The promoter is Auto & General Services Pty Ltd ABN 61 003 617 909, AFSL 241 411 (operating under the brand Budget Direct) of Level 13, Toowong Tower, 9 Sherwood Road, Toowong 4066, (Promoter) on behalf of the insurer, Auto & General Insurance Company Ltd (ABN 42 111 586 353) (Insurer).
These Terms and Conditions apply to the promotion, ‘$10K Monster Budget Booster’ (Promotion). The Promoter is offering one (1) existing Budget Direct policyholder the chance to win their choice of two (2) packages from the package options below, and ten (10) runners up the chance to win a $500 eGift card each. (See Eligibility and Participation section).

Information on how to enter, mechanics of entry and prizes form part of these Terms and Conditions. Entry into the Promotion is deemed acceptance of these Terms and Conditions. If there is any conflict between these Terms and Conditions and any other published material, these Terms and Conditions prevail.
The Promotion commences at 12.01am (AEST) on 20 January 2021 and ends at 11.59pm (AEST) on 28 February 2021 (Promotion Period). The total maximum prize pool in the Promotion is AUD $15,000.
Entry into the Promotion and any offer of Budget Direct Insurance is subject to the Insurer deeming that the risk is acceptable in accordance with its underwriting criteria. Before purchasing a policy, consider if the product is right for you by reading the Product Disclosure Statement and Financial Services Guide.
This Promotion is only open to existing Budget Direct policy holders who fulfil the eligibility criteria in accordance with Clause 7. The Promotion is not open to customers varying their policies or roadside assistance membership with Budget Direct, or customers who cancel an existing Budget Direct policy or roadside assistance membership during the Promotion Period for the purposes of participating in the Promotion.
Eligibility and Participation
Customers must meet the following criteria to participate in the Promotion (Eligible Entrant):
Be an existing policy holder of the promoter and retain an active and valid Insurance policy or Roadside Assistance membership as at applicable Draw Date; and
be 18 years or over and a permanent resident of Australia, or have resided in Australia continuously for six months or more on a temporary work visa at the time of participating in the Promotion; and
provide a valid email address; and
either:
complete the online entry form via https://www.budgetdirect.com.au/landingpages/budget-booster.html and provide the future renewal date of their non-Budget Direct insurance policies or otherwise; and/or
renew or have their existing Budget Direct policy auto renewed (with new risk period commencing during the promotional period); and/or
purchase a new roadside assistance membership through Budget Direct’s website, or via the Budget Direct call centre; and/or
complete a new quote and/or purchase one of the following Budget Direct products through Budget Direct’s website, or via the Budget Direct call centre:
car policy (providing either comprehensive, third party property, third party fire & theft); or
home and or contents policy; or
pet insurance policy; or
motorcycle insurance policy
(referred to as Eligible Products)
Officers or employees of the Promoter, its related entities or agents and service providers directly associated with the conduct of the Promotion, or their immediate family are not eligible to enter.
Eligible Entrants will receive the following entries into the prize draw:
A maximum of one (1) entry into the prize draw if the Eligible Entrant provides the future renewal date of their current non-Budget Direct policies online; and
A maximum of five (5) entries for successfully renewing their existing Budget Direct policy (with new risk period commencing during the promotional period). The Eligible Product must remain active and valid for a period of not less than twenty-one (21) days from the date the policy was issued (Cooling Off Period) and remain valid at the Draw Date;
One (1) entry for obtaining a quote for an Eligible Product; and
Five (5) entries for the purchase of any new Eligible Product or a stand-alone roadside assistance membership. Customers varying their existing Eligible Products or stand-alone roadside assistance membership with the Promoter are not eligible for these entries. The purchased Eligible Product must remain active and valid for a period of not less than twenty-one (21) days from the date the policy was issued (Cooling Off Period) and remain valid at the Draw Date. The entries will be awarded once the newly purchased eligible product has been held continuously for twenty-one (21) days.
Purchases made via third party aggregation platforms such as Compare the Market or iSelect are not eligible for participation in this Promotion.
The use of any automated entry software or any other means that allows an Entrant to automatically enter repeatedly or otherwise tamper with the entry process is prohibited and will render all entries submitted by that Entrant invalid.
If there is a dispute regarding the conduct of the Promotion, Entrants agree that the decision of the Promoter will be final.
Draw and Prizes
The prize draw will take place at von Muenster Legal, Suite 2, Level 2 105 Reservoir Street, Surry Hills NSW 2010 at 10:30am (AEST) on 16 April 2021 (Draw Date).
The winners will be notified via their nominated email addresses and via phone (where available) within two (2) business days of the Draw Date, or by no later than 20 April 2021 and their names will be published on the Terms and Conditions page of the Promoter’s website at https://www.budgetdirect.com.au/terms-conditions/budget-booster.html within twenty-eight (28) days of the Draw Date, and will remain on the Promoter’s website for no less than twenty-eight (28) days. All reasonable steps will be taken by the Promotor to notify the winners.
A total of eleven (11) Eligible Entrants, who upon request, has provided evidence of their eligibility and the validity of their entry (Eligible Winner), will be selected on the Draw Date.
