“CHOOSE YOUR OWN HUNTER VALLEY ADVENTURE” PROMOTION
Information on how to enter and details of the prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
Entry is only open to Australian residents aged 18 years or over. Employees (and their immediate families) of the Promoter and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
Promotion commences at 12:00am AEST on 30/09/2016 and final entries close at 11:59pm AEDST on 06/01/2017 (“Promotional Period”).
To receive one (1) entry into the draw, individuals must complete at least one (1) of the following entry methods during the Promotional Period:
(a) Promotional Email (only available to individuals who receive a promotional email about this promotion directly from the Promoter): click on the link provided in the promotional email to access the entry form, fully complete the entry form with all of the requested details (including their full name, telephone number, postcode, and a valid email address), confirm they are aged 18 years or over by ticking the relevant tick box, and submit the fully completed entry form so that it is received during the Promotional Period; OR
(b) Promotional Stand: visit a promotional stand, fully complete the official entry form found at the promotional stand with all of the requested details (including their full name, telephone number, postcode, and a valid email address), confirm they are aged 18 years or over by ticking the relevant tick box, and place the fully completed entry form in the entry box provided at the promotional stand during the Promotional Period. A full list of promotional stand locations can be found at http://www.wineselectors.com.au/customer-service/cellar-door-locations/cellar-door-locations. Entry will also be valid at any additional ad-hoc promotional stands that Wine Selectors organise, at their discretion, throughout the Promotional Period;
(c) Online: visit either (a) the Promoter’s website at www.wineselectors.com.au/huntervalleycomp or (b) one (1) of the following affiliated websites at www.explore.wineselectors.com.au/huntervalleycomp1, follow the prompts to the promotional entry page, input the requested details (including their full name, telephone number, postcode, and a valid email address), confirm they are aged 18 years or over by ticking the relevant tick box, and submit the fully completed entry form so that it is received during the Promotional Period.
Incomplete, illegible or indecipherable entries will be deemed invalid.
Only one entry is permitted per person.
The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the promotion. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.
The Promoters reserve the right, at any time to invalidate any entries which they reasonably suspects have been submitted using false, incorrect, fraudulent or misleading information, including but not limited to personal details and contact information and/or entries that have been submitted through the use of multiple identities, email addresses or accounts.
If there is a dispute as to the identity of an entrant, the Promoters reserve the right, in their sole discretion, to determine the identity of the entrant.
There will be one (1) draw conducted from all entries received during the Promotional Period. The draw will take place at Anisimoff Legal, Suite 5, Erina Plaza, 210 Central Coast Highway, Erina NSW 2250 on 11/01/2017 at 10:00am AEDST. The winner will be notified via phone and in writing within two (2) business days of the draw. The winner’s name will also be published online at www.wineselectors.com.au/About-Wine-Selectors/Competition-Winners from 13/01/2017. Anisimoff Legal, on behalf of the Promoter, may draw additional reserve entries and record them in order in case an invalid entry or ineligible entrant is drawn.
The Promoter’s decision is final and no correspondence will be entered into.
The first valid entry drawn in the draw will win their choice of ONE (1) of the following prize options (“Prize”):

• Breakfasts for ten (10) for two (2) mornings. RRP up to $600.00
• Buffet breakfasts for ten (10) for two (2) mornings. RRP up to $660.00
• Five (5) course degustation dinner for ten (10) people at Redsalt including wines. RRP up to $850.00
• One (1) hour private use of the Sanctuary suite for ten (10). Plus ten (10) x fifty (50) minute spa treatments. RRP up to $1,050.00
• Ten (10) x 750ml bottles of Jade Estate Semillon to take home. RRP up to $250.00

• Prize is for the winner and nine (9) guests, aged 18 years or over, of their choice
• Two (2) nights 4.5 star accommodation at at Sebel Kirkton Park in a Grand Deluxe Room. Five (5) x double rooms. RRP up to $2,500.00
• Ten (10) x breakfasts for two (2) mornings. RRP up to $600.00
• Private dining room with six (6) course degustation for ten (10) people including wines. RRP up to $1,100.00
• Scenic Helicopter Flight with three (3) x Gourmet Picnic Hamper (based on four (4) people per hamper) for ten (10) people. Separate flights (max four (4) people per flight). RRP up to $1,500.00
• Wine Tasting by First Creek in Epoche Lounge Bar for ten (10) People. RRP up to $300.00 • Transfers for ten (10) people from Sydney or Newcastle to the value of $1000.00
A total of five (5) x double rooms maximum per night.
