General
Information published by the Promoter, as defined below, on how to enter and prize form part of the Terms and Conditions of Entry (?Terms and Conditions?). Entry into this competition deems acceptance of these Terms and Conditions.
To the extent of any inconsistency between these Terms and Conditions and any other reference to this competition, these Terms and Conditions prevail.
Who can enter?Subject to clause 4, entry is open to all residents of Australia over the age of 18, as of the date of entry who have fulfilled the requirements set out below.
Employees, directors, managers and contractors and their immediate families, of the Promoter and Promoter?s franchisees and retailers, suppliers and associated agencies and companies are not eligible to enter this competition. Immediate family means any of the following: spouse, ex-spouse, defacto spouse, child or step child (whether natural or by adoption), parent, step parent, grandparent, step grandparent, uncle, aunt, niece, nephew, brother, sister, step brother, step sister or first cousin. How to enter
The competition may be entered as follows during the Promotional Period (defined below):
By making a reservation for a stay that commences during the Promotional Period (defined below) at one of the Promoter?s franchised Econo Lodge?, Comfort?, Quality?, Clarion? or Ascend Hotel Collection? properties in Australia (each a ?Choice Hotels? Location?) via one of the below methods.
Booking through the Promoter?s website (www.choicehotels.com.au); or
Booking through the Promoter?s contact centre by calling 13 24 00 or 1800 116 004

Entrants who are not existing members of the Promoter?s loyalty programme, Choice Privileges? may enter the competition during the Promotional Period (defined below) by:
Signing up to become a Choice Privileges member by:
visiting the Promoter?s website www.choicehotels.com.au;
calling the Choice Privileges team on 13 2400 or 1800 806 644

5.3.3 joining Choice Privileges during a stay at any Choice Hotels Location at the property reception.
In the event that a confirmed reservation is cancelled or the stay is not consumed, then the entry into the competition will be deemed void.
Entries must include all requested contact details to be eligible to win. Entrants may only enter their own name. Inaudible, incomprehensible, illegible, inappropriate or incomplete entries will be deemed invalid.
In the event that a reservation is placed on behalf of another person, the entrant into the competition will be the person whose name appears on the reservation confirmation.
Number of Entries permitted
Entrants will receive one (1) separate entry for every confirmed reservation which results in a consumed stay at a Choice Hotels Location during the Promotional Period.
Entrants who enter by joining the Choice Privileges loyalty programme as outlined in clause 5.2, will receive one (1) entry into the competition.
Prize on offer
There is one prize available to be won.
Total prize value is up to the value of $AU 25,970 RRP as at 06/10/2015 (inclusive of GST).

