Terms and Conditions
Instructions on “How to Enter” and information about the prize form part of these Terms and Conditions. By participating, in this promotion, entrants agree to be bound by these Terms and Conditions.
Entry is open to residents of Australia aged 21 years and over, who: (a) purchase a participating issue of MOTOR magazine; and (b) have a current full, unrestricted and valid motor vehicle driver’s license (that is not suspended) which entitles the entrant to drive on a public road.
Employees (and their immediate families) of the Promoter and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
Entrants acknowledge that to redeem the prize the winner must be aged 21 years or over and otherwise comply with clause 2.
The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of thepromotion. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.
Incomplete, indecipherable, or illegible entries will be deemed invalid.
The competition commences on April 5th, 2018 at 00:01am (AEST) and closes on June 27th, 2018 at 23:59pm (AEST) (“Promotional Period”). The draw will take place at 11:00am (AEST) on July 16th, 2018 at Bauer Trader Media, 73 Atherton Road, Oakleigh, VIC 3166. The winner will be notified in writing and by telephone, within two (2) business days of the draw, using the contact details given in their entry. The winner’s name will be published on www.motormag.com.au on July 18th, 2018 for a period of 28 days from this date.
To enter, individuals must undertake the following steps, during the Promotional Period:
Either:
i. Purchase a participating copy of MOTOR magazine being issue #Apr-18, #May-18 and/or #Jun-18; or
ii. Receive a participating copy of MOTOR magazine as part of their current MOTOR magazine subscription being issue#Apr-18, #May-18 and/or #Jun-18;
Visit www.motormag.com.au/BMWdrive and follow the prompts to the online competition page and fully complete the entry form including their full name, email address, state and telephone contact number as well as the reader code found within any participating issue of MOTOR magazine (as indicated above); and
Submit their fully completed only entry form as instructed.
Multiple entries permitted, subject to the following: (a) only one entry is permitted per participating issue of MOTOR magazine purchased or received as part of a subscription; (b) each entry must be submitted separately and in accordance with entry requirements; (c) a maximum of three (3)entries are permitted per person; (c) only one reader code per entry is permitted; (d) the same reader code cannot be used by the entrant more than once; (e) unrecognised reader codes will be deemed invalid
The first valid entry drawn from all valid entries received will win the prize of a BMW Driving Experience ,valued at up to $4,895 (including GST) depending on date and point of departure. Prize is for one (1) adult only and includes:
One (1) x Full Day BMW Advance 1 Course voucher (“BMW Driving Experience”) redeemable at: Phillip Island Grand Prix Circuit in VIC, Motorsport Park in NSW, or Norwell Motoplex in QLD. For clarity, the winner will be required to attend the BMW Driving Experience in the same State/Territory in which they reside. Should the winner reside outside of NSW, VIC or QLD the Promoter will also provide one (1) return economy class airfare from the winner’s nearest airport to either Sydney, NSW, Melbourne, VIC or Brisbane, QLD (as determined by the Promoter in its absolute discretion). Flights are only provided if winner resides outside of NSW, VIC or QLD and where it is appropriate for flights to be provided. If the winner is from NSW, VIC or QLD or within a distance in which it is not appropriate for flights to be provided (as determined by the Promoter in its absolute discretion), then the prize does not include airfares and the airfare component of the prize is not redeemable for cash. Voucher also includes morning tea, lunch, afternoon tea, and drink refreshments;
Transfers from the accommodation to the BMW Driving Experience and back; and
Two (2) x night’s single share accommodation in a minimum of four (4) star hotel (in either NSW, VIC or QLD);
Total prize pool is valued at up to $4,895.00 (depending on point of departure). Any ancillary costs associated with redeeming the prize are not included. These are the responsibility of the winner. Spending money, additional meals, insurance, transport to and from departure point, additional transfers, items of a personal nature, in-room charges and all other ancillary costs are not included. Prize must be taken by July 16th, 2019and is subject to booking and flight availability. Prize cannot be taken during Australian school holidays, public holidays or other peak periods. Itinerary to be determined by the Promoter in its absolute discretion. Frequent flyer points will not form part of the prize. Prize is subject to the standard terms and conditions of individual prize and service providers. The winner may be required to present their credit card at time of accommodation check in.
All components of the prize are subject to availability at the time of booking.
