TERMS AND CONDITIONS
PARTICIPATION
1. Information on how to enter this “FILL UP & WIN 2018 SHELL DEALER” PROMOTION (Promotion) and the prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of, and agreement to be bound by, these Terms and Conditions.
2. The promoter is Viva Energy Australia Pty Ltd (ABN 46 004 610 459), a company incorporated under the laws of the State of Victoria, Australia with its registered office at 16/720 Bourke Street, Docklands, Victoria, Australia, 3008 (Promoter). Phone number 03 8823 4444.
3. Entry is only open to Australian residents aged 18 years or over who:
• register and are accepted as eligible to participate in the Promotion by the Promoter; and
• where the prize involves any air tickets, or attendance of any event, have available and nominate up an adult who is agreeable to executing the necessary waiver and release documentation to attend motor race sport events to be prize takers (if any carer or special requirements are necessary, those adults are required to facilitate that themselves), (“Eligible Entrant”).
4. Employees (and their immediate families) of the Promoter, participating Shell service stations and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
5. The Promoter, in its absolute discretion, will determine who is eligible to register and participate in the Promotion
6. The Promotion commences at 12.00am AEST 01/07/2018 and closes at 11:59pm AEST on 31/07/2018 (“Promotional Period”).
REGISTRATION
7. To participate in the promotion, the entrant must be an Eligible Entrant and must during the Promotional Period:
• Purchase thirty (30) litres or more of Shell Premium Unleaded 98 in a single transaction at a participating Shell service station (Transaction). A participating Shell service station is any Shell service station in Australia that: (a) displays promotional material featuring this Promotion; and (b) sells Shell Premium Unleaded 98 petrol;
• Visit https://www.shell.com.au and follow the prompts to the promotion entry page;
• Input the requested details including full name, valid email address, phone number, State/Territory of residence, the full purchase receipt number, the site number (found on the purchase receipt), the product purchased, and the number of litres purchased;
• Agree to the Terms and Conditions; and
• Submit the fully completed online entry form.
8. Entry to this Promotion is not available for Shell Card, Fleet Card, Motorcharge or Motorpass purchases. It is the Eligible Entrant’s responsibility to request a purchase receipt if one is not provided at the time of purchase.
9. Entries are deemed to be received at the time of receipt into the promotion database by the Promoter and NOT at the time of transmission by the Eligible Entrant.
10. Once registered and accepted to participate, an Eligible Entrant will be deemed an Entrant.
11. The Promoter reserves the right, at any time, to verify the validity of entries and Eligible Entrants (including an Eligible Entrant’s identity, age and place of residence and proof of purchase) and reserves the right in its sole discretion, to disqualify any Eligible Entrant who the Promoter has reason to believe has breached these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the promotion. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter's legal rights, including its right to recover damages, or other compensation from such an offender are reserved.
12. Incomplete or indecipherable entries will be deemed invalid.
13. Multiple entries are permitted, subject to the following: (a) only one entry permitted per Transaction regardless of the amount of Shell Premium Unleaded 98 fuel purchased in that Transaction in excess of 30 litres; and (b) each entry must be submitted separately and in accordance with entry requirements.
14. Eligible Entrants must retain a copy of their participating Shell service station purchase receipt evidencing a Transaction. Failure to produce the proof of purchase when requested may, in the absolute discretion of the Promoter, result in invalidation of an Eligible Entrant’s entry and forfeiture of any right to a prize. The Promoter is not liable for late, lost, incomplete, incorrectly submitted, delayed, illegible, corrupted or misdirected entries, claims or correspondence due to error, omission, tampering, deletion, theft, communications failure, or otherwise. The Promoter has no control over communications networks and is not liable for any problems associated with them due to traffic congestion, technical malfunction or otherwise. The Promoter is not liable for any consequences of user error including (without limitation) costs incurred.
PRIZE DRAWS
15. Subject to clause 13, an Entrant will receive one (1) entry into the relevant prize draws for each valid Transaction.
