Terms and Conditions for the “KLM Orange Squad” Competition
General
These terms and conditions (“Terms and Conditions”) apply to the “KLM Orange Squad Competition”, (the “Competition”) which is organised by KLM in Australia (“KLM”).
The Competition shall commence on 04 April 2017, 13:00 (AEST) and will run until 07 April 2017 at 23:59 (AEST) (the “Competition Period”).
The Competition is accessible via the website with the domain http://au.klmcontests.com (the “Website”).
The Competition is open to residents of the following cities in Australi Melbourne, Sydney, Adelaide and Perth.
You can visit the Website via Facebook, via email addressed to you by KLM and/or its partners, or directly after hearing about the Competition through other means of promotion and communication.
The promoter is Koninklijke Luchtvaart Maatschappij N.V. (ABN 32 000 067 916) of Level 2, 55 Murray Street, Pyrmont, NSW, Australia 2009
Participation to the Competition
A “Participant” is defined as follows: any legal person who must be 18 years or older at the time of participation in the Competition
KLM employees and any of its associated companies or subcontractors, as well as their family members, are excluded from participation.
Participants can participate to the Competition by doing the following:
Answer one quiz question and one open-ended question by telling us in a few words why they should be part of the KLM Orange Squad.
Register with the following information on the Website: first name, surname, gender, date of birth, e-mail address and agree with the applicability of these Terms and Conditions to this Competition by clicking on the tick box and click on “Submit” on the Website.
The name and e-mail address provided by the Participant serve as the submission number for this Competition.
Participants shall only be entitled to submit one entry per unique e-mail address. All duplicate entries will be removed at the end of the Competition Period.
No purchase or payment of any kind in products or services or whatsoever is necessary to enter or to win. A purchase or payment of any of the aforesaid will not increase your chances of winning the Prize.
KLM reserves the right to exclude at any time of any submissions it believes to be fraudulent or submissions that do not meet these Terms and Conditions from participation and/ or winning without stating any reasons. This could be due to, for example, without limitation, cheating or improper use (hacking) or whatsoever.
Information about the Prize and how it will be awarded
The winner (“Winner”) will be selected based on the correct answer to the quiz question and the best or most inspired answer to the open-ended question in KLM’s opinion. The Winner will be selected and announced via the Website or other means of communication on 10 April 2017 at 14:00 (AEST).
All decisions taken by KLM with respect to this Competition are final and no correspondence will be entered into.
Winner will receive an e-mail notification from KLM by 11 April 2017 informing him/her that he/she has won. Winner needs to claim his/her Prize by 13 April 2017 from the e-mail notification.
KLM is entitled to request verification of the Winner’s place of residence and age prior to awarding the Prize.
Participants to the Competition may have the opportunity to win one (1) Prize only.
The prize (“Prize”) consists of:
3-night stay at a hotel in Amsterdam (1 room);
An Orange experience with fun-filled activities to celebrate King’s day; and
2 KLM Economy Class return tickets only including all taxes and surcharges from Australia (choose one of the following cities: Adelaide, Melbourne, Perth or Sydney) to Amsterdam (“Air Tickets”).
For the avoidance of doubt, the Air Tickets must depart together from one of the same cities as mentioned herein. The Winner and his/her travel companion must be at least 18 years of age and travel on the following dates and flights:
The Air Tickets are subject to KLM standard terms and conditions and further terms and conditions (if applicable, at KLM’s discretion). Air Tickets will be booked on KLM operated flights for the trip from Asia to Amsterdam, and from Amsterdam to Asia. For the flights from Australia to Asia, and Asia to Australia, tickets will be booked on its interline partners. The flight schedule is as follows:
Departure from Australia (choose one of the following cities: Adelaide, Melbourne, Perth or Sydney) is fixed on 25 April 2017 in cooperation with our interline partner to an Asian Gateway and connecting to Amsterdam on a KLM operated flight. Arrival is scheduled on 26 April 2017 in Amsterdam.
Return is fixed on 29 April 2017 from Amsterdam to an Asian gateway on a KLM operated flight and connecting to Australia via its interline partners. Extension is subject to availability and at KLM’s discretion. All costs and ground expenses involved with extension will be at the expense of the Winner and his/her travel companion.
Notwithstanding anything to the contrary, travel must be completed by the Winner and his/her travel companion by 31 August 2017. Air Tickets are to be used together, on the same travel dates and same departure city.
Air Tickets are strictly not transferable once they are issued, and the Winner of the Air Tickets must be among the travellers. The Air Tickets are not cash-redeemable and non-upgradeable. Frequent flyer points will not be awarded on this Air Tickets.
Through their participation in the Competition, Participants authorize KLM to publicly announce his or her name and agree to be featured in any marketing collaterals about this event including but not limited to video filming for the purpose of advertising.
The total value of the Prize is approximately AUD 5,000. No substitution or transfer of the Prize is permitted. The Prize may not be redeemed for cash. If, due to circumstances beyond KLM’s control, KLM is unable to provide the stated prize, KLM reserves the right to award, as a substitute, a prize of equal or higher value.
Winner and his/her travel companion are personally responsible for any other costs and gratuities which are not explicitly included in this Prize (e.g. visa application, travel insurance and etc.).
Winner and his/her travel companion agree when accepting the Prize that acceptance is entirely at his/her own risk and responsibility. KLM shall not be liable for any loss or damage whatsoever which is suffered (including but not limited to direct or consequential loss) or any personal injury suffered or sustained in connection with this Prize except for any liability which cannot be excluded by law. KLM accepts no responsibility for any tax implications that may arise from accepting the Prize.
Winner and his/her travel companion are responsible for having valid travel documents and obtaining the right to enter the Netherlands.
Personal Data of Participant
KLM will collect and save the following Participants’ personal dat first name, surname, e-mail address, gender, and date of birth (optional).
By participating to this Competition, Participant is expressly consenting to the processing of his personal data by KLM and or any of its subcontractors for the provision of this Competition.
All personal data gathered through this Competition will be used confidentially by KLM and/or its subcontractors and always according to the Dutch Personal Data Protection Act. KLM and/or its subcontractors will not use Participants’ personal data for other commercial purposes and will not sell any Participants’ personal data to any third party.
KLM’s Privacy Policy can be found on KLM.com.au and will apply to KLM’s processing of personal data.
System requirements
KLM is not responsible for problems with networks, computer hardware or software or failure of any kind resulting in the form or other Participant details being restricted, delayed or lost.
Miscellaneous
KLM reserves the right to change the Terms and Conditions, the Prize, the definitions or other information or to cancel the Competition at any time during the Competition term without being required to give prior notice of any kind.
This Competition including these Terms and Conditions are subject to Australian law.
