1 Information on how to enter and prize details forms part of these conditions of entry. Entry into the competition is acceptance of these Terms and Conditions.

3 The Supplier is Gaia Retreat & Spa’s and Retreatment Botanics’.
How to Enter
4 Entry is open only to permanent residents of Australia and New Zealand, who are over the age of 18 years old. Permanent and casual employees, contractors, subcontractors of the Promoter (including employees of Direct Group entities that are not TVSN Channel Pty Ltd) and members of such persons’ immediate families are not eligible to enter this competition.
5 To enter the Competition, Entrants must fill out the web form available at https://www.itvsn.com.au/community/competitions and answer the question ‘What are your favourite natural beauty rituals?’ in 25 words or less.
6 Entrants may enter once only and will be automatically entered on receipt of their web form.
7 This is a game of skill and chance plays no part in determining the Winner. The Promoter will judge the entries on their individual merit and select a Winner. The Promoter’s decision is final, and no correspondence will be entered with Entrants regarding its decision.
8 Notwithstanding clause 4, incomplete and incomprehensible entries will be ineligible to enter the promotion. The Promoter reserves the right to deem any incomplete or incomprehensive entries ineligible in its sole discretion.
9 Entrants must not include any offensive or inappropriate material in their entries or any material that if used by the Promoter would infringe any third party intellectual property rights. The Promoter reserves the right to invalidate such entries it deems offensive or inappropriate.
10 The Promoter’s decision in respect of all matters to do with the competition will be final and no correspondence will be entered into.
State Date and Close Date
11 The competition opens at 8:30am AEDT 1 January 2020 and closes at 11:59pm AEDT 30 January 2020.
Winner Draw
12 The Winners will be announced on 31 January 2020, contacted via email and announced on tvsn.com.au thereafter.
13 If a prize remains unclaimed two weeks after the announcement date, the Promoter will select another Winner on 17 February 2020.
Prize Details and their value
14 There is 1 prize/1 Winner. The prize is 5 nights at the luxurious Gaia Retreat and Spa. The is for the 1 Winner and 1 Guest. The package includes:
(a) 5 Nights’ Accommodation in the spectacular Komala villa;
(b) All Gourmet Meals and Snacks;
(c) Complimentary Relaxation Massage;
(d) 1hr Retreatment Botanics facial per person;
(e) ½hr Body Polish of your choice per person;
(f) 1hr Grounding Clay Masque per person;
(g) ½hr Wellness Consultation per person;
(h) Complimentary collection of Retreatment Botanics products to the value of $500;
(i) Daily 90min Morning Yoga;
(j) Daily Retreat Activities;
(k) Full use of all Facilities; and
(l) Return Complimentary Airport Transfers from Ballina or Coolangatta – at set times.
15 This prize is valid for use by the Winner for 9 months from the date of winning this prize as between 1 February 2020 and 1 November 2020 on certain dates. Blackout periods apply.
16 The total value of the holiday is $11,085.00. Values are in AUD and are correct at the time of printing. The Promoter is neither responsible nor liable for any change in the value or contents of the prize occurring between the publishing date and the date the prize is claimed.
17 The Entrant is responsible for any travel associated with claiming or receiving the prize beyond what is listed in clause 13. It is the Winner’s responsibility to ensure they possess valid documents required for travel.
18 The prize only includes those items listed in clause 13. For avoidance of doubt, it does not include:
(a) additional treatments;
(b) transfers outside of complimentary transfer times;
(c) costs for flights or other methods of transport to or from the retreat, with the exception of Return Complimentary Airport Transfers listed in clause 13;
(d) any upgrades or additional services and arrangements to the package. These are to be made through Gaia Retreat & Spa; or
(e) late check-in. The Winner must check in to Gaia Retreat & Spa before 5 pm or late check-in fee applies.
19 The Promoter will not pay any costs associated with the Entrant claiming the prize including travel to and from Gaia Retreat and Spa, except for complimentary airport transfers
20 The Winner must confirm booking arrangements with Gaia Retreat & Spa within sixty (60) days from the date of winning this prize. If the Winner does not book within the prescribed sixty (60) days the prize will be deemed invalid.