16. During the Promotional Period, there will be one (1) draw conducted each day for the eligible entries received on that day, for a total of thirty-one (31) draws (“Daily Draws”).
17. There will be one (1) draw conducted for all entries received during the Promotional Period (“Major Draw”).
18. Entries into each Daily Draw will open at 12:00am AEST and close at 11:59pm AEST each day. Entries in each Daily Draw will NOT be entered into any subsequent day’s Daily Draw(s), however, all entries (including the Daily Draw winners) will be entered into the Major Draw.
19. All draws will take place at Anisimoff Legal, Suite 5, Erina Plaza, 210 Central Coast Highway, Erina NSW 2250. Each Daily Draw will take place at 4:00pm AEST on the business day after entries close for that Daily Draw, with the first Daily Draw taking place at 4.00pm AEST on 02/07/2018 and the last Daily Draw taking place at 4.00pm AEST on 01/08/2018. The Major Draw will take place at 12:00pm (noon) on 02/08/2018. For the removal of doubt, no draws will be conducted during the weekend or on a public holiday in NSW.
20. The Promoter may draw additional reserve entries and record them in order in case an invalid entry or ineligible entrant is drawn. All winners will be notified in writing by email and telephone within two (2) business days of the relevant draw. Winners will have their names published online at https://www.shell.com.au from 03/08/2018 and remaining for a period of 28 days.
21. The Promoter’s decision is final and no correspondence will be entered into.
22. The first valid entry drawn in each Daily Draw will each win a Ferrari Merchandise Pack which includes 1 x umbrella, 1 x cap, 1 x water bottle and 1 x key ring valued at $150.00.
23. The first valid entry drawn in the Major Draw will win one trip for two (2) adults to the 2018 Singapore Grand Prix valued at up to AU$9,250 each depending on point of departure. Prize includes:
• Two (2) x return economy airfares from winner's nearest capital city to Singapore;
• Four (4) nights twin share minimum 4-star accommodation including breakfast daily;
• Entry to the Singapore Grand Prix for two (2) people including 3-day entry to the exclusive Shell Suite;
• AU$2000 spending money for the winner only; and
• Return airport to hotel transfers for two (2) people at pick up and departure.
MAJOR DRAW WINNERS
24. The Entrants that win the Major Draw, must notify the Promoter of those individuals who will be taking part in the prize, in the time specified by the Promoter (each a Prize Taker). Each Prize Taker must be aged 18 years or over. Each winner and Prize Taker must agree to, and sign such documentation, as determined by the Promoter, including a legal release and indemnity, before they are able to attend the prize. The Promoter accepts no responsibility for the failure of any Prize Taker to sign and return such documentation in the time required by the Promoter.
25. Each Prize Taker must take the prize to coincide with the tickets provided for the Singapore Grand Prix event on 14/09/2018 and as specified by the Promoter. All travel is subject to availability, at all times, and may be dependent on additional conditions, including but not limited to, airline and accommodation partners. If, for any reason, a Prize Taker does not take an element of the prize during the stated period, and on the conditions stipulated by the Promoter or any third parties, then that element of the prize will be forfeited and cash will not be awarded in lieu of that element of the prize.
26. Additional spending money, additional meals, taxes (excluding airline and airport taxes), insurance, passports, visas, vaccinations, transport to and from departure point, additional transfers, items of a personal nature, in-room charges and all other ancillary costs are not included.
27. The Prize must be taken to coincide with the 2018 Singapore Grand Prix event with flights departing on 13/09/2018 and is subject to booking and flight availability. Winners and their Prize Taker are responsible for ensuring that they have valid passports, and any requisite visas, vaccinations and travel documentation. Winners and their Prize Taker must depart from and return to the same departure point and travel together. Itinerary to be determined by the Promoter in its absolute discretion. Frequent flyer points will not form part of the prize. Prize is subject to the standard terms and conditions of individual prize and service providers including booking conditions, fare rules, including any amendment fees, baggage restrictions, conditions of carriage, codes of conduct and any standard restrictions or participation conditions in addition to those outlined herein. Each Prize Taker must become acquainted with any such additional terms and conditions before taking the prize. To the extent permitted by law, the Promoter does not accept any responsibility, and is not liable for, any additional conditions imposed by third party service providers on the taking of the prize, or for the breach of those conditions by any person and the consequences, which may follow. Winners may be required to present their credit card at time of accommodation check in.
