1. By entering the “Heaven on Earth! WIN a Luxury Escape to the Maldives!” competition (the “Competition”), you are agreeing to the following terms and conditions.
2. Information on how to enter form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
3. Subject to clause 4, entry is open to all residents of Australia aged 18 years and older. Entrants must have a registered CASHREWARDS account.
4. Employees and their immediate families of CASHREWARDS Pty Ltd, Ansible Pty Ltd and their associated agencies and companies are not eligible to enter.
5. Competition commences on Monday 7 January 2019 at 00:01 AEDT and closes on Thursday 7 March 2019 at 23:59 AEDT (the “Competition Period”).
6. In order to enter, entrants must:
• Entrants must be a CASHREWARDS transacting member (joining is free)
• To receive 1 x entry to the draw, entrants must make 4 transactions of $50.00 or more through CASHREWARDS during the competition period
• Every additional transaction of $50.00 or more (after the first 4 qualifying transactions) counts as an additional entry.
For clarity, the transaction amount is the transaction amount appearing in the member’s account at the time of the draw, which may, or may not include GST, delivery and other fees as reported by the merchant.

9. Incomplete or indecipherable entries will be deemed invalid.
10. Multiple entries are permitted, in accordance with the entry conditions stipulated in clause 6.
11. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
12. There will be One (1) Major Prize Draw conducted for this Competition. The draw will take place at Ansible Pty Ltd, Level 1, 16 Anster Street, Adelaide SA 5000 on Tuesday 19 March 2019 at 10:00 AEDT. The Winner will be notified by phone within two (2) business days of the draw, and in writing via email. 14. In accepting the prize, the Winner agree to participate and co-operate as required in all editorial activities relating to the Competition, including but not limited to being interviewed, photographed and social media activity. The Winner grants the Promoter a licence to use any footage and photographs and the Winner will receive no fee if material is used.
15. The Prize cannot be transferred nor can the prize be redeemed for cash. The Winner should seek independent financial advice about any tax implications arising from the prize winning.
16. The Promoter’s decision is final and the Promoter will not enter into correspondence regarding the result.
17. It is a condition of accepting the prize that the Winner must comply with all the conditions of use of the prize and the prize supplier’s requirements.
18. The STA Travel Card voucher awarded to the Winner must be used in accordance with the terms and conditions applicable to the voucher as specified by STA. The voucher is valid for thirty six (36) months from date of issue and any remaining balance after this time will be forfeited. STA Travel Gift Cards are not transferable and cannot be exchanged for cash. STA Travel are unable to replace or reimburse the value of the card if lost or stolen. The voucher is to put towards the flights to Male, in the event that the Winner’s chosen flights exceed the value of the STA Travel Gift Card, the Winner is responsible for any additional charges. All additional charges must be paid in full before commencement of travel.
19. Luxury Escapes is not a Sponsor nor associated with this promotion.
20. The Winner and their travelling companion/s are responsible for all expenses not explicitly specified in the Prize (as per Clause 13) including but not limited to: spending money, meals and drinks, transfers, laundry, activities, incidentals, taxes (excluding any flight associated taxes included within the prize), energy surcharges, gratuities, services charges and all other ancillary costs. Travel insurance is not included (unless specified in the prize inclusions) but is highly recommended.
21. The Winner and their travelling companion/s are responsible for any travel from their residences to the departure point and must depart from the same capital city, at the same time.
22. Once flights are booked and confirmed, any changes and costs incurred are at the responsibility of the Winner and not the Promoter.
23. The Winner will be required to provide a credit card, or cash deposit, at check-in to the hotel, for all incidental charges.
24. The Winner may be accompanied by an additional guest subject to the following conditions. An additional guest (aged 12 and over) may stay for a surcharge of US$265 per night, sleeping on a rollaway bed with accommodation, Green Tax and breakfast only. Add dinners for USD100 per day and/or transfers for US$520. Payable directly to the resort. One child (aged 11 and under) may stay for a surcharge of US$135 per night, sleeping on a rollaway bed with accommodation, Green Tax and breakfast only. Add dinners for US$50 per day and/or transfers for US$430. Payable directly to the resort. One infant (aged under two) may stay free of charge and will count towards maximum room occupancy. A cot can be provided by the hotel free of charge. Transfers may be added for US$160, payable directly to the resort. Please note: Green Tax also applies to infants at a cost of US$6 per day. This must be paid to the hotel upon checkout. For safety reasons, Park Hyatt does not recommend that small children stay in Park Water Villas. If parents staying in a Park Water Villa wish to bring their children, they must sign a disclaimer, agreeing to take full responsibility for their children’s safety. All flights and additional charges for extra guests are at the responsibility of the Major Prize Winner.
