2. This Promotion is not sponsored, endorsed, administered by or associated with Facebook.
3. Entry to the Promotion constitutes acceptance of these conditions. All entry instructions and prize information published by the Promoter form part of these conditions.
4. The Promotion commences at 10:00am AEDT on Wednesday 9 November 2016 and closes at 17:00pm AEDT on Tuesday 15 November 2016 (Promotion Period).
5. Entry is open to any Australian resident aged 18 years or older (Entrant). Employees and their immediate families of the Promoter, related companies of the Promoter and agencies associated with the promotion and their related companies are ineligible to enter.
6. To enter the Promotion, Entrants must visit the Nad’s Facebook Page (https://www.facebook.com/nads) then comment on the competition post answering: “Where would you buy your Nad’s Sensitive Hair Removal Cream – Chemist Warehouse, Woolworths or your nearest pharmacy?”, and submit it so that it is received during the Promotion Period (Entry).
7. Entrants may only enter the Promotion once during the Promotion Period. Incomplete, indecipherable or inaccurate Entries will be deemed invalid. Entries are deemed to be received at the time of receipt into the Promotion database. The Promoter is not responsible for any delay in, or failure of, transmission which causes an Entry not to be received within the Promotion Period.
8. By accepting the terms and conditions upon entering the promotion you are automatically entered into the Promoter’s email database.
9. No purchase is necessary to enter. Purchasing products will not help your chances of winning.
10. The total maximum Prize Pool is valued at $449.40. There are ten (10) Prizes in total. Each winner will receive one (1) prize each. Each Prize includes 1 x Nad’s Sensitive Hair Removal Cream (RRP $9.99) and 1 x Sarosha Classic Candy Turkish Towel (RRP $34.95). Prizes are not exchangeable and cannot be taken as cash. No responsibility is accepted for any variation in the value of the prizes. Please allow up to 40 days for delivery of prizes from being notified as a winner.
11. The Prize Draw will be conducted at 9:00am AEDT on Wednesday 16 November 2016 at Level 3, 145 William St, Darlinghurst. The ten (10) total Prize Winners will be the first ten (10) valid Entries drawn. Prizes are not transferable or exchangeable, and cannot be taken as cash.
12. The Winner will be notified by email within five (5) business days of the Prize Draw, and have their name published on the Nad’s Facebook page (https://www.facebook.com/nads), by Tuesday 21 November 2016. In their notification via Facebook, winners will be provided with details of how to claim their Prize and the date by which they must claim their Prize (Prize Claim Date). Winners may need to provide sufficient identification in order to claim their Prize.
13. If the Prize is unclaimed by the Prize Claim Date, subject to any directions from a regulatory authority, the Promoter may conduct a further draw on 16 February 2017 at the same time and location as the Prize Draw, in order to distribute the unclaimed Prize (Unclaimed Prize Draw). In the case of a winner, they will be notified by email within two days of the Unclaimed Prize Draw, and have their names published on the Nad’s Facebook page (https://www.facebook.com/nads) on 20 February 2017.
14. By entering this Promotion and submitting content you authorise that it is your own content and that you are permitted to distribute such content.
15. By entering this Promotion you authorise the Promoter to use content from your Entry on the Nad’s Facebook page (https://www.facebook.com/nads)
16. Supplying your valid contact details are part of the conditions of entry to this promotion. All contact details entered incorrectly shall be deemed invalid.
17. The Promoter reserves the right to disqualify entries if the entry has violated the Terms & Conditions in any way.
18. The Promoter’s decision is final and binding and no correspondence will be entered into. The Promoter reserves the right, at any time, to verify the validity of Entries and Entrants and to disqualify any Entrant who submits an Entry that is not in accordance with these Conditions of Entry or who tampers with the Entry process including the use of any form of automated entry device or software.
19. The Promoter is not liable for any loss, damage or personal injury suffered or sustained as a result of, in connection with, or arising out of the Promotion or taking the Prize.
20. If for any reason the Promotion is not capable of running as planned, including but not limited to fraud or causes beyond the control of the Promoter or anything which corrupts or affects the administration, security, fairness, integrity or proper conduct of the Promotion, the Promoter reserves the right in their sole discretion to cancel, terminate, modify or suspend the Promotion, subject to any directions from a regulatory authority.
21. The information entrants provide will be used by the Promoter for the purpose of conducting this Promotion. The Promoter may disclose Entrants’ personal information to companies and agencies connected with this Promotion.
22. This Promotion is not sponsored, endorsed, administered by or associated with Facebook. You understand that you are providing your information to Nad’s Pty Ltd, and not to Facebook. In order to conduct this Promotion, the Promoter needs to collect personal information about each entrant and may for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, gift suppliers and regulatory authorities. Participation in the Promotion is conditional on providing this information. It is a condition of entry that the entrant agrees to being entered into the Nad’s database. The Promoter and Nad’s Pty Ltd may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant and for such other purposes as set out in the Nad’s Pty Ltd Privacy Policy. Entrants should direct any request to access, update or correct information to the Promoter. All personal details of entrants will be stored at the office of the Nad’s Pty Ltd. Upon the entrant’s request, all information provided will be removed from our active database. 23. The collection, use and disclosure of personal information in connection with the Promotion is governed by the Privacy Act 1988 (Cth). By entering the Promotion, Entrants agree and consent to the Promoter:
i. using and disclosing the Entrant’s personal information for the purposes of conducting the Promotion, redeeming the Prizes and any other matter connected to or incidental to the Promotion;
ii. using the Entrant’s personal information for the purposes of carrying out marketing, planning, product development and promotional campaigns, in any media including email and SMS, unless an Entrant otherwise withdraws their consent to the use of their information in this manner; and
iii. using the Entrant’s name, likeness, image and/or voice (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting the Promotion and for any other purpose at the Promoter’s sole discretion.
