TERMS & CONDITIONS:
1. Instructions on how to enter and prizes form part of these conditions of entry. Participation in this promotion is deemed acceptance of these conditions of entry. Only entries which are submitted and comply with these conditions of entry may take part in this competition.
2. The Promoter is Bauer Media Pty Ltd (ABN 18 053 273 546) of 54-58 Park Street, Sydney, NSW 2000 (Phone: 02 9282 8000) (‘Promoter’).
3. Studiocanal Pty Limited of Level 50, 680 George Street (‘Studiocanal’) shall for the purposes of this promotion two (2) x Adult Return Economy flights only, as specified in clause 14(a) of these conditions of entry.
4. CIT Europe Pty Limited trading as CIT Holidays (ABN 29 603 169 204) (‘CIT Holidays’) shall provide for the purposes of this promotion the Italy tours, rail passes and accommodation only, as specified in clause 15(b) of these conditions of entry.
5. Studiocanal and CIT Holidays will be hereunder referred to as ‘Suppliers’.
6. Entry is open to all permanent residents of Australia aged 18 years and over only. Employees of the Promoter, Suppliers, the Promoter’s agents associated with this promotion and the immediate family of those employees, are not eligible to enter. All entrants must enter the competition for recreational purposes only. Any prize winner under the age of 18 must be accompanied by a parent/guardian and that parent/guardian must be at least 25 years of age.
7. Only one entry per person will be permitted.
8. The promotional period commences at 12.01am (AEST) on 17th March 2016 and closes at 11:59pm (AEST) on 17th April 2016 . The judging will be done by an independent panel of judges appointed by the Promoter. The judging will take place at Bauer Media, 54 Park Street, Sydney NSW 2000 and will begin on 26th April 2016. The winners will be notified by email using contact details provided in their entry.
9. To enter, entrants must go to http://gourmettraveller.com.au/ and follow the prompts to the competition entry page during the promotional period, and fill in the entry form including their full name, age, mailing address, current email address, daytime telephone number and answer to the competition question in 25 words or less “What Italian meal transports you to Italy and why?” and submit the entry as instructed.
10. This is a game of skill; chance plays no part in determining the winner. Each entry will be individually judged based on its literary and creative merit of the answer to the question provided and suitability to the promotion. All entries must be received by 11.59pm (AEST) on 17th April 2016. No entries will be accepted after this date. Entries must be correct, complete and comprehensible. Incomplete, damaged or incomprehensible entries will be deemed invalid. The judges’ decision in relation to any aspect of the competition will be final and binding on every person who enters. No correspondence will be entered into.
11. The Entrant warrants to the Promoter that the entry submitted is an original artistic work of the Entrant that does not infringe the rights of any third parties. If the entry or any part of the information provided to the Entrant in relation to the entry was provided by a third party, the Entrant warrants that they have obtained the relevant copyright permission to submit the entry for the purposes of this promotion. The entrant agrees to indemnify the promoter against all claims and costs by third parties arising from a breach of the warranty set out in this condition.
12. The Promoter is entitled to use any of the entries submitted in any manner and for any purpose at its absolute discretion, including using the entries for future promoter’s or their agents book publications, promotional, marketing and publicity purposes without any further reference or payment or other compensation to the entrant. The promoter is entitled to amend, edit, select, crop, retouch, add to or delete from any part of the submitted entry.
13. Entries must not be offensive, defamatory or racist. Any entry which the judges deem inappropriate will be invalid. The entrant agrees to indemnify the Promoter.
14. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions will be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
15. The best one (1) valid entry as determined by the judges will be deemed the major prize winner and will win:
a) Two (2) x Adult Return Economy flights from the winner’s closest Australian capital city (either: Sydney, Melbourne, Perth, Brisbane, Adelaide) to Rome and then departing from Venice to the winner’s closest Australian capital city (from which they departed) valued at approximately five thousand six hundred and eighty four Australian dollars (A$5684.00) (including taxes, depending on point of departure);
b) Italy tour for eight (8) nights from CIT Holidays including: eight (8) nights at a minimum four (4)-star accommodation (at Promoter’s discretion), Breakfast daily, First class rail tickets for two (2) adults to Rome/ Florence/ Venice, Ancient Rome walking tour, Welcome to Florence tour, Gondola tour in Venice) valued at approximately three thousand nine hundred Australian dollars (A$3900.00) (including taxes).