25. The Promoter and their associated agencies and companies, make no representation as to the safety conditions or other issues that may exist at any destination. International travel advice can be obtained from various sources, including government, local consular offices and the web site of the Australian Department of Foreign Affairs and Trade, www.dfat.gov.au.
26. It is the responsibility of the Winner and their travelling companion/s to obtain all relevant passports (with at least 6 months validity from the date of return), ESTA forms, visas and vaccinations if required. Any costs associated with this are to be borne by the Prize Winner and their travelling companions. As it is the traveller’s personal responsibility to ensure that they have valid documentation etc. as specified above, which meet the requirements of immigration and other government authorities at every destination, any fines, consequences or expenditures incurred as a result of such documents not meeting the requirements of those authorities will be the sole responsibility of the Winner and their travelling companion/s.
27. The Winner and their travelling companion/s must confirm their booking by 31 August 2019. Travel is subject to availability at the time of booking and the Winner must have completed travel by 31 October 2019.The winner is responsible for booking their own flights and travel.
28. Dates of travel within holiday periods are subject to availability. Blackout dates will apply unless otherwise stated within these terms and conditions. Blackout dates include 15-28 April 2019 and could include any public holidays and school holidays at the departure or destination locations and any other dates as advised by the Promoter. In the event any travel includes 19 March – 14 April 2019 and 29-30 April 2018, a non-refundable surcharge per room, of $250USD per night, applies payable directly at time of booking and is the responsibility of the Winner.
29. In the event the prize is not claimed within three (3) months, an unclaimed prize draw will take place at Ansible Pty Ltd, Level 1, 16 Anster Street, Adelaide, South Australia 5000 on Wednesday 19 June 2019 at 11:00 AEST. The Winner of this draw be notified of their prize by phone and in writing. The Winner’s details will also be published at www.cashrewards.com.au/blog from Thursday 20 June 2019.
30. The Promoter and associated agencies, are not liable for any loss, damage, personal injury or death whatsoever (including, but not limited to, any direct, indirect or consequential loss) suffered or sustained in connection with this competition, the use of a prize or any act or omission (whether negligent or not) of the promoter, its associated agencies or any person associated with any of them, except to the extent that any liability cannot be excluded by law.
31. It is a condition of accepting the prize that the Winner may be required to sign a legal release in a form determined by the promoter in its absolute discretion.
32. In the case of the intervention of any outside act, agent or event which prevents or significantly hinders the Promoter’s ability to proceed with the competition on the dates and in the manner described in these terms and conditions, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, act of terrorism, the Promoter may in its absolute discretion cancel the competition and recommence it from the start on the same conditions.
33. The Promoter and their associated agencies and companies will take no responsibility for prizes damaged or lost in transit, or late, lost or misdirected mail.
34. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.

Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a Winner or entrant; or (f) use of a prize.

The Promoter and their associated agencies and companies will not be liable for any misadventure, accident, injury, loss (including but not limited to consequential loss) or claim that may occur; during any draw; whilst undertaking any travel won on or connected with their entry; or in the participation in any prize; as a consequence of late, lost or misdirected mail; in relation to failure of an entry to be received by the Promoter on account of technical problems or traffic congestion; arising from or related to any problem or technical malfunction of any computer equipment, software, internet connection, any injury or damage to entrant’s or any other person’s computer software related to or resulting from participation in this promotion.
37. The Promoter assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries, and reserves the right to take any action that may be available.
38. If for any reason this competition is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures or any other causes beyond the control of the Promoter which corrupt or affect the administration security, fairness, integrity or proper conduct of this competition, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, take any action that may be available, and to cancel, terminate, modify or suspend the competition.
