HARRY’S ICE CREAM CO. ‘WHAT IS YOUR FAVOURITE AUSTRALIAN DESSERT AND WHY?’ PROMOTION TERMS AND CONDITIONS 1. Information about how to enter and prizes form part of these Terms and Conditions. Participation in this Promotion is deemed to be acceptance of these Terms and Conditions. 2. The Promoter is Harice Pty Ltd. 17 Tinning Street, Brunswick in the State of Victoria, Australia, 3056 (ABN 26 793 281 364) 3. The Promotion commences at 3pm AEDT (Australian Eastern Daylight Time) 30th November 2012 and closes at 5pm AEDT on 11th January 2013 (“the Promotion Period”) 4. Entry to the Promotion is open to all Australian residents and citizens (”Eligible Entrants"). Entrants under 15 years of age must have parental/guardian approval to enter and, further, the parent/guardian of the entrant must read and consent to all Terms and Conditions. Parents/guardians may be required by the Promoter to enter into a further agreement as evidence of consent to this Promotion. 5. To enter, an Eligible Entrant must fill in all detail and tick the box confirming they have read these Terms and Conditions. Eligible Entrants must send their answer via https://www.facebook.com/harrysicecream explaining in 25 words or less ‘What is your favourite Australian dessert and why?’. 6. The winner will be judged at 11am AEDT on 14th January 2013 at 17 Tinning Street, Brunswick, Victoria, 3056, Australia. There will be one $1000 voucher for ‘Best Restaurants in Australia’ to be won. The prize winner will be the Eligible Entrant who submits the entry judged by the Promoter to be the most creative. Chance plays no part in the judging of the entries. 7. The Prize is a valued at AUD $1000 The Prize is for the winner to use at any of the ‘Best Restaurants of Australia’ listed restaurants and: · Includes participation of all restaurants listed with Best Restaurants of Australia, listed on the website www.bestrestaurantscard.com.au · Includes food and beverages to the value of $1000 at the restaurants of winner’s choice (as above) · Voucher can be used at multiple venues while the card is valid, if the full amount is not used in one sitting. Please refer to Best Restaurants of Australia Terms and Conditions. · Excludes food and beverage costs exceeding $1000 total · Voucher valid for one year after issue · Includes Terms and Conditions stipulated by Best Restaurants of Australia 8. The Promoter will be notify the Prize Winner by email or phone. 9. Any entry not complying with these Terms and Conditions in any way or any entry not completely filled out including name, address and phone number will be deemed invalid. 10. The Prize Winner will be notified by the Promoter as to how they will receive the Prize. The Prize may not be exchanged for another product or cash. 11. If a prize is not claimed within three months of the date on which the original winner is selected as set out in Paragraph 6 (above), the Promoter will make a further determination of a winner, using the criteria set out in Paragraph 6 (above), at 11am AEDT on 12 April March 2013 at 17 Tinning Street, Brunswick, Victoria, 3056. 12. If the advertised Prize is not available, the Promoter may in its sole discretion substitute another Prize of equal value and/or specification subject to the requirements of any regulatory authority. 13. Entry is not available to employees of the Promoter, companies or agencies associated with this Promotion or the immediate families of any such employees, meaning any of the following: spouse, ex-spouse, de-facto spouse, child or stepchild (whether natural or adopted), parent, step parent, grandparent, step grandparent, uncle, aunt, niece, nephew, brother, sister, step brother, step sister or first cousin. 14. The Promoter reserves the right at any time to verify the validity of any claim and to verify the identity of the entrant. Failure by the Promoter to enforce any of its rights at any time does not constitute a waiver of those rights. 15. Multiple entries are not permitted. 16. The Promoter accepts no responsibility for any late, lost or misdirected entries including but not limited to electronic messages not received by the Promoter due to technical disruptions, network congestion or any other reason. 17. In the event of any dispute regarding the conduct of this Promotion, the decision of the Promoter is final and no correspondence will be entered into. 18. If the Promotion is not capable of being conducted as reasonably anticipated due to any circumstances beyond the control of the Promoter, the Promoter reserves the right in its sole discretion and to the fullest extent permitted by law, to modify, suspend or cancel the Promotion as appropriate, subject to the requirements of any regulatory authority. 19. To the fullest extent permitted by law, the Promoter and any companies associated with this Promotion, including Edge Loyalty Systems Pty Ltd, trading as Best Restaurants of Australia (including their officers, employees and agents), shall not be liable for any defects in Prizes or for any loss, damage or personal injury whatsoever which is suffered or sustained (including but not limited to indirect or consequential loss) as a result of taking a Prize, failing to take a Prize, participation in the Promotion, any decision of the Promoter including any variation of any aspect of the Promotion. 20. The Promoter collects personal information in order to conduct the Promotion and may, for this purpose, disclose such information to third parties, including but not limited to offer suppliers and as required to Australian regulatory authorities. Prize claims are conditional upon the customer providing this information. The Promoter may for an indefinite period use the information for promotional, marketing and publicity purposes, including sending electronic messages and telephoning the customer. Eligible Entrants may opt out of receiving marketing material from the Promoter by ticking the appropriate box on the online entry. Entrants may direct any request to access, update or correct personal information to the Promoter. All entries become the property of the Promoter. 21. The laws of Victoria apply to this Promotion and the each Entrant submits to the exclusive jurisdiction of the Courts of Victoria.
