Terms and Conditions (Chance-Based Competition)
General
1. Information on how to enter and prizes form part of the Terms and Conditions. Entry into this competition deems acceptance of these Terms and Conditions.
2. To the extent of any inconsistency between these Terms and Conditions and any other reference to Acer Xmas Rescue Campaign 2018 (‘AXR18’), these Terms and Conditions prevail.
Who can enter
3. Subject to clause 4, entry to AXR18 is open to all residents of Australia and New Zealand who have fulfilled the requirements set out below ('Eligible Entrants').
4. Employees, and their immediate families, of the Promoter, associated agencies and companies, contractors or individuals are not eligible to enter AXR18. Immediate family means any of the following: spouse, ex-spouse, defacto spouse, child or step child (whether natural or by adoption), parent, step parent, grandparent, step grandparent, uncle, aunt, niece, nephew, brother, sister, step brother, step sister or 1st cousin.
5. Entrants must be aged at least 18 years old at time of event. If a winner is under the age of 18 at the conclusion of the Promotional Period, the relevant prize will be awarded to someone else.
6. The Promoter is Acer Computer Australia Pty Ltd (ABN: 78003872768) of Building G, Level 2, 350 Parramatta Rd Homebush West, NSW 2140 ('Promoter').
7. The Promoter has taken all necessary permits, approvals required to run the AXR18.
How to enter
8. Eligible Entrants may enter AXR18 during the Promotional Period (defined below) by adhering to the following entry method.
9. Competition will run on Instagram and entrants will have to click the link in bio or click the sponsored post to go to the microsite where the competition will take place
10. AXR18 winners will be determined via Gleam, which is a thirdparty marketing platform. There will be options for entries and methods for additional entries to increase entrants chances of winning the prize.
11. Entry mechanisms:
11.1. Entrants are to fill out their name, email, date of birth and country. These fields are mandatory for entry.
11.2. Entrants have the following available entry mechanisms that count for entry
11.2.1. Enter using Instagram – value of two entries
11.2.2. Visit officialaceranz on Instagram – value of two entries
11.2.3. Share an Instagram photo of your Acer or Predator Gaming product– value of three entries
11.2.4. Visit AcerANZ on Facebook – value of one entry
11.2.5. Share a Facebook photo of your Acer or Predator Gaming product– value of three entries
11.2.6. Refer friends – value of three entries per friend entered
11.2.7. Enter using Twitter – value of one entry
11.2.8. Follow AcerANZ on Twitter – value of one entry
11.3. Entrants much tick to confirm they will adhere to the terms and conditions
12. There will be one winner each day, announced the following day in the comments, between 12:00pm -2:00pm AEDT.
13. Gleam uses a program, Random.org, to draw winners and this offers true randomness.
When to enter
14. AXR18 commences on 13/12/18 and closes 22/12/18 ('Promotional Period').
15. For each day, the Promotional Period runs from 9:00am AEDT to 11:59pm AEDT.
16. The prize winners will be different entrants each day for the 10 giveaways.
17. All entries during the Promotional Period count towards the 11th Giveaway
18. The the 11th giveaway winner is to be announced after the promotional period (22/12/18), in January 2019 between 02/01/19 and 18/01/19. The winner will be awarded based on randomness.
Number of Entries permitted
19. Entrants can enter via more than one entry mechanism each day to participate in AXR18. For example, one user can visit the Acer ANZ Facebook page, refer a friend and enter using Instagram to receive six entries under their name.
20. All entries will be included for the final ultimate giveaway announced in January 2019.
Prize on offer
21. The prizes on offer are part of a prize pool of AU$3,800. There will be a total of 19 prizes given away during the Promotional Period. There will be two days where five prizes are given away, while the rest of the period will have one each day. Each prize varies in price and depending on location of winner (AU or NZ) will incur a currency conversion.
22. Prizes include the following items:
22.1. 1st Giveaway – Thursday 13 December 2018 – There will be five Call Of Duty Games on offer for five winners. The games will be available at EBGames in both Australia and New Zealand, valued up to AU$100.00/NZ$115.00 each. Total value of day’s prize is AU$500.00/NZ$575.00. Giftcard to purchase will be delivered by email.
