Terms and Conditions
1. Information on how to enter and the prize forms part of the terms and conditions of entry. Participation in the Competition is deemed acceptance of these terms and conditions and any other notices referenced herein.
2. The promoter is FRENCH TOURIST BUREAU PTY LTD ABN 57 145 096 126 of Level 13, 25 Bligh Street, Sydney NSW 2000 ("Promoter").
3. The sponsors are the French Tourist Bureau, DriveAway, Galeries Lafayette, Air France ("Sponsors").
4. Subject to paragraphs 5 and 6 below, entry is only open to residents of Australia ("Entrants").
5. Entrants under the age of 18 must obtain the prior permission of a parent or guardian over the age of 18 to enter the Competition.
6. Employees (and their immediate family members) of the Promoter, the Sponsors and any of their associated agencies (including, without limitation, Atout France), suppliers or related bodies corporate are not eligible to enter this Competition.
7. The Competition commences on the 03rd July 2014 at 12:00:01 (EADT); and concludes on the 31th August 2014 at 23:59:59 (EAST) (“Competition Period”). No responsibility is accepted for late, lost or misdirected entries.
8. To enter the Competition and to be eligible to win the prize, Entrants must, during the Competition Period:
1) Access au.rendezvousenfrance.com and register their details including, without limitation, name and e-mail address. Failure to provide the requested information will render the entryinvalid; and
2) Correctly answer the six (6) multiple-choice questions about French gastronomy and the following question: ‘Using your most descriptive 30 words, tell us what is special to you about French cuisine.’
3) Otherwise comply with these terms and conditions ("Competition Entry").
9. Entrants may only submit one Competition Entry during the Competition Period. Any Entrant who submits more than one Competition Entry will have all entries apart from their original Competition Entry deemed invalid.
10. Entries will be deemed to be accepted at the time of receipt of the Competition Entry and not at the time of transmission. Incomplete or incomprehensible entries will be deemed invalid. If an Entrant's contact details change during the Competition Period, the Entrant must promptly notify the Promoter of the relevant change. A request to access or modify any information provided in an entry should be in writing and directed to Promoter.
11. There is one prize to be awarded in the Competition. The prize winner will be selected regarding his answers to the 7 questions. The selection will take place at the offices of the French Tourist Bureau of Level 13, 25 Bligh Street, Sydney 2000, on Wednesday, 10th September 2014 at 12:00 (EADT).
12. The selected winner will be awarded the prize which comprises:- Return Economy Class airfares to Paris for two people departing from Sydney, Australia. The airfares included in the prize are subject to the Flight Terms & Conditions set out at the end of these terms and conditions, and any other terms or conditions imposed by the airline;- One dinner for two at one of Alain Ducasse restaurants in France;- A €150 voucher for shopping at any Galeries Lafayette store in France;- A VIP shopping experience in Galeries Lafayette store in Paris only, subject to availability;- $1,000 voucher for Car Hire, Peugeot Leasing or Motorhome Rentals in France with DriveAway Holidays;- Four (4) nights in one of the ACCOR hotels selected by the Promoter;
13. If a winning entry is deemed by the Promoter not to comply with the conditions of entry, the entry will be discarded and a new winner of the prize will be determined from those entries eligible to receive the prize.
14. The prize winner will be notified by email within 2 days of the draw advising them of their prize. Notice of the prize winner will also be published on our website http://.au.rendezvousenfrance.com on the 12th of September
15. The winner and his/her travelling companion must depart on the same date from the same airport on the same flight. The winner and his/her travelling companion must depart Paris to return to Australia on the same date from the same airport on the same flight. Subject to paragraph 18 below,the winner and his/her travelling companion are responsible for transport to and from their nearest Flight Departure City.
16. If the winner resides in any other city than Sydney the winner and his/her travelling companion will be responsible for obtaining appropriate transport to Sydney. For the avoidance of doubt, such transport to Sydney does not form part of the prize and the prize winner must pay all costs in connection with the connecting transport.
17. The total prize value is up to AU$9,000 (including GST). Prize value is recommended retail price and is subject to change. The Promoter accepts no responsibility for any variation in the prize value.
18. The total prize must be booked and ticketed, and travel must have commenced, by 23:59:59 (EAST) on 31st August 2015. The prize is not available during peak times such as public holidays andschool holidays (if applicable), is subject to hotel and flight availability and cannot be changed once the booking has been made.
19. If for any reason whatsoever the winner is unable to take any element of the prize in the time period specified by the Promoter, then that element of the prize in its entirety will be forfeited by the winner and cash will not be awarded in lieu of that element of the prize.
