Information on how to enter forms part of these terms and conditions of entry. Participation in this promotion is deemed acceptance of these Terms and Conditions
Entry is open to all residents of Australia aged 18 years and over who are the registered home owner of the premises that they would like the prize to be installed in. Employees of the Promoters and their immediate families and agencies associated with this promotion are ineligible to enter.
If the Prize Winner is not the home owner of their premises or not in an area that Freedom services i.e If the winner is a resident of SA, WA, TAS, ACT, NT or lives outside 100km radius of Sydney, Melbourne or Brisbane the winner will be ineligible to win the prize.
To enter, sign up at completehome.com.au/wina20kfreedomkitchen and follow to fill in the entry form including name, postal address, current email address and day time telephone number and answer to the competition question in 25 words or less ‘How would a Freedom Kitchen change your life?’ Submit your completed entry as directed.
The promotion commences at 12pm (AEST) on 1 November 2014, and closes at 12pm (AEST) on 1 May 2015. The promotion will be judged by the Promoters. The Judging will begin on 1st May 2015 at 1:00pm at Universal Magazines Pty Ltd at Unit 5, 6-8 Byfield Street, North Ryde, NSW 2113. The winners will be notified by telephone and in writing using contact details provided in their entry.
This is a game of skill; chance plays no part in determining the winner. Each entry will be individually judged based on its literary and creative merit of the answer to the question provided. The judges’ decision in relation to any aspect of the competition will be final and binding on every person who enters. No correspondence will be entered into.
The Entrant warrants to the Promoters that the entry submitted is an original artistic work of the Entrant that does not infringe the rights of any third parties. If the entry or any part of the information provided to the Entrant in relation to the entry was provided by a third party, the Entrant warrants that they have obtained the relevant copyright permission to submit the entry for the purposes of this promotion. The entrant agrees to indemnify the Promoters against all claims and costs by third parties arising from a breach of the warranty set out in this condition.
The Promoters are entitled to use any of the entries submitted in any manner and for any purpose at its absolute discretion, including using the entries for future Promoters’ or their agents book publications, promotional, marketing and publicity purposes without any further reference or payment or other compensation to the entrant. The Promoters are entitled to amend, edit, select, crop, retouch, add to or delete from any part of the submitted entry.
Entries must not be offensive, defamatory or racist. Any entry which the judges deem inappropriate will be invalid. The entrant agrees to indemnify the Promoters.
The Promoters reserve the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions will be accepted at the Promoters' discretion. Failure by the Promoters to enforce any of its rights at any stage does not constitute a waiver of those rights.
The best (1) entry as deemed by the judges will be deemed the major prize winner and will win a Freedom Kitchen renovation package, comprised of:
Kitchen cabinets with Hettich InnoTech soft-closing drawers and a Caesarstone® Classico benchtop valued at up to $13,000
Baumatic® kitchen appliance pack, including an oven, gas cooktop, slide-out rangehood and dishwasher valued at up to $2,000
Design, delivery and labour for installation of the kitchen renovation package valued at up to $5,000
The total prize pool is valued at up to $20,000.00 (including GST). The winner will have a choice of (including but not limited to) specific colours, finishes, range of appliances to include in the installation of the Kitchen. These lists will be provided by the service provider at the time of winner notification. If the winner chooses a specific item or the design, delivery and labour for installation costs are outside of the current fee budget provided in the prize winning package, the winner will need to pay the difference and these costs will be the responsibility of the winner.
For the removal of doubt, the Prize does not include:
(a) Kitchen lighting and glass splashbacks, tiles and other kitchen accessories including but not limited to sink, taps, refrigerator etc;
(b) any gas, electricity, water or associated costs incurred in before, during or after the claiming, installing and using of the Prize;
(c) any accommodation, meals or other spending money incurred in relation to or ancillary to claiming or using the Prize;
(d) any other ancillary or incidental expenses incurred in connection with the prize, whether before, during or after installation;
(e) any insurances or taxes;
(f) any construction, electrical, tiling or plumbing services;
(g) any ongoing maintenance costs;
(g) any costs in excess of the allocated budget per component of the prize or
(h) any other ancillary costs associated with redeeming this prize.
