1. GIVEAWAY PERIOD. The Giveaway begins at 7:00:01 AM EST on August 4, 2022 and
ends at 11:59:59 PM EST on August 12, 2022. Administrator will be the official timekeeper
for the Giveaway. Any entries or submissions after the time and date specified in the
preceding sentence shall be automatically disqualified.
2. HOW TO ENTER GIVEAWAY. To enter the Giveaway, go to
https://fanhub.williamsf1.com/ and provide your name and a valid email address via which
you can be contacted.
3. GIVEAWAY WINNER SELECTION / PRIZE. Each winner of the Giveaway
(“Giveaway Winner”) will be chosen at random. Each Giveaway Winner will win one (1)
Razer Enki Pro – Williams Esports Edition Gaming Chair (the “Prize”). The estimated retail
value of the Prize is $1,299.00 USD. Giveaway Winners will be awarded the Prize in
Sponsor’s and Administrator’s sole discretion. Each Giveaway Winner will be contacted via
email to inform them that they have won and to provide them with information on how they
can receive their Prize. In order to claim their Prize, a Giveaway Winner must reply to such
email within three (3) working days. Giveaway Winners are solely responsible for ensuring
any contact details they share with the Sponsor and/or Administrator are accurate and contain
all of the information needed to receive the Prize. If the Prize is unable to be delivered to the
Giveaway Winner for reasons outside the Sponsor’s or Administrator’s control, the
Giveaway Winner forfeits the Prize. LIMIT ONE PRIZE PER PARTICIPANT. The
Giveaway Winners may be announced via Sponsor’s social media pages. The Administrator
will send the name and county of the Giveaway Winners to anyone who writes within one (1)
month after the end of the Giveaway requesting details of the Giveaway Winner and who
encloses a self-addressed envelope to the Administrator’s address. If a Giveaway Winner
wishes to object to any or all of their name, county and winning entry being published or
made available, please contact the Administrator at aidan.lyons@doriltoncapital.com. In such
circumstances, the Sponsor and/or the Administrator may still be required to provide the
information and winning entry to the Advertising Standards Authority in the UK or any other
applicable authority on request.
Participant Terms and Conditions
PLEASE READ THESE PARTICIPANT TERMS AND CONDITIONS (THE “TERMS &
CONDITIONS”) CAREFULLY. THE TERMS AND CONDITIONS CONSTITUTE A LEGAL
AGREEMENT BETWEEN YOU (“YOU” OR “PARTICIPANT”), WILLIAMS GRAND PRIX
ENGINEERING LIMITED (“SPONSOR”) AND WILLIAMS IP HOLDINGS LLC
(“ADMINISTRATOR”), AND STATE THE TERMS AND CONDITIONS THAT GOVERN
YOUR PARTICIPATION IN THIS GIVEAWAY (“GIVEAWAY”). BY PARTICIPATING IN THE
GIVEAWAY, YOU AGREE TO ABIDE BY THESE TERMS & CONDITIONS.
NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO PARTICIPATE. A
PURCHASE WILL NOT IMPROVE A PARTICIPANT’S CHANCES OF WINNING. VOID
WHERE PROHIBITED BY LAW.
A. SPONSOR AND ADMINISTRATOR. The Giveaway is sponsored by Williams Grand Prix
Engineering Limited, Grove, Wantage, Oxon OX12 0DQ. The Giveaway is administered by
Williams IP Holdings LLC, Hamilton, Bermuda.
B. ELIGIBILITY. To be eligible for the Giveaway, You must be sixteen (16) years or older. Any
Participant under eighteen (18) years old must have a parent or legal guardian enter this
Giveaway and accept any Prize awarded on the minor’s behalf. All other persons are ineligible.
Sponsor and Administrator reserve the right to verify the eligibility of any Participant at any
time. Officers, directors, and employees of Sponsor, Administrator, and their respective
promotional partners and parents, affiliates and subsidiaries, participating advertising and
promotion agencies (and members of their immediate family and/or those living in the same
household of each such employee) are also not eligible to enter the Giveaway. By entering the
Giveaway you are confirming you are eligible to do so and eligible to claim any prize you may
win. Winning a Prize is contingent upon fulfilling all requirements set forth herein. The
Giveaway is void where prohibited by law. Participation constitutes Your full and unconditional
agreement to these Terms and Conditions and Sponsor's and Administrator’s decisions, which
are final and binding in all matters related to the Giveaway. The Giveaway is subject to all
federal, provincial, territorial and local laws and regulations.
C. WINNER SELECTION / PRIZE. Giveaway Winner is responsible for all taxes and all other
expense not included in the Prize. All expenses not specified herein are the responsibility of the
Giveaway Winners. No transfer, assignment, or substitution of the Prize is permitted, except
Sponsor or Administrator reserve the right to substitute the Prize (or prize component) for an
item of equal or greater value at their sole discretion. Prizes are not redeemable for cash. All
details of any Prize not specified herein shall be determined solely by Sponsor and
Administrator. By accepting a Prize, each Giveaway Winner acknowledges compliance with
these Terms and Conditions.
