. If:
a. designated weather station in the Weather Lottery City List does not report any temperature for a particular day of the event at 12 Noon in that city, Weather Lottery will use the temperature reported at 12 Noon in that city at the first alternative weather station.
b. the first alternative weather station does not report any temperature for a particular day of the event at 12 Noon in that city, Weather Lottery will use the temperature reported at 12 Noon in that city at the second alternative weather station.
c. the second alternative weather station does not report any temperature for a particular day of the event at 12 Noon in that city, Weather Lottery will reschedule the event to another day before the next week's event, in which case the temperatures will be determined with reference to the temperatures recorded at the designated weather stations for that day (using the procedure in this clause 65a to determine the temperature in a situation where a designated weather station does not report).
d. if for any reason there is a variance between the official BOM datadase observations and the BOM website, the temperatures published on the BOM website at the time of the draw will be deemed to be the correct numbers for the purposes of a Weather Lottery event.
Bet Activity
67. Weather Lottery does not operate a lottery, nor does it sell or resell lottery tickets - the Bets are sports bets. Weather Lottery is licensed by the Northern Territory Racing Commission as a sports bookmaker.
68. All Bets are considered to be placed and received in the Northern Territory.
69. Weather Lottery reserves the right to decline, or limit, any Bet a Client attempts to place. No Bet stands until Weather Lottery has issued a Ticket Reference Number within the client's account.
70. No subscription Bet may be cancelled by a Client unless the cancellation is done so via the "Edit Picks" page and the cancelled bets are replaced by bets of an equal value in the same Weather Lottery event(s). The Edit Picks functionality can be found within a client's account at secure.weatherlottery.com.au/editsubscription
71. A Bet is deemed void (even if accepted) if it's submitted after the official closing time of an event.
72. Bets can only be made via the Website and will not be accepted via any other means - this includes email, phone, fax and post.
73. Bets may only be placed using cleared funds making up the "Available Balance" within a Client's account. Deposits via methods such as credit cards and bank transfers do not constitute cleared funds until such time as Weather Lottery has received notification by its relevant bank/payment facility of acceptance of the funds and Weather Lottery has approved the funds for use within the Clients account. Weather Lottery do not charge credit card fees however some credit card deposits may be subjected to a 'cash advance' fee as enforced by individual banks. Please check with your bank to see if your deposit will be treated as a 'cash advance'.
74. Weather Lottery does not offer users credit for betting.
Results
75. The BOM ("Bureau of Meteorology") website at www.bom.gov.au is the authoritative source of results for Weather Lottery events.
76. Results are as published by BOM at the time of settlement of a Bet. If at any time the BOM updates or changes observations on its website after the settlement of a Bet, the results published by Weather Lottery shall remain in effect as the official result.
77. Should a Client be proven to, or be associated with someone who has undertaken to, alter the results published by BOM or the results collection process through fraudulent methods, Weather Lottery retains the right to recoup all winnings plus interest from Client.
78. Weather Lottery gathers all results as soon as possible after each event. Winnings are then credited to a Client's account as soon as practicable. The availability to withdraw amounts or use these amounts to place a Bet are usually:
a. Less than $25,000: Immediately
b. $25,001 and above: Up to 21 Days
Customer Identification Requirements
79. To comply with Weather Lottery's obligations under the Anti-Money Laundering and Counter-Terrorism Financing Act 2006 (Cth), we require all newly registered Clients to provide us with adequate identification for the purposes of conducting identity verification.
80. A person seeking to become a Client is required to provide that her/his name, address and date of birth upon registration.
81. Weather Lottery provides Clients two methods to verify identity:
a. (electronic) a link to a third party electronic identity checking service will be provided during the registration process and the person registering should complete the necessary steps;
b. (paper based) or Email 2 current documents to verification@weatherlottery.com.au, we require 2 legal documents. One must confirm your name and D.O.B and one must confirm your name and address.
82. If a person's identity has not been verified within 45 days of opening his or her account, that account will be suspended and any balance in the account frozen.
83. Under the terms of our NT License and notwithstanding any other term of this Agreement, if a Client's account is, all Bets placed up to that point will stand.

85. Weather Lottery is not permitted to allow the withdrawal of any amount from a Client's account until the identity of the Client has been verified. Any amount will be released as soon as this process has been completed.
