1. Information on how to enter and the prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
2. The Promoter is Seagrass Operations Pty Limited ABN 25 634 378 135 of Suite 102, Level 1, 3 Rider Boulevard, Rhodes NSW 2138. ("Promoter").
3. Selected prizes will be provided and fulfilled by TLC Marketing Worldwide Asia Pacific Pty Ltd, ABN 75 622 802 180, of Ground Floor, 320 Pitt Street, Sydney NSW 2000, Australia ("TLC").
CONDITIONS OF ENTRY
4. This promotion is only open in Australia to Australian residents.
Entrants under 18 years old must have parental/guardian approval to enter and further, the parent/guardian of the entrant must read and consent to these Terms and Conditions.
Parents/guardians may be required by the Promoter to enter into a further agreement as evidence of consent to the minor entering this promotion. ("Eligible Entrant")
5. Employees (and their immediate families) of the Promoter and TLC and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
KEY DATES
6. The promotion is open for Qualifying Purchases (defined below) made between 12.01am AEDT 01/02/2021 and closes at 11:59pm AEDT on 28/2/2021 ("Promotional Period").
7. The promotion is open for Registrations between 12.01am AEDT 01/02/2021 and closes at 11:59pm AEDT on 14/3/2021 ("Registration Period").
8. The promotion is open for redemptions between 12.01am AEDT 01/02/2021 and closes at 11:59pm AEDT on 31/3/2021 ("Redemption Period").
HOW TO ENTER
9. To be eligible to participate in the Million Dollar Prize Giveaway Promotion, entrants must:
Spend $20 or more in a single transaction at a Participating Restaurant (defines below) or via a Participating Food Delivery Service Provider (defines below) during the Promotional Period. ("Qualifying Purchase").
Entrants must retain the original copy of their purchase receipt(s). In the event a purchase receipt is not automatically provided, it is the customer's responsibility to request one.
To enter, entrants must then:
Within 14 days of purchase, visit www.ribsandburgersrewards.com.au, input the requested details and upload an image of their proof of purchase (receipt); and complete registration by accepting these promotional terms and conditions.
Once the entry has been verified, entrants who perform the above steps (each a "Qualified Customer") will receive an email detailing exactly how to redeem their prize. The email will include one (1) unique code ("Reward Code") will be sent within three (3) Business Days of Qualified Customers submitting their registration. All Reward Codes are valid for fourteen (14) days from date of issue.
"Business Day" means a day which is not a Saturday, Sunday, National public holiday or bank holiday in NSW.
To redeem their prize, Qualified Customers must complete the following steps during the redemption period:
Visit www.au.rewardsforall.com to activate the Reward Code by following the prompts from the Rewards for All ("RFA") platform; and then
Select their preferred prize from the list available in the RFA account. The RFA account will remain valid for fourteen (14) days from date of activation or until the end of the Redemption Period, whichever is the first to occur.
Successful claimants will receive an email within three (3) business days containing a voucher code/link and instructions detailing exactly how to use the selected prize. For the avoidance of doubt, the prize is a temporary marketing promotion supplied in connection with the purchase of a good and is exempt for any validity requirement. Quantities of each prize are strictly limited and subject to availability.

10. All prizes are subject to the terms and conditions of individual promotional partners, which are outlined in Schedule 1.
11. A Participating Restaurant is any Ribs & Burger restaurant located in NSW, VIC, QLD and WA. A full list of Ribs & Burgers restaurants locations can be found here https://ribsandburgers.com/au/locations/ ("Participating Restaurant"). Participating Food Delivery Service Providers include: Menulog and DoorDash.
12. Multiple entries permitted, subject to the following:
only one (1) entry permitted per Qualifying Purchase (regardless of the amount spent in excess of $20 in that transaction); and
each entry must be submitted separately and in accordance with entry requirements.
13. Qualified Customers must retain their original purchase receipt(s) for all claims as proof of purchase. Failure to produce the proof of purchase when requested may, at the absolute discretion of the Promoter or TLC, result in invalidation of a Qualified Customer's claim (and/or all claims submitted by the Qualified Customer) and forfeiture of any right to a Reward.
14. The Promoter and TLC reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter or TLC has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the promotion. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.
15. Incomplete or indecipherable entries will be deemed invalid.
16. If there is a dispute as to the identity of an entrant, the Promoter or TLC reserves the right, in its sole discretion, to determine the identity of the entrant.
GENERAL TERMS & CONDITIONS
17. The Promoter and TLC's decision in relation to all aspects of this promotion is final and no correspondence will be entered into.
18. Should an entrant's contact details change during the promotion; it is the entrant's responsibility to notify the Promoter. A request to access or modify any information provided in a claim/entry should be directed to the Promoter.
19. Promotion is available online only and therefore access to the internet is required to participate in this promotion. Any cost associated with accessing the promotional website is the entrant’s sole responsibility and is dependent on the internet service provider used by the entrant. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.
20. The Promoter (including its directors, officers, employees and agents), TLC, its respective agents, Reward providers and distributors are not liable for lost, stolen or damaged rewards, and to the extent permitted by law do not make any contractual promise or representation regarding the quality and/or availability of the services offered and cannot be held liable for any resulting personal loss or damage.
21. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter or TLC, including but not limited to pandemic, technical difficulties, unauthorised intervention or fraud, the Promoter or TLC reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
22. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia ("Non-Excludable Guarantees"). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
23. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter's control); (b) any theft, unauthorised access or third party interference; (c) any entry or reward claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in reward value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use of a reward.
24. The Eligible Entrant, on entering into this promotion acknowledges and accepts that recreational activities including but not limited to, yoga and other related exercise activities may constitute a dangerous recreational activity and that this clause constitutes a risk warning in accordance with relevant legislation, including the Civil Liabilities Act 2002 (NSW) and the Civil Liability Act 2002 (WA). By engaging in the promotion, you acknowledge that you understand the risk of the related activities of the Reward. Any injury, loss or damage may result not only from your actions, including physical exertion but also from the action, omission or negligence of others. You further agree that the Promoter, TLC and the provider of the Reward, including their officers, employees or agents, will not be liable to any person whether in contract, tort, under statute or otherwise for any loss, damage, death, economic loss, loss of opportunity, loss or profits or income, or other consequential loss, whether direct or indirect, caused by or connected with your participation in the Reward activity. You accept that your participation in the Reward activity may be subject to your personal physical health, and where you do not accept the risk associated with this promotion as described in this clause 41 or your physical health does not permit you to engage in the Reward activity, you will be eligible for a substituted Reward at TLC's discretion, acting reasonably.
25. Personal information ("PI") is being collected by TLC and the Promoter in order to conduct this promotion. For this purpose, TLC and the Promoter may disclose PI to third parties, including but not limited to their employees, agents, contractors, service providers, suppliers and, as required to under any applicable law, to regulatory authorities. Participation is conditional on a claimant providing TLC and the Promoter this PI. TLC will use and handle personal information as set out in its Privacy Policy, which can be viewed at https://www.tlcmarketing.com/legals. The Promoter will also use and handle PI as set out in its Privacy Policy, which can be viewed at https://ribsandburgers.com/au/about/privacy-policy/. Each Privacy Policy also contains information about how Entrants may opt out, access, update or correct their PI, how Entrants may complain about the treatment of their PI, and how those complaints will be dealt with. The Promoter and TLC may disclose personal information to entities outside of Australia (for a list of countries, see the Promoter's or TLC's Privacy Policies).