For the sake of clarity, all of the bottles of wine listed above will be below 20% in alcohol volume and the Prize will include a maximum of ten (10) 750ml bottles of wine
The Prize can only be taken Sunday – Thursday. Not available public holidays, special events, school holidays or during other peak periods. The Prize is subject to booking availability. All other costs associated with the Prize will be the responsibility of the Prize winner. Flights are not included as part of the Prize. Accommodation partners will require the winner’s credit card details at check in for incidentals incurred outside of what is outlined in these terms and conditions. Prize is subject to the standard terms and conditions of individual prize and service providers.
Any ancillary costs associated with the Prize are not included. These include, but are not limited to, spending money, additional meals, mini bar charges, further costs for transfers outside the allocated amount specified, items of a personal nature, travel insurance.
Should the winner not have an additional nine (9) guests, the remaining value of the will be forfeited and not exchanged for cash or additional prize value. During the entire duration of the Prize, a nominated parent/guardian must accompany any person under 18 years of age. Adventure 4 ‘Beer Weekend’ does not permit guests under the age of 18 years. If using the transfer element of the Prize, the winner and his/her companions must depart from and return to the same departure point and travel together. Pick up points include an airport or major railway stations.
Any ancillary costs associated with the Prize are not included. These include, but are not limited to, spending money, additional meals, mini bar charges, further costs for transfers outside the allocated amount specified, items of a personal nature, travel insurance.
All elements within the same ‘adventure’ must be redeemed at the same time, they are unable to be taken at different times. The winner may not swap out elements from one adventure to the other. The winner must redeem the Prize within twelve (12) months of claiming the Prize.
The Promoter encourages consumers to enjoy responsibly. Legal aged consumers are advised to consider the safe drinking levels recommended in the National Health & Medical Research Council Australian Alcohol Guidelines that are available at www.nhmrc.gov.au.
Subject to the unclaimed prize draw clause, if for any reason the winner does not take or claim the Prize (or an element of the Prize), by the time stipulated by the Promoter, then the Prize (or that element of the Prize) will be forfeited.
If the Prize (or part of the Prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the Prize (or that part of the Prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
In the event of war, terrorism, state of emergency or disaster, the Promoters reserve the right to cancel, terminate, modify or suspend the promotion or suspend or modify the prize, subject to any written directions from a relevant regulatory authority.
Total prize pool value is valued up to $7,790. The Prize, or any unused portion of the Prize, is not transferable or exchangeable and cannot be taken as cash, unless otherwise specified.
A draw for the Prize, if unclaimed, may take place on 14/04/2017 at the same time and place as the original draw, subject to any directions from a regulatory authority. The winner will be notified via phone and in writing within two (2) business days of the draw. The winner’s name (if awarded in the unclaimed prize draw) will also be published online at www.wineselectors.com.au/About-Wine-Selectors/Competition-Winners from 19/04/2017.
Entrants consent to the Promoter using the entrant's name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoters, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoters reserve the right, in their sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate
Any cost associated with entering this promotion is the entrant’s responsibility and is dependent on the relevant Internet, telephone network/lines or postal service provider used. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.
Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorized access or third party interference; (c) any entry or Major Prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in the Major Prize value to that stated in these Terms and Conditions; (e) if a promotional stand is not present or is relocated for any reason beyond the reasonable control of the Promoter; (f) any tax liability incurred by a winner or entrant; or (g) taking/use of and/or participation in the Major Prize (or part of the Major Prize).
The Promoter collects personal information ("PI") in order to conduct the promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this PI. The Promoter will also use and handle PI as set out in its Privacy Policy, which can be viewed at http://www.wineselectors.com.au/Terms-and-Conditions/Privacy-Policy/default.aspx. In addition to any use that may be outlined in the Promoter’s Privacy Policy, the Promoter may, for an indefinite period, unless otherwise advised, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. The Privacy Policy also contains information about how entrants may opt out, access, update or correct their PI, how entrants may complain about a breach of the Australian privacy laws or any other applicable law and how those complaints will be dealt with. All entries become the property of the Promoter. The Promoter will not disclose entrant’s personal information to any entity outside of Australia.
As a condition of accepting the Major Prize, the winner (and the Major Prize winner’s travel companion) must sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.
