THE SHOP A DOCKET 30TH BIRTHDAY CELEBRATION PROMOTION
The Promoter is Shop A Docket Pty Ltd, Unit 2b, The Lakes business Park, 2 Lord Street, Botany, NSW, 2019 (ABN 32 145 906 403). Email marketing@shopadocket.com.au.
Information on how to enter and prizes forms part of the Terms and Conditions. Entry into the promotion is deemed acceptance of these Terms and Conditions.
If there is any inconsistency between these Terms and Conditions and any additional material that refers to this promotion, these Terms and Conditions will prevail.
Entry is open to all residents of Australia aged 18 years or over.
The promotion commences on Tues 1 November 2016 at 12:01am AEST and concludes on Tuesday 24 January 2017 at 5:00pm AEST. Entries must be received by the Promoter prior to the promotion close date and time (“Promotional Period”).
How to enter the Weekly Draw
To be eligible to enter the Weekly Draw for the chance to win $30,000, individuals must visit www.shopadocket.com.au/30 (“Promotional Website”) and follow the prompts to the entry page and enter their name, address, email address, phone number, a number between 1 and 30 and a Shop A Docket promotional code word which will be :
. located on the back of Shop A Docket receipts (“Receipts”) during the promotional period;
. posted on Shop A Docket Facebook and social media distribution channels during the promotional period;
. announced live on air via one of the Australian Radio Network stations during the promotional period;
. distributed via EDM to Shop A Docket customers and competition entrants during the promotional period;
. distributed via promotional partners during the promotional period; and submit their entry online.
For clarity, there are different Code Words for each month of the Promotional Period. Entrants must submit the correct Code Word by 4:00pm AEST on the day of the draw to be eligible for that weekly draw. Any entries not submitted in accordance with the above, will not be eligible for that Weekly Draw.
There will be a total of twelve (12) Weekly Draws. Each Weekly Draw will take place on the same day as entries close for that Weekly Draw at Loyalty.com.au Pty Ltd, 11 Springfield Avenue, Toorak, 3142 at 5:00pm AEST with the first Weekly Draw taking place on Tuesday 8th November 2016 and every consecutive Tuesday until the end of the Promotional Period. Entries in each Weekly Draw will automatically be entered into any subsequent Weekly Draw(s). The Promoter may draw additional reserve entries in each Weekly Draw and record them in order in case an invalid entry or an ineligible entrant is drawn. Winners will be notified in writing via email within two (2) business days of the relevant Weekly Draw.
The first valid entry drawn in each Weekly Draw will win the entrant that submitted that entry (Participant) the opportunity to play a contingency game (Game) for the chance to win $30,000 cash. Each Game will take place at Loyalty Pty Ltd, 11 Toorak Road, Toorak, 3142 at 5:00pm on the same day as the corresponding Weekly Draw.
There will be one (1) sealed and tamper proof envelope containing a single number between 1 and 30 (the “Winning Number”) put on display prior to the Weekly Draw. The Promoter’s representative (“Representative”) will then call the Participant to confirm their Chosen Number which may be changed at the time of call at the Participant’s discretion. If the Participant cannot be contacted by telephone, the number as entered by the Participant at time of online entry will be accepted as their Chosen number.
The Representative will then open the sealed security envelope to reveal the Winning Number. If the Participant’s Chosen Number is the same as the Winning Number then, subject to verification by the judges, the drawn Participant will receive $30,000, payable by cheque within 28 days of the draw.
If the Participant’s Chosen Number is not the same as the Winning Number, then the major prize will not be given away and, subject to verification by the judges, the drawn Participant will win the consolation prize of $300. The prize will be awarded as a cheque made payable in the Participant’s name.
The Weekly Draw and the Game will be recorded and published on the Promotional Website, Shop A Docket social media distribution channels and participating radio stations and promotional partners within 24 hours of the Draw and Game.
Winners names for each Weekly Draw will be published on the Promotional Website from Tuesday 8th November 2016.
Instant Win
Consumers are eligible to win an instant prize on entering their personal details at www.shopadocket.com.au/30. Entrants will be notified if they are a winner via pop up screen and a follow up email advising them of their prize and fulfilment details. Instant winners will also be published on www.shopadocket.com.au/30 by 18 February 2017.
