1. Information on how to enter forms part of the terms and conditions of entry. Entry into the Competition/acceptance of a prize is deemed acceptance of these terms and conditions. Headings in this document are included for ease of reference, and do not affect interpretation in any way.
2. The promoter is UNIQLO Australia Pty Ltd (ACN 161 922 103) of Level 15, 385 Bourke Street, Melbourne, Victoria, 3000 (telephone number (03 9629 3883)) (Promoter).
Duration
3. All references to time in this document are a reference to the local time in Melbourne, Victoria, Australia on the date stated. The promotion commences at 9am Monday 10th December 2018 and closes at 11:59pm on Monday 31st December 2018 (Competition Period).
4. Entries received outside of the Competition Period will not be accepted by the Promoter and will be deemed to be invalid.
Eligibility to enter
5. Entry is open only to Australian residents aged over 18, excluding South Australian residents, directors, managers, employees and their immediate families of the Promoter and its related bodies corporate (Eligible Entrants). For the purpose of this clause “immediate families” includes his or her spouse, ex-spouse, de facto spouse, child, step child, adopted child, parent, step-parent, grandparent, uncle, aunt, siblings, step-siblings or first cousin, whether or not they live in the same household as the director, manager or employee.
Entry into the Competition
6. To enter the Competition, Eligible Entrants must make any purchase in store or online during the Competition Period and enter their details at http://cloud.news.uniqlo.com.au/rogerfederer2019 including the Transaction ID (for online purchases) or Receipt Number (for instore purchases). Eligible Entrants must submit their entry according to the entry instructions and comply with all requirements during the Competition Period.
7. Eligible Entrants may enter as many times as they like throughout the Competition Period. This does not apply to South Australian residents.
8. Any costs associated with entering this Competition are the responsibility of the Eligible Entrant.
9. The Promoter is not responsible for any lost, late or misdirected entries. The Promoter cannot accept responsibility for any entry not received and assumes no responsibility for any failure to receive an entry, inaccurate information or for any loss, damage or injury as a result of technical/telecommunications failures or security breaches.
10. The time of entry will be deemed to be the time the entry is received by the Promoter.
11. The Promoter reserves the right, at any time, to verify the validity of entries and Eligible Entrants (including an entrant's identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct. Incomplete or illegible entries will also be deemed invalid and will not be included in the Competition. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
Drawing of entries
12. The draw will take place at 9am on Wednesday 2nd January 2018 at the Promoter’s head office UNIQLO Australia Pty Ltd (ACN 161 922 103) of Level 15, 385 Bourke Street, Melbourne, Victoria, 3000. The draw will be conducted by the Promoter (Drawer).
13. Five winning entries will be chosen by a computer generated random selection.
14. The result of the draw is final and no correspondence will be entered into.
The prize
15. There will be five prizes. The value of the prize is up to a value of AU$4,000 depending on exact date and point of departure. The maximum total prize pool value is AU$20,000, based on the recommended retail value at the time of printing. The Promoter accepts no responsibility for any variation in the value of the prizes.
16. The prize is:
- Two return economy class flights to Melbourne from the winners’ closest capital city determined from their entry details, arrival and departure to be determined by the Promoter in its absolute discretion as (only provided if the winner resides outside of Victoria. If the winner is from Victoria, the prize does not include airfares and this component of the prize is not redeemable for cash).
- Two nights twin share accommodation at a hotel to be determined by the Promoter in its absolute discretion (no less than 3 stars and within 3kms of Melbourne CBD).
- $1000 pre-paid Visa debit card (or similar).
- One VIP experience for the winner (not including their companion) with Roger Federer in Melbourne city after midday on Wednesday 9th January 2019.
17. Each prize must be taken as stated and no compensation will be payable if a winner is unable to use the prize as stated. Prizes are not exchangeable or redeemable for cash or other goods or services. A prize cannot be transferred to any other person, unless agreed to by the Promoter. It is a condition of accepting a prize that the winner accept the conditions of use of that prize.
18. If the prize (or part of the prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
19. Travel arrangements are subject to the terms of the Promoter or its selected representatives and may be dependent on availability of airline seat classes or room availabilities with the accommodation partner. If any booking is unavailable on the proposed dates, the Promoter may in its absolute discretion consult with the winner to determine alternative dates. If the winner for whatever reason is unable to take an element of the prize on the date stipulated by the Promoter (or an alternative date as agreed between the winner and the Promoter) then the prize will be forfeited.
