TERMS AND CONDITIONS
Conditions of Entry
1. Participation in this promotion is deemed acceptance of these terms and conditions.
2. The entrant is responsible for ensuring his or her familiarity with terms and conditions at the time of participation.
3. The Promoter is Swisse Wellness Pty Ltd, ABN 62 004 926 005, located 111 Cambridge St, Collingwood VIC 3066 (Promoter).
4. This promotion is open to all Australian residents, aged 18 years or over (Eligible Entrants), excluding:
a. directors, management, employees, officers and contractors of the Promoter, its related entities, the participating outlets and other agencies, firms or companies associated with the Promotion (including suppliers of the prize)
b. a spouse, de-facto spouse, parent, guardian, child or sibling of a person referred to in paragraph 5(a) of these Conditions of Entry
c. persons who have breached the terms and conditions of any promotion run by or on behalf of the Promoter.
The persons referred to in paragraph 4(b) of the terms and conditions includes natural and non-natural relations (in the opinion of the Promoter) and the Promoter is responsible for determining whether a person is an Eligible Entrant in its absolute discretion.
5. The competition commences on 11th November 2016 at 12:01am and concludes on 24th December 2016 at 11:59pm (Promotional Period). All times are AEDT.
6. Retailers participating in this Promotion are Chemist Warehouse (in store and online), Discount Vitamin Warehouse (in store and online), My Chemist (in store and online) and ePharmacy.com.au (online) (Participating Outlets). Participating Outlets will display Promotion materials. If in doubt, an Eligible Entrant may ask a retailer if they are participating in this Promotion.
How to enter
6. To enter, eligible entrants must complete the following steps during the Promotional Period:
a. Purchase any one (1) Swisse product at a Chemist Warehouse (in store and online), My Chemist (in store and online), Discount Chemist Pharmacy (in store and online) or ePharmacy.com.au (online) during the promotional period. (Qualifying Purchase)
b. then visit Swisse.com/California follow the prompts to the promotional entry page, input the requested details (including full name, date of birth, telephone number, residential address, a valid email address and receipt number)
c. submit the fully completed online entry form and
d. retain the original store receipt or online store purchase receipt for all entries submitted as proof of purchase.
7. The Promoter is not responsible for technical difficulties with the entry mechanism.
8. Incomplete or indecipherable entries will be deemed invalid at the Promoter’s absolute discretion.
9. Multiple entries permitted, subject to the following:
a. only one (1) entry permitted per Qualifying Purchase (i.e. 1 entry per any Swisse product purchased in one transaction) and
b. each entry must be submitted separately and in accordance with entry requirements. For the sake of clarity, individuals are eligible to submit one (1) unique entry when they make a Qualifying purchase of (1) One Swisse product in a single transaction from any participating retailer in Australia during the Promotional Period 10. Failure to produce the proof of purchase for all entries when requested may, in the absolute discretion of the Promoter, result in invalidation of ALL of an entrant’s entries and forfeiture of any right to a prize. Purchase receipt(s) must clearly specify the store of purchase or the online store, and that a (Qualifying Purchase) of a Swisse product has been made in accordance with the terms and conditions.
11. The winning entry will be drawn at random at Oxygen Marketing 117 Wellington Street St Kilda at 11:00am on 09/01/2017AEDT.
12. The winner will be notified via email and phone on the day. The name of the winner will also be published on Swisse.com/California
from Monday 16th January 2017 and remain online for 30 days.
13. If neither a phone number or email address of the winner is supplied or they are incorrect, then the winner will be disqualified and a new winner will be drawn. 14. If the prize is not claimed by 9:00am AEDT on Monday 17th April 2017 the winner’s entry will be deemed invalid and the Promoter reserves the right at its absolute discretion to conduct a further draw at 11:00am AEDT on the Tuesday 18th April 2017 at the same location as the original draw as are necessary to distribute the prize, subject to any written directions given by the relevant gaming authorities. The winner of the unclaimed prize draw will be notified via email and phone. The name of the winner will also be published at Swisse.com/California after the draw on 21 April 2017 and will remain on the site for 30 days after the draw date.
15. The winner will receive a Family holiday for four (4) people in Los Angeles, valued at up to $19,000, depending on the point of departure. The prize includes: Airport transfers from nearest Australian capital city metropolitan area to and from airport,
• Four (4) return economy airfares from the winners nearest capital city to Los Angeles
• Five (5) nights’ accommodation in Los Angeles, minimum 4-star accommodation, family room, quad share.
• Travel dates to be confirmed but must be taken within 9 months of the major
prize draw. Blackout travel periods will apply and are subject to booking and flight
availability.
• Return Hotel transfers from LAX to LA 4 Star Hotel accommodation.
• $10,000 spending money (to be deposited into the winner’s nominated bank account prior to departure)
16. The total prize value of the promotion is approximate $19,000. depending on Australian City of departure. Any unused funds from the total prize pool cannot be redeemed by the winner for cash.
17. All references to $ shall mean Australian Dollars (AU) unless otherwise stated.
18. Choice of all elements of the prize including flights, accommodation and airport
transfer is at the Promoters absolute discretion.
19. The winner and their family travel companions must depart from and return to the same departure point. All aspects of the prize (including travel and accommodation) are for four (4) people travelling together at all times. Itinerary to be determined by the Promoter in its absolute discretion. Frequent flyer points will not form part of the prize. The prize is subject to the standard terms and conditions of individual prize and service providers. The winner or their companion must hold a valid credit card and will be required to present it at the accommodation establishment at the time of accommodation check in.