22.2. 2nd Giveaway – Friday 14 December 2018 – One winner will receive a Spa Voucher valued at AU$200.00/NZ$200.00 at the following venues; in Australia, Endotaspa and in New Zealand, East Day Spa. Giftcard will be delivered by email.
22.3. 3rd Giveaway – Saturday 15 December 2018 – There will be five Assassins Creed Odyssey games given to five winners. Games available at EBGames at Australia valued at AU$99.95 per game, and available at Mighty Ape in New Zealand valued at NZ$92.00 per game. Total value of day’s prize is AU$499.75/NZ$460.00. Giftcard to purchase will be delivered by email.
22.4. 4th Giveaway – Sunday 16 December 2018 – A premium subscription to Spotify for 12 months will be provided to the one winner in either Australia or New Zealand. Subscription details will be delivered by email. Subscription valued at AU$143.88/NZ$143.88. Prices to vary based on currency conversion and timing.
22.5. 5th Giveaway – Monday 17 December 2018 – One winner will receive double pass tickets to Gold Class Gold Class at Event Cinemas in both Australia or New Zealand. Price of tickets to differ depending on location and currency conversion. Movie tickets will be delivered by email.
22.6. 6th Giveaway – Tuesday 18 December 2018 – One winner will receive a massage voucher, valued at AU$160.00/NZ$140.00. The massage voucher will be redeemable at the following venues; Endotaspa in Australia and East Day Spa, in New Zealand. Voucher to be delivered by email.
22.7. 7th Giveaway – Wednesday 19 December 2018 – One winner will receive a dinner voucher valued at AU$200.00/NZ$200.00, from Good Food in Australia and Gift Station in New Zealand. Prices to vary based on currency conversion. Voucher to be delivered via email.
22.8. 8th Giveaway – Thursday 20 December 2018 One winner to be awarded an Angelica Hicks Get a Room! gift card from Mr and Mrs Smith for the value of AU$500.00/NZ$500.00. Gift card to be delivered via email.
22.9. 9th Giveaway – Friday 21 December 2018 One winner to receive a arcade gaming voucher, valued at AU$200.00/NZ$200.00 to an Arcade Gaming venue in the winner’s city or the nearerst one. Winner to be contacted via email to organise venue and gift card. Email correspondence will be between winner and Acer and/or Acer’s marketing and public relations agency.
22.10. 10th Giveaway – Saturday 22 December 2018 One winner will receive a 12 month subscription to Netflix in either Australia or New Zealand. One winner will receive subscription details via email. Subscription valued at AU$197.00/NZ$221.88.
22.11. 11th Giveaway – Thursday 13 to Saturday 22 December – The ultimate grand prize is a ‘Surviving Xmas Home Cinema Experience’. Prize valued up to AU$1,255.00. The giveaway includes; 1x Acer H7550ST Projector (AU$1,049.00), 1x picnic basket (including cutlery, plates, glasses) (AU$79.00), 1x stemless glasses (AU$49.95), 1x 100 LED Solar Fairy Lights (AU$12.00), 1x picnic rug (AU$15.95), 2x The Fabulous Food Company’s Creamy Coconut Popcorn (AU$10.00 each), Mars’ Maltesers (AU$4.25), Pikes’ Reisling (AU$27.00). Prize to be delivered to a postal address and winner will be contacted for their current postal address (see clause 19 and 20).
23. The winners will be notified about their prize the following day between 12:00pm-2:00pm AEDT. It will be announced in the comment section of the post on the Acer feed.
24. Prizes will be delivered after the competition ends on 22nd December, between 2nd January to 18th January 2019. Most prizes, unless stated otherwise, will be delivered via email. Other prizes will be delivered by courier to a postal address.
25. If the Promoter is unable to contact the winner to claim fulfilment of the promotional prize, that winner will forfeit the prize in its entirety and it shall be awarded to the next runner-up in the promotion. The Promoter will not be liable for a winner who cannot be contacted and therefore forfeits their prize and no correspondence will be entered into.
