TERMS AND CONDITIONS
If you predict the The prize winner (the Winner) will receive Two (2) x Reserved Seats to a NBL Regular Season Game (excluding NBL Finals) as part of the 2018/2019 NBL Season, in the Winner’s home state and a signed NBL Ball from any team of their choosing (the Prize).
Entry is only open to Australian and New Zealand residents (Eligible Entrants). Entrants under 18 years old must have parental/guardian approval to enter and further, the parent/guardian of the entrant must read and consent to these Terms and Conditions. Parents/guardians may be required by the Promoter to enter into a further agreement as evidence of consent to the minor entering this promotion
Employees (and their immediate families) of the Promoter and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or first cousin.
D. The Promotion will run between 10am on Thursday, 17 January 2019 and 9pm on Monday, 28 January 2019
(the Promotion Period).
E. To enter the Promotion, eligible entrants must, during the Promotion Period, visit the promotion page www.nbl.com.au/Latrobepedict and follow the instructions contained therein.
F. Only one (1) entry per person per game will be allowed.
The Prize is not exchangeable or transferable for cash and all travel expenses including and not limited to Flights, accommodation and other expenses to attend the event will be borne by the Winner.
In the case of multiple correct Winners, the Winner will be selected based on first entry (based on Time and Date).
In the case of no correct guesses for a game, the closest guess from each game in the round will win a ‘rebound’ prize which will be a signed NBL Ball
Number of draws: one (1) (for each Game in Round 15 excluding NZ and Perth) (the Prize Draw).
Number of prizes: five (5) (one (1) Winner for each Game in Round 15 excluding NZ and Perth) with each Winner provided with two (2) tickets to the nominated game.
The total prize pool for the Promotion is valued at $850.00 as of December 13th 2018
Travel to and from the game including road and air transport, spending money, meals, taxes insurance, passports, visas, vaccinations, transport to and from departure point, transfers, items of a personal nature, in-room charges and all other ancillary costs are not included.
Prize must be taken to coincide with the 2018/2019 Hungry Jack’s NBL Season games.
The draw will take place at the Promoter’s office, Level 6, 10 Queens Road, Melbourne, VIC 3004 at 10am on Wednesday, 30 January 2019.
The Winner will be notified by telephone and in writing via email, within two (2) business days of the draw. Once a winner's identity, address and age have been verified in accordance with these Terms, the Promoter will publish the Winner's details via the Promoter’s Electronic Direct Marketing data base and on the Promoter’s website within 24 hours of the draw. If any prize is not claimed within 4 working days of the draw, the relevant Winner’s entry will be deemed invalid.
In the event of war, terrorism, state of emergency or disaster, the Promoter reserves the right to cancel, terminate, modify or suspend the promotion or suspend or modify a prize, subject to any written directions from a relevant regulatory authority.
If the Winner of the prize is under the age of 18 years, the prize will be awarded to the Winner's nominated parent or guardian on the Winner’s behalf.
Subject to the unclaimed prize draw clause, if for any reason the Winner does not take / redeem the prize (or an element of the prize) at/by the time stipulated by the Promoter, then the prize (or that element of the prize) will be forfeited.
If the prize (or part of the prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
Promoter collects personal information ("PI") in order to conduct the promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this PI. The Promoter will also use and handle PI as set out in its Privacy Policy, which can be viewed at http://www.nbl.com.au/privacy-policy/. In addition to any use that may be outlined in the Promoter’s Privacy Policy, the Promoter may, for an indefinite period, unless otherwise advised, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. The Privacy Policy also contains information about how entrants may opt out, access, update or correct their PI, how entrants may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with. All entries become the property of the Promoter. The Promoter may disclose Australian entrant's PI to any entity outside of Australia – see Privacy Policy and below for details.

CONDITIONS OF ENTRY
This document contains the terms and conditions of entry (Terms) into the Promotion.
Entry into the Promotion is deemed acceptance of the Terms.
Eligible Entrants are responsible for ensuring their familiarity with the Terms at the time of participation. The Promoter’s decision not to enforce a specific restriction (whether communicated to an entrant or not) does not constitute a waiver of that restriction or of the Terms generally.
All entries must be received by the Promoter during the Promotion Period.
RESTRICTIONS ON ENTRY
All entries become the property of the Promoter.
The Promoter, subject to the relevant Australian State or Territory legislation, reserves the right not to accept an entry from any Entrant or to disqualify an Entrant if the Promoter considers that the entry contains anything defamatory, is otherwise inappropriate, is not submitted in accordance with these Terms, or is received after the closing date.
An Eligible Entrant may only enter as an individual.
The Winner will be chosen from a draw of Entrants pursuant to these Terms that satisfy the eligibility requirements as set out in these Terms.
SELECTION OF WINNERS
Eligible Entrants may only enter the draw once per game.
It is a condition of accepting the Prize that the Winner must comply with all the conditions of use of the Prize contained in these Terms.
The Prize remains the property of the Promoter until claimed by the respective Winner.
The Promoter’s decision in relation to any aspects of the Promotion is, subject to relevant Australian State or Territory legislation, final and binding on every person who enters and no correspondence will be entered into. At all times, Eligible Entrants agree to act in accordance with the Promoter's Terms and Conditions and other related policies (available at www.latrobefinancial.com/home/privacypolicy).