Bonuses
86. If a Client is granted a bonus from Weather Lottery, the Client is not permitted to withdraw these funds until the total bonus amount is wagered 1x its value on one or more Bets.
87. Weather Lottery reserves the right to cancel and/or not award a bonus to a Client if it becomes apparent that an individual alone or together in concert is attempting to take undue advantage or manipulate the spirit of the bonus. The decision of whether an action is an attempt to take undue advantage or manipulate the spirit of the bonus is at the sole discretion of Weather Lottery.
88. Weather Lottery reserves the right to make changes to or end a bonus without notice. Any decision to change a bonus will not affect those Clients that have already received the bonus.
89. Weather Lottery reserves the right, in its absolute discretion, to refuse to allow a Client to participate in Bonus Promotions. Weather Lottery will provide written notification to any such Client whom Weather Lottery determines will not be eligible to participate in Bonus Promotions from notification.
90. Bonus Promotions may include specific terms and conditions related to when a Bonus can be used, i.e. restricted to use on specific events, or with a specific expiry date and Clients should read the restrictions, if any, disclosed in any additional terms and conditions.
91. All deposited funds and their associated bonuses must both be used in full to renew your subscriptions at least once before a withdrawal is permitted.
Self Exclusion
92. A Client may exclude themselves from further betting by contacting the Weather Lottery support department via our contact form on site or directly via email at support@weatherlottery.com.au. Alternatively, the Client can reach us at 1300 780 782 during office hours, but we must receive your request in writing to validate your information.
93. A Client may request a cool off period during which he will be excluded from using his or her account and/or creating an account. The cool off period must be no less than 30 days and the Client may request this period to be extended or renewed. Unless specified otherwise, the Weather Lottery will exclude the person indefinitely.
94. A person considering exclusion, or having requested exclusion, is also encouraged to read our Responsible Gambling policy which can be found at secure.weatherlottery.com.au/help#Bet-Responsibly.
95. A person may request reversal of his or her exclusion by emailing our support department. The reversal will be subject to the requirements at Northern Territory law and the licence granted to Weather Lottery. Subsequent to completing those requirements, the person will be advised of any remaining steps to complete the removal of exclusion. Weather Lottery reserves the right to refuse to revoke any exclusion.
96. In respect of a person that excludes themselves:
a. all Bets on events that have yet to occur will be still stand,
b. b. any subscription (such as the Weather Lottery Subscription) will be cancelled subject to the terms of this Agreement.
Marketing
97. Weather Lottery handles data and tracks activity of Clients and visitors to the Website in accordance with our Privacy Policy at secure.weatherlottery.com.au/privacy.
98. A Client may elect to receive promotional email related to Weather Lottery, its products and other products supplied by third parties.
Miscellaneous
99. A Client's use of Weather Lottery may be subject to the consumer guarantees of the Competition and Consumer Act 2010 (Cth). Nothing in this Agreement is intended to exclude, restrict or modify these guarantees or any remedies which you may have in respect of these guarantees. To the extent permitted, we restrict our obligations under these guarantees to the minimum and any damages to the minimum amount.
100. Weather Lottery has made considerable efforts to ensure its business operates in a fair, prompt and accurate manner. Save to the extent permitted by law (and only to such an extent), Weather Lottery excludes all warranties (express or implied) relating to its business and shall not have any liability for direct, indirect, special, incidental, consequential or exemplary loss, damage, expense or injury suffered by any Client.
101. To the extent permitted by law (and only to such an extent), Weather Lottery's liability in respect of any claim or loss shall be limited in amount to the stake of the Bet placed.
102. To the extent permitted by law (and only to such an extent), Weather Lottery accepts no liability for any damages or losses arising from, or caused by, the Website or site's content, including any person's inability to access the site or any delays in transmission.
103. Where a Client has been referred to Weather Lottery by a third party including by a third party operated website and where that third party is an affiliate or agent of Weather Lottery, Clients acknowledge that Weather Lottery may make commission payments to that third party. Payments to agents or affiliates are unrelated to the odds or prize money offered to Clients by Weather Lottery. Details of Weather Lottery's affiliate program are located at www.pluspartners.com.au.
104. This Agreement represents the entire understanding and agreement between the Client and us on this subject matter and supersedes all other previous agreements.