26. Unless expressly stated in these Terms and Conditions all other expenses are the responsibility of the winners (and their companions) including but not limited to current passports, visas, spending money, transport to and from departure and arrival points, transfers, meals and drinks (excluding dinner voucher), incidentals, mini-bar, laundry, room service, telephone calls, gratuities, services charges, travel insurance, and all other ancillary costs. A credit card imprint or cash deposit may be required from the winner at check-in for some of the prizes, such as hotel, for all incidental charges.
27. The terms and conditions mentioned herein are subject to the laws of Australia and Parties agrees that any dispute regarding the terms and conditions shall be first resolved through mediation between an authorized representative of Promoter and the Entrant. Each Party’s aggregate laibility for any claim, damages, action, suit under this agreement shall be limited to the price value mentioned for the prize with respect of which the claim and/or claim has arisen.
Further Terms and Conditions
28. The Promoter reserves the right to amend these Terms and Conditions if AXR18 cannot be run as originally planned. The Promoter may also cancel or suspend AXR18 if an event beyond the control of the Promoter corrupts or affect the administration security, fairness, integrity or proper conduct of AXR18. The Promoter will disqualify any individual who has tampered with the entry process or any other aspect of AXR18.
29. The Promoter reserves the right in its sole discretion to disqualify any individual who the Promoter has reason to believe has breached any of these conditions, or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of AXR18. The Promoter's legal rights to recover damages or other compensation are reserved.
30. The Promoter highly recommends a current residential street address be provided when requested for ease of correspondence and potential prize delivery of the ‘Surviving Xmas Home Cinema Experience’ prize for the winner. The Promoter makes all reasonable efforts to deliver prizes to the addresses provided by competition entrants. The Promoter cannot guarantee that any prizes returned to the Promoter due to non-delivery at the provided address will be re-sent to the prize winner.
31. The promoter highly recommends current and correct email address to be provided for each of the prize winners for ease of correspondence and prize giftcards and information transfer. The Promoter makes all reasonable efforts to transfer prizes to the details provided by competition entrants.
32. The Promoter reserves the right to request winners to sign a winner's deed of release or any other relevant forms or agreements that the Promoter deems necessary, to provide proof of identity, proof of age, proof of residency at the nominated prize delivery address and/or proof of entry validity (including phone bill) in order to claim a prize. Proof of identification, residency, age and entry considered suitable for verification is at the discretion of the Promoter. In the event that a winner cannot provide suitable proof, the winner will forfeit the prize in whole and no substitute will be offered.
33. The Promoter reserves the right to rejudge in the event of an entrant, claiming to be a winner, being unable to satisfy these Terms and Conditions.
34. The Promoter’s decision in relation to any aspect of the competition is final and binding on each person who enters. Chance plays no part in determining any winner. No correspondence will be entered into. No responsibility is accepted for late, lost or misdirected entries.
Privacy Collection Statement
35. The Promoter and its related entities collect entrants' personal information for the purpose of conducting and promoting this competition (including but not limited to determining and notifying winners). The Promoter may disclose personal information collected to an agent who is engaged for prize fulfilment. The Promoter may also disclose personal information collected to Australian regulatory authorities, such as the regulators of trade promotions. The Promoter will otherwise handle your personal information in accordance with its Privacy Policy available https://www.acer.com/ac/en/AU/content/privacy. 36. The winner permits Acer Computer Australia Pty Ltd to use their name, details, any digital content from AXR18 across social media.
Copyright, Statutory guarantees, Waiver and liability
37. In participating in AXR18, entrants agree to participate and co-operate as required in all editorial activities relating to AXR18, including but not limited to being interviewed, videoed, and photographed. Entrants also agree to grant the Promoter a perpetual and non-exclusive licence to use such content, footage and photographs in all media worldwide, including online social networking sites, and entrants will not be entitled to any fee for such use.
38. Prize winners are advised that tax implications may arise from their prize winnings and they should seek independent financial advice prior to acceptance of that prize.
39. Nothing in these Terms and Conditions limit, exclude or modify or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act 2010 (Cth), as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia ('Non-Excludable Guarantees').
40. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter's control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or Entrant; or (f) use of a prize.