Total prize pool for the entire promotional period has a retail value of approximately nine thousand five hundred and eighty four Australian dollars (A$9584.00) (including taxes, depending on point of departure). Prize does not include any ancillary costs associated with redeeming this prize. These are the responsibility of the winner.
16. Prize is for 2 adults only. The winner’s travel companion must be over the age of 18 years old.
17. The flights and tours must be booked and redeemed in full and as a package by 27th April 2017. The flights, accommodation, domestic transfers, tours and any other bookings are subject to availability and subject to the conditions of the airlines and other suppliers of the various elements of the prize at the time of booking. Blackout periods may apply. The prize cannot be taken on school holidays, Christmas, New Year’s holidays, Easter holidays.
18. Date changes are not permitted once the booking has been finalised. Once the booking is confirmed and ticketed, normal cancellation charges apply and will be the sole responsibility of the winner. Refer to CIT HOLIDAYS brochure for full booking conditions
19. The Promoter is neither responsible nor liable for any loss or damage suffered in the event that the CIT Holidays Italy tour or any arranged tours within the package is postponed, cancelled, rescheduled or relocated for any reason whatsoever. If unforeseen circumstances beyond the Promoter control require a change in the prize, departure or any part of the tour, CIT Holidays will provide the winner with an alternate holiday of equal value at CIT Holidays discretion
20. Travel insurance, domestic airfares if required, any additional meals (excluding breakfasts provided by hotels), any additional sightseeing or activities, any additional accommodation, any additional travel expenses, other transfer costs, personal spending money, passports, travel visas required, transport to and from departure point and all other ancillary costs, as well as obtaining any of these, are the responsibility of the winner and their travel companions. Prize also excludes medical expenses, travel insurance, visas, passports, items of a personal nature, beverages, optional tours not outlined, laundry, telephone calls, additional nights, room upgrades or other ancillary costs associated with redeeming the prize other than those specified. These costs and expenses are the responsibility of the winner. Any extension to the duration of the prize is at the winner’s sole expense and subject to availability at the time of booking.
21. It is a condition of accepting the prize that the winner may be requested to present their credit card upon arrival at any hotel to cover all incidentals they may incur including their stay at that hotel. The winner will also be required to pay a city tax in the local currency directly to all hotels at the time of checkout (approximately four (4) Euros per person per night).
22. Changes to flight schedules may require additional overnight accommodation at either commencement, during the itinerary, or on completion of tour. Any such accommodation is not included in the prize and will be the responsibility of the winner.
23. Prize must be taken as offered. The prize, or any unused portion of the prize, is not transferable or exchangeable and cannot be redeemed as cash. Winner(s) cannot change, vary, substitute or extend any element of the prize (in whole or in part). The prize cannot be used in conjunction with any other special offer. The prize is valued in Australian dollars. The Promoter accepts no responsibility for any variation in the prize value. Prize winner is advised that tax implications may arise from their prize winnings and they should seek independent financial advice prior to acceptance of their prize. In the event that a portion of the prize is awarded to the winner in the form of a voucher / ticket / pass/ letter, redemption of that portion of the prize will be subject to the terms and conditions stipulated on the voucher / ticket / pass/ letter. The Promoter will not be liable for any voucher / ticket / pass/ letter that has been lost, stolen, forged, damaged or tampered with in any way.
24. The winner (and their companion) are responsible for all other expenses including spending money, meals (unless specified), drinks, transfers (unless specified), laundry charges, activities (unless specified), incidentals, energy surcharges, gratuities, services charges, passports, visas, travel insurance and all other ancillary costs. Travel insurance is highly recommended to protect against the additional costs incurred in the event of unforeseen circumstances.