20. Prize is also subject to the standard Terms and Conditions of the Promoter’s selected service providers.
21. All applicable taxes (excluding GST) and surcharges and all additional costs involved, (including but not limited to excess baggage, transfers, meals, in-room charges, spending money, travel insurance and any other ancillary costs) , unless otherwise specified, are not included and are the responsibility of the winner.
22. The winner is responsible for ensuring that their companion complies with all terms and conditions relating to the prize. The winners must act in a respectable and civilised manner at all times whilst attending the VIP event.
Notification of the winner
23. The winner will be notified by email and phone on Tuesday 2nd January, 2019 and their name will be published on the UNIQLO AUSTRALIA Facebook page on Tuesday 2nd January, 2019.
24. The winner must accept the prize in writing by 9am Friday 4th January 2019 and confirm names (including their companion) for booking of flights by that time. Failure to do so will result in forfeiture of the prize and a redraw.
Right of the Promoter to redraw
25. The Promoter reserves the right to redraw in the event of an entrant being unable to satisfy these Competition Terms and Conditions or forfeiting or not claiming a prize. For any prize that remains unclaimed at 9am Friday 4 January 2019, a second draw will be conducted by the Drawer at 10am Friday 4 January 2019 at the same place as the original draw, subject to any written direction given under applicable law. Any winners determined in accordance with this clause will be notified by email and phone by Friday 4 January 2019 and their names will be published on the UNIQLO AUSTRALIA Facebook page on Friday 4 January 2019.
Entry details and privacy
26. Entry details remain the property of the Promoter. As a condition of accepting the prize, the winner and their travel companion consent to the Promoter using their name, likeness, image and/or voice (including photograph, film and/or recording) in any media for an unlimited period without remuneration for the purpose of promoting the Competition and promoting any products of the Promoter.
27. Entrants consent to the Promoter using personal information provided in connection with this Competition for the purposes of facilitating the conduct of the Competition and awarding any prizes and to conduct marketing activities. All entries will be entered into a database and entrants consent to the Promoter using the entrants' names and addresses for future promotional, marketing and publicity purposes. By entering this Competition, the entrant consents to receipt of information (including via post, email and SMS), about the Competition as well as other communications which inform the entrant of the Promoter’s other products and events. Tax Implications
29. The Promoter accepts no responsibility for any tax implications that may arise from accepting a prize. Independent financial advice should be sought.
Limitation of liability and variation of terms
30. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees or implied warranties as provided under any applicable consumer protection laws.
31. If any act, omission, event or circumstance occurs which is beyond the reasonable control of the Promoter and which prevents the Promoter from complying with these Terms and Conditions, the Promoter will not be liable for any failure to perform or delay in performing its obligations. If for any reason, this Competition is not capable of running as planned the Promoter reserves the right, in its sole and absolute discretion, to take any action that may be available, which may include to cancel, terminate, modify or suspend the Competition in whole or in part.
32. The Promoter, its related bodies corporate and their respective officers, employees, contractors and agents (Promotion Parties) will not be liable for any losses, damages, expenses, costs or personal injuries arising out of this Competition, the promotion of this Competition or the use of any prize, including but not limited to any breach of these Terms and Conditions, contract or tort (including negligence) and any other common law, equitable or statutory remedy (Damages) whatsoever, including but not limited to direct, indirect and consequential Damages, including Damages that cannot reasonably be considered to arise naturally and in the ordinary course of things, even if those Damages were in the contemplation of the Promotion Parties.
33. The exclusion of liability in clause 34) does not apply to limit or exclude liability to the extent it is not permissible at law to limit or exclude liability in the manner contemplated in that clause (in which case that liability is limited to the maximum extent allowable by law).
34. This Competition (including any aspect of it), may be subject to change or withdrawn by the Promoter at any time without prior notification. In the event of any dispute, the Promoter decision will be final and binding (subject to any applicable laws).
35. These Terms and Conditions are governed by, and are to be construed in accordance with, the laws enforceable in Victoria, Australia. Each party submits to the exclusive jurisdiction of the courts exercising jurisdiction in Victoria, Australia.