20. The prize, in whole or in any part, is not transferable to another individual and is not exchangeable or redeemable for cash, goods or services. The prize is not refundable and cannot be upgraded. The prize winner cannot change, vary, substitute or extend any element of the prize(in whole or in part) and the prize winner must be among the travellers.
21. The Promoter, the Sponsors and their associated agencies, and other contractors associated with this Competition, accept no responsibility for prizes, prize information or for tickets lost intransit.
22. The Promoter accepts no responsibility for any tax implications that may arise from the prize winnings. Independent financial advice should be sought.
23. The prize winner and his/her travel companion are responsible for all other expenses including, without limitation, spending money, meals, transfers (including from the airport of the arrival city to the hotel), activities (unless specified), incidentals, taxes (except departure taxes), surcharges, gratuities, services charges, passports, visas, travel insurance and all other ancillary costs.
24. Accommodation selection, location and room type and air carrier selection and flight routing is at the sole discretion of the Promoter and the Sponsors.
25. The travellers must ensure that they have valid documentation, including but not limited to valid passports and visas, which meet the requirements of immigration and other government authorities at every destination. Any fines, penalties, payments or expenditures incurred as a result of such documents not meeting the requirements of those authorities will be the sole responsibility of the traveller/s.
26. The Promoter and the Sponsors make no representation as to the safety, conditions or other issues that may exist at any destination.
27. To the extent permitted by law and any direction of the relevant gaming authority, if the prize is unavailable, for whatever reason, the Promoter reserves the right to substitute the prize for aprize of equal or greater value.
28. If the prize winner is under 18 years of age, the prize will be awarded to the winner’s parent or legal guardian. Subject to any written direction given under regulation 37 of the Lotteries and Gaming Act 1993 (SA), an unclaimed prize winner selection will take place at the offices of the French Tourist Bureau, Level 13, 25 Bligh Street, Sydney 2000, on Thursday, 13th November 2014 at 12:00 (EADT). The redrawn winner will be notified directly in writing. The draw results will be published on au.rendezvousenfrance.com on the 14th of November 2014.
29. The decision of the Promoter in relation to the conduct of the Competition and the prize winner is binding and final and the Promoter and the Sponsors will not enter into any correspondence regarding the Competition result.
30. The Promoter reserves the right to require the prize winner to provide proof of identification and/or proof of residency or address details in order to claim the prize. Proof of identification, residency and address considered suitable for verification is at the discretion of the Promoter. If the prize winner cannot provide suitable proof, the prize winner will forfeit the prize in whole and no substitute or cash will be awarded in lieu of the prize.
31. The Promoter reserves the right to disqualify any entry which, in the opinion of the Promoter, contains objectionable content, profanity, potentially insulting, or defamatory statements or if the entry does not comply with these Terms and Conditions. The Promoter also reserves the right to, in its sole discretion, disqualify any Entrant whom the Promoter believes has tampered with the entry process or has engaged in conduct in relation to the Competition that the Promoter believes to be fraudulent,misleading, deceptive or generally damaging to the goodwill or reputation of the Promoter.
32. The prize winner must comply with all the conditions of use of the prize and the prize supplier's requirements. The prize winner and his/her travelling companion may also be required to sign a legal release in a form determined by the Promoter in its absolute discretion.
33. To the extent permitted by law, no responsibility will be accepted by the Promoter, the Sponsors, their related bodies corporate, employees, associated agencies or suppliers to the Promoter (together the "Parties") for any late, lost or misdirected entries or for any claim arising from the conduct of the Competition. The Promoter accepts no responsibility for outdated or incorrect contact details or contact details by which the Entrant cannot be contacted during business hours onthe relevant dates.
34. To the extent permitted by law, the Parties will not be liable for any for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense, misadventure, accident, personal injury, death, damage or claim which is suffered or sustained (whether or not arising from any person’s negligence) in connection with:
1) any travel connected with the Competition or any prize won;
2) any act or omission (whether negligent or not) of the Parties, or any person associated with any of them; or
3) any circumstances outside the Parties’ reasonable control.
35. To the extent permitted by law, if for any reason this Competition is not capable of running as planned, due to causes beyond the control of the Promoter, including but not limited to infection bycomputer virus, bugs, tampering, unauthorized intervention, fraud or technical failures, which corrupt or affect the administration, security, fairness or integrity or proper conduct of this Competition, the Promoter reserves the right in its sole discretion to take any action that may be available to it, and to cancel, terminate, modify or suspend the competition, and recommence it from the start on the same conditions subject to any government regulation.