21 Once the prize has been claimed by the Winner, any responsibility will lie solely with Gaia Retreat & Spa.
General
22 Subject to relevant state authority approval, the Promoter reserves the right to modify the Terms and Conditions of this competition at any time.
23 The Promoter reserves the right to withhold a prize from a Winner if the prize Winner’s TVSN account is in arrears.
24 Subject to relevant state authority approval, the Promoter reserves the right, in its absolute discretion, at any time before the awarding of the prize to cancel the competition or to vary or cancel the award of the prize including, without limitation, circumstances where in the Promoter’s opinion (which it shall form in its absolute discretion):
(a) a prize Winner does not satisfy the competition entry requirements; or
(b) the Promoter cannot conduct the competition or award the prize for any reason beyond its control.
25 Subject to relevant state authority approval, in the event that the Promoter cancels the competition or varies or withdraws the prize it shall not:
(a) be liable to any person for any loss or damage (including loss or damage caused by any negligence) arising out of, or in connection with, such cancellation, variation or withdrawal; and
(b) be required to conduct the competition at any other time.
26 Entrants enter the competition at their sole risk. With the exception of liability which cannot be excluded by law, the Promoter will not be liable for any loss or damage which is suffered (including but not limited to indirect or consequential loss) or for personal injury suffered or sustained or loss or damage to tangible property as a result of accepting and using the prize, any goods or services attained through accepting and using the prize or entering the competition.
27 Any attempt, deliberate or otherwise, to cause malicious damage or interference with the normal functioning of the Promoters or Gaia Retreat & Spa and Retreatment Botanics’ website(s), the information on the Promoter’s website, may be a violation of criminal and civil laws. Should an Entrant attempt to damage their normal functioning of the Promoters website, whether successful or not, the Promoter reserves the right to seek damages to the fullest extent permitted by law.
28 The Promoter reserves its right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, including but not limited to tampering with the entry process, engaging in any unlawful or other improper misconduct that is calculated to jeopardise fair and proper conduct of the competition. Errors and omissions may be accepted at the Promoter’s discretion.
29 If the Promoter becomes aware after an Entrant has won the prize that the Entrant did not comply with these terms and conditions, that Entrant will have no entitlement to the prize, even if the Promoter has announced them as a Winner, and that Entrant will be required, at the direction of the Promoter, to return, or refund prize.
30 The Promoter is neither responsible nor liable for any change in the value of the prize occurring between the publishing date and the date the prize is claimed.
31 The prize, or any unused portion of the prize, is not transferable or exchangeable and cannot be taken as cash. The prize must be taken in its complete entirety or it will be forfeited. If, for any reason a winner does not take the prize or an element of the prize at the time stipulated by the Promoter, then the prize or that element of the prize will be forfeited.
32 The Promoter reserves the right to use the content of winning entries for the purpose of future promotions. The right to use granted in this clause includes a right to modify, adapt and exploit the content of the winning entries for use in this competition or any other competition conducted by the Promoter, it’s related entities or commercial partners. To the extent moral rights exist in the content of winning entries, the right to use extends to a right to use the content in the winning entries without attribution of the author and a right to make any form of modification without first obtaining the consent of the author.
Privacy
33 Upon entry into the Competition an Entrant gives permission for the use of personal data and information by the Promoter. This information will be retained in accordance with the Privacy Act 1988 (Cth) and TVSN’s Privacy Policy. 34 Upon entry into the Competition an Entrant consents to their personal data and information being provided to Gaia Retreat & Spa and Retreatment Botanics for the specific and limited purposes of:
(a) the Competition; and
(b) being added to Gaia Retreat & Spa and Retreatment Botanics’ email subscriber databases. Entrants can opt to stop receiving these communications from the receipt of the first email communication.
This information will be retained in accordance with the Privacy Act 1988 (Cth), Gaia Retreat & Spa’s Privacy Policy and Retreatment Botanics’ Privacy Policy. 35 Nothing in these clauses limits or derogates from the Promoters or Gaia Retreat & Spa and Retreatment Botanics’ obligations under the Privacy Act 1988 (Cth).
36 The Promoter is not be liable for a breach of these obligations where the breach is attributable to Gaia Retreat & Spa and Retreatment Botanics.