The winner acknowledges and agrees that they have read and accepted the terms and conditions of the BMW Driving Experience which can be found at: https://www.bmw.com.au/offers-and-services/bmw-driving-experience/requirements or, a copy can be provided upon request. The winner must comply with all laws (including regulations) applying or otherwise relevant to the BMW Driving Experience.
The winnerof the BMW Driving Experience prize (“Activity”) acknowledges that the Activity is a dangerous activity that may result in injury or death, and participate at their own risk. The winner must: (a) attend, undergo and pass any appropriate training, briefings, required medical tests and other requirements of the Promoter and Activity organisers as determined by them in their absolute discretion; (b) not have any heart condition or history thereof, or other medical conditions that would make it dangerous to participate in the Activity; (c) not be under the influence of drugs or alcohol; (d) comply with all directions of the Promoter and Activity organisers at all times; and (e) wear all safety and other equipment required. The Promoter and Activity organisers, in their absolute discretion, at all times reserve the right to: (a) prevent any winner from participating in the Activity if, at any time, they reasonably believe that the winner poses a safety risk or for any other reason; and/or (b) cancel the Activity if the conditions are deemed dangerous. If the Activity is varied for any reason beyond the control of the Promoter it may not be rescheduled and no compensation will be offered.
The Promoter recommends that the winner obtain travel insurance at their own cost to protect against the additional costs incurred in the event of unforeseen circumstances.
Prize must be taken as offered. The prize, or any unused portion of the prize, is not transferable or exchangeable and cannot be redeemed as cash. The prize cannot be used in conjunction with any other special offer. The prize is valued in Australian dollars. In the event that a portion of the prize is awarded to the winner in the form of a voucher / ticket / pass/ letter, redemption of that portion of the prize will be subject to the terms and conditions stipulated on the voucher / ticket / pass/ letter. The Promoter will not be liable for any voucher / ticket / pass/ letter that has been lost, stolen, forged, damaged or tampered with in any way. Redemption of prize at a venue is subject to the standard rules and regulations of the prize supplier.
As a condition of accepting the prize, the winner must sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.
All prize items are valued inclusive of GST and the Promoter takes no responsibility for any variations in item values. The components of the prize may alter for reasons beyond the Promoter’s control. The prize is not, nor any component thereof, transferable, exchangeable or redeemable for cash. No components of the prize can be exchanged for other travel or accommodation at other destinations. In the event that any prize item is unavailable, the Promoter reserves the right to substitute a prize item of equal or greater value, subject to any directions from a regulatory authority. Any taxes (other than GST, if any) which may be payable as a consequence of a winner receiving the prize are the sole responsibility of the winner.
The winner must not engage in any illegal or unsafe behaviour whilst participating in the prize. To the extent allowable by law, the Promoter and its partners exclude any legal liability or responsibility for legal or otherwise incidents or activities engaged in by the winner during participation in the prize.
General:
If necessary, a draw for the prize, should it remain unclaimed, may take place on October 22nd, 2018 at 11.00am (AEDST), at Bauer Trader, 73 Atherton Road Oakleigh, VIC 3166, subject to any directions from a regulatory authority. The winner (if one is required) will be notified by telephone and in writing, within two (2) business days of the draw, using the contact details given in their entry. The winner’s name will be published on www.motormag.com.au on October 24th, 2018 for a period of 28 days from this date.
In the event that for any reason whatsoever the winner does not take the prize (or an element of the prize) at the time stipulated by the Promoter, then the prize (or that element of the prize) will be forfeited by the winner and cash will not be awarded in lieu.
Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter or repeatedly is prohibited and will render all entries submitted by that entrant invalid.
Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act (Cth), as well as any other implied warranties under the ASIC Act (Cth) or similar consumer protection laws in the State and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) if the BMW Drive Day Experience is delayed, postponed or cancelled for any reason beyond the reasonable control of the Promoter; (f) any tax liability incurred by a winner or entrant; or (g) use of the prize.
If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
Privacy:
The Promoter collects personal information (“PI”) in order to conduct the promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this PI. The Promoter will also use and handle PI as set out in its privacy policy, which can be accessed by visiting http://www.bauer-media.com.au/privacy.htm. In addition to any use that may be outlined in the Promoter’s Privacy Policy, the Promoter may also, for an indefinite period, unless otherwise advised, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. Entrants should direct any request to opt out, access, update or correct PI to the Promoter and direct any complaints regarding treatment of their PI according to the Privacy Policy. All entries become the property of the Promoter.