36. In the case of the intervention of any outside person or event which changes the result or prevents or hinders the determination of the Competition, including but not limited to vandalism, power failures, tempests, acts of terrorism, natural disasters, civil unrest, strikes or any other event beyond the control of the Promoter; the Promoter may in its discretion cancel, terminate, modify or suspend the Competition and recommence it from the start on the same conditions subject to anygovernment regulation.
37. All entries become the property of the Promoter. To facilitate participation in the Competition, the Promoter may disclose an Entrant’s personal information to other companies associated with this promotion. If the information requested is not provided, the individual may not enter this promotion. By entering the Competition, unless otherwise advised, each Entrant acknowledges and agrees that the Promoter and the Sponsors collecting the Entrant's personal information and enter same in a database, and the Entrant consents to the Promoter and the Sponsors using such information for future promotional and marketing activities including, without limitation, sending the Entrant electronic messages, and for any media and publicity purposes in any media worldwide without any further reference, payment or other compensation to the Entrant.
38. By accepting the prize, the winner agrees to participate in and co-operate as required with all reasonable media editorial requests relating to the prize, including but not limited to, being interviewed and photographed, filmed and/or chaperoned throughout the duration of the prize.
39. In consideration for the Promoter awarding the prize to the prize winner, the prize winner hereby assigns to the Promoter all right, title and interest in and to all copyright in any material created in connection with the prize winner’s participation in any aspect of the prize ("Works"). The prize winner acknowledges that the Promoter is free to use the Works and to exercise its rights in relation thereto and the prize winner will not be entitled to any fee for such use.
40. Entrants' personal information may also be disclosed to State and Territory lottery departments or to another government authority, as required by law. A request to access, update or correct any personal information should be directed to the Promoter or the relevant Sponsor.
41. The benefiting parties are the FRENCH TOURIST BUREAU PTY LTD of Level 13, 25Bligh Street, Sydney NSW 2000 (ABN 57 145 096 126), AIR FRANCE (115 PITT ST - LEVEL 17 2000 SYDNEY - ABN: 46 946 036 913), DRIVEAWAY (Level 1, 157 Walker Street, North Sydney, NSW, 2060, Australia ABN: 67 107041 912)
Flight Terms and Conditions ( AIR FRANCE)
• Travel is subject to availability in T class. It is appreciated that you give us at least 7 working days prior notice from the intended travel date, but we suggest booking your travel date as early as possi-ble to ensure availability.
• Please note that Air France has a blackout period over Christmas & Easter. Please note also that flights during holidays are usually heavily booked. We advise you to book early.
• Ticket must be issued before 31 December 2014 but travel is permitted until 10 September 2015.
• Travel between Australia and Asia is to be on the services of one of Air France partner in economy class.
• Travel between Asia and Paris is to be on the services of Air France in economy class. • Validity of the ticket(s) is 6 months from the date of departure and all tickets are to be used to-gether, on the same travel date.
• Date change permitted within the 6 months’ validity at a fee of AUD180.
• Air France prize winner’s tickets are not transferable, not cash-redeemable, non-upgradeable and their validity cannot be extended. (The winner of the ticket(s) must be among the travelers)
• Any taxes and/or surcharges, and additional costs are not included in the prize and are at the Prize Winner’s own expense and responsibility
• Frequent flyer points will not be awarded on this airfare.
DriveAway Holidays Terms and Conditions:
The voucher prize of $1,000 is redeemable for Car Hire, Peugeot Leasing or Motorhome Rentals in France at locations offered by DriveAway Holidays and must be redeemed for travel by 30 September 2015.
Vehicles are subject to availability, and blackout dates may apply.
Minimum driver’s age applies to products provided by DriveAway Holidays and an additional young drivers surcharge may be applicable to the supplier by the winner if under 25 years.
If the winner falls under the minimum age requirement, the DriveAway Holidays voucher will be forfeited unless an alternative product can be provided.
The driver must hold a full drivers licence.
The prize does not include additional charges imposed directly by the supplier of the car rental vehicle e.g. one way fees, child seats, GPS rental, additional driver fee, young drivers’ surcharge which must be covered at the prize-winner’s own expense. The prize-winner will be liable for the excess charged by the supplier in the event of damage or theft to the rental vehicle. Upon collection of the vehicle, this amount will be frozen on the prize-winner’s credit card until the vehicle is returned.
The prize does not include fuel.The voucher value is non-transferable or redeemable for cash. Further conditions may apply.
