A. General
1. Information on how to enter this competition, mechanics of entry and prizes form part of these Conditions of Entry. Entry into this competition is deemed acceptance of these Conditions of Entry by each Entrant.
2. Entry is open to Velocity members (Australian residents) who earn Velocity Points during the promotional period (Entrants). The Promoter is Velocity Frequent Flyer Pty Ltd (ACN 601 408 824) of registered address 56 Edmondstone Road, Bowen Hills, Queensland 4006.
3. The directors, officers, management and employees (and their immediate families) of the Promoter and its related bodies corporate are not eligible to enter this competition.
4. The competition commences at 12:01 am AEST on 1 August 2016 and ends at 11:59 pm AEST on 30 September 2016 (Promotion Period).
B. Entry
5. Entrants will be automatically entered into the competition when they earn Velocity Points that have an Activity Date during the Promotion Period (Eligible Earn Transaction).
6. The Activity Date of a Velocity Points earn is the date listed next to the transaction on the Entrant’s online Velocity account. Generally, the Activity Date will be the date you receive the product or service associated with the Velocity Points earn. The Activity Date of a Velocity Points earn may not be the date of a purchase or booking. For example:
a) When earning Velocity Points by purchasing Virgin Australia flights, the Activity Date will be the date the flights are flown;
b) When earning Velocity Points by purchasing BP fuel, the Activity Date will be the date of purchase.
7. Any transaction with an Activity Date outside of the Promotion Period is not eligible. For example, if a Velocity Frequent Flyer member books a flight with a Velocity Frequent Flyer airline partner during the Promotion Period for travel outside the Promotion Period (e.g. in October 2016), the Velocity Points earned for this flight will not be considered an Eligible Earn Transaction, as the Activity Date will be when the flight is flown.
8. There is no limit to the number of entries per person for the competition. A member will receive an entry into the competition for every Eligible Earn Transaction. For example, 10 Eligible Earn Transactions will result in 10 entries into the competition.
9. Velocity Points earned by a Contributor in a Family Pooling arrangement will be considered an Eligible Earn Transaction for that member and not the Beneficiary of the Velocity Points.
10. An Eligible Earn Transaction that is reversed, cancelled or otherwise deducted (other than by a valid redemption) prior to the draw will be deemed invalid and will not be considered an Eligible Earn Transaction.
11. Points Transfer – Family or Velocity Points that are issued by Velocity Frequent Flyer or Virgin Australia as a gesture of goodwill will not be considered an Eligible Earn Transaction.
12. Velocity Frequent Flyer reserves the right to cancel (without any liability) any Eligible Earn Transaction that is credited incorrectly or in error (for whatever reason), or any Eligible Earn Transaction in which Velocity Points are credited as a result of a breach of the Velocity Frequent Flyer Terms and Conditions.
13. Entries will be deemed accepted on the Activity Date of the Eligible Earn Transaction. Entries received will be considered final by the Promoter. The Promoter accepts no responsibility for any late, lost, incomplete, incorrectly submitted, delayed, corrupted or misdirected entries, claims or correspondence whether due to error, omission, alteration, tampering, deletion, theft, destruction or otherwise including those entries not received by the Promoter.
14. If you enter the competition but no longer wish to participate, please email Optout.HoldenGiveaway@velocityfrequentflyer.com and you will be removed from the competition.
15. Costs associated with entering the competition remain an Entrant’s responsibility and may vary.
C. Drawing Winners
16. The draw will be conducted on 18 January 2017 at 10:00 am at Anisimoff Legal, Suite 5, Erina Plaza, 210 Central Coast Highway, Erina, NSW 2250.
17. The winner or winners (a Winner) may be announced on Velocity’s website after 10:00 am AEST on 24 January 2017. The Winner will be notified after 10:00 am AEST on 18 January 2017 directly by phone or email where further contact information and details will be requested including, but not limited to, full name, phone, email, and address.
18. If the prize is not claimed within 3 months of publication, a redraw will be conducted. If required, the redraw will be conducted 2 May 2017 at 10:00 am at Anisimoff Legal, Suite 5, Erina Plaza, 210 Central Coast Highway, Erina, NSW 2250.
