Entry
1. Entry into this competition (the ?Competition?) is open to all permanent residents of Australia aged 18 years and over with a valid physical address within Australia
2. Information on how to enter forms part of the terms of entry. Participation in this promotion is deemed acceptance of these Terms and Conditions.
3. Competition is run by Menulog Pty Ltd ABN 76 120 943 615 located in Suite 1, Level 9, 447 Kent Street, Sydney NSW 2000.
4. Menulog employees (or immediate family) are not eligible to enter.
5. Competition commences from 9.00 on 11th November 2015 and closes 23.59hrs on 13th December 2015 (the ?Competition Period?)
6. The Competition is a game of skill, and chance plays no part in determining the winners.
7. To enter the Competition and be eligible to win, entrants must submit a Prize Request by:
a. placing an order via the Menulog APP or Mobile Website www.menulog.com.au and
b. providing the required details via the competition entry form including the details of their Prize Request
8. All entries must include the entrant?s Prize Request, 25 word or less explanation and physical address to be eligible for entry. Mandatory details will be indicated on the entry form. It is the entrants? responsibility to inform Menulog if their email address changes during the Competition Period.
9. By entering the Competition, participants consent to receiving the Menulog newsletter to the e-mail address submitted in their entry. Entrants can unsubscribe to the newsletter at any time.
10. By entering the Competition, participants consent to receiving Menulog marketing collateral to the address submitted in their entry.
11. Participants receive one entry per order , there is no limit to the number of times they can enter.
Prizes
12. The total prize pool is valued at $25,000.
13. The total prize pool will be divided according to the value of the winning Prize Requests. Hence,the nature and number of Prizes will be subject to the value of winning Prize Requests. Prize Requests must have physical dimensions (including packaging) that fit within a standard takeaway box with dimensions of 110mm x 95mm x 70mm. No cash alternative will be offered for any physical prizes.
14. Prizes may be delivered in person. Prizes not delivered in person will be delivered by post. All Prizes will be sent by 25th December and Menulog is not liable for any issues associated with delivery including loss, delay or damage.
15. Menulog Pty Ltd is neither responsible nor liable for any change in the value of the Prizes occurring between publishing date and date the Prizes is claimed. All Prizes values are in Australian dollars.
16. All Prize winners are advised that tax implications may arise from their Prize winnings and they should seek independent financial advice prior to acceptance of their Prize.
17. No responsibility will be taken by the Promoter Menulog Pty Ltd for any changes in dates, times or cancellations or other arrangements that may prevent the Prize winners from winning the Prize.
Winners
18. Prize winners will be judged based on originality and creative merit. Judging will take place in three phases at Suite 1, Level 9, 447 Kent Street, Sydney, NSW, 2000:
a. Phase one (1) will be take place on 18th November, winners will be announced on 19th November.
b. Phase two (2) will take place on 30th November, winners will be announced on 1st December.
c. Phase three (3) will take place on 14 December, winners will be announced on 15 December.
19. Winners maybe notified by phone or e-mail and will be displayed on www.menulog.com.au for 28 days from date of judging.
20. Unless contacted by phone, winners will not be required to provide a response to notification. In the event that a Winner does not wish to receive their Prize, a redraw will take place on the 7th April 2016 at 3.00 p.m. at Suite 1, Level 9, 447 Kent Street, Sydney NSW 2000.
21. Redrawn winners will be announced on www.menulog.com.au and notified by e-mail by 18th December and will displayed on www.menulog.com.au for 28 days.
22. Unless otherwise stated, all timing references are based on Sydney, NSW Australia time.
General
23. Subject to relevant state authority approval, Menulog reserves the right, in its absolute discretion, at any time before the awarding of the Prizes to cancel the competition or to vary or cancel the award of the Prizes including, without limitation, circumstances where in the Promoter?s opinion (which it shall form in its absolute discretion):
a. Prize winners does not satisfy the Competition entry requirements; or
b. Menulog cannot conduct the Competition or award the Prizes for any reason beyond its control.
24. Subject to relevant state authority approval, in the event that Menulog cancels the Competition or varies or withdraws the Prizes it shall not:
a. Be liable to any person for any loss or damage (including loss or damage caused by any negligence) arising out of, or in connection with, such cancellation, variation or withdrawal;
b. Be required to conduct the Competition at any other time.
25. No responsibility will be accepted by Menulog for late, lost or misdirected entries and all entries are deemed to be received at the time of receipt of the entry into the Menulog?s database and NOT time of transmission by the entrant. Menulog accepts no responsibility for out-dated or incorrect contact details or contact details by which the entrant cannot be contacted during business hours on the relevant dates.
26. Menulog reserves the right to cancel the award of prize/s to, and/or to disqualify any individual who, as determined in the sole discretion of Menulog, has breached these terms and conditions or who has otherwise engaged in unlawful or improper conduct that is designed to jeopardise the fair conduct of the Competition.
27. A decision of Menulog in relation to the conduct of the Competition is binding and conclusive and no correspondence will be entered into.
28. Entrants enter the Competition at their sole risk. With the exception of liability which cannot be excluded by law, Menulog shall not be liable for any loss or damage which is suffered (including but not limited to indirect or consequential loss) or for personal injury suffered or sustained as a result of taking the Prizes or entering the Competition.
29. All entries become the property of Menulog and may be communicated to the public by Menulog or used for promotional purposes, subject to the Menulog?s privacy policy which is available at www.menulog.com.au. By entering the Competition, the Prize winner agrees to the use of their name, image, audio-visual recording and/or photograph/s, without compensation, and agrees that Menulog will own copyright in any such images, audio-visual recordings and photograph/s.
