Terms
About the Voting Service
1. These Terms govern the Promotion. Casting a Vote in the Promotion is deemed acceptance of the Terms.
2. Experience Oz’s “7 Wonders of Australia” sees a field of iconic Australian sites, buildings and travel hotspots nominated by regional and state tourism organisations across the country. The campaign puts each of these nominees up for public vote to determine the seven most aspirational nominees as voted by the Australian public for the title of one of the 7 Wonders of Australia.
3. Voting is open to all people ages 18 and over. Voters under the age of 18 years at the time of voting must have parental/guardian consent prior to casting each Vote.
4. During the broadcast of the Poll (“Voting Period”), voters will be invited to cast votes vi
a. SMS voting for each of their top-suggested Wonders of Australia (“SMS Vote”); and
b. online web application/poll hosted on the experienceoz.com.au web domain (“Web Vote”) for their seven top-suggested Wonders of Australia. (Each of an SMS Vote and a Web Vote is a “Vote”).
Unless, during the Vote Period, participants are notified about additional valid voting method(s):
(A) voting via SMS is the only valid voting method for an SMS Vote; and
(B) voting via the web platform on experienceoz.com.au is the only valid voting method for a Web Vote.
Voting Periods
5. The voting period for the public Vote is referred to as a “Voting Period”.
6. During the Promotion, readers will be notified of the Voting Period and the voting methods for the SMS Vote and Web Vote options.
7. Voting Periods are subject to change at the discretion of the Promoter.
8. It is the responsibility of each voter to ensure they cast their Votes via the correct Voting Method and within the relevant Voting Periods. Voters who submit a vote by SMS outside the Voting Period will be charged for their message but it will not be valid. Voters who submit a vote by SMS when SMS is not a valid voting method will be charged for their message but it will not be valid vote. The Promoter and Voting Service Provider accept no responsibility or liability for any costs incurred by voters who cast Votes outside the Voting Periods or via an incorrect voting method.
Voting Charges
9.Each Vote cast via SMS (or message sent to the nominated SMS number) is charged at $0.55 (Engage Australia) and will appear on the voter’s next telephone bill.
10. Each Vote cast via the experienceoz.com.au web platform may incur data and/or internet charges by the voter’s telecommunications or internet service provider and are the responsibility of the voter. Votes submitted via the web platform when that is not a valid voting method for that vote will not be counted as valid votes.
Maximum Number of Votes
11. If SMS is the nominated voting method, Voters may cast as many Votes as they like via SMS during the relevant Voting Period.
12. If the experienceoz.com.au web platform is the nominated voting method, Voters may cast as many Votes as they like (seven selections per vote required) via the embedded poll application during the relevant Voting Period.
Voting Mechanics
13. Voters may cast SMS Votes by sending an SMS with the Wonder nominee’s name as prompted on display advertising and web assets during the Promotion to 19719777 ($0.55 per SMS Engage Australia).
14. Voters may cast Web Votes by:
a) Logging onto the Experience Oz micro-site at 7wonders.experienceoz.com.au with the applicable hashtag promoted on screen during the Promotion for the nominee; and/or
b) Logging into their Instagram account at instagram.com and posting an image with the applicable hashtag promoted on screen during the Promotion for the nominee. To cast a valid vote via Instagram, the voter’s Instagram profile must be public.
15. To cast a Vote by SMS, voters must have a mobile phone account with a telecommunications service provider recognised by the Promoter and Premium Services enabled on the Voter’s mobile phone account to allow the voter to send a SMS vote to the premium SMS number. It is the responsibility of the voter to check with their provider that they have 19 Premium Services enabled. Voters under the age of 18 must have the prior consent of the mobile phone account holder before lodging an SMS vote.
16. Voters will receive an SMS notifying confirmation of each Vote cast via SMS, or notifying that the Voting Period has closed (together “Notification SMS”). Voters will not be charged for a Notification SMS.
17. SMS entries transmitted via the internet or generated or sent by computer software or such other means are invalid.
18. SMS helpline number is 1300 855 510, which is run by the Voting Service Provider.
19. Votes are deemed made at the time each Vote is received by the Voting Service Provider on its database and not at the time sent by the voter. The Promoter and the Voting Service Provider accept no responsibility for any late, lost or misdirected Votes due to technical disruptions, network congestion or for any other reason.
Voting Results
20. The Promoter and the Voting Service Provider reserve the right to keep all voting results confidential.
21. At the close of the Voting Period, all Votes will be totalled and the 20 Wonder finalists will be submitted to the Judging Panel.
22. For the Finalist Stage, the Wonder nominees with the 20 highest number of SMS Votes and Web Votes Votes will be shortlisted and promoted as Finalists for the 7 Wonders of Australia. They will be provided with marketing collateral to indicate their shortlisting as a much-desired Australian asset.
23. During the Finalist Stage, the Judging Panel will be required to their seven suggested Wonders of Australia based on the outlined Voting Criteria (found online at 7wonders.experienceoz.com.au/criteria).
24. The Voting Criteria includes Desirability & Aspiration, Natural / Cultural Value, Tourism Value, and Level of Recognition.