The Promoter may draw five (5) additional reserve entries on the Draw Date and record them (in order) in case the Eligible Winners do not accept their prizes or are deemed ineligible at the time of draw. In this event, the prize will be awarded to the first reserve entry drawn and the Promoter will continue to draw from the reserve entries until the prize is awarded. If after this process a prize has still not been awarded, or if an entrant drawn cannot be notified, the Promoter will hold an unclaimed prize draw in accordance with Clause 18.
A prize will be deemed unclaimed if the Promoter is not reasonably able to contact the Eligible Winner within three (3) months and one (1) day of the Draw Date via the Eligible Winner’s provided contact details.
If the prize remains unclaimed, an Unclaimed Prize Draw will be held on 23 July 2021 at the same time and location as advised in Clause 13. Any Unclaimed Prize Draw winner will be notified within two (2) business days of the applicable Unclaimed Prize Draw and the Unclaimed Prize Draw winner’s name will be published in accordance with Clause 14.
The Eligible Winners will receive an email within twenty-eight (28) days of the Draw Date from Digital Glue Australia Pty Limited ABN 36 127 466 899 (Digital Glue) who operates the redemption website with a link to access their cash or eGift card prize. The Promoter is not responsible for, or liable in respect of, products and services provided by Digital Glue.
Each Eligible Winner will then be required to follow the instructions contained in the email and on the website of Digital Glue for the payment of prize money (Redemption Process).
As part of the Redemption Process, Eligible Winners must ensure they provide current bank account details, including bank account name, BSB and account number. Each Eligible Winner acknowledges and agrees that any prize is not transferable.
The payment of the cash prize will be effected via Digital Glue by way of electronic funds transfer into the Eligible Winner’s nominated bank account. This may take up to five (5) business days from successful completion of the Redemption Process. Eligible funds transfer payments will only be made into an Australian Bank Account.
The eGift cards are not reloadable, transferable or exchangeable and cannot be taken as cash. If an eGift card or receipt of it incurs a tax liability, the relevant recipients of the eGift cards are liable for payment of such tax.
Privacy Statement and Marketing Consent
The Promoter is committed to protecting your Personal Information and will use and handle personal information collected in a manner consistent with the Promotor’s Privacy Policy which is available on the website, at https://secure.budgetdirect.com.au/branding/resources/BUDD/legal/car/privacy.pdf. The Privacy Policy also includes details of how the Promoter will collect, store, use and disclose personal information collected. As per the relevant Privacy Act 1988 (Cth), a request to access, update or correct any information should be directed to the Promotor’s Privacy Officer at privacyquery@autogeneral.com.au.
By entering the Promotion, Entrants consent to the Promoter disclosing the Personal Information to Digital Glue and to any of the Promoter’s related entities, and to use the Personal Information to process and validate redemptions of an Eligible Winner. Eligible Entrants acknowledge that a further purpose for collection of the Eligible Entrant’s Personal Information is to contact the Eligible Entrant in the future with information about the Promoter and its products and services, including special offers, market research or to provide the Entrant with marketing materials via any medium including mail, telephone and commercial electronic messages or any other form of electronic, emerging, digital or conventional communications channel whether existing now or in the future.
The Promoter will never sell an Eligible Entrant’s Personal Information to other companies; however the Promoter may share an Eligible Entrant’s Personal Information with its Australian and overseas related companies, promotional partners, servants, employees, agents and trusted third parties who may contact the Entrant for their legitimate commercial purposes, including special offers, market research or to provide the Entrant with marketing materials in this way. By entering the Promotion, Entrants acknowledge and consent to the Promoter and any applicable third parties’ using their Personal Information in the manner set out in this clause.
General
The Promoter, its related entities, their officers and employers will not be liable for any loss or damage, whether direct, indirect or consequential (including loss of profits or loss of opportunity) which is suffered or sustained in connection with the Promotion including the use of any prize money, except to the extent of any liability which cannot be excluded by the law (including under the Australian Consumer Law).
The Promoter reserves the right to disqualify any person from receiving the prize if any of the following occurs:
if it suspects fraudulent activity; or
for a breach of these Terms and Conditions.
The Promoter reserves the right at its discretion or subject to any written directions from a regulatory authority, to modify, suspend, terminate, withdraw, or cancel the Promotion at any time without notice. Unless prohibited by law, these Terms and Conditions may be varied at any time without notice.
Except for any liability which cannot be excluded by law, the Promoter, (including its officers, employees and agents) will not be liable for any loss or damage whatsoever (including but not limited to direct or consequential loss) including any loss of enjoyment, loss of opportunity, or any personal injury suffered or sustained in connection with this Promotion.
The Promoter reserves the right to substitute any prize with another incentive of the same value, subject to regulatory authority.
In these Terms and Conditions:
“Australian Consumer Law” means Schedule 2 of the Competition and Consumer Act 2010 (Cth). “Personal Information” means, for the purpose of the Privacy Act 1988 (Cth), information or an opinion about an identified individual, or an individual who is reasonably identifiable, whether the information or opinion is true or not and whether the information or opinion is recorded in a material form or not.
