Entry in the promotion is open to all Australian residents aged 13 years or over (“Entrant”). Entrants between 13 and under 18 years old must have parental/guardian approval to enter and further, the parent/guardian of the Entrant must read and consent to these Terms and Conditions. Parents/guardians may be required by the Promoter and the Administrator to enter into a further agreement as evidence of consent to the Entrant entering this promotion.
Employees (and their immediate families) of the Promoter, Administrator, Franchise Word Headquarters LLC (“FWH”), Subway® stores and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
Promotion commences at 9am AEST on Monday 24/02/2014 and ends at 11.59pm AEST on Sunday 23/03/2014 or once the last prize has been won and the winner verified, whichever occurs first (“Promotional Period”). The Promotional Period will be divided into four (4) rounds (“Rounds”), with entries into each Round opening at 9am AEST each Monday and closing at 11.59pm AEST the following Sunday or once the prize allocated to that Round has been won and the winner verified, whichever occurs first. No purchase is necessary to participate in this promotion. For the avoidance of doubt, all times stated in these Terms and Conditions are in local Queensland time (i.e. AEST), unless stated otherwise.
The Promoter will choose/create a ‘secret sub’ by selecting a particular make up and ingredients for a Subway 6-Inch® sub, Subway Footlong® sub, salad, wrap or flatbread, prior to the first Round starting (“Secret Sub”). To participate in the promotion, Entrants must follow the instructions in clause 7 to guess the make up and ingredients of the featured Secret Sub.
In the event that an Entrant correctly guesses the ingredients/make up of the Secret Sub in a particular Round, then the Promoter will choose/create a new Secret Sub to be featured in the following Round. If, however, the ingredients/make up of the featured Secret Sub is not guessed correctly during the applicable Round, then the same Secret Sub will be featured in the following Round.
Throughout each Round, the Promoter will also release a number of clues about the make up of and the various ingredients contained in the Secret Sub featured in that Round, to assist Entrants in guessing correctly. Clues will be released on the Subway® Facebook Page (defined below), via email to the members of the Subway Eat Fresh® Club and via any additional method(s) selected by the Promoter in its discretion. The number and nature of the clues as well as the exact times the clues will be released will be determined by the Promoter in its absolute discretion.
To participate in the promotion, Entrants must complete either of the following entry mechanics during the Round they wish to participate in:
a) visit www.subway.com.au/secret-sub (“Subway® Promotional Website”), follow the prompts to access the promotional page, click on the ‘Sub Creator’, input their requested personal details including a valid email address, first & last name, phone number and date of birth, complete the sub builder form and submit;
OR
b) visit the Subway® Australia Facebook Page at https://www.facebook.com/SubwayAustralia (“Subway® Facebook Page”), select the ‘like’ button on the Subway® Facebook Page (if not done so already), follow the prompts to the “Sub Creator” promotional application, input their requested personal details including a valid email address, first & last name, phone number and date of birth, complete the sub builder form and submit.
The sub builder form on the Subway® Website and the Subway® Facebook Page will feature a number of categories (“Categories”), including “Sub Type”, “Bread”, “Sub”, “Cheese”, “Toasted?”, “Extras”, “Salads”, “Sauce”, “Salt/Pepper”. Entrants will be required to, for each Category, select an answer from the options provided (as per the instructions on the screen). Entrants will be notified on screen if the guess they have submitted is incorrect. In some instances, Entrants will simply be notified that their entry has been received and will be checked, and that they will be contacted within 48 hours with a determination.
There is a strict limit of one (1) entry per person per day. For the avoidance of doubt, each Entrant can submit only one (1) guess as to the make up and the ingredients of the featured Secret Sub each day.
One (1) prize of $5,000 will be allocated to each Round. The first valid Entrant that guesses the make up/ingredients of the featured Secret Sub correctly in a particular Round will be deemed a winner and will win the prize allocated to that Round (subject to verification). For the avoidance of doubt, Entrants must guess all elements of the Secret Sub correctly, including the make up and the ingredients in each Category. To assist Entrants in selecting the exact make up and ingredients, all potential answer options for each Category will be presented on screen for selection.
In the event that the Secret Sub in a particular Round is not guessed correctly by any Entrants, the prize allocated to that Round will jackpot to the next Round. For example, if no one correctly guesses the Secret Sub in Round 1, the prize allocated to Round 1 will jackpot to Round 2, so that the winner, if any, in Round 2 will win $10,000. However, if no one guesses the Secret Sub in Round 2 also, then the prize will jackpot again to Round 3, so that the winner, if any, in Round 3 will win $15,000, and so on. The maximum that the prize can jackpot to will be $20,000 (in Round 4, in the event the Secret Sub is not guessed correctly in any of the first three (3) Rounds).
