TERMS & CONDITIONS OF ENTRY
Information on how to enter the “Christmas Campaign” Promotion (“Promotion”) and the prize form part of these Terms and Conditions of Entry. Entry into this Promotion is deemed acceptance of these Terms and Conditions of Entry by each (Velocity Member) (defined below).

TERMS & CONDITIONS OF ENTRY
Information on how to enter the “Christmas Campaign” Promotion (“Promotion”) and the prize form part of these Terms and Conditions of Entry. Entry into this Promotion is deemed acceptance of these Terms and Conditions of Entry by each (Velocity Member) (defined below).
The Promoter is Velocity Frequent Flyer Pty Ltd (ACN 601 408 824) of registered address 56 Edmondstone Road, Bowen Hills, Queensland 4006, Australia (“Promoter”).
Entry is only open to Australian and New Zealand residents aged 18 years or over who are a member of the Velocity Frequent Flyer program at the time of entry and the draw (“Velocity Member”).
The directors, officers, management and employees (and their immediate families) of the Promoter and its related bodies corporate International Customer Loyalty Programmes Pty Ltd (ABN 13 083 835 661) and Anisimoff Legal (ABN 40 134 644 689) are ineligible to enter this Promotion. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or cousin.
Promotion commences at 12:01am AEDST on 01/11/2016 and closes at 11.59pm AEDST on 21/12/2016 (“Promotional Period”).
To receive an automatic entry, Velocity Members must spend a minimum of AU$100 (or the equivalent of this amount in local currency) at any Velocity eStore retailer (excluding eBay) via the Velocity Frequent Flyer eStore (http://estore.velocityfrequentflyer.com/) during the Promotional Period (“Qualifying Transaction”). For example, Velocity Members that make a purchase via a UK-based Velocity eStore retailer must spend an equivalent of AU$100 or more in pounds sterling via that store, Velocity Members that make a purchase via a US-based Velocity eStore retailer must spend an equivalent of AU$100 or more in US dollars via that store, etc. Transactions must be ‘pending’ or ‘approved’ to be eligible. Every valid Qualifying Transaction entitles the Velocity Member to one (1) automatic entry into the draw.
Incomplete transactions will be deemed invalid. Any transaction/s that are cancelled or returned during the Promotional Period will not be eligible for entry in this Promotion.
Entries will be deemed accepted at the time of receipt by the Promoter and not at the time of transmission. Entries received will be considered final by the Promoter. Illegible, incomprehensible and incomplete entries will be deemed invalid. The Promoter accepts no responsibility for any late, lost, incomplete, incorrectly submitted, delayed, illegible, corrupted or misdirected entries, claims or correspondence whether due to error, omission, alteration, tampering, deletion, theft, destruction or otherwise including those entries not received by the Promoter.
Velocity Members will be automatically entered into the Promotion with each valid Qualifying Transaction made via the Velocity Frequent Flyer eStore during the Promotional Period. If the Velocity Member does not wish to be automatically entered into this Promotion they must send an email with the subject title “Christmas Campaign no participation” and with their contact details (i.e. full name, address and phone number) in the body of the email, to velocity.shopandearnstore@iclp.com.au during the Promotional Period.
Multiple entries permitted however, only one (1) entry is permitted per Qualifying Transaction (regardless of the amount spent in excess of AU$100 in that transaction). Each entry must be submitted separately and in accordance with the entry instructions.
The Promoter reserves the right, at any time, to verify the validity of entries and Velocity Members (including a Velocity Member’s identity, age and place of residence) and to disqualify any Velocity Member who breaches the Velocity Frequent Flyer terms and conditions of membership or who tampers with the entry process or who has engaged in any unlawful or other improper misconduct that jeopardises the fair and proper conduct of the Promotion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.
If there is a dispute as to the identity of a Velocity Member, the Promoter reserves the right, in its sole discretion, to determine the identity of the Velocity Member.
The draw will take place at Anisimoff Legal, Suite 5, Erina Plaza, 210 Central Coast Highway, Erina NSW 2250 at 2.00pm AEDST on 04/01/2017. The winner will be notified in writing via email within two (2) business days of the draw where further contact information and details will be requested including, but not limited to their full name, telephone number, email address, and residential address. The winner’s name will be published online at www.velocityfrequentflyer.com from 06/01/2017.
Should a Velocity Member’s contact details change during the Promotion Period, it is the Velocity Member’s responsibility to notify the Promoter. A request to access or modify any information provided in an entry should be directed to the Promoter.
The Promoter’s decision is final and no discussions or correspondence will be entered into.
There will be one (1) prize awarded in this promotion. The first valid entry drawn will win 1,000,000 Velocity Frequent Flyer Points (“Prize”), valued at AU$39,893.62. The notional value of the prize is based on a sample of the flights/rewards that can be obtained by redeeming 1,000,000 Velocity Frequent Flyer Points.
The Velocity Frequent Flyer Points will automatically be loaded onto the winning Velocity Member’s Velocity Frequent Flyer Account within two (2) weeks of the draw.
Use of points is subject to the Velocity Members Terms and Conditions, which are located on the Velocity Frequent Flyer website at: https://www.velocityfrequentflyer.com/content/TermsConditions/
If the Prize is unavailable, the Promoter, in its discretion, reserves the right to substitute the Prize with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
Total prize pool value is AU$39,893.62.
