The Promotion ("Promotion") is open to legal residents of Australia and New Zealand only, who have reached 18 years of age as of the beginning of the Promotion period, and who are not an employee of or domiciled with an employee of the Promoter or its affiliated companies, their advertising and promotional agencies.
The Promotion period runs from Monday 6th June, 2016 at 9.00am AEST to Sunday 19th June, 2016 at 11.00pm AEST ("Promotion Closing Date").
The conditions for entry will vary depending on whether you apply online or in store. During the Promotion period:
In store entrants must make a purchase and opt into the competition by giving their contact details via a digital form at point of sale; and online entrants do not have to make a purchase, but are required to provide their contact details via an entry form at www.forevernew.com.au.
The Promotion is subject in all instances to compliance with applicable law.
All entries that are incomplete, illegible, damaged, contain an erroneous phone and/or email address or do not conform to or satisfy any condition of the terms and conditions may be disqualified by the Promoter.
Following the conclusion of the Promotion, Forever New will select one entry as the winner via random allocation software. The draw will take place at the offices of Forever New Building 8, Level 4, 576 Swan Street, Richmond, Victoria, Australia, on Tuesday 21st June, 2016 at 10.00am. The winner will be notified by email (to the email address registered with the Promoter) on the same date. The winner must claim their prize by responding via email by 10.00am Thursday 23rd June, 2016. The winner will be published on the Forever New website page on Monday 27th June, 2016.
The Promoter’s decision is final and no correspondence will be entered into.
In the event of the prize being unclaimed by 10.00am Monday 27th June, 2016, further draw/s will take place to determine replacement winner. The draw will take place at the offices of Forever New, Building 8, Level 4, 576 Swan Street, Richmond, Victoria, on Tuesday 28thJune, 2016 at 10.00am AEST. The replacement winner will be notified by email on the same day. The winner must claim their prize by responding via email by Thursday 30th June, 2016. The winner will be published on the Forever New website page on Thursday 30th June, 2016.
The single prize consists of a voucher for the winner and a friend to stay at the Byron at Byron Resort and Spa in NSW for 2-night stay over a weekend to the value of $1105 (excluding long weekends, school holidays, public holidays, or major event periods). Plus, economy flights from their nearest capital city (in Australia or New Zealand) to the value of $1800, transfers to the value of $500, a $1000 Forever New Autumn Wardrobe Gift Card, and $500 spending money. Travel insurance is also included. Both participants must be 18 years or over.
The prize must be accepted as awarded and are not transferable or otherwise redeemable for cash. The prize is valid for 2 people only. The accommodation voucher must be presented on arrival. The odds of winning the prize depend on the number of eligible entries received.
To claim the prize all New Zealand entrants must have a valid passport.
This offer is subject to availability at time of booking and is valid until 29th April 2017.
Total prize pool value is up to $4,905 AUD.
This Promotion may be promoted through third party websites, like Facebook. Entrants must at all times comply with the terms of service for those third party websites when using them to participate in this Promotion. This Promotion is in no way sponsored, endorsed or administered by, or associated with, those third party websites.
Members of the Promoter/or those who provide incorrect or fraudulent information are ineligible to participate in the promotion. The Promoter reserves the right to request, appropriate photo identification order to confirm the members’ eligibility to enter and claim a prize, before issuing a prize and may deem the entry invalid.
The Promoter is not liable for any problems or technical failure including any internet, telecommunication or website technical problems or any damage to computers in relation to this Promotion. If for any reason this Promotion is not capable of running as planned due to any technical problems the Promoter reserves the right in its sole discretion to cancel, postpone, or amend this Promotion.
The Promoter as well as its associated agencies and companies are not liable for any loss (including, without limitation, indirect or consequential loss), damage, personal injury or death which is suffered or sustained (including but not limited to that arising from any person's negligence) in connection with the prize or use of the prize. This excludes any liability that cannot be excluded by law (in which case that liability is limited to the minimum allowable by law).
If any of the provisions of these terms and conditions are held to be invalid or unenforceable in whole or in part that part shall be severed from the remainder of the provisions and the validity of the other provisions and the remainder of the provision in question shall not be affected.
The Promoter collects entrants' personal information in order to conduct the promotion. If the information requested is not provided, the entrant may not participate in the Promotion. By entering the Promotion, unless otherwise advised, each entrant also agrees that the Promoter may use this information and approved images (photograph and/or film recording), or disclose it to other organizations that may use it, in any media for future promotional, marketing and publicity purposes without any further reference, payment or other compensation to the entrant. Forever New is committed to compliance with the Australian Privacy Principles (APPs). By subscribing to our marketing emails and entering this Promotion you consent to the Promotor collecting your personal information in accordance with our Privacy Policy
These terms and conditions shall be governed by the laws of Victoria and any dispute shall be subject to the exclusive jurisdiction of the Victoria courts.
