“iSelect Your Adventure” Gift Card & Prize Draw Conditions of Entry
1. These Terms & Conditions apply to the “iSelect Your Adventure” promotion and prize draw promoted by iSelect Ltd (ABN 48 124 302 932) of 294 Bay Road, Cheltenham, Victoria, 3192 (“iSelect” or the “Promoter”).
2. We recommend that you read these Terms & Conditions in full. Information on how to enter the Promotion and information in relation to the prizes form part of these Terms & Conditions. Participation in the Promotion is deemed acceptance of these Terms & Conditions.
3. If you are an Eligible Person (see section 5 below) and satisfy all of the Entry Requirements (see section 6 below) then, subject to these Terms & Conditions, you will be entitled to:
a. receiveaAU$100prepaideftposcard(“GiftCard”);AND
b. automatically be entered into a prize draw, to be one of 3 winners who will each win a Travel Package (see
section 9 below) (“Prize Draw”),
(collectively, the “Promotion”).
4. The Promotion commences at 00.01 AEST on 4 October 2016 and ends at 23:59 AEST 23 October 2016 (“Promotion Period”).
Eligibility and Entry
5. Entry to the Promotion is ONLY open to persons who:
a. are permanent Australian Residents aged 18 years or older. For the purposes of these Terms & Conditions, “Australian Residents” means a person who resides in Australia at the start of the Promotion Period and who holds Australian citizenship or holds an Australian permanent residency visa. Employees of iSelect and its related bodies corporate (as that term is defined in the Corporations Act 2001 (Cth)) or immediate families of the aforementioned employees are ineligible to enter. For the purposes of these Terms & Conditions, “immediate family” means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or first cousin; AND
b. purchase an Eligible Health Insurance Policy during the Promotion Period through iSelect in the manner described in section 6 below. For the purposes of these Terms & Conditions, “Eligible Health Insurance Policy” means any health insurance policy purchased through iSelect (excluding ‘Overseas Visitors’ cover, ‘Corporate policies’ or membership of any restricted fund) AND the Eligible Person must maintain the Eligible Health Insurance Policy purchased for a period of 30 days from the date of purchase,
(“Eligible Persons”).
6. In order to participate in the Promotion, Eligible Persons must:
a. purchase an Eligible Health Insurance Policy through iSelect via clicking on a promotional email from iSelect inviting them to participate in the Promotion (sent either directly from iSelect or forwarded to them) or via clicking on digital advertising published by iSelect promoting the Promotion; OR
b. purchase an Eligible Health Insurance Policy through iSelect over the telephone by calling 131920 and mentioning the “iSelect Your Adventure” Promotion,
(“Entry Requirements”).
7. FOR THE AVOIDANCE OF DOUBT, IF YOU PURCHASE YOUR ELIGIBLE HEALTH INSURANCE POLICY BY TELEPHONE,
YOU MUST MENTION THE “ISELECT YOUR ADVENTURE” PROMOTION. IT IS NOT POSSIBLE FOR YOU TO SUBSEQUENTLY DO THIS (FOR EXAMPLE DURING A SUBSEQUENT TELEPHONE CALL).
Eligible Applications
8. Each time an Eligible Person satisfies all of the Entry Requirements in sections 5 and 6 above, it shall be referred to in these Terms & Conditions as an “Eligible Application”.
9. For each Eligible Application, the Eligible Person will:
a. receive a Gift Card (see sections 10 to 17 for the process for redemption of the Gift Card); AND
b. automatically be entered into the Prize Draw to win one of three (3) prizes. Each prize consists of (i) a Flight Centre gift voucher valued at AU$18,000 (“Travel Package”); and (ii) a AU$2,000 eftpos card (“eftpos Card”); (together, the “Prize”). The Travel Package is provided by Flight Centre Travel Group Limited (ABN 25 003 377 188) trading as Flight Centre (ATAS Accreditation No. A10412) (“Flight Centre”).
Redemption and Use of Gift Card
10. iSelect (or any designee of iSelect) will send a Gift Card to each Eligible Person, by regular post to their postal address (as nominated by that Eligible Person at the time of purchase of the Eligible Health Insurance Policy) by 30 November 2016. iSelect is not responsible for any Gift Card that is lost in the post or undelivered.
11. Gift Cards for this Promotion will be issued on behalf of iSelect by Edge Loyalty Systems, ABN 96 138 299 288 (“Edge Loyalty”). For any questions in relation to the use of the Gift Cards contact Edge Loyalty at info@giftcardplanet.com.au, or call 1300 079 267.