The Prize, or any unused portion of the Prize, is not transferable or exchangeable and cannot be taken as cash, unless otherwise specified.
A draw for the Prize if unclaimed after three (3) months may take place on 04/04/2017 at the same time and place as the original draw, subject to any written directions from a regulatory authority. The winner, if any, will be notified in writing via email within two (2) business days of the unclaimed prize draw and their name will be published online at www.velocityfrequentflyer.com from 06/04/2017.
Velocity Members consent to the Promoter using the Velocity Member's name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this Promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
Any costs associated with accessing the Velocity Frequent Flyer eStore is the Velocity Member’s responsibility and is dependent on the Internet service provider used.
If this Promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any Velocity Member; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the Promotion, as appropriate.
Nothing in these Terms and Conditions of Entry limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Australian Consumer Law, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia or any statutory consumer guarantees as provided under consumer protection laws in New Zealand (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion.
Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control), including but not limited to, systematic incidents that prevent a sale from being validated for entry during the Promotional Period; (b) unintentional exclusion of a valid purchase for entry by the Promoter; (c) any theft, unauthorised access or third party interference; (d) any entry or Prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (e) any variation in Prize value to that stated in these Terms and Conditions of Entry; (f) any tax liability incurred by a winner or Velocity Member; or (g) taking and/or use of the Prize.
All entries become the property of the Promoter. The Promoter is bound by the Privacy Act 1988 (Cth) including the Australian Privacy Principles. The information Velocity Member’s provide will be collected for the purpose of conducting this promotion and managed in accordance with the Promoter’s Privacy Policy (available at www.velocityfrequentflyer.com.au).
The Promoter is collecting your personal information provided by you for the purpose of conducting the Promotion, including providing any prize to you. Entry into promotions run by the Promoter is conditional on providing this information. The Promoter will disclose your personal information to International Customer Loyalty Programmes Pty Ltd. The Promoter may also disclose your personal information to and/or collect your personal information from its related companies and third parties who provide (or help the Promoter provide) products and services, some of whom may be located overseas. The Promoter may disclose your personal information to persons or organisations located in Germany, Hong Kong, India, Ireland, Malaysia, New Zealand, Singapore, The Philippines, Turkey and United States of America. The Promoter’s Privacy Policy (https://www.velocityfrequentflyer.com/content/Privacy/privacy-policy/) states how you can seek to access or correct your personal information and how to make a privacy complaint. You can contact the Promoter’s Privacy Officer at privacy@virginaustralia.com. You consent to the Promoter using your personal information for future promotional and marketing purposes regarding the Promoter’s products and services, including contacting the entrant via SMS and email messages (and you consent to receiving such messages from the Promoter). Information on how to opt-out from these messages is set out in the Promoter’s Privacy Policy.
Velocity is operated by Velocity Frequent Flyer Pty Ltd. To earn and redeem Velocity Points, you must be a Velocity Member. Velocity membership and Velocity Points earn and redemption is subject to the Member Terms and Conditions located at http://www.velocityfrequentflyer.com/content/TermsConditions/index.htm as amended from time to time.
The laws of Australia apply to this Promotion to the exclusion of any other law. Velocity Members that enter this Promotion submit to the exclusive jurisdiction of the courts of Australia.

“CHRISTMAS CAMPAIGN” DOUBLE POINTS OFFER PROMOTION
TERMS & CONDITIONS OF ENTRY
I. Velocity Members who make a Qualifying Transaction at participating Velocity eStore retailers via the Velocity Frequent Flyer eStore during the Promotional Period will earn double the standard rate of Velocity Points for their purchase, which will be credited to their Velocity Frequent Flyer account. The following retailers are not participating in this Double Points offer and the standard rate of Points earn will apply for these retailers during the Promotional Period: Appliances Online AU, ASOS AU, Banana Republic US, Chemist Warehouse, Connor AU, eBay, ePharmacy, Gap US, Grays Online, Mattel Shop, Menulog Australia, Menulog New Zealand, Mothercare, Old Navy US, Onsport, Surfstich, Sony Australia, The Vet Shed, Wiggle, 123Inkjets.
II. To earn Velocity Points, the Velocity Member must be logged into the Velocity eStore website (using their Velocity Membership number and password) prior to making a purchase.
III. Not all items purchased through the Velocity Frequent Flyer eStore are eligible for Velocity Points to be earned. See the individual retailer purchase conditions available on the individual retailers' page on the http://estore.velocityfrequentflyer.com for full details of exclusions. Points will not be earned for purchases made directly via the retailer's website.
IV. Velocity Points will be allocated to the Velocity Member’s Velocity Frequent Flyer account up to 30 days after the date of purchase, upon receipt of the Pending Points notification email. Once a Velocity member enters a participating retailer's online store, the retailer's terms and conditions will apply. V. Clauses 1-5, 7-8, 11-12, 14-15, 18, and 24-31 of the “Christmas Campaign” Prize Draw Promotion as detailed above, equally apply to this “Christmas Campaign” Guaranteed Offer Promotional. These terms and conditions of entry should be read in conjunction with those terms and conditions of entry. If there are any inconsistencies these shall prevail. Any reference to ‘prize/Prize’ in the relevant clauses should be replaced with the word ‘Velocity Points for the purposes of the “Christmas Campaign” Guaranteed Offer Promotion.
