Entrants may enter the competition multiple times. See the entry criteria and conditions of entry specified below
The entire promotional period commences at 9:00am on 19th August 2016 and closes at 9:00pm (AEDST) on 14th October 2016 (the “Promotional Period”). There will be eight individual weekly entry periods during the Promotional Period. Entry period start and closing dates and times, and weekly shortlisting and judging dates are stipulated in the table below. For each weekly entry period, eight (8) entries will be shortlisted by Bauer Media, and these eight (8) entries will then be judged by the Promoter for selection of the finalist for that weekly entry period (each a “Finalist”), such shortlisting and judging to be based on the criteria below (see clause 4). The shortlisting will be done by a panel of judges appointed by Bauer Media, and will take place at Bauer Media Pty Ltd (ABN 18 053 273 546) of 54-58 Park Street, Sydney, NSW 2000. The judging will be done by a panel of judges appointed by the Promoter. The judging will take place at Nutricia Australia Pty Ltd, Level 4, Building D, 12-24 Talavera Rd, Macquarie Park NSW 2113.
This is a game of skill, chance plays no part in determining the winner. Each entry will be individually considered for shortlisting and (if shortlisted) judged based on creative representation of the toddler’s love for Karicare+ Toddler Milk and suitability to the promotion.
Weekly judging
The weekly judging by the Promoter will be to determine one (1) Finalist from that weekly entry period to move forward to the second round of judging for the major prize (see clause 6). All non-winning entries (including those shortlisted but not selected as a Finalist) will roll over into subsequent weekly entry periods, however an entrant may only win one weekly entry period irrespective of the number of entries they submit. All Finalists will be notified as soon as reasonably practicable after the relevant judging date, by telephone and email using the contact details given in their entry.

Major prize judging:
The major prize (see clause 24) will be determined from only the eight (8) Finalists . The judging will be done by a panel of judges appointed by the Promoter. The judging will take place at Nutricia Australia Pty Ltd, Level 4, Building D, 12-24 Talavera Rd, Macquarie Park NSW 2113. The judging will take place on 18 October 2016.
Entry criteria
Entry is open to residents of Australia aged 18 years and over. Employees of the Promoter (see clause 42), those persons conducting the shortlisting and judging (see clause 3), associated agencies, and their immediate families, are not eligible to enter.
To enter, entrants must during the Promotional Period go to www.womansday.com.au/win/ or www.karinourish.com.au/milklove and follow the prompts to the competition page and then:
complete the entry form including their full name, current email address, daytime telephone number; and
upload a photograph of a child, which meets the requirements in clauses 9 and 10, for whom the entrant is the parent or legal guardian, and which photograph creatively expresses the child’s love for Karicare+ Toddler Milk.
The photograph attached to your entry form:
must be of a child who is an Australia resident and is between one and three years of age during the Promotional Period;
must depict the child between one and three years;
must not contain any baby bottles or baby teats;
must not be a group photograph with any other children in shot;
must be of a clothed child, and not wearing swimwear or underwear only;
must not be taken in a pool, bath or similar context;
must not be taken in a mirror (i.e. must not be a “selfie”);
must not have had any filters, airbrushing tools, or other photographic enhancements applied to it (whether submitted by either a camera, mobile app or social media application, or otherwise);
must be in a JPEG form of a maximum of 3MB;
must not contain any products or branding of any of the Promoter’s competitors; and
must not contain any food products or branding for food products which are intended for children under twelve months (that is, infant formula products).
The photograph (and entry from) must not be:
a) submitted later than the date and time for the relevant weekly entry period;
b) delayed;
c) incomplete;
d) incomprehensible;
e) unlawful;
f) obscene;
g) defamatory;
h) discriminatory;
i) libellous;
j) threatening;
k) pornographic;
l) harassing;
m) hateful;
n) racially or ethnically offensive;
o) capable of encouraging of conduct that would be considered a criminal offence;
p) capable of violating any law; or
q) capable of giving rise to civil liability.
The entrant must not engage in any illegal or unsafe behaviour whilst creating the entry (including during the taking of any photograph). To the extent permitted by law, the Promoter and its partners exclude any legal liability or responsibility for any incidents or activities engaged in by the entrant or any person during creation of the entry (including during the taking of the photograph).
Conditions of entry
If an entry is approved, the photograph will appear on the image wall on Woman’s Day www.womansday.com.au/win/ and Karicare+ Toddler www.karinourish.com.au/milklove websites during the Promotional Period. For the removal of doubt, only successful entries will be featured on the wall, and these entries are not necessarily the winning entries and such appearances do not allow the entrants be awarded any prize.
