The “WIN $50,000* Cash, in a Heartbeat” Promotion (the Promotion).
Terms and Conditions.
1. Information on How to Enter and prize information form part of these Conditions of Entry (Conditions of Entry). Entry into this Promotion is deemed acceptance of these Conditions of Entry. The promoter is Roadshow Films Pty Limited ABN 28 100 746 870 of Level 1, 500 Chapel Street, South Yarra, VIC 3141 (the Promoter).
2. Entry in the Promotion is open to Australian residents aged 18 years and over, (Entrants) excluding those who are:
(a) Management, employees, directors and contractors of the Promoter, its related entities, agencies, or companies associated with the Promotion;
(b) a spouse, de-facto spouse, parent, guardian, child or sibling of the entrant;
Any cost associated with accessing the competition website is the responsibility of the entrant and is dependent upon the internet service provider used.
3. The Promoter’s decision in relation to any aspect of these Conditions of Entry and the Promotion is final and binding. No correspondence will be entered into.
4. The Promotion commences at 12:00 AM AEST on 15 September 2014 and ends at 23:59 AEST on 26 October 2014 (Promotion Period).
5. To be eligible to win this Promotion, entrants must, during the Promotion Period complete and submit the Entry Form at www.roadshowent.com.au/heartbeat for one chance in the draw. (Eligible Entrant). Entry is free. One entry per household.
Anyone found intentionally creating multiple Registrations to generate entries (whether using an alias, false name or abbreviated name) will be immediately disqualified from the Promotion. This includes registrations generated on-behalf of members of competition websites.
6. This Promotion is a game of chance. The random Prize draw will be conducted at 2pm on 3 November 2014, at MDSA, 15 Grosvenor Street, Neutral Bay, NSW 2089.
7. The first Eligible entry drawn at random will be the winner of the Promotion and will be eligible to participate in the Envelope Selection as described in condition 9 of these Terms & Conditions.
8. The winner of the Draw will be notified by phone, by email, and announced in The Australian newspaper on 14 November 2014 (the Winner).
9. The awarding of the Grand Prize or the Major Prize will be determined by an envelope selection (Envelope Selection). One (1) sealed envelope will contain a message “You have won $50,000” (the Grand Prize). The remaining ninety-nine (99) sealed envelopes will each contain details of the Major “Britain Experience” Prize, with a maximum value of $10,000 (the Major Prize).
The chance of the Winner selecting the Grand Prize envelope is one in one hundred and the chance of the Winner selecting the Major Prize is ninety-nine in one hundred.
10. The Envelope Selection will take place at 12.00pm on 01 December 2014, at a location to be agreed between the Promoter and the Winner. The Winner will receive the Grand Prize or the Major Prize, detailed in the envelope they select.
In the case that the Winner is unable to attend the Envelope Selection, they may appoint a proxy to attend and choose an envelope in their absence, or may request that a representative of the Promoter choose the envelope on their behalf.
11. If the winner selects the envelope containing the Grand Prize (the “$50,000 Cash” message), the funds will be transferred electronically to the Winner’s Bank Account.
Total maximum retail value of the Grand Prize is $50,000 including GST.
12. If the winner selects an envelope that includes details of the “Britain Experience” Major Prize, they will receive;
• 2 return economy airfares for the winner and their travel companion, from the Winner’s nearest Australian Capital City, flying with an Airline provided by the Prize Partner, Helloworld, to London, including airline taxes.
• Return Airport transfers in London.
• 4 night’s twin share accommodation in the 4 Star Hotel, provided by the Prize Partner, Helloworld.
• $500 towards spending expenses.
Total maximum retail value of the Major Prize is AU$10,000 including GST.
Conditions for the “Britain Experience” Major Prize. The total maximum retail value of the Major Prize is $10,000. The Promoter takes no responsibility for any variation in this Prize value.
Air tickets will be for Economy Class travel and the Hotel accommodation, are subject to any embargoes and availabilities. The flight itinerary may need to be adjusted depending on the Winner’s departure city and current flight schedule of the participating Airline.
Major Prize Conditions
The Major Prize must be booked and taken before 30 September 2015. Frequent Flyer points are not available in respect of flights booked in this Promotion.
A credit card imprint or cash deposit may be required from the Winner upon at check-in at the hotel, which may be used in relation to incidental charges, not included in the Major Prize. Once accommodation is booked, changes aren’t permitted.
It is the personal responsibility of the Winner to ensure that they and their Companions have valid documentation, including but not limited to valid passports and visas, which meet the requirements of United Kingdom immigration. Any fines, penalties, payments or expenditures incurred as a result of such documents not meeting the requirements of those authorities will be the sole responsibility of the Winner and their Companions.
Changes and cancellations to any booking may be subject to fees payable by the Winner. Unless otherwise specified, spending money, meals (other than specified), taxes (other than airline/airport taxes), insurance, passports, visas, vaccinations, transport to and from the Australian departure point, transfers, items of a personal nature, in-room charges and all other ancillary costs are not included and are the responsibility of the Winner.
Travel insurance is not included in the Major Prize and the Promoter highly recommends that the Winner take out travel insurance to protect against the additional costs incurred in the event of unforeseen circumstances.
If any part of the Major Prize is unavailable, the Promoter, in its discretion, reserves the right to substitute the Major Prize (or that part of the Major Prize) with a prize, or element, to the equal value and/or specification, subject to any law or written directions from a regulatory authority.
In the event that for any reason whatsoever a Winner does not claim, use or accept the Major Prize at or within the time stipulated by the Promoter, the Major Prize will be forfeited by the Winner.