After a Winner is successfully contacted in accordance with these Terms, the Winner must, if required by the Promoter, within seven (7) days email a copy of either a current valid passport or a current valid driver's licence as proof of identity, address and age. The copy must be certified by an independent witness if required by the Promoter and forwarded to the Promoter at the email address nominated by the Promoter at the time the Winner is contacted.
In the event a Winner fails to comply with clause 13, the Prize may be withdrawn.
GENERAL
The Promoter shall not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) or for any personal injury suffered or sustained in connection with any entry or Prize participation except for any liability which cannot be excluded by law.
The Promoter reserves the right to verify the validity of entries including an Eligible Entrant’s identity, age and place of residence. The Promoter reserves the right, subject to relevant Australian State or Territory legislation, to disqualify any Entrant for tampering with the entry process or for submitting an entry which is not in accordance with these Terms.
The Promoter is neither responsible nor liable for any late, lost or misdirected entries and all entries are deemed to be received at the time of receipt of the entry into the Promotion database and not the time of transmission by the Eligible Entrant. The Promoter, subject to relevant Australian State or Territory legislation, assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to or alteration of entries.
If there is a dispute as to the identity of an Entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the Entrant.
Incomplete, indecipherable and incorrect entries or entries containing offensive or defamatory comments, or which breach any law or infringe any third party rights, including intellectual property rights, are not eligible to win.
It is a condition of taking a Prize that the Winner must, if requested to do so by the Promoter, sign and return documents relating to their eligibility to enter the promotion.
By participating in the Promotion, Entrants agree and acknowledge that:
they may be contacted by the Promoter to provide comments about the Promotion and the Promoter (or an agent of the Promoter) may take photos of them;
the Promoter may use such comments or photos (the Materials) for the Promoter’s future promotional and marketing purposes without further reference or compensation to them;
the Promoter may duplicate, alter, adapt and utilise the Materials in such a manner as the Promoter wishes at anytime, anywhere, and by any means. The Promoter may license, authorise or otherwise transfer the rights in the Materials to others to do the same;
the Promoter retains all right, title and interest, including copyright, in the Materials and, by participating in the Promotion, they assign to the Promoter on creation of the Materials all right, title and interest which might, but for these Terms, vest in them;
they unconditionally and irrevocably consent to any act or omission that would otherwise infringe any of their moral rights in the Materials (as defined in Part IX of the Copyright Act 1968 (Cth)) and present and future rights of a similar nature conferred by statute anywhere in the world whether occurring before or after this consent if given (Moral Rights); and
they waive all Moral Rights in the Materials that arise outside Australia; and they agree not to institute, maintain or support, any claim or proceeding for infringement of their Moral Rights in the Materials.
In order for Eligible Entrants to participate in the Promotion, the Promoter may collect the name, age, email, address and telephone number of each Entrant (Personal Information). The privacy of each Eligible Entrant is important to the Promoter and all Personal Information will be kept securely and confidentially. All personal information provided by an Eligible Entrant will be used by the Promoter and on behalf of selected third parties in accordance with its Privacy Policy. This may include for promotional and direct marketing purposes and other disclosures as specified in the Promoter’s Privacy Policy which is available at www.latrobefinancial.com/home/privacypolicy.
If the Personal Information requested is not provided, or the Entrant does not consent to their Personal Information being used for the above primary purpose, the Entrant should not participate in the Promotion. By entering the Promotion, the Entrant understands and agrees that the Promoter may disclose the information provided by the Entrant to a lottery regulator (if necessary), publish the Winner’s name as required under relevant lottery legislation, as well as use their Personal Information for further promotional, marketing and publicity purposes.
Nothing in these Terms limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act (Cth), as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (Non-Excludable Guarantees). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury or any loss or damage (including loss of opportunity), whether direct, indirect, special or consequential, arising in any way out of the Promotion.
Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of:
any technical difficulties or equipment malfunction (whether or not under the Promoter’s control);
any theft, unauthorised access or third party interference;
any entry, registration, tip or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter;
any variation in the Prize value or these Terms and Conditions;
any tax liability incurred by a Winner or an Entrant; or
taking and/or use of a Prize.
The Promoter accepts no responsibility for any tax liabilities that may arise from winning the prize and any costs incurred by Eligible Entrants in entering the competition is borne by the Eligible Entrant.
If for any reason the Promotion does not run for its duration due to a computer virus, tampering, unauthorised intervention, fraud, technical failures or any other cause beyond the control of the Promoter that corrupts or affects the administration, security, fairness, integrity or proper conduct of the promotion, the Promoter reserves the right to cancel, terminate, modify or suspend the promotion or disqualify any individual who tampers with the entry process, subject to the relevant Australian State and Territory regulations. The Promoter is not responsible for any:
malfunction, delay or traffic congestion on any network or line, computer on-line system, servers or providers, computer equipment, software, or website;
failure of any email or entry to be received by the Promoter; or
injury or damage to entrants or any other person related to or resulting from participation in the promotion or downloading any materials for the promotion.
In the case of the intervention of any outside agent or event which naturally changes the result of the Promotion or prevents or hinders its determination, including but not limited to vandalism, power failures, tempests, natural disasters, Acts of God, civil unrest or strikes, the Promoter may cancel the Promotion and recommence it from the start on the same conditions, subject to the relevant Australian State and Territory regulations.
