Terms and Conditions
1. The competition commences at 9:00am (AEST) on 31/12/2018 and concludes at 11.59pm (AEST) on 07/01/2019 (Competition Period). The winner will be decided on 08/01/2019 at 12pm (AEST) at Appliances Online, Level 2, 20A Danks St, Redfern NSW.
2. Entry is open to all Australian residents, in all States where Appliances Online delivers. Employees (and their immediate families) of Appliances Online are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or stepchild (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or cousin.
3. Information on the offer and how to enter the competition form part of these Terms and Conditions. Participation in this Competition (Competition) is deemed acceptance of these Terms and Conditions.
4. To enter the Competition, participants are required to visit Black Appliances page, and find a product that the participant subjectively believes would look great in their home. The participant must then leave a comment of 30 words or less on the promotional facebook post as to why their chosen product would look great in their home. The participant must also mention a friend that they believe would love a new black kettle and toaster.
5. Entrants must be over the age of 18 to enter. Entrants (including winners) in the Competition may enter multiple times during the Competition Period.
6. By entering the Competition, the entrant agrees to the publication of their name on the Appliances Online Website and email newsletter, should they be declared the winner.
7. Appliances Online is entitled to use any of the entries submitted in any manner and for any purpose at its absolute discretion, including using the entries for research, promotional, marketing and publicity purposes without any further reference or payment or other compensation to the entrant. Appliances Online is entitled to amend, edit, select, crop, retouch, add to or delete from any part of the submitted entry.
9. There will be one (1) winner as determined by a panel at Appliances Online, which may be subject to change. The winning participant who leaves a comment on the facebook post as per the rules in section 4 above, will win the Smeg ECF01BLAU. The winning participant’s mentioned friend will win the Smeg KLF03BLAUTSF01BLAU kettle and toaster.
10. The prize winner will be notified by Appliances Online on 08/01/2019. The winner will be notified via Facebook private message from a member of the Appliances Online head office team. The winner’s tagged friend will also be notified by a member of the Appliances Online head office team. It is the Entrants’ responsibility to provide correct details to confirm acceptance of each Prize. If the winner does not contact Appliances Online by phone or via email within two days of being notified they are a prize winner, they will forfeit the Prize and another winner will be selected and notified.
11. Appliances Online reserves the right to select additional reserve entries and record them in order, in case an invalid entry is the original winner.
12. The prize consists of a ECF01BLAU Smeg Coffee machine for the participating winner who comments their preferred black appliance. And for the participating winner’s mentioned friend, the prize consists of a Smeg KLF03BLAUTSF01BLAU. Please note: There is only one single ECF01BLAU coffee machine to be won and one single KLF03BLAUTSF01BLAU kettle and toaster pack to be one. By accepting the prize, the winner and their tagged friend agree to participate in and co-operate as required with all reasonable media editorial requests from Appliances Online relating to the prize, including but not limited to, being interviewed, photographed, filmed and/or chaperoned throughout the duration of the prize.
15. All decisions of Appliances Online are final and no discussions or correspondence will be entered into.
16. Appliances Online reserves the right, at any time, to verify the validity of entries and entrant and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Failure by Appliances Online to enforce any of its rights at any stage does not constitute a waiver of those rights.
17. Appliances Online reserves the right to cancel, terminate, modify or suspend the Competition subject to any written directions from a relevant regulatory authority.

Nothing in these Terms and Conditions limits excludes or modifies or purports to limit, exclude or modify any provision of relevant legislation including the Competition and Consumer Act 2010 (Cth). Except for any liability that cannot by law be excluded, Appliances Online (including its Related Bodies Corporate, their respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Competition.

Except for any liability that cannot be excluded by law, Appliances Online (including its Related Bodies Corporate, their officers, employees and agents) excludes all liability (including for negligence) for any personal injury or any loss or damage (including loss of opportunity) whether direct, indirect, special or consequential, arising in any way out of the Competition, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under Appliances Online’ control); (b) any theft, unauthorised access or third party interference; (c) any entry that is late, lost, altered,damaged or misdirected due to any reason beyond the reasonable control of Appliances Online; (d) any variation in offer value to that stated in these Terms and Conditions; (e) any tax liability incurred by a entrant; or (f) acceptance or use of a prize.
20. All entries and any copyright subsisting in the entries become and remain the property of Appliances Online. Appliances Online collects personal information about entrants to include entrants in the Competition and where appropriate award prizes. If the personal information requested is not provided, the entrant may not participate in the Competition. By entering the Competition and opting in at the point of registration, each entrant agrees that Appliances Online may use entrants’ personal information in this manner. Each entrant also agrees that Appliances Online may publish or cause to be published the winner’s name and locality in any media as required under the relevant legislation.
