1.2 Who meet these criteri
To enter into the Competition for the CENTURY 21 Sunshine Coast Apartment Giveaway, entrants must meet one (1) or more of the following entry requirements before the closing date specified in Condition 1.10:
Receive a Current Market Opinion or Appraisal conducted by a participating CENTURY 21 agent on a property owned by and in the name of the entrant; or
Attend an open home conducted by a participating CENTURY 21 agent and register the entrant's details with the agent or via the CENTURY 21 Open House app; or
Sell a property, owned by and in the name of the entrant, through a participating CENTURY 21 agent; or
Buy a property, in the name of the entrant, through a participating CENTURY 21 agent; or
Use the Property Management services of a participating CENTURY 21 agent or Property Manager.

1.14 Prizes, the method by which they are awarded, any additional conditions that apply to the prize(s), and their individual values:
(a) There will be one (1) Prize Winner who will receive the Prize.
(b) The Prize is a two (2) bedroom apartment, being Lot No. 7 in "Ocean Verge", 27 Verney Street, Kings Beach QLD 4551, and
(i) the Prize is an apartment in "Ocean Verge", 27 Verney Street, Kings Beach QLD 4551 Certificate of Title Reference 17061016; and
(ii) the Certificate of Title of the Prize will be issued prior to the date of drawing the Prize as specified in Condition 1.13; and
(iii) plans of the Prize are available online at www.c21win.com.au/plan; and
(iv) the registered proprietor of the Prize is Marketing Nominees Pty Ltd ACN 611 661 075; and
(v) the Prize is valued at $400,000AUD including applicable stamp duties, transfer fees, fixtures and car park allocation; and
(vi) the Prize does not include furniture, conveyancing or any additional legal costs associated with receiving the Prize.
(c) Entrants who meet the criteria specified in Condition 1.2 will qualify for entry into the draw.
(d) Submission of the form on www.c21win.com.au does not constitute entry into the draw.
(e) Only entries verified and accept by the Promoter will be submitted into the draw.

2. ELIGIBILITY
2.1 Entry is open to persons who:
(i) are residents of Australia or New Zealand; and
(ii) have meet the criteria specified in Condition 1.2; and
(iii) have attained the age specified in Condition 1.3; and
(iv) are not employees of, or contractors to, the Promoter or any of its agencies involved with this Competition, or of any entity specified in Condition 1.4; and
(v) are not members of the immediate family of any such employees or contractors.
2.2 "Immediate family" means spouse, defacto spouse, parent, natural or adopted child, and sibling (whether natural or adopted by a parent), whether or not they live in the same household as the employee/contractor.
3. ENTRANTS BOUND BY CONDITIONS
3.1 By entering this Competition in accordance with the entry instructions specified in Condition 1.2 entrants have agreed and accepted the terms and conditions contained herein.
4. ENTRY INSTRUCTIONS
4.1 Information on the prize and entry instructions both form part of these terms and conditions.
4.2 To enter, eligible entrants specified in Condition 2 must comply with the entry instructions specified in Condition 1.2.
4.3 Submission of the form on www.c21win.com.au does not constitute entry into the draw. Only entries verified and accepted by the Promoter will be submitted into the draw.
5. AUTOMATIC AND NON-PERMITTED ENTRIES
5.1 Any entry that is lodged by automatic, repetitive, robotic, programmed or similar entry methods or agents, including the use of a competition entry service, will void all entries by that entrant.
5.2 The Promoter may, at its absolute discretion, declare any or all entries made by an entrant invalid or disqualify any entrant from this Competition, if the entrant:
(i) fails to establish their entitlement to enter into this Competition in accordance with Condition 2 and to the Promoter's satisfaction; or
(ii) breaches any of the terms and conditions herein;
(iii) engages in any unlawful or other improper conduct calculated to jeopardise the fair and proper conduct of this Competition.
5.3 The Promoter reserves its legal rights to recover damages or other compensation from any entrant who engages conduct referred to in Conditions 5.1 and 5.2 above.
6. NUMBER OF ENTRIES PER ENTRANT
6.1 The maximum number of times an entrant may enter this Competition is specified in Condition 1.5.
7. COST OF ENTRY
7.1 There is no cost of entry.
8. DURATION
8.1 This Competition commences at the Commencement time specified in Condition 1.7 on the Commencement date specified in Condition 1.8.
8.2 Entries must be received by the Closing time specified in Condition 1.9 on the Closing date specified in Condition 1.10.
8.3 After the Closing date specified in Condition 1.10, no further entries to this Competition will be permitted.
9. DRAW TO DETERMINE PRIZE WINNERS
9.1 The draw to determine the Prize Winner will take place at the address specified in Condition 1.11 at the time specified in Condition 1.12 on the date specified in Condition 1.13.
9.2 The Prize Winner will be determined from all entries received and verified by the Promoter or its agents.
9.3 The Prize Winner must claim the Prize within six (6) weeks after the determination of the Prize Winner of this Competition.
9.4 The Promoter's decisions in respect of all matters relating to this Competition are final and the Promoter will not enter into any discussion.
10. PRIZE
10.1 There will be one (1) Prize Winner who will receive the Prize.
10.2 The Promoter will select one (1) Prize Winner at random from all the entries received, verified and accepted by the Promoter.
10.3 The Prize, the method by which it is awarded and any additional conditions that apply to the Prize are specified in Condition 1.14.