25. Unless expressly stated in these terms and conditions all other expenses (including travel to and from the departure point) become the responsibility of the winner.
26. A current valid passport (with at least 6 months validity as at date of departure) is required for all international journeys. It the responsibility of the winner and their travel companions to ensure they have all required travel documentation (including but not limited to passports & visas) as required for travel to the destination point and for the entire period of the stay in Italy. All costs associated with obtaining this travel documentation is the responsibility of the winner.
27. The two (2) flights must be utilised at the same time, for the same travel dates, to the same destination.
28. As a condition of accepting the prize, prize winners may be required to provide supporting identification. The winner (and their companion) must sign any legal documentation as and in the form required by the Promoter and/or Suppliers in their absolute discretion, including but not limited to a legal release and indemnity form in a form determined by the promoter in its absolute discretion. The promoter reserves the right to refuse to allow a winner to take part in any or all aspects of the prize, if the promoter determines, in their absolute discretion, that a winner is not in the mental or physical condition necessary to be able to safely participate in the prize.
29. In the event that for any reason whatsoever the winner does not take any element of the prize at the time stipulated by the Promoter, then the prize will be forfeited by the winner, with no compensation or further liability of the Promoter. Cash will not be awarded in lieu of the prize.
30. In the event that a prize, or part of a prize, is unavailable, the Promoter reserves the right to substitute the prize or part of the prize in its discretion with an alternative prize or part of the prize to the same and equal recommended retail value and/or specification.
31. The promoter is neither responsible nor liable for any late, lost or misdirected mail (including but not limited to prizes).
32. The Promoter is not responsible nor liable for any prize damaged in transit in the delivery of their prize
33. Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used.
34. In the event of unforeseen circumstances, including but not limited to the intervention of any outside agent, war, terrorism, civil unrest, strikes, vandalism, power failures, tempests, state of emergency or disaster (including but not limited to natural disaster), acts of God or any other event which changes the result of the promotion or prevents or hinders its determination, the Promoter reserves the right to subject to reference to all relevant state and territory rules and regulations, to cancel, terminate, modify or suspend the promotion, including the right to recommence it from the start on the same conditions subject to any government regulation.
35. If a medical circumstance in some way restricts your ability to enter the competition through the required mechanic, you are still eligible to enter however you must briefly state your circumstances upon entry.
36. If your entry is selected as a winning entry, validation of your circumstances/ the validity of your entry will be undertaken by the Promoter. Method of validation (without limitation) will be determined by the Promoter in its complete discretion.
37. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter, Suppliers and associated agencies (including its respective officers, employees and agents) exclude all liability (including negligence), for any personal injury or death; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion, the use of a prize or any act or omission (whether negligent or not) of the Promoter.
38. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter and its associated agencies (including its respective officers, employees and agents) are not responsible for and exclude all liability (including negligence), for any personal injury or death; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use of the prize.
39. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the reasonable control of the Promoter, which corrupt or affect the administration security, fairness or integrity or proper conduct of this competition, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant who tampers with the entry process; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
Privacy:
40. The Promoter and Suppliers collect personal information (“PI”) in order to enter contestants in the promotion and conduct the promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. If an entrant does not provide the Promoter with all or part of the personal information requested, the Promoter may not be able to enter the entrant into the competition. The Promoter will also use and handle PI as set out in its privacy policy, which can be accessed by visiting http://www.bauer-media.com.au/privacy.htm. In addition to any use that may be outlined in the Promoter’s Privacy Policy, the Promoter may also, for an indefinite period, unless otherwise advised, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages (such as email or SMS) or telephoning the entrant. Entrants should direct any request to opt out, access, update or correct PI to the Promoter and direct any complaints regarding treatment of their PI according to the Privacy Policy. If an entrant wishes to opt out of receiving electronic messages they need only reply to any received message and include in that reply the word "unsubscribe". All entries become the property of the Promoter and will not be returned.