It is a condition of participating in the competition that the eight (8) Finalists agree to be interviewed, photographed and permit the use of their entry at any time by the Promoter or their agents for a story or feature on this promotion to be developed and featured in Woman’s Day magazine, website, social media pages or the Karicare+ Toddler website (or any other form of media the Promoter regards as suitable) without further remuneration or reference to the Finalist. The inclusion of any such feature (including but not limited to creative control of the feature) will remain with the Promoter at all times.
The Promoter is entitled to use any entry submitted (whether or not a winning entry) in any manner and for any purpose at its absolute discretion, including (whether by itself or permitting any third party) using the entry after the Promotional Period for future promotions or their agent’s book publications, promotional, commercial, marketing, advertising, publicity and other purposes without any further reference or payment or other compensation to the entrant. The Promoter is entitled to amend, edit, select, crop, retouch, add to or delete from any part of an entry.
Entries must comply with clauses 9 and 10. Any entry which the judges regard as inappropriate will be invalid.
All entries submitted become the property of the Promoter. As a condition of entering into this promotion, each entrant assigns all right, title and interest (including copyright) in and to their entries (including photograph) to the Promoter.
The entrant represents and warrants that:
a) their entry is an original artistic work of the entrant that does not infringe the rights of any third parties;
b) they own or have all necessary licences, rights, consents and permissions to use and authorise the promoter to use all patent, trademark, trade secret, copyright or other proprietary rights in and to any and all entries to enable inclusion and use of the entries in the manner contemplated by these terms and conditions;
c) they are the parent or legal guardian of the child depicted in the photograph submitted as part of their entry and consent to the use of such photograph in accordance with these terms and conditions, ; and
d) they own the copyright in each photograph uploaded and are able to assign this copyright under clause 16.
All decisions relating to the conduct of the Promoter and the shortlisting and judging of this competition, including, but not limited to, the approval of any and all parts of an entry to be published, and the awarding of prizes, are at the sole and exclusive discretion of Promoter and those persons conducting the shortlisting and judging, and are final and not subject to appeal. . No correspondence will be entered into.
Failure to comply with any of these terms and conditions may result in disqualification and/or forfeiture of any awarded prize, at the Promoter’s sole and absolute discretion.
The Promoter reserves the right to verify the validity of entries at any time during or after the Promotional Period, and reserves the right to disqualify any entrant who interferes with the entry process (including the weekly shortlisting and judging) or who submits an entry that is not in accordance with these terms and conditions. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
Prizes
Finalist prize:Each of the eight (8) Finalists will win:
One (1) x One (1) year Woman’s Day magazine subscription, valued at up to $228.80
This prize will be delivered to the nominated address of the Finalist. Delivery of this prize is valid to any state and/or city in Australia. The Promoter is not responsible nor liable for any loss or damage in transit in the delivery of this prize.
Each Finalist acknowledges that they understand that ‘tip-ons’ and gifts that may be available with non-subscriber copies may not be provided with subscriber copies. This determination is made at the sole discretion of the Promoter.
Major prize:The best one (1) valid entry from the eight (8) Finalists as determined by the judges will be selected as the major prize winner and will win (subject to clause 25):
Return economy flights for two (2) adults and two (2) children (aged 11 years and under) from the winner’s nearest Australian capital city to Nadi Fiji, valued at up to $5,600.00 (including taxes) (value subject to departure point)
Five (5) nights accommodation at the Sofitel Resort and Spa Fiji, in a family room including breakfast daily, valued at up to $4,260.00.
Return transfers from Nadi airport and the above hotel for two (2) adults and two (2) children (aged 11 years and under), valued at up to $140.00
The major prize, in total, is valued at up to $11,830.04 (including GST) (value subject to departure point). Any ancillary costs associated with redeeming the major prize are not included. These are the responsibility of the winner.
The major prize must be redeemed as a package in full between the dates of January 15th 2017 to June 30th 2017. Redemption of the major prize is subject to booking and availability at time of booking. The major prize is a single event holiday and cannot be separated into different holiday vacations. The four (4) flights must be utilised at the same time, for the same travel dates, and only to the destination of the major prize.
A valid passport is required for all international journeys. All passports must be valid for six (6) months prior to departure. It the responsibility of the winner and their travel companions to ensure they have all required travel documentation (including but not limited to passports and visas) as required for travel in connection with the major prize. All costs associated with obtaining this travel documentation is the responsibility of the winner.