D. CONSENT. By entering into the Giveaway, You consent to Sponsor, Administrator’s and their
affiliates use of your name, portrait, picture, voice, likeness, opinions, biographical information,
hometown and statements relating to the Giveaway and their ownership of all right, title and
interest in and to your entry or submission, without further compensation, notification or
permission in any publicity, promotion or advertising carried out by Sponsor, Administrator, their
affiliates or their designees in any and all media now known or hereafter developed without
territorial or time limitation, except where prohibited by law.
E. OWNERSHIPAND INTELLECTUAL PROPERTY RIGHTS. All Giveaway entries and
any accompanying material submitted to the Sponsor and/or Administrator will become the
property of the Sponsor on receipt and will not be returned. By submitting your Giveaway entry
and any accompanying material, you agree to: (a) assign to the Sponsor all your intellectual
property rights with full title guarantee; and (b) waive all moral rights; in and to your Giveaway
entry and otherwise arising in connection with your entry to which you may now or at any time
in the future be entitled under any applicable laws in force anywhere in the world. You agree that
the Sponsor and/or the Administrator may, but is not required to, make your entry available on
the Williams website at www.williamsf1.com and any other media, whether now known or
invented in the future, in connection with any publicity of the Giveaway, the Sponsor, the
Williams Racing Formula 1 Team and/or otherwise. You agree to grant the Sponsor a
non-exclusive, worldwide, irrevocable licence, for the full period of any intellectual property
rights in the Giveaway entry, to use, display, publish, transmit, copy, edit, alter, store, re-format
and sub-licence the Giveaway entry and accompanying materials for such purposes.
F. DISCLAIMER / WARRANTIES. THE GIVEAWAY IS IN NO WAY SPONSORED,
ENDORSED, ADMINISTERED BY OR ASSOCIATED WITH FORMULA 1 OR ANY
FORMULA 1 RACE. SPONSOR AND ADMINISTRATOR MAKE NO REPRESENTATIONS
OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, REGARDING THE
GIVEAWAY OR YOUR PARTICIPATION THEREIN OR THE PRIZE AND YOUR
ACCEPTANCE OR USE OF THE PRIZE, INCLUDING YOUR ADMITTANCE TO OR
ATTENDANCE OF ANY FORMULA 1 RACE. EVERYTHING REGARDING THIS
GIVEAWAY, INCLUDING THE PRIZES, ARE PROVIDED “AS IS” WITHOUT
WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT
LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A
PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
SPONSOR AND ADMINISTRATOR ARE NOT RESPONSIBLE OR LIABLE FOR: (1) ANY
INCORRECT OR INACCURATE INFORMATION, WHETHER CAUSED BY
PARTICIPANTS, THE MECHANISM BY WHICH YOU ENTER INTO OR PARTICIPATE IN
THE GIVEAWAY OR BY ANY OF THE EQUIPMENT OR PROGRAMMING ASSOCIATED
WITH OR UTILIZED IN THE GIVEAWAY; (2) TECHNICAL FAILURES OF ANY KIND,
INCLUDING, BUT NOT LIMITED TO MALFUNCTIONS, INTERRUPTIONS, OR
DISCONNECTIONS OF THE EQUIPMENT OR PROGRAMMING ASSOCIATED WITH OR
UTILIZED IN THE GIVEAWAY; (3) UNAUTHORIZED HUMAN INTERVENTION IN ANY
PART OF THE GIVEAWAY; (4) TECHNICAL OR HUMAN ERROR WHICH MAY OCCUR
IN THE ADMINISTRATION OF THE GIVEAWAY; (5) ANY ENTRIES OR SUBMISSIONS
THAT ARE LOST, DAMAGED OR DELAYED IN TRANSIT; OR (6) ANY INJURY OR
DAMAGE TO PERSONS OR PROPERTY WHICH MAY BE CAUSED, DIRECTLY OR
INDIRECTLY, IN WHOLE OR IN PART, FROM PARTICIPANT’S PARTICIPATION IN THE
GIVEAWAY OR RECEIPT OR USE OR MISUSE OF ANY PRIZE.
PARTICIPANTS ACKNOWLEDGE THAT THE PRIZE MAY BE SUBJECT TO
ADDITIONAL TERMS AND CONDITIONS IMPOSED BY THIRD PARTIES.
PARTICIPANTS ARE SOLELY RESPONSIBLE FOR BECOMING ACQUAINTED WITH
SUCH TERMS AND CONDITIONS BEFORE ACCEPTING THE PRIZE AND ARE SOLELY
LIABLE AND RESPONSIBLE FOR THEIR COMPLIANCE WITH SUCH TERMS AND
CONDITIONS AND ANY LIABILITY THAT MAY RESULT BETWEEN SUCH THIRD
PARTY AND THE PARTICIPANT. SPONSOR AND ADMINISTRATOR DO NOT ACCEPT
RESPONSIBILITY OR LIABILITY FOR ANY SUCH TERMS AND CONDITIONS OR
BREACH OF THOSE TERMS AND CONDITIONS BY ANY PERSON.