10.4 The maximum total value of the Prize in this Competition in Australian dollars is as specified in Condition 1.15.
10.5 The Prize is subject to availability and the Promoter reserves their rights, subject to the approval of any relevant trade lottery authority, to substitute a prize item of equal or greater value.
10.6 The Promoter is not responsible whatsoever for inaccurate prize details supplied to any entrant by any third party connected with this Competition.
10.7 The Prize is not transferable or exchangeable and is not redeemable for cash.
11. WINNER NOTIFICATION
11.1 The Prize Winner will be notified in the manner specified in Condition 1.16 using the contact details provided in their entry.
12. WINNER PUBLICATION
12.1 The name and suburb of the Prize Winner will be published:
(i) in the publication specified in Condition 1.17 on the date specified in Condition 1.18, and
(ii) on the website specified in Condition 1.19 from the date specified in Condition 1.20 until the date specified in Condition 1.21.
13. UNCLAIMED PRIZES
13.1 If the Prize cannot be delivered by the Promoter to the Prize Winner, or the Prize has not been claimed by the Prize Winner, and the Promoter has taken all reasonable steps to deliver the Prize to the Prize Winner, within six (6) weeks after the determination of the Prize Winner of this Competition, then,
(i) the Prize Winner will have forfeited all entitlement to the Prize; and
(ii) the Prize will be awarded to another Prize Winner in a further draw to be held at the time on the date and at the placed specified in Condition 1.22.
14. TAXES
14.1 Any tax implications that may arise from Prize Winner receiving the Prize are and shall remain as the sole responsibility of that Prize Winner.
14.2 Entrants shall obtain independent financial and/or legal advice at their expense prior to entering into the Competition.
15. NO QUALITY, ETC, REPRESENTATIONS
15.1 The Promoter makes no representations or warranties whatsoever as to the quality, suitability, and merchantability of the Prize.
16. EXCLUSION OF LIABILITY
16.1 To the extent permitted by law, the Promoter is not responsible or liable for:
(i) inaccurate/incorrect transcription of entry information;
(ii) purported entries that are not received for any reason, including because they are lost, misdirected or stolen, or that are received, but are late, illegible, incomplete, sent with insufficient postage (where entry is by post), or sent other than as directed in the entry instructions;
(iii) any problems or technical failures of any kind, including malfunction of any telephone network or lines, computer online systems or network, servers or providers, computer equipment, or software;
(iv) the unavailability or inaccessibility of any service whether or not caused by traffic congestion on the Internet or at any Website;
(v) unauthorised human intervention in any part of this Competition;
(vi) electronic or human error which may occur in the administration of this Competition;
(vii) any loss suffered or sustained, to person or property and including, but not limited to, consequential (including economic) loss by reason of any act or omission, deliberate or negligent, by the Promoter, or its servants or agents, in connection with the arrangement for supply, or the supply, of any goods or services by any person to the Prize Winner and, where applicable, to any family/persons accompanying the Prize Winner;
(viii) any injury or damage to persons or property, including to the participant's or any other person's computer related to, or resulting from, participation or downloading any materials in this Competition; and
(ix) any claim whatsoever.
16.2 This condition does not affect, and is not intended to affect, any rights a consumer might have, which cannot be excluded under applicable consumer protection laws. To the fullest extent permitted by law, any liability of the Promoter or its servant or agents for breach of any such rights is limited to payment of the cost of having the Prize delivered again.
17. OWNERSHIP OF ENTRIES AND PRIVACY
17.1 The Promoter collects personal information ("PI") in order to conduct the promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this PI. The Promoter will also use and handle PI as set out in its Privacy Policy, which can be viewed at http://www.century21.com.au/privacy/. In addition to any use that may be outlined in the Promoter's Privacy Policy, the Promoter may, for an indefinite period, unless otherwise advised, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. The Privacy Policy also contains information about how entrants may opt out, access, update or correct their PI, how entrants may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with. All entries become the property of the Promoter. Some of the entities to whom the Promoter may disclose entrants' PI are located outside Australia. The Promoter takes steps to ensure that such recipients respect the confidentiality of PI by abiding by the Australian Privacy Principles (APPs) or equivalent privacy laws.
18. PUBLICITY
18.1 The Prize Winner consents to the use of their name, suburb of residence and image for promotional and marketing purposes and agrees to participate in reasonable promotional activities as requested by the Promoter from time to time.
19. TAMPERING AND OTHER FAILURES
19.1 If for any reason this Competition is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the Promoter which corrupt or affect the administration security, fairness, integrity or proper conduct of this Competition, the Promoter reserves their right in their sole discretion to disqualify any individual who tampers with the entry process or who may benefit from such tampering and, subject to the approval of those authorities that have issued permits for the conduct of this Competition, to cancel, terminate, modify or suspend the Competition. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEBSITE OR THE INFORMATION ON A WEBSITE, OR TO OTHERWISE UNDERMINE THE LEGITIMATE OPERATION OF THIS COMPETITION, MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, WHETHER SUCCESSFUL OR NOT, THE PROMOTER RESERVES THE RIGHT TO SEEK DAMAGES TO THE FULLEST EXTENT PERMITTED BY LAW.
20. HEADINGS
20.1 The headings in these Conditions are for convenience only and do not affect interpretation.
21. ENTIRE CONDITIONS
21.1 These terms and conditions constitute the entire agreement of the parties relating to the entry into and the conduct of this Competition.
22. PROMOTER
22.1 The Promoter is the entity specified in Condition 1.25.
23. PERMITS
23.1 The permits issued for the conduct of this Competition are specified in Condition 1.26.
