“TAYLORS WINES PEOPLE’S CHOICE AUSTRALIAN PLAYER OF THE YEAR 2017” PROMOTION TERMS AND CONDITIONS
1. Information on how to enter and the prize form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
2. Entry is only open to Australian residents aged eighteen (18) years or over – the prize includes authorised entry into a licensed venue, and the provision of alcoholic beverages.
3. This is a joint promotion. The Promoters are Taylors Wines Pty Ltd (ABN 43 007 733 897) of Suite 2, Shed 72, The Woolstores, 4F Huntley St, Alexandria NSW 2015 and The Rugby Union Players’ Association Inc. (RUPA - ABN 61 115 979 068) of Level 1, 10 Mallett Street, Camperdown NSW 2050 (“Promoters”).
4. Employees (and their immediate families) of the Promoters and agencies, companies and /or contractors associated with this promotion are ineligible to enter. Immediate families means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
5. This Promotion commences at 01:00am AEDT on 11 November 2017 and ends at 02:00am AEDST on 27 November 2017 (“Promotional Period”).
6. To be eligible to enter individuals must, during the Promotional Period, do all of the following:
- visit www.rupa.com.au and follow the prompts to the competition entry page;
- acknowledge their agreement to RUPA’s Privacy Policy by following the prompts on the competition entry page;
- select their personal Taylors Wines People’s Choice Australian Player of the Year 2017 from the nominated list of 10 finalist players (“Selection”);
- input all requested details; and
- submit the fully completed online entry form.
7. Individuals who submit a valid entry by completing the above acknowledge that by doing so they will be added to the Promoter’s database (“Entrants").
8. Entrants further acknowledge and agree that their details may be used in accordance with clause 23 and RUPA’s Privacy Policy.
9. Subject to the sole discretion of the Promoters, “The Taylors Wines People’s Choice Australian Player of the Year” will be the player who garners the highest tally of votes from Entrants’ selections.
10. The Promoters reserve the right, at any time, to verify the validity of entries and Entrants (including an Entrant’s identity, age and place of residence) and to disqualify any Entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoters to enforce any of its rights at any stage does not constitute a waiver of those rights.
11. Subject to clause 10, incomplete or indecipherable entries will be deemed invalid.
12. Only one (1) entry is permitted per individual.
13. If there is a dispute as to the identity of an Entrant, the Promoters reserve the right, in their sole discretion, to determine the identity of the Entrant.
14. There will be five (5) winning Entrants from the pool of valid entries. Subject to the sole discretion of the Promoters, the five (5) winning Entrants will be five (5) Entrants whose individual selection matches the Promoters selection of “The Taylors Wines People’s Choice Australian Player of the Year” (“Winners”). The Promoters reserve the right in their sole discretion to make the final determination of who the Winners will be. Any decision the Promoter makes as to the Winners is final and no correspondence or negotiation will be entered into.
15. In the event more than five (5) Entrants select the player that matches Promoters selection of “The Taylors Wines People’s Choice Australian Player of the Year”, the Promoters reserve the right in their sole discretion to make the final determination of who the Winners will be.
16. The Winners will be notified by the email address supplied upon competition entry within two (2) business days of the Promotional Period ending. The Promoters may select additional reserve winners and record them in case an invalid entry of Entrant deemed ineligible is selected as one of the Winners. The Promoter’s decision is final and no correspondence or negotiation will be entered into.
17. The prizes for the Taylors Wines People’s Choice Australian Player of the Year 2017 (“Prizes”) will consist of:
Five competition remaining Winners will receive a prize consisting of two (2) tickets to one (1) 2018 DOMESTIC Test Match in the State or Territory of their residence and one (1) bottle of award-winning Taylors Wine selected from the Jaraman range.
18. The Promoters reserve the right in their sole discretion to allocate the Prize to each Winner in the manner it chooses. For the avoidance of doubt, the Prize does not include flights or accommodation.
19. The winner will be contacted by the Promoters to obtain details of Prize fulfilment and the Promoters will liaise with the Winners on delivery of all elements of the Prize ahead of the event.
20. All Winners must submit photographic proof of age (copies of a driving license, passport or police proof of age card) verifying they are over the age of 18 prior to receiving the Prize. The submission of these records must be done within any time period stipulated by the Promotors and the verification of such records will be at the absolute discretion of the Promotors
21. If for any reason any of the Winners do not respond to contact made from the Promoter via email within three (3) months of notification, the Prize will be allocated to the reserve winner as per clause. The reserve winner (if one is required) will be notified in writing within one (1) business day of being determined the winner and will be contacted via the email address supplied upon competition entry.
22. The Prize is not transferable or exchangeable and cannot be taken as cash.
23. The Winners agree not provide any alcoholic beverages that form part of the Prize to any persons under 18 years of age and further agree not to accompany or induce a person under 18 years of age to enter a licensed venue.
24. Winners consent to the Promoters using their name, likeness, image and/or voice (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any services or products manufactured, distributed and/or supplied by the Promoters.
25. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoters, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoters reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any Entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
26. Any cost associated with accessing the promotional website is the Entrant’s responsibility and is dependent on the internet service provider used.
27. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia (“Non- Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoters (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
28. Except for any liability that cannot by law be excluded, including the Non- Excludable Guarantees, the Promoters (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or Prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoters) due to any reason beyond the reasonable control of the Promoters; (d) any variation in Prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or Entrant; or (f) use of the Prize.
29. As a condition of accepting the Prize, the Winners must sign any legal documentation as and in the form required by the Promoters and/or Prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.
30. The Promoters collect personal information in order to conduct the promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, Prize suppliers and, as required, to Australian regulatory authorities. Such collection will be made pursuant to RUPA’s Privacy Policy and in accordance with the Privacy Act 1998 (Cth) the and the Australian Privacy Principles. Entry is conditional on Entrants providing this information. The Promoters may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the Entrants. Entrants should direct any request to opt out, access, update or correct information to the Promoters on (02) 9519 8211. All entries become the property of the Promoters.
31. This promotion and these Terms and Conditions shall be governed by and construed in accordance with the laws of New South Wales and the laws of the Commonwealth. The parties agree to the exclusive jurisdiction of the State of New South Wales and the Commonwealth.
