The Woolworths Rewards Easter Scan to Win Promotion (the “Promotion”) is a promotion conducted under the Other Benefits component of the Woolworths Rewards Program, as set out in the Woolworths Rewards Terms and Conditions.
Terms and Conditions
1. Information on how to enter and prizes form part of these Terms & Conditions. By participating, entrants agree to be bound by these Terms & Conditions. Entries must comply with these conditions to be valid.
Definitions
2. Definitions used in these Terms & Conditions:
Card means a Woolworths Rewards card issued by the Promoter as part of the Woolworths Rewards Program. For the avoidance of doubt, Temporary Card holders are not eligible to enter or win prizes under this Promotion.
Eligible Shop means a total single transaction made for purchases at a Participating Store, excluding smoking/tobacco products and accessories, gift cards (including iTunes), mobile recharge, Woolworths Mobile phone plans, travel cards and tickets, delivery charges, internet cafes, online purchases at www.woolworthsflowers.com.au, Carpet Care products, lottery products and purchases using a Caltex StarCard.
Major Prize means the major prize defined in clause 7 of these Terms and Conditions.
Minor Prize means the minor prize defined in clause 8 of these Terms and Conditions.
Participating Stores means any Woolworths supermarket across Australia (excluding Tasmania), BWS, selected Caltex Woolworths (excluding Star Mart and Star Shop) promoting the Woolworths Rewards program, and the Woolworths Online store www.woolworths.com.au.
Promoter means Woolworths Limited ABN 88 000 014 675 of 1 Woolworths Way, Bella Vista NSW 2153.
Promotion means The Woolworths Rewards Easter Scan to Win Promotion governed by these Terms & Conditions and conducted as a promotion under the Other Benefits component of the Woolworths Rewards Program
Promotional Period means 00.01 AEDT on 29 March 2017 until 23.59pm AEST 17 April 2017.
Registered Cardholder means a cardholder of a Card and all mandatory cardholder information (including cardholder’s legal name) has been correctly completed in the Woolworths Rewards database.
Woolworths Terms and Conditions means the terms and conditions governing the Woolworths Rewards Program available at woolworthsrewards.com.au.
Entry Requirements
3. Entry is open to Registered Cardholders who are 18 years of age or older and a resident of Australia. Entrants who are under the age of 18 must seek permission from their parent or guardian to enter. Employees of the Promoter and the agencies directly involved with this promotion are ineligible to enter.
How to Enter
4. To enter, each entrant must, during the Promotional period:
a) complete an Eligible Shop from any Participating Store; and
b) scan their Card in-store at the checkout or input their Card number at the Woolworths Online checkout prior to finalising the transaction.
5. Registered Cardholders will receive one (1) entry into the Major Prize daily draw for every Eligible Shop for that day only - the entry will not roll over into other Major Prize draws. A limit of five (5) entries per day applies. In addition, each valid entry on a given day during the Promotion Period will also be entered into the Minor Prize draw for that day only - the entry will not roll over into other Minor Prize draws. Entries for each Major and Minor Prize draws open at 00:01am AEST and closes at 11:59pm AEST on the date of each draw.
6. Only one (1) prize will be awarded per household across all the Major Prize draws, and only one (1) prize awarded per household across each of the daily Minor Prize draws, during the Promotional Period (excluding South Australian residents, who are eligible to win a Major Prize for each valid entry). For the avoidance of doubt, entrants are eligible to win both a Minor Prize and a Major Prize.
Prizes
7. There will be a total of twenty (20) Major Prizes awarded, one (1) Major Prize drawn for each day, over the Promotional Period. Each Major Prize consists of $1,000 worth of groceries. The total Major Prize pool value is $20,000.
8. There will also be a total of two hundred (200) Minor Prizes awarded, ten (10) drawn for each day, over the Promotional Period. Each Minor Prize consists of 10,000 Woolworths Rewards points, valued at $50. The total Minor Prize pool value is $10,000.
9. All prize values are correct as at 6 January 2017 and are in Australian dollars, but to the extent permitted by law, no responsibility is accepted by the Promoter for any variation in the value of the prize after that time.
10. The total prize pool value of the Promotion is $30,000.
14. Minor Prize winners will be notified in writing by email within two (2) days of the relevant draw date. The names of the winners will be published on the Woolworths Rewards website at woolworthsrewards.com.au on the Publication Date listed in the table above.
Prize Fulfilment
15. Each prize will be awarded as follows:
(a) Major Prizes of $1000 worth of groceries will be loaded in the form of equivalent Woolworths Rewards points (200,000 Woolworths Rewards points) onto the winner’s card in one instalment within ten business days from the Draw Date. Each 2000 Woolworths Reward points = $10 Woolworths Dollars. The points can be redeemed for groceries in-store and online at Woolworths and BWS (excluding Tasmania).
(b) Minor Prizes will be loaded onto the winner’s Card within ten business days from the Draw Date.