12. Specific terms and conditions issued by Edge Loyalty will apply to the use of the Gift Cards and can be viewed at the following address: http://www.giftcardplanet.com.au/eftpos-cardholder-terms.
13. Gift Cards are not redeemable for cash or any alternative form of credit.
14. Before the Gift Card can be used it must be activated. The Gift Card will be accompanied by a letter outlining how
to activate the Gift Card. Visit www.activatemycard.com.au/iselect or call 1300 079 267 and enter/provide your Gift Card number, full name, email address and phone number to activate the Gift Card. The Gift Card needs to be activated within 1 month of the date of the accompanying letter.
15. Once activated, the Gift Card will be ready to use from midday of the following business day, and will be valid for 6 months.
16. To use the Gift Card, simply:
a. Swipethecard;
b. Select SAVINGS; and
c. Enter the 4 digit PIN which can be found on the back of the Gift Card.
17. Gift Card recipients are responsible for ensuring that any Gift Cards redeemed by them are used in accordance
with the specific terms and conditions of use referred to in this section, including any terms and conditions in relation to the validity or expiry periods for those Gift Cards. iSelect and Edge Loyalty are not able in any circumstances to extend the expiry date of any Gift Card issued as part of the Promotion.
Prize Draw
18. The total allocated prize pool for the Prize Draw is AU$60,000, to be divided into three (3) separate prizes of up to AU$20,000 only and awarded to three (3) Eligible Persons (each, a “Winner”). This includes AU $2,000 spending money in the form of an eftpos gift card. The Promoter accepts no responsibility for any tax implications that may arise from prize winnings. Independent financial advice should be sought. All Prize values are the recommended retail price including GST.
19. There will be one draw for all Winners, which will take place following the end of the Promotion Period.
20. The draw will be conducted by Anisimoff Legal, an independent third party, located at Suite 5, Erina Plaza, 210
The Central Coast Highway, Erina, NSW, 2250, and will take place at AEST 16:00 on Tuesday 25 October 2016.
21. In the event that any Prize or Prizes become unavailable for reasons beyond iSelect’s control, iSelect may at its discretion substitute the Prize for an alternative prize, subject to any written directions from a regulatory
authority.
22. All taxes which may be payable as a consequence of receiving the Prize are the sole responsibility of the Winner.
Any additional expenses involved are at the Winners’ expense.
23. Allocation of Prizes to Winners is final and binding and no correspondence will be entered into.
24. Winners will be notified in writing via the contact details supplied by the Eligible Person to iSelect when
purchasing an Eligible Health Insurance Policy. Winners will be notified within two (2) working days after the Winners are drawn and all Winners’ names will be published on www.iselect.com.au and for those Winners residing in ACT and for those Winners of prizes valued at over $250 residing in South Australia, in The Australian newspaper on Monday, 31st October.
25. If necessary and at its complete discretion, iSelect may conduct an unclaimed prize draw at the same time and place as the original draw on Monday 30th January, 2017 in order to distribute any unclaimed Prize. All non- winning entries from the original draw will be included in the unclaimed prize draw. The Winner of any unclaimed prize draw will be notified in writing (via the contact details supplied by the Eligible Person to iSelect when purchasing an Eligible Health Insurance Policy) within two (2) working days of the draw and the Winners’ names will be published on www.iselect.com.au and for those Winners residing in ACT and for those Winner of prizes valued at over $250 residing in South Australia, in The Australian newspaper on Tuesday 31st January, 2017.
26. The Prize will only be awarded where a Winner fulfils all the requirements of the Promoter’s verification tests and procedures. iSelect reserves the right, at its absolute discretion, to request verification of age, identity, residential address of the Winner and/or proof of eligibility and other information relevant to entry into or participation in this Promotion. iSelect reserves the right to disqualify any individual who: (a) is involved in any way with interfering or tampering with the conduct of the Promotion; or (b) iSelect otherwise deems has acted in a way which is contrary to the spirit of the Promotion.
Redemption and Use of Prize
27. To redeem the Travel Package, each Winner must email Gabrielle Williamson, customer_solutions@iselect.com.au within 14 days of being notified in accordance with sections 24 or 25, above. Winners must specify that they wish to redeem a Travel Package as a Winner of the “iSelect Your Adventure” Promotion. Any Winner who does not send the email described in this section 27 will forfeit their Prize.
28. iSelect shall provide each Winner with initial guidance about how the Travel Package should be booked and shall direct the Winner to the relevant person at Flight Centre in order to book the Travel Package. The Travel Package must:
a. be appropriate and must not create undue risk of harm (by way of example, Winners shall not be entitled to book a Travel Package to any country that the Australian government advises against or prohibits travelling to); and
b. conclude with a returning flight to Australia.