19. A redrawn Winner will be notified by phone or email within two (2) days of the draw.
20. Entries not fully complying with these Conditions of Entry may be deemed invalid at the Promoter’s discretion. If a winning entry is deemed not to comply with these Conditions of Entry, the entry will be discarded and the relevant prize will be re-awarded in accordance with the relevant clause of these Conditions of Entry, as if the discarded entry had not been received.
21. All decisions of the Promoter are final and no discussions or correspondence will be entered into.
22. This is a game of chance and skill plays no part in determining the outcome.
23. It is a condition of accepting the prize that the winner may be required to provide proof of identity, proof of age, proof of residence and/or proof of entry, at the Promoter’s discretion.
D. Prize
24. There are four (4) prize packages to be won. Each prize package consists of:
c) one (1) x Holden Trax LTZ 1.4L DOHC 16-valve 4-cylinder petrol iTi turbo petrol engine, 2016 Plated MY16 Trax valued at up to $29,264 AUD (excluding GST) (Holden Vehicle);
d) one (1) x Wilson Parking Access Pass valid for six (6) months, valued at up to $3,500.00 AUD (excluding GST) (Parking Pass); and
e) one (1) x BP Gift Card valued at $1,500 AUD (excluding GST) (BP Card) (collectively, Prize).
25. The Prize may be subject to additional Terms and Conditions. You should contact the supplier of the component of the prize for more information.
26. The Prize includes the following on road costs excluding GST and valued up to $3,000 AUD: registration, compulsory third party insurance stamp duty and dealer delivery (capped at $995 excluding GST).
27. The Prize excludes comprehensive car insurance and any optional extras.
28. Average total Prize value is $34,264 AUD (excluding GST). The Prize value is correct as at the date of printing, but may change depending on the location of the Holden dealership. The promoter accepts no responsibility for change in value of the Prize between the time of printing and the final date on which the Prize is redeemed.
29. The total Prize pool value is up to $137,056.00 AUD (excluding GST).
30. The Prize is not exchangeable and cannot be taken as cash.
31. Colour selection of the Holden Vehicle is at the discretion of the supplier and subject to availability.
32. Additional options (including accessories) and all ancillary costs plus insurance on any modifications and additional options (including accessories) are the responsibility of the winner Velocity Frequent Flyer Pty Ltd ACN 601 408 824 and cannot be guaranteed. Unless expressly stated in these Terms and Conditions all other related expenses become the responsibility of the Winner.
33. The Holden Vehicle will be delivered to the Winner’s closest Holden Dealership. Any costs associated with the Winner travelling to their nearest Holden Dealership to collect the prize will be at the Winner’s expense. The Winner will be required to provide proof of identity.
34. The Promoter takes no responsibility for cosmetic (paint), body or mechanical damage, or any other damage which may be incurred from date of collection.
35. The Parking Pass is subject to Wilson Parking Terms and Conditions.
36. The Parking Pass is valid for six (6) consecutive months (upon pass issue) at participating Wilson Parking car parks in the Winner’s state of residence only.
37. Participating car parks are subject to change without notice.
38. The Parking Pass must be taken as stated and is not transferable to another person (unless agreed to by Wilson Parking) or exchangeable for other goods and services and cannot be redeemed for cash.
39. The Winner will be issued with one Wilson Parking Access Pass within 14 days of winning the Prize.
40. The Winner will have unlimited access within operating hours during the six (6) month period in their chosen state’s participating car parks.
41. If the Winner resides in South Australia, they will instead be issued with one (1) x Wilson Parking Access Pass valid for six (6) months, within 14 days of winning the Prize, which can be used for unlimited access to one preferred car park in participating South Australian car parks. The participating SA car parks are Adelaide Central, East End, Flinders Link, City West, and 30 Hindley St.
42. The Winner must enter and exist using the Wilson Parking Access Pass and can park in any unreserved bay.
43. The BP Card is issued by and remains the property of BP Australia Pty Ltd ABN 53 004 085 616 (BP).
44. BP may from time to time amend the Terms and Conditions applicable to use of the BP Card. Any new or amended Terms and Conditions will be available on the BP website and at participating BP outlets.