16. If a winner in the Promotion has opted to Save for Christmas, their Woolworths Rewards points will accrue until the Pay Out Date for Save for Christmas as outlined in the Woolworths Rewards Terms and Conditions. If a winner in the Promotion has opted to convert their Woolworths Reward points to Qantas Points, their points will accrue until the next Pay Out Date for Qantas Points as outlined in the Woolworths Rewards Terms and Conditions . 17. If the winner of the Major Prize is under 18 years of age, the prize will be awarded to the winner’s parent or guardian on the winner’s behalf. ​As a condition of accepting or participating in any prize on behalf of a winner, the winner’s parent or guardian accepts these conditions. If the winner’s parent or guardian is not a registered Woolworths Rewards member, there will be a requirement to become registered in order to receive the Major Prize.
Second Chance Draw
18. If any prize is unclaimed within 3 months from the Draw date, a Second Chance Draw will be held at 3pm AEST on Wednesday, 26 July 2017 at Salmat Digital Pty Ltd, Level 2, 116 Miller Street, North Sydney NSW 2060 in order to distribute any unclaimed prizes.
19. Winners will be notified in writing by email within two (2) days of the Second Chance Draw. The names of winners (and address of any Major Prize winners in SA) will be published in The Australian (for any unclaimed Major Prizes) and on the Woolworths Rewards website at woolworthsrewards.com.au on Wednesday 2nd August 2017 .
Further Details
20. The Promoter accepts no responsibility for any tax implications that may arise from the winning of the prizes. Independent financial advice should be sought.
21. All reasonable attempts will be made to contact the winners. If a winner does not claim their prize by the Second Chance Draw date, their entry will be deemed invalid and the Promoter may conduct the Second Chance Draw, subject to relevant regulatory authority instructions.
22. If an entrant’s contact details change at any time between the date which they enter the Promotion and the Second Chance Draw date, that entrant must notify the Promoter of their correct contact details immediately.
23. If any prize becomes unavailable for reasons beyond the Promoter’s control, the Promoter may substitute a prize of equal or greater value, subject to any written directions from the various authorities.
24. The Promoter and its agencies and companies associated with this Promotion will not be liable for any loss (including but not limited to indirect or consequential loss), damage or personal injury which is suffered or sustained (including, without limitation, that caused by any person's negligence) relating to the Promotion or the awarding or taking of the prizes, except for any liability which cannot be excluded by law (in which case liability is limited to the minimum amount allowable by law). Nothing in these conditions restricts, excludes or modifies or purports to restrict, exclude or modify any statutory consumer rights under any applicable law including the Competition and Consumer Act 2010 (Cth).
25. The Promoter accepts no responsibility for late, lost or misdirected entries or other communications. The Promoter assumes no responsibility for any failure to receive an entry or for inaccurate information or for any loss, damage or injury as a result of technical or telecommunications problems, including security breaches, theft or destruction, any cause beyond the Promoter’s control, or unauthorised access to or alteration of the promotion. If such problems arise, then the Promoter may (where necessary with the approval of the relevant lottery authority) modify, cancel, terminate or suspend the Promotion. Further, the Promoter at its sole discretion may recommence this Promotion under the same conditions.
26. If in the conduct of this Promotion, the Promoter is liable for a breach of any guarantee, warranty, condition or other term that applies under the Competition and Consumer Act 2010 (Cth) or is implied by any other commonwealth, state or territory law that cannot by law be excluded, the Promoter's liability under that legislation is limited, to the extent permitted by law, to the cost of replacement of any benefit or prize won.
27. Without limiting the previous paragraph, the Promoter and its associated agencies and companies will not be liable for any damage, loss or delay in transit to the prize.
28. Before the prize is awarded, the winner and any other person(s) sharing the prize with the winner may be required to sign an agreement to release the Promoter from any liability arising from the use or participation in the prize.
29. The Promoter reserves the right to request verification of age, identity, residential address of winners and any other information from entrants relevant to entry into or participation in this promotion. Verification is at the discretion of the Promoter, whose decision is final. The Promoter reserves the right to disqualify any individual who provides false information, fails to provide information, is in breach of these conditions, provides entries that are offensive or otherwise inappropriate in the sole opinion of the Promoter, conspires with others to gain an unfair advantage or who is otherwise involved in any way in manipulating, interfering or tampering with the conduct of this promotion, or who has engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the promotion. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.
30. Entrants consent to the Promoter using their name, image and/or voice in the event that they are a winner in any media for an unlimited period of time without remuneration for the purpose of promoting this promotion (including any outcome) and/or promoting any products manufactured, distributed and/or supplied by the Promoter.
31. The Promoter may use any personal information that a Registered Cardholder has provided to it for the purpose of running the Promotion, and also in advertisements, publications, media statements and other promotional material associated with the Promotion. For purposes of public statements and advertisements, the Promoter will only publish the winner’s surname, first initial and state of residence. By entering the Promotion entrants consent to the use of their information as described and agree that the Promoter may disclose the information for those purposes to its related bodies corporate, agencies and contractors (including call centres, advertising agencies and direct mail houses) which the Promoter engages for that purpose. The Promoter is bound by the Australian Privacy Principles contained in the Privacy Act 1988 (Cth). A copy of the Promoter's privacy policy can be viewed at www.woolworths.com.au. To request access to, or to update, personal information the Promoter holds about them, Cardholders can contact the Promoter in writing at privacy@woolworths.com.au.
32. Prizes are not transferrable or exchangeable and cannot be redeemed for cash. The Promoter’s decision is final and binding – no correspondence will be entered into.
33. These conditions are governed by the laws of New South Wales and each of the relevant State authorities.