The selection of each Travel Package shall be subject to the prior written approval of iSelect. Each Travel Package must be booked no later than June 30, 2017 or that Travel Package will be forfeited by the Winner in full.
29. All bookings made in connection with a Travel Package are subject to availability at the time of booking. Specific terms and conditions issued by Flight Centre and the relevant travel service providers (e.g. airlines, accommodation providers, etc.) will also apply to the Travel Package. These will be notified to the Winners prior to completion of booking of the Travel Package and must be accepted by the Winners in order to redeem the Prize.
30. A Travel Package will be deemed fully used once a qualifying booking has been made by the relevant Winner and confirmed to be available by Flight Centre. Travel Packages are not able to be reinstated, refunded or replaced, even in the event that the reservation is cancelled or changed.
31. iSelect (or any designee of iSelect) will send an eftpos Card to each Winner, by regular post to their postal address (as nominated by that Winner at the time of purchase of the Eligible Health Insurance Policy) by Wednesday 30th November, 2016. eftpos Cards will be issued on behalf of iSelect by Edge Loyalty and sections 11 to 17 of these Terms & Conditions will apply to the use of the eftpos Cards by the Winners.
32. The Prize is not transferable or redeemable for cash, any alternative form of credit or exchanged for any other form of travel services and can only be used as specified by the Promoter or Flight Centre (as applicable).
33. There is no residual value and no credit will be issued if the booking amount is less than the Travel Package amount.
34. Other than the items specifically stated as included in the Prize, all other taxes, fees, charges and surcharges applicable to the Prize and to taking the Prize, including, without limitation, transfers, meals, extra persons, phone charges, parking and other charges must be paid at the time the Prize is redeemed or to the relevant travel or other supplier directly and are the responsibility solely of the Winner.
35. The Winners must conduct themselves in a responsible, courteous, respectful and friendly manner at all times whilst participating in the Prize. Acceptance of the Prize and participation in the Prize is subject to the prevailing terms and conditions of travel/accommodation/transfers/services suppliers and any other Prize suppliers, and in particular behaviour and safety requirements. The Winners must follow all reasonable directions given by the Promoter and any travel/accommodation/transfers/services suppliers during the course of their participation in the Prize, including all directions in relation to responsible consumption of alcohol, behaviour and safety. The Promotor and or Prize supplier reserve the right, in their absolute discretion, to refuse admission onto any flight or to refuse participation in certain activities, on the grounds of inappropriate behaviour, or safety reasons, or for any breach of these Terms & Conditions or any other terms and conditions applicable to the Prize (as indicated above) generally. If a Winner fails to participate in the Prize in the manner required, as stated in this section and in the reasonable opinion of the Promoter, their entry and the balance of the Prize will be forfeited with no compensation payable.
36. It is a condition of accepting and participating in the Prize that a Winner may be required to sign a legal release or release(s) in a form determined by the Promoter in its absolute discretion.
General
37. iSelect assumes no responsibility for any failure to receive an entry in the Promotion or for inaccurate information by any person or for any loss, damage or injury as a result of technical or telecommunications problems, including security breaches. If such problems arise, then iSelect may (where necessary with the approval of the relevant lottery authority) modify the Promotion.
38. Where necessary and subject to the approval of the relevant lottery authorities, iSelect reserves the right to modify and vary these Terms & Conditions or may withdraw the Promotion at any time. iSelect may exclude from the Promotion any entrant who breaches these Terms & Conditions or who acts in a way which is contrary to the spirit of the Promotion or these Terms & Conditions. Any decision of iSelect is final and no further correspondence will be entered into.
39. Information provided by Promotion entrants will be collected and used by iSelect for the purposes of conducting the Promotion and for promotional purposes surrounding this Promotion. By entering this Promotion, entrants consent to the use of their information as described and agree that iSelect may use this information, or disclose it to other organisations that may use it, in any media for future promotional purposes without any further reference or payment to the entrant. 40. To the extent permitted by law, iSelect, Flight Centre Travel Group Limited and their related bodies corporate (as that term is defined in the Corporations Act 2001 (Cth)), their employees, and agents shall not be liable for any claims, damages, injuries, costs, and expenses suffered, sustained or incurred (including but not limited to indirect or consequential loss) as a result of, or arising out of, or in any way connected with this Promotion and/or the Prizes or any act or omission (whether negligent or not) of iSelect, Flight Centre Travel Group Limited and their related bodies corporate (as that term is defined in the Corporations Act 2001 (Cth)), their employees and agents.
