The competition is an instant win game of chance and is authorised under the permits.
The material used to market and promote the competition forms part of the competition terms. If there is an inconsistency between the material used to market and promote the competition and the competition terms, the competition terms prevail.

Eligibility to enter
During the promotional period, anyone may enter the competition, provided that they are:
over 18 years of age;
a resident of Australia;
a current Flybuys member or a new Flybuys member who joins during the Promotional Period (to be a valid Flybuys member, the Flybuys member account must include the member’s full name, a valid postal address, a valid email address and a valid contact number current at time of draw and prize distribution);
not an employee or immediate family member of the Promoter, Flybuys or an agent of the promoter, who is directly associated and connected with the organisation of this competition.
Entering
By entering the competition, entrants accept the competition terms.
For the chance to win an instant win prize, entrants must play the Flybuys Shake ‘n’ Shop game in the Flybuys app between 06:00am (AEDT) on Wed 18 Nov 20 and 11:59pm on Tue 01 Dec 20 (Promotional Period) and attempt to catch and claim a prize as directed by the game’s onscreen prompts and instructions.
Entrants may enter as many times as they like during the Promotional Period but are limited to playing the Flybuys Shake ‘n’ Shop game a maximum of 3 times per day and claiming a maximum of 1 prize per day.
All winners will be notified instantly on screen upon claiming a prize, and the names of major prize winners and the last 3 digits of their Flybuys card number will be posted on the website on or before Fri 11 Dec 20
Standard Flybuys points and product offers are also available to be claimed in the Flybuys Shake ‘n’ Shop game which are subject to the Standard Flybuys offer terms and conditions available at flybuys.com.au/shakenshop.
If, subsequent to a qualifying entry, you do not wish to participate in the competition you must advise the promoter by calling the Flybuys service centre (13 11 16).
The promoter may disqualify any entrant who:
enters the competition without being eligible;
tampers with the entry process;
submits an entry that is not in accordance with the competition terms; or
in entering the competition, engages in conduct which is fraudulent, misleading, deceptive or damaging to the goodwill or reputation of the competition or the promoter.
Failure by the promoter to exercise its rights under paragraph 11 does not constitute a waiver of the promoter’s rights under paragraph 11. If the entrant’s contact details change, the entrant must notify the promoter.
Awarding prizes
The maximum number of instant win prizes being given away for this promotion is 222,010 and the maximum total value of all prizes in the Promotion is up to $166,550. The final number of prizes distributed by the Promotor will be the number of prizes claimed by the entrants.
Each prize will be automatically allocated to the Flybuys account associated with the winner’s entry within four weeks of the member claiming the winning prize.
The promoter may request that the winners provide proof of identity, proof of age or proof of residency to the promoter’s reasonable satisfaction before awarding the prize.
If upon request a major prize winner does not provide proof of identity, proof of age or proof of residency to the promoter’s reasonable satisfaction by Tue 02 Mar 21, then the relevant major prize winner may be deemed to have forfeited their entitlement to their prize. In those circumstances the promoter may redraw the prize in accordance with paragraph 19.
In consideration of the promoter awarding the prize to the winner, the winner:
consents to the promoter, without royalty or any fees, using his or her name, likeness, image, voice and entry in any marketing and promotion of the competition, the promoter or the promoter’s business;
agrees to use the prize in accordance with the supplier’s specified conditions and requirements; and
agrees that the prize is not transferable or exchangeable and cannot be taken as cash.
If the prize is unavailable, the promoter may substitute the prize with a substitute prize, provided that the substitute prize is of the same or similar value or specification as the prize subject to legislative approval.
Further Draw
If for any reason, there are major prizes that have not been awarded within 3 months after the claim period concludes the promoter may conduct a further draw from the pool of valid entries at 10:00am (AEDT) on Wed 03 Mar 21 at Focal Promotions, 2/7 Stayner Street Beaumaris VIC 3193.
The first valid entry the promoter draws is the winner, subject to the promoter’s rights under paragraph 11.
The promoter will notify the winner by email within 7 days after the further draw date and post the winner’s name and last 3 digits of their flybuys card number on the website within 7 days after the further draw date.
Force majeure
If there is a force majeure event which prevents or materially and adversely affects the promoter’s ability to market, promote and run the competition in accordance with the competition terms, the promoter may cancel, terminate, modify, suspend or postpone the competition, subject to State Licensing Authorities approval.
Liability
The promoter is not liable for any loss, expense, damage or liability suffered or incurred by entrants and winners in connection with the competition, including:
any late, lost, altered, damaged or misdirected entries or prize acceptance, including delays due to technical disruptions or network congestion;
any incorrect or inaccurate information caused by equipment or programming associated with or utilised in the competition;
any technical error, including any omission, interruption, deletion, defect, delay in operation or transmission or communications line, telephone, mobile or satellite network failure; and
any theft, destruction, unauthorised access to or alteration of entries; and
any use of the prize or any tax liability incurred by the winner as a result of accepting the prize.
Nothing under paragraph 23 is intended to limit entrants or winners’ rights under the Australian Consumer Law (ACL).

The promoter collects personal information about entrants in order to run the competition and comply with the permits. By entering the competition, each entrant consents to the promoter using their personal information for future marketing and promotional purposes.