* The winner will be able to choose between a sedan or hatch and the colour of their car prize (from the list above) when contacted by the Promoter to notify them they are the winner. In the event that the chosen colour is not available or out of stock for a period of time, the winner will be given the option to choose an alternative colour. In the event that Preston Motors does not have available the colour as requested by the Competition Winner, Preston Motors has the right to allocate the colour of the prize at its sole discretion, subject to state and territory legislation. The prize excludes all optional extras but includes all mandatory items.
The prize is not transferable to another person.
The Promoter takes no responsibility for petrol, comprehensive insurance, health, transport, body, paint or mechanical damage, or any other costs or damages, from date of pick-up.
The winner will be required to pick up the car from a local Choice hotel (organised by the Promotor). In the event there is no Choice hotel within a reasonable distance from the winner?s home address, the car will be available from a local car dealership (organised by the Promotor).
The winner will be required to have photos taken, at the pick-up location (either at a local Choice hotel or a car dealership). Choice Hotels may use these photos in media and for any other use at their discretion.
The winner will be responsible for any expenses incurred in getting to a local Choice hotel or car dealer and for collecting the vehicle on a day to be negotiated between the winner and Choice Hotels (must be within 28 days of the draw).
The prize value includes on-road costs (stamp duty, registration and compulsory third-party insurance) In WA, winners will be responsible for arranging and paying for an immobiliser to be fitted, as required by WA Road Traffic regulations.
To be eligible to claim the car, the winner must be capable of obtaining motor vehicle registration of the Vehicle in his or her name in accordance with the applicable legislation in the State or Territory in which the winner resides. If the winner is, through any legal incapacity or otherwise, unable to register the Vehicle in his or her name, then he/she may transfer the Vehicle to another person with legal capacity for the purpose of registering the Vehicle in the State or Territory in which the winner resides, notwithstanding any other provision of these Terms and Conditions.
Prize Open, Close, Draw and Publish dates
The competition commences 019/11/15 at 00:01 AEDT and ends 31/01/2016 at 23:59 AEDT (the Promotional Period).
The prize winner will be the first entry drawn at the premises of Permitz Group Pty Ltd 39 Greenhaven Drive, Umia Beach NSW at 11:00 AEDT on 05/02/2016.
The Promoter will ensure that all valid entries have an equal chance of winning a prize.
The winner will be notified by phone and mail within two (2) business days of the draw and their names published on the Promoter?s website (www.choicehotels.com.au) from 05/02/2016 for 28 days. The winner will also be published in the Advertiser newspaper on 20/02/2016.
The Promoter may conduct such further draws on 05/05/2016 at the same time and place (11:00 AEDT, Permitz Group Pty Ltd 39 Greenhaven Drive, Umina Beach NSW) and in the same manner as the original draw in order to distribute any unclaimed prize if unclaimed by this date, subject to State and Territory legislation.
Winners of any further draws will be notified by phone and mail within two (2) business days of the draw and their names published on the Promoter?s website (www.choicehotels.com.au) from 05/05/2016 for 28 days.
Further Terms and Conditions
Any entrant found to have used a third party (including online competition entry site) to enter on their behalf will have all entries invalidated and any claim they have to any prize will be invalidated. If such an entrant is awarded a prize and then found to have breached this clause, the entrant must immediately return any awarded prize to the Promoter. The Promoter has sole discretion to determine if this clause has been breached by any entrant. The Promoter reserves the right to request whatever documentation it deems necessary to confirm if the entrant has breached this clause. An entrant must provide any requested documentation to the Promoter upon request.
If the prize is unavailable, for whatever reason, then the Promoter reserves the right to substitute the prize for a prize of equal or greater value, subject to State and Territory legislation. It is a condition of accepting a prize that the winner must comply with all the conditions of use of the prize and prize supplier?s requirements. Each prize must be taken as stated and no compensation will be payable if a winner is unable to use the prize as stated.
The Promoter strongly recommends that a current residential street address be provided when requested for ease of correspondence and coordinating of prize pick-up.
The Promoter reserves the right to request winners to sign a winner?s deed of release or any other relevant forms or agreements that the Promoter deems necessary, to provide proof of identity, proof of age, proof of residency, at the nominated prize delivery address and/or proof of entry validity (including phone bill) in order to claim a prize. Proof of identification, residency, age and entry considered suitable for verification is at the discretion of the Promoter. In the event that a winner cannot provide suitable proof, the winner will forfeit the prize in whole and no substitute will be offered.
The Promoter reserves the right to conduct a redraw in the event that an entrant, claiming to be a winner, is unable to satisfy these Terms and Conditions or has breached these Terms and Conditions.
The Promoter?s decision in relation to any aspect of the competition is final and binding on each person who enters, subject to State and Territory legislation. No correspondence will be entered into. No responsibility is accepted for late, lost or misdirected entries. Prize is subject to availability, and is not redeemable for cash.
Copyright, Statutory Guarantees, Waiver and liability
In participating in the prize, the winner agrees to participate and co-operate as required in all editorial activities relating to the competition, including but not limited to being interviewed and photographed. The winners (and their companions) agree to grant the Promoter a perpetual, irrevocable and exclusive licence to use such footage and photographs in all media worldwide, including online social networking sites, and the winners (and their companions) will not be entitled to any fee for such use.
The Promoter (subject to State and Territory Legislation) reserves the right to amend, cancel or suspend this competition if an event beyond the control of the Promoter corrupts or affects the administration security, fairness, integrity or proper conduct of this competition. The Promoter will disqualify any individual who has tampered with the entry process or any other aspect of this competition. In particular, computer generation and use ?scripting? is not permitted and will not be accepted.
Any cost associated with entering the competition is the entrant's responsibility and may be dependent on the Internet service provider used.
Nothing in these Terms and Conditions limit, exclude or modify or purport to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act 2010 (Cth) or any other implied terms, conditions or warranties under other legislation (?Non-Excludable Guarantees?). Except for any liability that cannot by law be excluded, including liability under the Non-Excludable Guarantees, the Promoter (including its officers, employees and agents) excludes all liability (including in negligence) for any personal injury or death; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the competition and promotion.
Except for any liability that cannot by law be excluded, including liability under the Non-Excludable Guarantees, the Promoter (including its officers, employees and agents) is not responsible for and excludes all liability (including in negligence) for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter's control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after its receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use of a prize by any person. The Promoter (including its officers, employees and agents) excludes all liability for any loss (including, without limitation, indirect, special or consequential loss or loss of profits or opportunity), expense, damage, personal injury or death which is suffered or sustained (whether or not arising from any person?s negligence) in connection with this competition including taking or using a prize, except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum allowable by law), including the Non-Excludable Guarantees. Any change in value of a prize occurring between the publishing date and date the prize is claimed is not the responsibility of the Promoter. The Promoter collects personal information in order to conduct the competition and may disclose such information to third parties, including but not limited to agents, contractors, service providers, prize suppliers and to Australian regulatory authorities. Entry is conditional on this information being provided. By entering, entrants consent to the Promoter and any other third party nominated by the Promoter using the information for current and future promotional, marketing, publicity and research purposes, including sending messages or telephoning entrants.
