The Promotion
    The Promoter of the Virgin Money Home Loans Launch Promotion (the Promotion) is Virgin Money (Australia) Pty Ltd ABN 75 103 478 897 (Promoter) of Level 8, 126 Phillip St Sydney NSW 2000. Lottery Permit Numbers NSW LTPS/16/04110 ACT TP 16/01018 SA T16/907.
    Information on how to enter and prizes forms part of the terms and conditions of entry. If there is any conflict between these terms and conditions and any other published material, these terms and conditions prevail.
    By entering the Promotion, participants are deemed to accept these terms and conditions.
    The promotion commences at 12.01am Australian Eastern Standard Time (AEST) on 1 June 2016 and closes at 11.59pm on 31 July 2016 (Promotion Period). Entries received by the Promoter after the Promotion Period are ineligible to participate in the prize draw.
    This is a game of chance and skill plays no part in determining the winners.
    The promotion comprises of 10 x 100,000 Velocity Points prizes, with a combined prize pool of 1,000,000 Velocity Points.
Entry
    The Promotion is open to Australian residents who are aged 18 years or over and hold an active Velocity Frequent Flyer membership during the Promotion Period (“Entrant”).
    Directors and Employees (and their immediate families) of the Promoter, participating partners and agencies associated with this promotion are ineligible to enter.
    Entrants whose Velocity Frequent Flyer account is suspended, cancelled or otherwise terminated at the time of a prize draw will not be eligible to win a Prize.
Eligible Entries
    To enter the Promotion, Entrants who are named as the Primary Borrower (Applicant 1) on an application for a Virgin Money Reward Me Home Loan (Home Loan) made during the Promotion Period which is formally approved by 31 August 2016, will be automatically entered into the Prize draw.
The Prize
    There are 10 prizes to be won. Each prize consists of 100,000 Velocity Points with a maximum value of $3,700 AUD. The total prize pool is 1,000,000 Velocity Points with a maximum valued of $37,000 AUD.
    The prize value is based on a sample of the Velocity Points options that could be obtained by redeeming the prize through the Velocity Frequent Flyer program at the time of this Promotion (as more fully defined in the terms and conditions of the Velocity Frequent Flyer program). The estimate of value is provided for the purposes of licensing this Promotion only – the value of the Velocity Points will vary depending on how they are redeemed by the winner through the Velocity Frequent Flyer program.
    The Velocity Points will be loaded onto the winner’s Velocity Account within 3 months of being notified they are a winner.
    The prize (or part thereof) is non-transferable, not redeemable for cash and cannot be used in conjunction with any other promotional offer. The prize must be taken as offered and cannot be varied.
    No responsibility is accepted for any variation in the value of the prize. Any change in the value of prize between the publishing date and the date the prize is claimed is not the responsibility of the Promoter. The Promoter accepts no responsibility for any late, lost or misdirected entries.
    The Promoter and its agents will not be liable for any losses or damages whatsoever (including but not limited to direct or consequential loss) or personal injury suffered or sustained, in connection with the Promotion, competition, the receipt, acceptance or use of the Prize or any act or omission (whether negligent or not) of the Promoter or its agents, employees and contractors, except for any liability that cannot be excluded by law.

    If the prize is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize with another prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
    Any unused portion of the prize is not transferable or exchangeable or redeemable for cash.
The Draw
    The draw will take place at Central Coast Erina Plaza, 210 The Central Coast Highway, Erina, NSW 2250, Australia at 3:00pm AEST on the 2nd September 2016.
    There will be a total of ten (10) winners drawn from the Eligible Entries received.
    The winners will be notified via email and via telephone within two (2) business days of the draw. The phone number and email supplied with the Virgin Money Reward Me Home Loan application will be used to contact the winners. The winners will have their name published on the Virgin Money website (virginmoney.com.au/competition-winners) within two (2) business days of the draw.
    The Promoter's decision is final and no correspondence will be entered into.
    If the Promoter is unable to contact a winner and confirm the winner’s acceptance of the prize within 3 months of the draw, the winner will be deemed to have forfeited the prize.
    A draw for any unclaimed prizes may take place on 6 December 2016: at the same time and place as the original draw, subject to any directions from a regulatory authority. Winners, if any, will be notified in via email and via telephone within two (2) business days of the unclaimed prize draw, using the phone number and email supplied with the Virgin Money Reward Me Home Loan application and their names will be published on the Virgin Money website (virginmoney.com.au/competition-winners) within two (2) business days of the draw.
General
    The Promoter reserves the right to request winners to provide proof of identity, proof of age, proof of residency and/or proof of entry validity in order to claim a prize. Proof of identification, residency, age and entry considered suitable for verification is at the discretion of the Promoter. In the event that a winner cannot provide suitable proof, the winner will forfeit the prize in whole and no substitute will be offered.
    Prize winners are advised that tax implications may arise from their prize winnings and they should seek independent financial advice prior to acceptance of their prize.
    The Promoter reserves the right in its sole discretion to disqualify any individual who the Promoter has reason to believe has breached any of these conditions, or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the Promotion. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.
    Entrants consent to the Promoter and each of their related bodies corporate, agents and contractors using the Entrant’s name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this Promotion (including any outcome), and promoting any products and services promoted, distributed or supplied by the Promoter.
    By entering this competition the Entrants consent to their name and contact details being used for Direct Marketing purposes. The Privacy Policy applies and we may let you know about other products and services from time to time. If you do not wish to receive further marketing, please contact privacy@virginmoney.com.au.
    If this Promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any Entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the Promotion, as appropriate.
    Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the consumer protection laws in the State and Territories of Australia (“Non-Excludable Guarantees”).
    Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or Entrant; or (f) use of a prize.
    The Promoter is not responsible for any failure of equipment or programming associated with or utilised in the Promotion, or for any technical error, or any combination thereof that may occur in the course of the administration of the Promotion including any omission, interruption, deletion, defect, delay in operation or transmission, communications line or telephone, mobile or satellite network failure, theft or destruction or unauthorised access to or alteration of entries.
    If for any reason the Promotion is not capable of running as planned due to infection of data by computer viruses, bugs, tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the Promoter, which corrupt or affect the administration, security, fairness or integrity or proper conduct of the Promotion, the Promoter reserves the right in its sole discretion to cancel, terminate, modify or suspend the Promotion or disqualify any individual from participating in the Promotion (or both).
    As a condition of accepting a prize, the winner must sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.

Privacy Statement
The Promoter is bound by the Privacy Act 1988 (Cth) including the Australian Privacy Principles. The Promoter collects personal information in order to conduct the Promotion, including providing any prize to you. Entry is conditional on providing this information. The Promoter may disclose your personal information to third parties and prize suppliers. The Promoter may also disclose your personal information to and/or collect your personal information from its related companies and third parties who provide (or help the Promoter provide) products and services, some of whom may be located overseas. The Promoter may disclose your personal information to persons or organisations located in New Zealand, Philippines, India, Singapore, the United States of America, United Kingdom, Spain and Israel.
You consent to the Promoter using your personal information for future promotional and marketing purposes regarding the Promoter’s products and services, including contacting the Entrant via SMS and email messages (and Entrants consent to receiving such messages from the Promoter). Information on how to opt-out is set out in the Privacy Policy of the Promoter.
The Privacy Policy also explains how an Entrant can seek to access or correct any personal information the Promoter holds about the Entrant, how to complain about a privacy breach by the Promoter and how the Promoter will deal with a privacy complaint. Entrant's personal information may be disclosed to State and Territory lottery departments and winners’ names published as required under the relevant lottery legislation.
