Vintage Cellars ‘Coincidence” Facebook promotion 1. The Promoter is Vintage Cellars Australia Pty Ltd (“Promoter”) of 800 Toorak Road, Hawthorn East, Melbourne, VIC 3123. 2. The name of the promotion is Vintage Cellars ‘Coincidence’ Facebook promotion (“Promotion”). 3. Information on how to enter and prizes form part of these terms and conditions. By entering into the Promotion you will be deemed to have accepted these terms and conditions. 4. Entry to this promotion is open to all Australian residents aged 18 years or over, excluding Northern Territory residents. Directors, officers, management, agencies or employees (and their families) of the Promoter are ineligible to enter. 5. The Promotion will commence at 10am (AEST) on Friday 3rd June 2016 and will conclude at 4pm (AEST) on Monday 6th June 2016 (“Promotion Period”). 6. The Promoter encourages the responsible consumption of alcohol and practices the responsible service of alcohol at all times and takes its obligations and responsibilities under all liquor and other relevant Regulations and Acts very seriously. The National Health and Medical Research Council recommends no more than 2 standard drinks per day to reduce health risks over a lifetime. 7. To be eligible to win one of six (6) packs containing $17.99 The Coincidence GSM 750mL, $17.77 The Coincidence Pinot Noir 750mL and $17.77 The Coincidence Cabernet Shiraz 750mL, entrants must head to the Vintage Cellars Facebook timeline https://www.facebook.com/Vintage Cellars/ and complete the following actions: • https://www.facebook.com/Vintage Cellars/ Simply tell us which red variety is your favourite and why for your chance to win. 8. Comments will be judged on creativity of response. The best six (6) judged entries for the selected post, as decided by the Vintage Cellars Liquor social media team in their sole determination, will be selected as winners on 8 June 2016 at 100 York Street, South Melbourne 3205. This is a skill-based draw – luck plays no part in selecting a winner. 9. Each prize consists of one (1) The Coincidence GSM 750mL valued at $177 inc GST. one (1) The Coincidence Pinot Noir 750mL valued at $17.77 inc GST and one (1) The Coincidence Cabernet Shiraz 750mL valued at $177 inc GST. There are six (6) prizes to be won. The total prize pool value is $319.86 (inc GST). 10. All and any costs that may be associated with accepting the prize are the responsibility of the winners. 11. Persons are eligible to enter this promotion multiple times, yet are only permitted to win a maximum of one prize per entrant. 12. The winners (6) of a prize will be announced on the Vintage Cellars Facebook page (https://www.facebook.com/Vintage Cellars/). Each winner will then need to private message Vintage Cellars through their Facebook page, and provide more of their personal details in order to provision the prize. Winners will need to do this within 2 business days after the prize draw has been conducted. Vintage Cellars will provide more details to winners privately via Facebook message on next steps in order to receive their prize. 13. Prizes, or any component of a prize, are not redeemable or transferrable for cash. The Promoter accepts no responsibility for variation in prize value and may substitute the prize for another item of equal or higher value. 14. The Promoter accepts no responsibility for any delays in the processing of information or for late, incomplete, lost, incorrectly submitted, delayed or illegible entries, claims or correspondence whether due to error, omission, alteration, tampering, theft, destruction or otherwise. Incomplete, indecipherable or illegible entries will be deemed invalid. 15. The Promoter reserves the right to request verification of age, identity, residential address any other information relevant to the Promotion. The Promoter can disqualify any individual who provides false information, conspires to gain an unfair advantage, engages in unlawful or other improper conduct calculated to jeopardise the fair and proper conduct of this Promotion or is otherwise involved in manipulating, interfering or tampering with the Promotion. The Promoter’s decision is final. The Promoter’s legal rights to recover damages or other compensation from such an offender will not be affected by the disqualification. 16. The winners must, at the Promoter’s request participate in all reasonable promotional activity (such as photographs and publicity) relating to the winning of any prize, free of charge, and they consent to the Promoter using their name and image in any promotional material for a reasonable period. 17. A second chance selection for any unclaimed prize may take place on 13th June 2016 at the same time and place as the original selection. Winners, if any, will be notified within two (2) business days of the second prize draw. 18. Participation in this Promotion is considered acceptance of the following: a. a complete release of Facebook by any entrant or participant; b. an acknowledgement that this Promotion is in no way sponsored, endorsed or administered by, or associated with Facebook; and c. that the information provided by each entrant is provided the Promoter (as detailed in these Terms and Conditions) and not to Facebook. 19. Participation and entry in this Promotion is conditional upon the entrant complying with all rules, regulations and guidelines set down by Facebook. 20. Entrants acknowledge that their Facebook profile photograph may be featured on the Application and/or any associated Facebook page for public viewing. Facebook membership and the use of Facebook generally are subject to the Facebook prevailing terms and conditions of use available at www.facebook.com. Entrants understand that they are providing their information to the Promoter and not to Facebook. Entrants are solely responsible and liable for the content of their entries and any other information they transmit to other internet users via Facebook. To the extent permitted by law, each Entrant agrees to indemnify, defend and forever hold harmless, Facebook and its associated agencies and companies, against any and all losses, actions, claims, costs, expenses and damages (of any nature) which may be incurred by an Entrant in respect of the Entrant’s participation in the promotion. Any questions, comments or complaints about this Promotion must be directed to the Promoter and not to Facebook. 21. Any information entrants provide will be collected and used by the Promoter for the sole purpose of conducting this Promotion including notifying winners as set out in these terms and conditions. If any information requested by the Promoter is not provided, the entrant may not participate in the Promotion. The Promoter may disclose entrants’ personal information to its contractors and agents to assist in conducting this Promotion or communicating with entrants. The Promoter is bound by the National Privacy Principles in the Privacy Act 1988. Entrants can request access, update or correct the personal information the Promoter holds about them by contacting the Promoter (at the address stated above). 22. The Promoter accepts no responsibility for any costs incurred by Participants in entering the Promotion. Prize winners are advised that tax implications may arise from their prize winnings and they should seek independent financial advice prior to the acceptance of the prize. 23. If for any reason any aspect of this Promotion is not capable of running as planned, including by reason of tampering, unauthorised intervention, fraud, technical failures, computer virus, bugs or any cause beyond the control of the Promoter which corrupts or affects the administration, security, fairness, integrity or proper conduct of this Promotion, the Promoter may in its sole discretion cancel, terminate, modify or suspend the Promotion, or invalidate any affected entries, subject to State and Territory law. 24. The Promoter accepts no responsibility for any problems or technical malfunction of any telephone network or lines, computer online systems, servers, or providers, computer equipment, software, technical problems or traffic congestions on the Internet or at any website, or any combination thereof, including but not limited to, any injury or damage to participants or any other person’s computer related to or resulting from participation in this Promotion. 25. To the extent permitted by law, the Promoter will not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) or for personal injury which is suffered or sustained, as a result of a person entering the Promotion or taking a prize. 26.