Winner is responsible for all of the trade works (other than the actual kitchen installation) such as plumbing, electrical and tiling. Much of this will need to be completed before the kitchen can be installed. The Freedom Kitchens team will make all reasonable attempts to assist the winner with contacts for these trades.
The Prize must be redeemed in full, as a package and completed by 01/05/2016. Freedom Kitchens will contact the winner after winner notification to organise redemption of the prize.
All materials in relation to the installation of the prize will be provided and all installation will be undertaken by suppliers and persons selected in the Promoters absolute discretion. The Promoters will provide contracted kitchen installers to install the prize components but are not responsible for any plumbing and/or electrical services or any structural, renovation or construction work. The Prize is subject to all of Freedom Kitchens’ standard terms, conditions and warranties relating to purchase and installation.
All prize items are valued in Australian dollars and are inclusive of GST. Prize item values stipulated in the above Condition 7 are based on the recommended retail prices as at the time of writing. The Promoters accept no responsibility for any variations in prize values between such time and the date of prize redemption. The prize is not transferable, exchangeable or redeemable for cash. In the event that the Prize Winner does not take or redeem a component of the Prize by 01/05/2016, that component will be forfeited by the Prize Winner and cash will not be awarded in lieu of that component. In the event that any prize item is unavailable, the Promoters reserve the right to substitute a prize item of equal or greater value. Any taxes (other than GST, if any) which may be payable as a consequence of a winner receiving the prize are the sole responsibility of the Prize Winner.
The Promoters make no representations or warranties as to the quality/suitability/merchantability of any of the goods/services offered as prizes; and accepts no responsibility for loss or damage to prizes in transit.
In acceptance of the prize, the Winner acknowledges that they may incur ongoing costs associated with the prize which are the entire responsibility of the winner.
Prize is subject to the standard terms and conditions of individual prize and service providers.
In the event that for any reason whatsoever the Winner does not take the prize at the time stipulated by the Promoters, then the prize will be forfeited by the Winner and cash will not be awarded in lieu of the prize.
In the event that a prize, or part of a prize, is unavailable, the Promoters reserve the right to substitute the prize or part of the prize in its discretion with an alternative prize or part of the prize to the same and equal recommended retail value.
Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used.
In the event of unforeseen circumstances, war, terrorism, state of emergency or disaster (including  but not limited to natural disaster)the  Promoters reserves the right to subject to reference to all relevant  state and territory rules and regulations, to cancel, terminate, modify or suspend the promotion.
If a medical circumstance in some way restricts your ability to enter the competition through the required mechanic, you are still eligible to enter however you must briefly state your circumstances upon entry.
If your entry is selected as a winning entry, validation of your circumstances/ the validity of your entry will be undertaken by the Promoters. Method of validation (without limitation) will be determined by the Promoters in its complete discretion. If the winning entry is deemed to be a winner, the winner will be notified as per the terms and conditions herein. In the event that the Promoters requests the entrant to sign any legal documents relating to the verification of their medical circumstance, the legal documents will take the form determined by the Promoters. It is a condition of accepting the prize the winner sign any such legal documentation.
Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoters (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees,  the Promoters (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoters’ control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoters) due to any reason beyond the reasonable control of the Promoters; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use of the prize.
If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoters, the Promoters reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
The Promoters collect personal information in order to conduct the promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this information. The Promoters may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. Entrants should direct any request to opt out, access, update or correct information to the Promoters. All entries become the property of the Promoters.

By entering the competition and providing an email address, the entrant consents to receipt of any email regarding the competition, and other emails which inform the entrant of the Promoters other publications, products, services and events and to promote third party goods and services it may be interested in.