Transport to and from the departure point (including but not limited to additional domestic airfares, if required), any additional meals, any extra sightseeing or activities, any additional accommodation, personal spending money, and all other ancillary costs and expenses, as well as the cost of obtaining any of these, are the responsibility of the winner of the major prize and their travel companions. The major prize also excludes medical expenses, items of a personal nature, beverages, optional tours not outlined, laundry, incidentals, gratuities, service charges, passports, visas, travel insurance, telephone calls, additional nights, room upgrades or other ancillary costs associated with redeeming the major prize other than those specified in these terms and conditions. These costs and expenses are the responsibility of the winner. Any extension to the duration of the major prize is at the winner’s sole expense and subject to availability at the time of booking. For the removal of doubt, taxes for international travel are included in the international airfares component of the major prize. Travel insurance is highly recommended to protect against the additional costs incurred in the event of unforeseen circumstances.
No components of the major prize can be exchanged for other travel or accommodation at other destinations. Any taxes (other than GST, if any) which may be payable as a consequence of a winner receiving the major prize are the sole responsibility of the winner.
General:
It is a condition of accepting a prize that the Finalists (including the major prize winner):
including, where applicable, the major prize winner’s traveling companions, must comply with any conditions and requirements of any supplier of the prize. The Promoter is not the supplier of any of the prizes, and the Promoter will not be responsible for any acts or omissions of any of the suppliers of the prizes; and
must sign any legal documentation as and in the form reasonably required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.
Prizes must be taken as offered. Each prize:
or any unused portion of the prize, is not transferable, exchangeable or redeemable for cash;
or the components of a prize, may alter for reasons beyond the Promoter’s control;
cannot be used in conjunction with any other special offer; and
is valued in Australian dollars (inclusive of GST), and the Promoter accepts no responsibility for any variation in the prize value.
Prize winners will be notified as soon as reasonably practicable after the relevant judging date, by telephone and email using the contact details given in their entry.
In the event that for any reason whatsoever a winner does not claim their prize at the time stipulated by the Promoter, then the prize will be forfeited by the winner and cash will not be awarded in lieu of the prize.[
In the event that a prize, or part of a prize, is unavailable due to events outside the reasonable control of the Promoter, the Promoter reserves the right to substitute the prize or part of the prize in its discretion with an alternative prize or part of the prize to the same or greater recommended retail value and/or specification.
The Promoter is neither responsible nor liable for any late, lost or misdirected mail or email.
Any cost associated with accessing the promotional website (see clause 8) is the entrant’s responsibility and is dependent on the internet service provider used.
In the event of unforeseen circumstances, war, terrorism, state of emergency or disaster (including but not limited to natural disaster) the Promoter reserves the right, subject to the laws of any relevant State or Territory, to cancel, terminate, modify or suspend the competition.
If an entry is selected as a winning entry, validation of the entry may be undertaken by the Promoter. Method of validation will be determined by the Promoter in its complete discretion. If an entry is selected as a winner, the winner will be notified as per these terms and conditions.
Nothing in these terms and conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other warranties, guarantee, term or condition implied or imposed under any applicable laws in the States and Territories of Australia (the “Non-Excludable Guarantees”).
Subject to the Promoter’s obligations under the Non-Excludable Guarantees (see clause 38) and to the maximum extent permitted by law, the Promoter’s maximum aggregate liability (including that of its officers, employees and agents) in contract, tort (including negligence) or any other basis, for any loss or damage (including loss of opportunity), whether direct, indirect, special or consequential, arising out of or in connection with the competition, including (without limitation):
any technical difficulties or equipment malfunction (whether or not under the Promoter’s control);
any theft, unauthorised access or third party interference;
any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter;
any variation in prize value to that stated in these terms and conditions;
any tax liability incurred by a winner or entrant; or
use of any prize by a Finalist or (if applicable) the major prize winner,
is limited to $50.
If this competition is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the competition, as appropriate.
Privacy:
Nutricia Australia Pty Limited (ABN 99 076 246 752) (“Nutricia”) respects your privacy and is committed to handling your personal information in accordance with its privacy policy, which can be accessed at www.karinourish.com.au/privacy/ (the “Privacy Policy”), and the following provisions which apply in addition to the Privacy Policy:
Nutricia may collect personal information from you from your entry form (see clause 8), any interview you participate in (see clause 13) and any other communications Nutricia and you enter into in relation to this competition; and
Nutricia may use and disclose personal information for the purposes set out in the Privacy Policy, and for the purpose of conducting this competition in accordance with these terms and conditions, including disclosing personal information to third parties (see clauses 13 and 14).
