Information on how to enter forms part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
WHO IS ELIGIBLE TO ENTER?Entry is only open to Australian residents aged 18 years and over. Employees (and their immediate families) of the Promoter and agencies associated with this promotion are ineligible to enter. Multiple entries are permitted.
The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant's identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions may be accepted at the Promoter's discretion. Identification considered suitable for verification is at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. Incomplete or indecipherable entries will be deemed invalid.
PROMOTIONAL PERIOD
Promotion commences on 27 June 2016 and closes on 30 August 2016. Responses will then be judged by the Promoter's agencies and the winner (being the person with the entry who in the judges' opinion best answered the questions in the online survey) will be notified in writing using the details listed on the winner's entry form and their name will be published on Fisher & Paykel's website from 10 September 2016.
HOW TO ENTER
To enter, entrants must complete a corresponding entry form. The entry form can be found at here. All mandatory questions and fields must be answered and completed on the form in order for the entry to be eligible. No other means of entry to this competition are permitted.
UNCLAIMED PRIZE DRAW
The Promoter reserves the right to redraw in the event of a prize winner being uncontactable, unable to satisfy these Terms & Conditions or forfeiting or not claiming the prize. If required the Promoter will reallocate the prize to the next best entry (in the judges' sole discretion).
PRIZE
There will be one (1) prize winner. The total prize value is AUD $10,000 RRP. The prize includes the winner's choice from the current range of Fisher & Paykel kitchen appliances to the value of $10,000 RRP, subject to stock availability. The prize strictly excludes all non-kitchen appliances such as, but not limited to, laundry appliances and commercial only products.
The Promoter is only responsible for delivery of the chosen appliances, and will not undertake or incur any costs for installation, cabinetry or associated costs with installing any of the chosen appliances, or for any extraordinary (in the Promoter's sole opinion) costs relating to delivery of the prize to the location nominated by the winner. Delivery of appliances is to one metropolitan location within Australia.
PRIZE TREMS
The appliance component of the prize will be subject to stock availability. If an appliance is unavailable a replacement appliance will be chosen by the winner in consultation with the Promoter. The appliances will be delivered to the winner's home by or on behalf of the Promoter.
The prize winner's appliances must be able to be delivered by 1st December 2016 and must be able to satisfy these terms and conditions. If the kitchen delivery cannot occur within this time frame for any reason, the entrant will be deemed ineligible and the prize will be forfeited.
The prize is not transferable or exchangeable and cannot be taken as cash. Any unused balance of the total prize value will not be awarded as cash. Any portion of the prize that may be over the total prize value of AUD $10,000 RRP is at the cost of the competition winner and must be negotiated and paid directly between the competition winner and the Promoter.
VARIATIONS
The Promoter reserves the right to vary these Terms and Conditions or any of the terms of entry applying to this promotion or to modify, terminate, suspend or reschedule this promotion without notice but subject to State and Territory legislation.
EXCLUSIONS AND LIABILITY
If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The promotion is not valid in conjunction with any other offer, unless otherwise advised. The Promoter accepts no responsibility for lost, delayed, misdirected or illegible entries.
Except for any liability that cannot be excluded by law, the Promoter and its respective related bodies corporate (including their officers, employees and agents) excludes all liability whether arising in tort (including, without limitation, negligence), contract or otherwise for any personal injury; or any loss or damage (including, without limitation, loss of opportunity, loss of profits); whether direct, indirect, special or consequential, arising in any way out of the promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter's control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms & Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use of a prize. The winner takes the prize entirely at their own risk and indemnifies the Promoter in respect of any claim for accident, injury, property damage or loss of life that may occur in connection with the prize. The winner is responsible for all insurance, tax or other costs that may be associated with the prize.
Where the prize is supplied by an entity outside of the Promoter's control and that entity fails, for whatever reason, to supply the prize, the Promoter has no responsibility for the provision of the prize and is not obliged to supply an alternative prize or to take legal action to require the prize supplier to supply the prize.
USE OF PERSONAL INFORMATION
The Promoter collects personal information in order to conduct the promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities, or use such information to contact the entrant in relation to this promotion. Entry is conditional on providing this information. If the entrant marks the applicable box, the Promoter may use the entrant's personal information for the purposes specified at the time of collection which shall include promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. Entrants should direct any request to access, update or correct information to the Promoter. All entries become the property of the Promoter.
Entrants agree that if they win they will be required to be available for publicity purposes relating to the promotion without compensation including, but not limited to, photographs and interviews of both them and their existing and new kitchen and their house and agrees that their name and image and their town or city may be used for publicity purposes by the Promoter or its agents including on national television, in newspapers, magazines and online and for an unlimited period of time. JURISDICTION
These Terms & Conditions shall be governed by and construed in accordance with State and Territory legislation.
