TERMS & CONDITIONS:
1. Information on how to enter and the prize(s) form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions
2. You must retain your Best&Less register receipt(s) OR online purchase order as proof of purchase. Prizes will only be awarded to the drawn entrant if they produce qualifying receipt(s). Best&Less purchases MUST be made between the competition entry dates for each state.
3. Entry is only open to Australian residents. Employees (and their immediate families) of the Promoter, participating retail stores and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st.
4. Promotion commences at 12:01am AEDST on 07/01/2016 and ends at 11:59pm AEDST on 03/02/2016 (“Promotional Period”).
5. To be eligible to enter, individuals must enter during the Promotional Period, spend at least $50.00 on schoolwear in one (1) transaction at any Best&Less retail store nationally or online at bestandless.com.au (“Eligible Transaction”). Schoolwear includes all items on the website School Zone www.schoolzone.net.au, school accessories, compression activewear, kids' velcro and lace up canvas shoes, Rio netball, monkey bar and shortie underwear, girls' seamfree co-ordinates, school coloured socks, kids' sport socks, stockings, lunch boxes, drink bottles, back packs and stationery. 
6. To enter, individuals must go to bestandless.com.au/win-italy and input the requested details including their full name, email address, mobile phone number, purchase receipt number or online order number (from the Eligible Transaction) and an answer to the question “What is the worst that your children’s schoolwear will see ?” in 25 words or less during the Promotional Period.
7. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age, place of residence) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the promotion. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.
8. Incomplete or indecipherable entries will be deemed invalid.
9. Multiple entries permitted, subject to the following: (a) only one (1) entry permitted per Eligible Transaction; (b) each entry must be substantially unique; and (c) each entry must be submitted separately and in accordance with entry requirements. Multiple entries only accepted with multiple proof of purchase. Only one entry may be made for each proof of purchase of the noted product(s) range from Best&Less. In order to be entitled to win a prize, an Eligible Entrant whose entry is drawn MUST, if asked, hand over to the Promoter, within 7 days (at no additional cost to the Eligible Entrant), their original Best&Less register receipt(s) OR online order confirmation evidencing the $50 or more purchase of Best&Less schoolwear and accessories. An Eligible Entrant drawn in the Competition who cannot do so, forfeits all entitlement to any prizes and the next drawn Eligible Entrant in the Competition will be awarded the prize, subject to that Eligible Entrant meeting the requirements of this condition.
10. Entrants must retain their original purchase receipt/invoice as proof of purchase. Failure to produce the proof of purchase when requested may, in the absolute discretion of the Promoter, result in invalidation of an entrant’s entry and forfeiture of any right to a prize. Purchase receipt must clearly specify the place of purchase and that the purchase was made during the Promotional Period but prior to entry.
11. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
12. This is a game of skill and chance plays no part in determining the winners. Each entry will be individually judged based on literary and creative merit of the answer provided to the promotional question. The judging of entries will take place at Best&Less 657 – 673 Parramatta Rd, Leichhardt, NSW, 2040. The Promoter may judge additional reserve entries and record them in order of merit in case an invalid entry or ineligible entrant is judged. The winners of the promotion will be contacted and notified by mobile phone and/or email and their name will be published on the Best&Less Facebook, website & Instagram page/website.
13. The best one (1) valid entry as determined by the judges will win the following first prize. The first prize details are as follows:

14. The prize consist of a “Italian Dream” CostSaver Tour, operated by Trafalgar Tours (AUST) Pty Ltd  through Italy for eight (8) days, for four (4) people, valued at up to AU$6,700 ($1,675 per person), departing 18 September 2016. Prize includes: four (4) return economy airfares to Italy (with a Trafalgar Tours (AUST) Pty Ltd designated airline) from the winner’s nearest capital city international airport (as determined by the Promoter and Trafalgar Tours (AUST) Pty Ltd); seven  (7) nights accommodation at hotels; luxury coach transportation to selected venues; breakfast daily; access to the Trafalgar Tours (AUST) Pty Ltd Travel Directors during the holiday; access to local guides; and all associated taxes, flight and airline charges. Additional travel expenses, including but not limited to, passports, visas, vaccinations, spending money, additional meals, taxes (excluding airline and airport taxes), optional excursions, insurance, transport to and from departure point, additional transfers (if applicable), items of a personal nature, in-room charges and all other ancillary costs are not included. 15. The next best twenty (20) valid entries, as determined by the judges will each win one of 20 x $100 Best&Less gift vouchers.
16. The draw will take place week commencing Monday, 15th February 2016 at Best & Less 657 – 673 Parramatta Rd, Leichhardt, NSW, 2040. Winners will be contacted on or before 26th February 2016 - Subject to meeting the requirements in Conditions 1-6
17. The prize(s) must be taken prior or used by 30/06/2017, the date of expiry.
18. If any prize is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize with a prize to the equal value.
19. The prize winner is advised that tax implications may arise from their prize winnings and should seek independent financial advice prior to acceptance of the prize.
20. The Promoter shall not be liable for any entries that have been lost, stolen, forged, damaged or tampered with in any way.
21. Total prize pool value is up to seventeen thousand one hundred dollars ($17,100.00). Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash.
22. The Promoter’s decision is final and no correspondence will be entered into.
23. Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
24. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
25. Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used.
26. The Promoter shall not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) or for any personal injury suffered or sustained as a result of, or in connection with the prize except for any liability that cannot be excluded by law.
27. The prize is not transferable, exchangeable or redeemable for cash. In the event that for any reason whatsoever a winner does not take an element of the prize at the time stipulated by the Promoter then that element of the prize will be forfeited by the winner and cash will not be awarded in lieu of that element of the prize.
28. The Promoter accepts no responsibility of any variation in the prize value from time of printing.
29. As a condition of entering this promotion, each entrant licenses and grants the Promoter, its affiliates and sub-licensees a non-exclusive, royalty-free, perpetual, worldwide, irrevocable, and sub-licensable right to use, reproduce, modify, adapt, publish and display their entry for any purpose, including but not limited to future promotional, marketing or publicity purposes, in any media, without compensation, restriction on use, attribution or liability.
30. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
31. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use of a prize.
32. As a condition of accepting the major prize, the winner must sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.
33. The Promoter collects personal information ("PI") in order to conduct the promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this PI. The Promoter will also use and handle PI as set out in its Privacy Policy, which can be viewed at http://www.bestandless.com.au/en/privacypolicy In addition to any use that may be outlined in the Promoter’s Privacy Policy, the Promoter may, for an indefinite period, unless otherwise advised, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. The Privacy Policy also contains information about how entrants may opt out, access, update or correct their PI, how entrants may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with. All entries become the property of the Promoter. Unless otherwise indicated by the Promoter, the Promoter may disclose personal information to entities outside of Australia (for a list of the countries, see the Promoter’s Privacy Policy).