45. The BP Card has a stored value which may be used to purchase (or part pay) any goods or services at participating BP outlets which has an EFTPOS terminal, which is operational at the time of the transaction. BP does not warrant that the EFTPOS terminal will be operational at any particular participating BP outlet at any particular time.
46. Only one (1) BP Card per transaction at BP is allowed and it cannot be used for payment of credit or retailer accounts.
47. Minimum purchase on the BP Card in a single transaction is $5.00.
48. The BP Card cannot be reloaded and is not redeemable for cash. No cash out facilities are available to the BP Card.
49. Defaced, mutilated, altered, lost or stolen BP Cards will not be replaced, refunded or redeemed.
50. BP will refund the unused value on damaged BP Cards, except where the amount of the refund is less than $5.00 or the card number and magnetic strip are unreadable. This refund will be the last balance shown by BP’s records as remaining on the BP Card, unless the Winner is able to demonstrate that this is incorrect.
51. The BP Card is not valid for use after the expiry date, which is printed on the BP Card. Any unused value on the BP Card prior or after expiry will not be refunded or credited.
52. If the Winner’s purchase(s) are greater than the balance remaining on the BP Card, the Winner will be liable for the payment in cash of any excess purchase amount.
53. BP (including its officers, employees, agents and representatives) are not liable for any loss, damage, or expenses arising in any way out of the use of the BP Card, including but not limited to, any purchases made with the BP Card, any loss the Winner or anyone else incurs as a result of loss, theft or use of the BP Card by any unauthorised party, or as a consequence of the BP Card being unable to be used due to damage, a participating BP outlet refusing to supply goods or services to the Winner or refusing to accept the BP Card, a failure of any participating BP outlet to accept the BP Card due to the fact that the EFTPOS terminal is not operational or by any failure in the EFTPOS terminal, which results in the BP Card not being accepted at any time.
54. The Promoter makes no representation as to the safety, usability, availability, conditions or other issues that may exist or arise as part of the Prize. From when the Prize is awarded, any issues that arise in relation to the Prize must be raised with the supplier of the component of the Prize and not with Velocity Frequent Flyer.
55. The Prize will be awarded to the Entrant named in the entry. If the Winner is under 18 years of age at the date of the draw, the prize will be awarded to the Winner’s nominated parent or guardian on behalf of the winner.
E. Contacting the Entrant
56. Should an Entrant’s contact details change during the Promotion Period, it is the Entrant’s responsibility to notify the Promoter. A request to access or modify any information provided in an entry should be directed to the Promoter.
57. By accepting the Prize, Winners agree to participate in and co-operate as required with all reasonable media editorial requests relating to the prize, including but not limited to, being interviewed and photographed. Winners will not be entitled to any fee for participating in these activities.
F. Intellectual Property
58. If this competition requires an Entrant to create any written material, imagery or sound recordings, the provisions in this Section F apply.
59. As a condition of entering this competition, the Entrant warrants to the Promoter that:
a. The entry does not infringe the intellectual property rights or moral rights of any third party; and
b. The Entrant has obtained permission from any third party appearing or participating in the entry.
60. As a condition of entering this competition, Entrants hereby assign to the Promoter, all right, title and interest in and to all intellectual property rights (including copyright but excluding moral rights) in any material created pursuant to the Entrant’s participation in any aspect of the competition (Works). Entrants acknowledge that the Promoter is free to use the Works and to exercise its rights in relation thereto and the Entrant will not be entitled to any fee for such use. Entrants agree they may not be attributed as the author of the Works and that the Promoter may undertake any act or omission in relation to the Works, which may otherwise constitute an infringement of their moral rights.
61. The Promoter may want a Winner to participate in promotional activity after the competition has ended. In consideration for the Promoter awarding the prize to a Winner, the Winner permits the Winner’s image and/or voice, as recorded, photographed or filmed during the Winner’s participation in the prize to appear in any media whatsoever throughout the world for an unlimited period and the Winner will not be entitled to any fee for such use.
62. The Promoter reserves the right to request that a Winner provides proof of identity, proof of age, proof of residency and/or proof of entry validity in order to claim a prize. Proof of identification, residency, age and entry considered suitable for verification is at the discretion of the Promoter. In the event that a Winner cannot provide suitable proof, the Winner will forfeit the Prize in whole and no substitute will be offered.