In the event of war, terrorism, state of emergency, disaster or any other circumstance beyond the control of the Promoter, the Promoter reserves the right to either provide an alternative travel destination to the same value as the original Prize or, subject to any applicable laws or written directions made under applicable legislation, to cancel, terminate, modify or suspend the promotion. The Promoter and the associated agencies, make no representation as to the safety, conditions or other issues that may exist at any destination. It is the sole responsibility of the Winner and guest to first check with all government travel advisory information regarding the safety and situation of the destination of their chosen destination/event. International travel advice can be obtained from various sources, including the Australian Government, any local consular offices and the web site of the Australian Department of Foreign Affairs and Trade.
Subject to clause 17 above, the Grand Prize or the Major Prize, or any element of a Prize, is not transferable or redeemable for cash.
The Promoter reserves the right to redraw in the event of an entrant being unable to satisfy these Terms and Conditions, or forfeiting or not claiming the Grand Prize or the Major Prize. The Promoter will use all reasonable efforts to contact the winner using the contact details provided in their entry, however the Grand Prize or the Major Prize will be considered forfeited if the winner still cannot be contacted after 3.5 months from the date of the Draw. If the Grand Prize or the Major Prize remains unclaimed or forfeited (through ineligibility or otherwise, the Promoter will instruct MDSA to conduct such further random redraw at 12 noon (AEST) on 17 February 2015 at the same place as the original draw as necessary to award the unclaimed Prize, subject to any written direction given under applicable law. The unclaimed Prize Winner will be notified by phone, by email, and announced in The Australian newspaper on 24 February 2015.
The Promoter accepts no responsibility for any entries not received for any reason, during the Promotion Period. No responsibility will be taken for lost, late or misdirected entries.
If, for any reason, the Promotion is not capable of being run as planned, including due to tampering, unauthorised intervention, fraud or any other causes beyond the control of the Promoter, which corrupt or affect the administration, security, fairness, integrity or proper conduct of the Promotion, the Promoter reserves the right in its absolute discretion to take any action that may be available to it, subject to States and Territories regulations, including cancelling, terminating, modifying or suspending the Promotion.
Any entrant who, in the opinion of the Promoter, tampers or interferes with the entry or draw mechanism in any way, engages in any unlawful or improper conduct which jeopardises or is likely to jeopardise the fair or proper conduct of the Promotion, or who does not properly comply with the entry process, will be ineligible to win.
The Promoter, Promoter’s Management, employees, Directors and contractors, its related entities, agencies, or companies associated with the Promotion shall not be liable for any loss or claim, action, demand, liability, damage, cost, expense or personal injury whatsoever (including but not limited to any direct, indirect or consequential loss), incurred, suffered or sustained by any person or entity (without limitation) in connection with, or arising from, the Promotion or the acceptance or use of the Grand Prize or the Major Prize, except that which cannot be excluded by law (in which case that liability is limited to the maximum extent allowable by law).
The Promoter accepts no responsibility for any tax liabilities that may arise from winning or receiving the benefit of any Prize.
All entries become the property of the Promoter. Entries not completed in accordance with the conditions of entry or received after the closing date will not be considered. Indecipherable or incomplete entries will be disregarded. No responsibility is taken for any late or misdirected email.
The Promoter makes no representations or warranties as to the quality, suitability or merchantability of any elements included in the Grand Prize or the Major Prize. To the extent permitted by law, the Promoter, its employees and agents are not liable for any loss suffered to person or property by reason of any act or omission, deliberate or negligent, by the Promoter or its employees or agents, in connection with the arrangement for the supply, or the supply, of goods and services by any person to the Winner and, where applicable, to any persons accompanying the Winner. This clause does not affect any rights a consumer may have which are unable to be excluded under Australian law.
The Promoter reserves the right to announce or publish the winner’s name for publicity purposes. This information may be disclosed to State departments and published as required by the relevant legislation regulating trade promotions.
The information Entrants provide (Entry Information) will be used by the Promoter/s for the purpose of conducting this Promotion and for the purposes set out in this clause 29 and below in clause 31. By entering this Promotion, entrants consent to the storage of their entry information on the databases of the Promoter, its related bodies [and all Partners involved in this Promotion] who include: Roadshow Films Pty Limited (ABN 28 100 746 870), Cohort Digital (ABN 13 562 062 502), Stella Travel Services (Australia) Pty Limited (ABN 84 003 237 296) trading as Helloworld, Reader's Digest (Australia) Pty Limited, (ABN 81 000 565 471), Retirement Living Today Pty Ltd (ABN 44 074 775 572) and PermissionCorp Pty Ltd (ABN 26 119 988 519).The Promoter and its related bodies [and/or Partners] may use this information for future promotional and marketing purposes regarding their products and services, including contacting entrants via any contact details (eMail, mail, phone or SMS) provided by the entrant without further reference or compensation to the entrant, for an indefinite period, or until the entrant opts out from any Partner involved with this Promotion. [The eMail platform of some Partners may be housed outside Australia.]
All entries become the property of the Promoter. By entering the Promotion, entrants agree to receive information on Promotions from the Promoter and the Partners involved in this Promotion. If entrants wish to stop receiving this information, they may unsubscribe by clicking on the unsubscribe link within any future emails they receive. Entrant’s details will then be removed from that database.
The Promoter collects entrant’s information so that entrants can participate in the Promotion. If entrants do not give the Promoter the information, entrants cannot participate. In addition to the rights set out in clause 29 above, the Promoter may use this information for the purposes of the conduct of the Promotion and the compilation of survey results and evidence. The Promoter may disclose this information to third parties who provide the Promoter with services relating to the fulfilment of the Grand Prize or Major Prize. This information will be stored at the office of the Promoter.