25. The Finalist Stage will last for two (2) weeks, within which the Judging Panel will be required to submit their 7 Wonders of Australia recommendations.
26. The Promoter and Voting Service Provider accept no responsibility or liability for any costs incurred by voters who cast Votes for a Wonder during the Finalist Stage or who submit incomplete or incomprehensible votes.
27. At the end of the Finalist Stage, the seven (7) Wonders which receive the highest quantity of recommendations aggregated from the Judging Panel will be announced as The 7 Wonders of Australia, with media activity to follow.
General Terms
28. The Promoter reserves the right to amend the Terms at any time throughout the Promotion.
29. The Promoter may cancel the Promotion at any time for any reason.
30. If, for any reason, the Promotion is not capable of running as planned, the Promoter reserves the right to take such action it deems necessary in its sole discretion.
31. Except for liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability for personal injury, loss and damage (including loss of opportunity) whether direct, indirect, special or consequential, arising in any way out of or in connection with the Promotion.
32. The Promoter reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached, or not fully complied with, any of the Terms, tampered with or manipulated the entry or voting process, or engaged in any unlawful or other improper misconduct which may jeopardise the Promotion (including jeopardising the administration of the Promotion). The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.
33. All Votes become the property of the Promoter.
34. Each voter consents to the Promoter collecting their personal information for the purpose of conducting the Promotion. The voter’s personal information may be disclosed to the Voting Service Provider and third party service providers for this purpose.
35. The Promoter is bound by the Australian Privacy Principles (“APPs”) in the Privacy Act 1988 (Cth) and by casting a vote in the Promotion, each voter is taken to consent to the Promoter’s privacy policy which contains information, amongst other things, about how the voter may access personal information that is held by the Promoter about the voter and seek correction of such information. The Promoter may disclose a voter’s personal information to related entities, the Voting Service Provider and third party service providers outside Australia.
36. The Promoter is TicketMates Australia Pty Ltd trading as Experience Oz (ABN: 731 2753 2147) of 46 Cavill Ave, Surfers Paradise, QLD, 4217, Australia.
37. The Voting Service Provider is Engage Australia Pty Ltd (ABN 15 611 855 219) of Level 8, 56 Clarence Street, Sydney, NSW, 2000, Australia.
38. The words “include”, “includes” and “including” are not words of limitation in these Terms.
39. The Promotion is governed by the laws of New South Wales, the Australian Capital Territory, South Australia and other territories of Australia, and each voter submits to the exclusive jurisdiction of the courts in that State.
Determination and Notification of winners
40. The 7 winner(s) will be chosen from valid entries submitted in accordance with these terms and conditions selected on 31/10/2018 at Experience Oz/TicketMates Australia Pty Ltd, 46 Cavill Ave, Surfers Paradise, QLD, 4217.
41. If any particular determination is scheduled on a public holiday, the determination will be take place on the following business day.
42. The Promoter’s decision is final and the Promoter will not enter into correspondence regarding the competition result or any other decisions the Promoter makes in connection with the Promotion.
43. The winners will be notified by email within two days of being determined. Winners of prizes will be published on Facebook.com/ExperienceOz on 31/10/2018.
44. Prizes will be awarded to person named in the entry. However, in a dispute, will be awarded to the account holder of the entry mechanism used to submit their entry (i.e. mobile phone account holder or email account holder).
45. Should an entrant’s contact details change during the promotional period, it is the entrant’s responsibility to notify the Promoter. A request to access or modify any information provided in an entry should be directed to the Promoter.
46. If a winner(s) has not claimed their prize by 7/11/2018 then he or she will forfeit the prize and the prize will be awarded to a valid entry submitted in accordance with these terms and conditions at 5pm on 10/11/2018 at Experience Oz/TicketMates Australia Pty Ltd, 46 Cavill Ave, Surfers Paradise, QLD, 4217. The winner of the unclaimed prize will be notified by telephone or email within two days of the date on which they are judged to be the unclaimed prize winner.
Prize on offer
47. Individual prize value is up to $1,000 (including GST). Total prize pool value is up to $7,000 (including GST). Winners will each receive: Experience Oz experience for two (2) adults to visit one of their voted 7 Wonders of Australia; two (2) nights accommodation in proximity to the destination of their relevant experience.
48. Unless otherwise expressly stated, prize values are based upon the recommended retail prices at the time of first publication of these Terms and Conditions (inclusive of GST). The Promoter accepts no responsibility for change in prize value between now and the ultimate prize redemption date.
49. Independent financial advice should be sought as tax implications may arise as a result of accepting the prize.
50. Prizes cannot be transferred, exchanged or redeemed for cash.
51. It is a condition of accepting the prize that the winner must comply with all the conditions of use of the prize and the prize supplier’s requirements.
52. It is a condition of accepting the prize that the winner may be required to sign a legal release in a form determined by the Promoter in its absolute discretion.
53. Prize validity is six (6) months from when Experience Oz issues the prize.

Key Dates
55. The start date of the Voting Period (“Lottery”) is 12:01am on 7/7/2018.
56. The closing date of the Voting Period (“Lottery”) is 11:59pm on 7/10/2018.
57. The drawing date of the Prize Announcement is 5:00pm on 31/10/2018.
