Visa Entertainment Kinky Boots Promotion Terms and Conditions
Information on how to enter and the prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
Entry is only open to Australian residents aged 18 years or over who can take the prize in Melbourne on 10th November 2016. Individuals must have a Facebook account in order to access the competition post and enter the promotion.
Employees (and their immediate families) of the Promoter and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin
Promotion commences at 9am AEDT on Wednesday 27th October 2016 and ends at 5pm AEDT on Monday 31st October 2016 (“Promotional Period”).
To enter, individuals must, complete the following steps during the Promotional Period:
A. Visit the Visa Australia Facebook page at https://www.facebook.com/VisaAU and locate the competition post; and then
In the comments section of a competition post, post a comment with the first name of the friend they want to share the Kinky Boots experience with. For privacy reasons, individuals are not required or encouraged to provide the full name or other personal details of their nominated friend in their comment.
The Promoter collects entrants’ personal information so that it can provide entrants with its services and also to carry out its functions and activities. This means collecting things like entrants’ contact details so that they can process their prize fulfilment. Incomplete or indecipherable entries will be deemed invalid.
Multiple entries are permitted, provided each entry is submitted separately and in accordance with entry requirements.
The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the promotion. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.
If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
The draw will be conducted for the entries received at Clemenger BBDO, 120 Pacific Highway, St Leonards, NSW 2065 on Monday 31st October 2016 at 5:15pm AEDT. The Promoter may draw additional reserve entries and record them in order in case an invalid entry or ineligible entrant is drawn.
The winners will be notified in writing within two (2) business days of the draw and their names will be published on the Visa Australia Facebook page from Tuesday 1st November 2016.
The Promoter’s decision is final and no correspondence will be entered into.
The first five (5) valid entries drawn will each win two (2) x VIP in season tickets to Kinky Boots at Her Majesty’s Theatre Melbourne on 10th November 2016, valued at $490. Each prize includes: Two (2) x ‘Meet and Greet photo opportunities’ with the cast of Kinky Boots for the winner and a friend; Two (2) x ‘backstage tours’ for the winner and a friend; and Two (2) x merchandise packs for the winner and a friend.
The following conditions apply to the prize: a) The prizes and all elements of the prize must be taken at the venue and on the date specified by the Promoter below to coincide with the Kinky Boots tour date performance in Her Majesty’s Theatre Melbourne: Thursday 10th November, otherwise the prize is forfeited. b) Prizes are Kinky Boots VIP Experience pack only. All additional costs not expressly stated, but which may be incurred in acceptance and use of the prize, are the responsibility of the winners and their respective companion. Such additional costs include, but are not limited to, travel (including airfares, if applicable) and/or transport to and from the location of the Kinky Boots tour concert, accommodation, transfers, meals and beverages and spending money. All components of a prize must be taken together and when offered or are forfeited. c) The Promoter and event organisers accept no responsibility for any loss incurred in the event that the appearance of Kinky Boots is cancelled or unable to occur for any reason whatsoever. Talent appearances are determined by production schedules and other various factors determined at the complete discretion of the producers of the show. d) No part of the prize may, without the prior written consent of the event organisers and the Promoter, be re-sold or offered for re-sale at a premium (including via online auction sites) or used for advertising, charity fundraising, promotion or other commercial purposes (including but not limited to competitions and trade promotions) or to enhance the demand for other goods or services, either by the winner or any subsequent bearer. If a ticket is sold or used in breach of this condition, the ticket may be cancelled and the bearer of the ticket may be refused admission.
The ‘Meet and Greet photo opportunities’ with the cast of Kinky Boots awarded as part of the prize provides the winners (and their companions) with an opportunity to meet one (1) or more members of the cast of Kinky Boots, and an opportunity to have a photograph taken with the cast members. These elements of the prize are not guaranteed and are subject to the goodwill of the cast on the day. The Promoter accepts no responsibility and will not offer any alternative in the event that these elements of the prize cannot be offered for any reason.
Subject to the unclaimed prize draw clause, if for any reason a winner does not take a prize (or part of a prize) by the time stipulated by the Promoter, then the prize (or that part of the prize) will be forfeited.
If any prize (or part of any prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
The prizes are subject to the event venue and ticket terms and conditions, including any applicable age restriction. The Promoter and event organisers hereby expressly reserve the right to eject any winner (and/or his/her companion) for any inappropriate behaviour, including but not limited to intoxication, whilst participating in any element of the prize.
Total prize pool value is $2,450.
Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash, unless otherwise specified.
A draw for any unclaimed prize(s) may take place on Friday 4th November 2016 at the same time and place as the original draw, subject to any directions from a regulatory authority. Winners, if any, will be notified in writing within two (2) business days of the draw and their names will be published on the Visa Australia Facebook page from Monday 7th November 2016.
Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
Any cost associated with accessing the Visa Australia Facebook page is the entrant’s responsibility and is dependent on the Internet service provider used.
The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.
Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; (f) taking/use of and/or participation in a prize; or (g) if the appearance of the Kinky Boots event is rescheduled or cancelled for any reason beyond the reasonable control of the Promoter.
As a condition of accepting a prize, each winner must sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form
The Promoter collects personal information ("PI") in order to conduct its business and the promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this PI. The Promoter will also use and handle PI as set out in its Privacy Policy, which can be viewed at http://visa.com.au/index.shtml. In addition to any use that may be outlined in the Promoter’s Privacy Policy, the Promoter may, for an indefinite period, unless otherwise advised, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. The Privacy Policy also contains information about how entrants may opt out, access, update or correct their PI, how entrants may complain about a breach of the Australian privacy laws or any other applicable law and how those complaints will be dealt with. All entries become the property of the Promoter. The Promoter will not disclose entrant’s personal information to any entity outside of Australia.
