Who Can Enter
Entry is open to residents of Australia 18 years or over except employees and immediate families of the Promoter, associated companies and agencies. Immediate family means any of the following: spouse, ex-spouse, defacto spouse, child or stepchild (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, stepbrother, stepsister or first cousin. The Promoter is Puzzles4Fun of PO Box 800, Bondi Junction, NSW 1355.
How to Enter
If you received an entry form via mail, entrants may enter the competition by completing the puzzle and writing the answer to the questions on the official entry form. You can place the entry form in an envelope and return it free of charge to: Reply Paid/ PO Box 790, Strawberry Hills, NSW 2012 ; alternatively, you can enter online at www.puzzles4fun.com. Entries must include all requested contact details to be eligible to win. Entrants may only enter in their own name. Illegible, incomprehensible and incomplete entries will be deemed to be invalid. All entries become the property of the Promoter and cannot be returned.
Number of Entries Permitted
All entrants may enter as many times as they like but only one prize will be awarded per person. However, minor prize winners will also have a chance at winning the major prize.
Opening, Closing, Draw, and Notification Date
Entry for the $5,000.00 AUD competition opens on September 15, 2014 at 00:01 AEST and closes on September 14, 2015 23:59 AEST. Entries must be received by the Promoter prior to the puzzle closing date. The winner will be the first correct entry drawn at the Promoter?s premises on September 30, 2015 at 9.30am. The Promoter will ensure that all entries have an equal chance of winning the major prize. The winners will be notified by mail within 2-5 days of the draw date.
Prize on Offer
For any cash prizes, the name on the entry must match that of an eligible bank account to which a cheque can be cashed. All prize values are in Australian dollars. The Promoter makes all reasonable efforts to send cheques in the names as specified on the original entries. Winning entries with only a family name or reference to a family as the entrant cannot be cashed by banks.
Further Terms and Conditions
The Promoter (subject to State and Territory legislation) reserves the right to amend, cancel or suspend this competition if an event beyond the control of the Promoter corrupts or affects the administrative security, fairness, integrity or proper conduct of the entries for the competition.
Copyright and Personal Information
All entries and any copyright subsisting in the entries become and remain the property of the Promoter who may publish or cause to be published any of the entries received. Puzzles4Fun Ltd and its related entities collect entrants? personal information for the purpose of conducting and promoting this competition (including but not limited to determining and notifying winners) and, if you consent, for the purpose of the Promoter sending you promotional and direct marketing materials for related purposes. By participating in the competition, winners agree to participate and cooperate as required in all editorial activities relating to the competition, including but not limited to being interviewed and photographed. The winners agree to grant the Promoter a perpetual and non-exclusive licence to use such footage and photographs in all media worldwide, including online networking sites and the winners agree that they will not be entitled to a fee for such use.
Liability and Indemnity
The Australian Consumer Laws grant you certain rights and protections related to the provision of goods and services that no one can exclude. Nothing in these terms of use can exclude or restrict the application of such laws but, to the extent that it can under these laws, the Promoter does not give any guarantee or warranties or make any representation of any kind, express or implied. Subject to claims available under consumer protection laws, the Promoter is not liable to you or anyone else (including for negligence, breach of contract or tort) for any loss or damage (including any form of consequential loss such as any third party loss, loss of profits, loss of revenue, loss of opportunity, loss of anticipated savings, pure economic loss and any increased operating cost) however caused and which is suffered directly or indirectly.
Except for liability that cannot by law be excluded, the Promoter (including its respective officers, employees and agents) is not responsible for and exclusives all liability (including negligence) for any personal injury; or any loss or damage (including loss of opportunity) whether direct or indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter?s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these terms and conditions; (e) any tax liability incurred by the winner or entrant; or (f) use of a prize.
Indemnity
You must indemnify and hold harmless the Promoter or its employees, contractors and agents and keep them indemnified against all loss, actions, proceedings, costs, expenses (including legal fees), claims and damages arising from:
a) any breach by you of these terms and conditions; or
b) reliance by you on any information obtained through the competition.
You agree to defend, indemnify and hold harmless the Promoter, its business partners, third party suppliers, providers, licensors, officers, directors, employees, distributors and agents against any damages, losses, liabilities, settlements, and expenses (including without limitation costs and reasonable solicitors? fees) in connection with any claim or action that (i) arises from any alleged breach of these terms and conditions or (ii) otherwise arises from or relates to you entering the competition.
Smart 3D Ultra HD 4K 40" LED TV Prize Draw Rules
No purchase is necessary for this prize draw (?Promotion?). The Promoter is Puzzles4Fun Pty Ltd of Reply Paid/PO Box 790, Strawberry Hills, NSW 2012 (Promoter?).This Promotion is open to residents of Australia and New Zealand aged 18 or over. Employees (or family members of employees) of any group company of the Promoter, companies associated with the Promotion and all affiliates of such companies may not enter this Promotion. All entries must be in the entrants own name and received by midnight on September 14, 2015 (?Closing Date?). The prize winner will be selected at random (under the supervision of an independent person) from all complete, correct and eligible entries received by the Closing Date. The draw will take place within 15 days of the Closing Date. The winner will be notified within 30 days of the Closing Date, using the details provided at the time of entry. The Promoter reserves the right to substitute the prize for a prize of equivalent monetary value if this is necessary for reasons beyond its reasonable control.
