3. By entering Urban Walkabout competitions, entrants accept the below-stated Terms & Conditions of Entry.
4. Entry to Urban Walkabout competitions are open to all Australian residents except employees and families of the Promoter and its affiliate companies, agencies and anyone professionally connected with the promotion. Family members include spouses, de facto spouses, parents, natural or adopted children and siblings, whether or not they live in the same household as the employee/contractor.
5. To enter Urban Walkabout competitions, entrants must answer all competition questions and entries must be received by the Promoter, by the close of business on the specified closing date.
6. By entering the promotion, the entrant consents to receipt of any email regarding the promotion from the Promoter and competition partners, and other emails which inform the entrant of the Promoter and competition partners other publications, products, services and events and to promote third party goods and services the entrant may be interested in. Entrants grant the Promoter & competition partners permission to communicate with them by e-mail in order to provide details of the prize and/or instructions as to how the winner is to claim the prize and establish his/her entitlement to it. The Promoter and competition partners may also send information on future promotions to entrants. Any entrant who wishes not to receive any such promotional information should tick the box on the competition entry form in order to opt OUT of any future communications from the Promoter and competition partners.
7. Prize winners of Urban Walkabout competitions are selected at 120A Devonshire St, Surry Hills NSW 2010, on the specified competition judging date. Winners are contacted by email or mail within 5 business days of selection and may be announced in an upcoming issue of the respective publication and/or the publication's website.
8. The judges' decision is final and binding. As such, no correspondence will be entered into.
9. Entrants are deemed to have accepted these terms and conditions by participating in this game of skill and creativity. All entries become the property of the Promoter. The Promoter is entitled to use any of the entries submitted in any manner and for any purpose at its absolute discretion, including using the entries for future promotional, marketing and publicity purposes without any further reference or payment or other compensation to the entrant. Unless expressly stated, all other expenses become the responsibility of the winner.
10. If any prize is unavailable, for whatever reason, the Promoter reserves the right to substitute the prize for a prize of equal or greater value.
11. Prize winners are advised that tax implications may arise from their prize winning and may wish to seek independent financial advice prior to the acceptance of the prize.
12. If the Promoter is unable to make contact with the winners within 48 hours of their entry being selected and announced, and the winner/s have not responded via email or phone to claim their prize, the winner’s entry will be deemed invalid. The Promoter reserves the right to re-judge in the event of any entrant being unable to satisfy these competition conditions or forfeiting or not claiming a prize. If any prize remains unclaimed or forfeited through ineligibility or otherwise, the Promoter will conduct a further judging. All prize winners agree to the use of their name and address suburb for publicity and competition purposes, without compensation.
13. As a condition of accepting the prize, the winner (and his/her companion – where applicable) must sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.
14. Prizes are not redeemable for cash, credit or product and no exchanges are offered. The Promoter accepts no responsibility for any variation in the value of the prize (or part thereof).
15. Each entrant's personal information ("PI") is collected to enable the Promoter to administer and promote this Competition and the winner. Entrants who fail to provide all requested PI, may be determined by the Promoter, at its sole discretion to be ineligible to win a prize. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
16. The Promoter assumes no responsibility for any error, omission, interruption, corruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to, or alteration of, entries. The Promoter is not responsible for any problems or technical malfunction of any telephone network or lines, computer networks and systems, servers, or providers, computer equipment, software, failure of any e-mail or entry to be received by the Promoter on account of technical problems or traffic congestion on the Internet or at any web site, or any combination of them, including any injury or damage to any entrant's or any other person's computer related to or resulting from participation or downloading any materials in this Competition.
17. All entries become the property of the Promoter. As such, the Promoter is the owner of all copyright and other intellectual property in the winning responses.
18. The laws of New South Wales govern Urban Walkabout competitions.
19. For all alcohol prizes: Entry is open to all residents of Australia aged 18 years and over (excluding residents of Northern Territory). No more than 20 litres of alcohol will be won by New South Wales residents. The Promoter will require winners to provide proof of age. Identification considered suitable for verification is at the Promoter's discretion. The Promoter encourages consumers to drink responsibly. Guidelines are available here
20. For all travel prizes; Passports, any requisite visas, spending money, meals, insurance, transport to and from departure point, additional transfers, items of a personal nature, in-room charges and all other ancillary costs are not included. The winner and companion must depart from and return to the same departure point and travel together. Frequent flyer points will not form part of the prize. If for any reason a winner does not take the prize or an element of the prize at the time stipulated by the Promoter, then the prize or that element of the prize will not be redeemable for cash and is subject to booking and flight availability. Itineraries are to be determined by the Promoter in its absolute discretion.
21. During the entire duration of the travel prizes, a nominated parent/guardian must accompany any person under 18 years of age unless otherwise stated. The winner (and his/her companion) is responsible for ensuring that they have valid passports, and any requisite visas, vaccinations and travel documentation. Prize is subject to the standard terms and conditions of individual prize and service providers. Winner may be required to present credit card at time of accommodation check in.
22. The Promoter reserves the right to exclude any entries which it believes to be fraudulent or based on misconduct; infringes a third party’s intellectual property rights, or in the opinion of the Promoter, includes objectionable content, including but not limited to profanity, nudity, potentially insulting, inflammatory or defamatory language or in any other manner, not in accordance with these Terms and Conditions.
23. In the case of the intervention of any outside agent or event which naturally changes the result or prevents or hinders its determination, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strikes; the Promoter may in its absolute discretion cancel the event and recommence it from the start on the same conditions at a later date.
24. Please allow up to 14 days for collection and/or delivery of prizes from the draw date.
25. Prizes/vouchers will be given to each prize winner, at the following address: Urban Walkabout Pty Ltd, 120A Devonshire St Surry Hills NSW 2010. If any winner lives outside the Sydney metropolitan area and cannot collect the prize voucher in person and that prize is required to be posted or couriered to the winner, the Promoter cannot accept responsibility for loss or damage to prizes in transit. The Promoter makes no representations or warranties as to the quality/suitability of any of the goods/services offered as prizes. To the extent permitted by law, the Promoter is not liable for any loss suffered or sustained, to person or property and including, but not limited to, consequential (including economic) loss by reason of any act or omission, deliberate or negligent, by the Promoter, or its agents, in connection with the arrangement for supply, or the supply, of any goods or services by any person to the prize winner. This clause does not affect, and is not intended to affect, any rights a consumer might have, which are not able to be excluded under applicable Australian consumer protection laws.
26. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter's control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any tax liability incurred by a winner or entrant; (e) use of the prize (f) if the event is cancelled, amended or rescheduled for any reason.