At the completion of the promotion, all valid and existing claims for prizes and entitlements to claims will be met notwithstanding the advertised prize pool has been exceeded.
Any unclaimed prizes will be distributed as per clause 27. General
A valid name, address, email and telephone number must be supplied for validation and distribution of prizes.
Incomplete or indecipherable entries will be deemed invalid.
The Promoter is not responsible for late, lost, destroyed, altered, damaged or defaced Receipts or delays in the delivery of the entry due to technical disruptions, network congestion or for any other reason. .
Multiple entries permitted, subject to the following: (a) only one (1) entry permitted per Receipt; (b) each entry must be submitted separately and in accordance with entry requirements; (c) only one Code Word per entry is permitted; and (d) unrecognised Code Words will be deemed invalid.
The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity and place of residence). Printing errors and omissions and other quality control errors may be accepted at the Promoter’s discretion.
The Promoter reserves the right to disqualify any entrant who tampers with the entry process, who submits an entry that is not in accordance with these Terms and Conditions or who has, in the opinion of Promoter, engaged in conduct in entering the promotion which is fraudulent, misleading, deceptive or generally damaging to the goodwill or reputation of the promotion and/or Promoter. This includes, but not limited, to entrants and households using multiple email addresses, postal addresses, PO Box addresses or SIM cards to register single or multiple entries where not permitted. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.
Printing errors or other quality assurance matters outside the control of the individual entrant will not be used as the sole basis for refusing to award a prize.
Any ancillary costs associated with redeeming a prize are not included. Any unused balance of a movie ticket will not be awarded as cash. Redemption of a movie ticket is subject to any terms and conditions of the issuer including those specified on the movie ticket.
Subject to the unclaimed prize draw clause, if for any reason a winner does not take and/or redeem a prize (or an element of the prize) by the time stipulated by the Promoter, then the prize (or that element of the prize) will be forfeited.
Total prize pool value is up to $365,880.
The Promoter’s decision is final and the Promoter will not enter into correspondence regarding the promotion result or any other decisions the Promoter makes in connection with the promotion.
Should an entrant’s contact details change during the Promotional Period, it is the entrant’s responsibility to notify the Promoter. A request to access or modify any information provided in an entry should be directed to the Promoter.
Prizes, or any unused portion of a prize, are not transferable or exchangeable for any other prize, and cannot be taken as cash, unless otherwise specified.
If any Weekly Draw Prize remains unclaimed by 9:00am AEST on 17/4/2017, a re-draw for the Weekly Prize will take place at 9:30am AEST on 17/4/2017 at the same place as the original Weekly Draw, subject to any directions from a regulatory authority. The winner, if any, will be notified by telephone and email within two (2) business days of the re-draw and their name will be published online at the Promotional Website from 17/4/2017 for thirty days. The unclaimed prize draw winner must then claim their prize by the time specified by the Promoter.
If any Minor Prize remains unclaimed by 9:00am AEDST on 17/4/2017, an unclaimed draw will take place at 10.00am AEDST on 17/4/2017 at the same place as the original Weekly Draws, subject to any directions from a regulatory authority. Winners, if any, will be notified by telephone and email within two (2) business days of the re-draw and their names will be published online at the Promotional Website from 17/4/2017 for thirty days. The unclaimed prize draw winner(s) must then claim their prize by the time specified by the Promoter.
Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used.
If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (g) taking/use of and/or participation in a prize.
As a condition of accepting a prize, each winner must sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.
The Promoter collects personal information (“PI“) in order to conduct the promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers, and, as required, to Australian regulatory authorities. Entry is conditional on providing this PI. The Promoter will also use and handle PI as set out in its Privacy Policy, which can be viewed at shopadocket.com.au/consumer/privacy. In addition to any use that may be outlined in the Promoter’s Privacy Policy, the Promoter may, for an indefinite period, unless otherwise advised, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. The Privacy Policy also contains information about how entrants may opt out, access, update or correct their PI, how entrants may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with. All entries become the property of the Promoter. Unless specified otherwise, the Promoter may disclose entrant’s personal information to any entity outside of Australia (see Promoter’s Privacy Policy for details).