G. Legal
63. The Promoter reserves the right to verify the validity of entries and to disqualify any Entrant who tampers with the entry process, who submits an entry that is not in accordance with these Conditions of Entry or who has, in the opinion of the Promoter, engaged in conduct in entering the competition which is fraudulent, misleading, deceptive or generally damaging to the goodwill or reputation of the competition and/or the Promoter. The Promoter reserves the right to disqualify a Winner if the Promoter becomes aware that the Winner and/or the Winner’s entry is of a type described in this clause. Any Entrant disqualified under this clause is prohibited from any further participation in the competition.
64. In the case of the intervention of any outside act, agent or event which prevents or significantly hinders the Promoter’s ability to proceed with the competition on the dates and in the manner described in these Conditions of Entry, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, act of terrorism, the Promoter may in its absolute discretion cancel the competition and recommence it from the start on the same conditions, subject to any written directions given under State Regulation.
65. If for any reason this competition is not capable of running as planned, including due to infection by computer virus, communications network failure, bugs, tampering, unauthorised intervention, fraud, technical failure or any causes beyond the control of the Promoter, which corrupt or affect the administration, security, fairness or integrity or proper conduct of this competition, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, take any action that may be available and to cancel, terminate, modify or suspend the competition, or invalidate any affected entries, subject to any written direction given under State Regulation.
66. Nothing in these terms and conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act 2010 (Cth), as well as any other implied warranties under the ASIC Act 2001 (Cth) in Australia, or similar consumer protection laws in the State and Territories of Australia (Non- Excludable Guarantees). The Promoter, its associated agencies and companies (and their respective officers, employees and agents) exclude all liability (including negligence) except for any liability that cannot be excluded by law, including the Non-Excludable Guarantees, for any direct, indirect or consequential injury, loss and/or damage arising in any way in connection with this competition or any Prize/s. This includes, but is not limited to: (i) technical malfunctions, delays or failures, including those resulting from accessing any materials related to this competition and any incorrect or inaccurate or incomplete information communicated in the course of, or in connection with, this competition as a result of any technical malfunctions, delays or failures; (ii) theft, unauthorised access or third party interference; (iii) lost entries, prize claims or prizes; and (iv) acceptance and/or use of any prize.
67. The Promoter reserves the right in its sole discretion to disqualify any individual who the Promoter has reason to believe has breached any of these Conditions of Entry, or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of this competition. Any Entrant disqualified under this clause is prohibited from any further participation in the competition. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.
68. The Promoter and their associated agencies and companies assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, internet failure, theft or destruction or unauthorised access to, or alteration of entries, and reserves the right to take any action that may be available.
69. The Promoter is not liable for any tax implications arising from prize winnings. Independent financial advice should be sought as tax implications may arise as a result of accepting the prize.
70. The Promoter is collecting your personal information provided by you for the purpose of conducting the competition, including providing any prize to you. Entry into competitions run by the Promoter is conditional on providing this information. The Promoter may disclose your personal information to the promoters and prize suppliers. The Promoter may also disclose your personal information to and/or collect your personal information from its related companies and third parties who provide (or help the Promoter provide) products and services, some of whom may be located overseas. The Promoter may disclose your personal information to persons or organisations located in Germany, Hong Kong, India, Ireland, Malaysia, New Zealand, Singapore, The Philippines, Turkey and United States of America. The Promoter’s Privacy Policy states how you can seek to access or correct your personal information and how to make a privacy complaint. You can contact the Promoter’s Privacy Officer in at privacy@virginaustralia.com.
71. You consent to the Promoter using your personal information for future promotional and marketing purposes regarding the Promoter’s products and services, including contacting the entrant via SMS and email messages (and you consent to receiving such messages from the Promoter). Information on how to opt-out from these messages is set out in the Promoter’s Privacy Policy.
72. Entrant’s personal information may be disclosed to State and Territory lottery departments and Winners’ names published as required under the relevant lottery legislation. A request to access, update or correct any information should be directed to the Promoter.