28. Unless expressly stated in these Terms and Conditions all other expenses become the responsibility of the Prize Taker.
29. The Promoter recommends that each Prize Taker obtain travel insurance.
30. To the extent permitted by law, the Promoter is not responsible for and cannot be held liable for any element of the prize which is cancelled or delayed, or where the location is changed, or any other occurrence, which is out of the reasonable control of the Promoter
GENERAL
31. In the event of war, terrorism, state of emergency or disaster, the Promoter, to the extent permitted by law, reserves the right to cancel, terminate, modify or suspend the promotion or suspend or modify a prize, subject to any written directions from a relevant regulatory authority.
32. Each winning Entrant and Prize Taker must, in accordance with the directions, claim their prize in the time notified by the Promoter. The Promoter accepts no responsibility should a winner or Prize Taker not claim their prize in the required time, and will not be held responsible in this regard.
33. Subject to the unclaimed prize draw clause, if for any reason a winner does not redeem a prize (or an element of the prize) at/by the time stipulated by the Promoter, then the prize (or that element of the prize) will be forfeited.
34. If any prize (or part of any prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
35. The 2018 Singapore Grand Prix ticket prizes are subject to the event venue and ticket terms and conditions, including any applicable age restriction. The Promoter and event organisers hereby expressly reserve the right to eject any winner (and/or his/her companion/s) for any inappropriate behaviour, including but not limited to intoxication, whilst participating in any element of the prize.
36. Total prize pool value is up to AUD$23,150.
37. Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash.
38. A draw for any unclaimed Daily Draw prizes will take place on 02/11/2018 at the same time and place as the original draws, subject to any directions from a regulatory authority. Winners (if any) will be notified in writing by email and telephone within two (2) business days of the draw and their names will be published online at https://www.shell.com.au/motorists/promotions-and-offers.html from 08/11/2018 and remaining for a period of 28 days.
39. If the Major Prize of a 2018 Singapore Grand Prix trip remains unclaimed by 12:00pm (noon) AEST on 16/08/2018 an unclaimed prize draw will take place on 16/08/2018 at 4pm AEST at the same place as the original draw, subject to any directions by a regulatory authority. The first valid entry drawn and successfully contacted by phone and in writing will win the prize. If the unclaimed prize draw winner cannot be contacted within 24 hours, the Promoter will contact the next drawn winner until a prize winner is determined. Results will be published at https://www.shell.com.au/motorists/promotions-and-offers.html from 27/08/2018.
40. Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
41. If this Promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the Promotion, as appropriate.
42. Any cost associated with accessing the promotional website is the Entrant’s responsibility and is dependent on the Internet service provider used.
43. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
44. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) if the 2018 Singapore Grand Prix event is delayed, postponed or cancelled for any reason beyond the reasonable control of the Promoter; (f) any tax liability incurred by a winner or entrant; or (g) taking of a prize or attendance at the prize event.
45. The Promoter collects personal information ("PI") in order to conduct the promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on individuals providing this PI. The Promoter will collect, store, use and disclose PI as set out in its Privacy Policy, which can be viewed at http://www.vivaenergy.com.au/contact-us/privacy-policy. In addition to any use that may be outlined in the Promoter’s Privacy Policy, the Promoter may, unless otherwise advised, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. The Privacy Policy also contains information about how entrants may opt out, access, update or correct their PI, how entrants may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with. All entries become the property of the Promoter. The Promoter will not disclose PI overseas, see Privacy Policy for more details.