20. Unless expressly stated in these Terms and Conditions, all other expenses are
the responsibility of the winner (and their companions) including but not limited to: any extra transport between a traveler’s residence and the departure airport, insurance, visa requirements, meals, in-room charges (such as mini-bar charges, telephone calls, in-house movies, food and beverages), any vaccinations or other medical or health related services, items of a personal nature and any other ancillary costs which may be incurred by those travelling.
21. All components of the Prize must be taken together as a single trip as set out in these Conditions of Entry and as booked by the Promoter. Once booked, no changes to the booking are permitted.
22. All travel is subject to availability at all times and may be dependent on select seat class with airlines or specific room category availability with accommodation partner.
23. The winner and their travel companions must hold a current passport with a minimum of 6 months’ validity from the departure date. They also must be eligible to meet the criteria of the US Visa Waiver program and be eligible to travel to the US during the period stated above. If they cannot meet US visa requirements all elements of the prize may be invalidated and another winner drawn at the promoters discretion.
24 Any costs incurred in sourcing visas and/or passports are the responsibility of the prize participants.
25 The winner and their nominated travelling companions are responsible for compliance with any health, passport, visa and other requirements for entry into the United States of America, any country en-route and for return to Australia
26 The winner and their nominated travelling companions are responsible for making themselves familiar with, and following, the Australian Government's travel advisory and consular assistance advice available at www.smartraveller.gov.au.
27. The winner and their nominated travelling companions must have valid travel insurance for the duration of their travel. Documentary evidence of insurance for all persons travelling must be supplied to the Promoter prior to travel. Should the winner and their travelling companion fail to take out travel insurance, the Promoter will require them to sign a waiver and provide this to the Promoter before travel. The Promoter may withhold any part(s) of the Prize at its absolute discretion until all documentation required by it has been received.
28 Prizes cannot be exchanged for other travel, flights or accommodation at other destinations.
29. The Prize winner and nominated travelling companion participating in the Prize are responsible for compliance with all applicable Third Party Terms and bear all risks associated with failure to comply with any of them. They will be required to maintain an acceptable standard of behaviour while a participant in the Prize. The promoter may, at its sole discretion, exclude the winner/companion from all or any part of the prize if, in its reasonable opinion, the winner/companion are not maintaining an acceptable standard of behaviour.
The Promoter assumes no liability (and will provide no compensation) to the Prize winner and/or nominated travelling companions who, as a result of any failure to comply with any Third Party Terms:

31. The Promoter reserves the right to verify the validity of entries (including an entrant’s identity, age and place of residence) and to disqualify any eligible entrant where the Promoter believes that the entry or the entry process has been tampered with or where any entry has been submitted not in accordance with the Terms and Conditions. The winner must be able to produce valid ID to prove they are the rightful winner.
32. The Promoter accepts no responsibility for any lost, late, misdirected claims or correspondence due to incorrect entrant information.
28. The Promoter accepts no responsibility for any tax liabilities that may arise from winning or receiving the benefit of a Prize.
33. The Promoter collects entrants' personal information in order to conduct the promotion. If the information requested is not provided, the entrant may not be able to participate in the promotion. All personal information collected will be dealt with in accordance with Australian privacy laws and Chemist Warehouse privacy policy, which can be viewed at www.chemistwarhouse.com.au. The Promoter and Chemist Warehouse will not disclose this information to anyone other than contractors who provide services to the Promoter for the purposes of conducting this promotion unless compelled or permitted by law. The contact details of the winning entry may be passed onto a third party for prize notification and fulfilment.
34. If the prize or any part of it is unavailable, the Promoter, in its absolute discretion, reserves the right to substitute the prize with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
35. The Promoter reserve the right, at its sole discretion and without notice, to cancel, modify or suspend these terms and/or this promotion in whole or in part for any reason, including, but not limited to in the event of fraud, technical or other difficulties or if the integrity of the Promotion is compromised, subject to any written directions from the various lottery departments and without liability to the participant. 36. The prize (including any unused portion of the prize) cannot be assigned, transferred, redeemed for cash, or substituted except by the Promoter who may at their sole discretion, subject to the relevant state authorities, substitute any prize with one of comparable value if the advertised prize is or becomes unavailable for any reason. The Promoter will not replace any lost or stolen prizes, or take responsibility for any broken products in the delivery of the product or after it has been delivered. It is not the responsibility of the Promoter to insure any products.
37. The prize cannot be sold, scalped, auctioned, raffled, pledged or promoted as an incentive or reward by any third party as an inducement for any person or other entity to enter into any commercial or other arrangements with that third party. If a Prize is obtained through any of those methods, it will not be honored.
38. Entrants consent to the Promoter and Chemist Warehouse using the entrant’s name, likeness, image and/or voice in the event that they are a winner (Inc. photograph, film, and/or recording of the same) in any media for an unlimited time without notice or remuneration for the purpose of promoting this competition.
39. To the extent permitted by law, the Promoter (including its officers, employees and agents) and its associated agencies and companies will not be liable for any loss (including, without limitation, direct, indirect, special or consequential loss, or loss of profits), expense, damage, personal injury or death which is suffered or sustained (whether or not arising from any person's negligence) in connection with this promotion or accepting or using any prize.