G. OPERATION / FORCE MAJEURE. If for any reason, this Giveaway is not capable of
running as planned, including due to infection by computer virus, tampering, fraud, technical
failure, or any other cause that corrupts or threatens the administration, security or integrity of
the Giveaway, Sponsor and Administrator reserve the right, in their sole discretion, to terminate
or suspend the Giveaway or any portion of the Giveaway. Sponsor and Administrator reserve the
right to disqualify any Participant’s entry(s) in the Giveaway (and void all associated
registrations and/or entries) or entitlement to a Prize, if, in the sole discretion of the Sponsor and
Administrator, they determine or suspect that the Participant has attempted to undermine the
legitimate operation of the Giveaway by cheating, hacking, deception, or other fraudulent,
deceptive or unfair playing practices (including submitting any entries or obtaining any followers
by script, macro, robotic, programmed, or any other automated means and entries by any means
which subvert the entry process).
Sponsor and Administrator are not responsible for any problems that may arise, including but not
limited to: (a) lost, interrupted, inaccessible or unavailable networks, servers, satellite, cable
Internet Service Providers, websites, or other connection, availability or accessibility problems
arising in connection with or over the course of the Giveaway; (b) communications failed,
jumbled, scrambled, delayed, or misdirected computer, telephone or cable transmissions or
hardware or software malfunctions, failures or difficulties; (c) failure of personal computers
and/or software and hardware configurations, any technical malfunctions, failures, or difficulties,
printing errors, clerical, typographical or other errors in the offering or announcement of any
prize or in any prize notification documents or any other Giveaway-related materials; (d) any
other errors of any kind relating to or in connection with the Giveaway, whether human,
mechanical, clerical, electronic, or technical in nature, including, but not limited to, errors which
may occur in connection with the administration of the Giveaway or the processing of entries
and/or registrations; (e) the incorrect or inaccurate capture of information, or the failure to
capture any information in connection with the Giveaway; or (f) damage to a user's system
occasioned by participation in this Giveaway or downloading any information necessary to
participate in this Giveaway. Any attempt by a person to tamper with, disrupt, or deliberately
damage any website or technology related to this Giveaway, or undermine the legitimate
operation of this Giveaway may be a violation of criminal and civil laws, and, should such an
attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest
extent permitted by law. Sponsor or Administrator’s failure to enforce any term of these Terms
and Conditions shall not constitute a waiver of that provision.
H. GENERAL DISCLOSURES. In the event of any conflict with any Giveaway details contained
in these Terms and Conditions and any Giveaway details contained on promotional advertising
or any other promotional media, the details of the Giveaway as set forth in these Terms and
Conditions shall prevail. Sponsor and Administrator reserve the right in their sole discretion to
modify or suspend the Giveaway (or any portion thereof) at any time and for any or no reason, as
determined by Sponsor in its sole discretion without notice to Participants.
I. INDEMNITY / RELEASE OF LIABILITY. To the maximum extent permitted by law, each
Participant indemnifies Sponsor, Administrator, and their affiliates, subsidiaries, parent
companies, licensors, advertising and promotional agencies, and all of their officers, directors,
shareholders, employees and agencies (“Promotion Entities”), at all times from and against any
and all liability, claims, demands, losses, damages, costs and expenses arising out of or relating
to Participant’s participation in the Giveaway or receipt or use of any Prize.
UNDER NO CIRCUMSTANCES SHALL ANY OF THE PROMOTION ENTITIES BE
LIABLE FOR ANY ATTORNEY'S FEES, INDIRECT, SPECIAL, PUNITIVE, INCIDENTAL
OR CONSEQUENTIAL DAMAGES WHETHER FORESEEABLE OR NOT AND WHETHER
BASED ON NEGLIGENCE OR OTHERWISE.
J. GOVERNING LAW. All issues and questions concerning the construction, validity,
interpretation and enforceability of these Terms and Conditions, or the rights and obligations of
the Participants and Sponsor in connection with the Giveaway, shall be governed by, and
construed in accordance with, the substantive laws of the State of New York without regard to
conflicts of law principles. All Participants consent to the jurisdiction and venue of New York,
New York.
K. PRIVACY. Sponsor, Administrator and their affiliates reserve the right to use any information
provided by Participants in their participation in this Giveaway in accordance with their official
Privacy Policies. By participating in this Giveaway, Participants acknowledge and agree to the
terms of such Privacy Policies and agree to receiving marketing materials from Sponsor,
Administrator and their affiliates, as described in the applicable party’s official Privacy Policy.
L. SEVERABILITY. If any provision of these Terms and Conditions is found to be invalid or
unenforceable by a court of competent jurisdiction or appointed arbitrator, such determination
shall in no way affect the validity or enforceability of any other provision herein.
