The Promotion is a game of skill and chance plays no part in determining the winner. The Promoter is Entertainment One Films Australia Pty Ltd (ABN 73 149 606 726), Level 2, 28-30 Queen Street, Chippendale, NSW 2008, phone (02) 8303 3800.
Promotion commences at 9:00 AM [AEDT] on [24th January 2017] and closes at 11:59 PM AEDT on [Wednesday 8th February 2017]
Entry is restricted to residents of Australia.
There is one (1) major prize to be won.
The total prize pool value is up to AUD$8,284.95
The Major Prize winner will receive a trip for two (2) adults to NEW YORK, UNITED STATES OF AMERICA (“New York”) (“the Major Prize”).
The Major Prize includes:
Return economy Virgin Australia flights from the Major Prize winner’s nearest capital city within Australia to SYDNEY, AUSTRALIA (“Sydney”) (transfer at Sydney);
Return economy (Main Cabin) airfares for two (2) adults from Sydney to New York flying with Delta Air Lines valued at AUD$4,000;
Airport-hotel return transfers for two (2) adults valued at AUD$250;
Five (5) nights’ accommodation in minimum three (3) star twin-share accommodation in New York based valued at AUD$2,000; and
A copy of “The Girl on the Train” on DVD valued at AUD$34.95.
Major Prize is valued at up to AUD$8,284.95 as at 16.01.2017.
To enter the Promotion, entrants must provide their name, address, email and phone number and answer on the entry page the skill question “TELL US IN 25 WORDS OR LESS WHY YOU LOVED THE FILM THE GIRL ON THE TRAIN”.
The Promoter will, at its discretion, select the best answer/s based upon originality, creativity, and adherence to the word limit. Chance plays no part in determining the winner. The Promoter’s decision is final and no correspondence will be entered into.
Each entry must be the entrant’s original work. By entering the Promotion, entrants consent to the Promoter making copies of the whole or any part of their entry and otherwise exploiting the entry to publicise the Promotion or for any other purposes and undertake to the Promoter that their entry is not, and its use by the Promoter will not be, in breach of any third party intellectual property rights.
Entries that in the Promoter’s opinion are offensive, defamatory or otherwise inappropriate or that infringe any third party rights will be invalid.
Entries will be judged at the Promoter’s premises within five (5) business days after the Promotion’s closing date. The Promoter will attempt to contact the Major Prize Winner two (2) times by phone and two (2) times by email to claim their prize within three (3) weeks after verification of their entry. Minor prize winners will have their prize mailed to the address provided in their entry within four (4) weeks of verification of their entry. Winners can claim prizes by contacting the Promoter by email, phone or post.
Should any prize be unclaimed 5 business days after winner notification, a new winner or winners will be selected, in accordance with the above procedure.
Prizes will be awarded to the person named in their contestant entry. Should an entrant’s contact details change during the Competition Period it is the entrant’s responsibility to notify the Promoter. A request to access or modify any information provided in an entry should be directed to the Promoter.
Names of Major prize winner will be published on the Promoter’s website at www.eonehub.com.au within five business days of judging.
Participation in the Promotion is deemed acceptance of these Terms and Conditions. These Terms and Conditions must be read together with the terms provided on the Promotion entry page. In the event of any conflict, the terms on the entry page supersede any conflicting terms in these Terms and Conditions.
The Major Prize travel must be booked on or before Friday 30 June 2017 and is subject to booking and availability.
The Promotion closes at midnight on the closing date advertised on the entry page. The time of entry will in each case be the time the online entry is received by the Promoter’s database. The Promoter accepts no responsibility for any late, lost or misdirected entries due to technical disruptions or for any other reason.
Entry is limited to one per person. Any additional entries citing the same email address will be disqualified. Employees of the Promoter, their partners, agents and suppliers associated with the Promotion and their immediate families are not eligible to enter. Incomplete, indecipherable or illegible entries will be deemed invalid.
Any entrant under the age of 18 must obtain permission from their parent or legal guardian before entering the Promotion.
“The Girl on the Train” DVD is rated MA 15+ and as such viewer discretion is advised for those under the age of 15 years.
Entry into the Promotion is free. However, any costs associated with accessing the entry page are the responsibility of the person seeking access and are dependent on the internet service provider used.
The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or with the terms on the entry page or who tampers with the entry process. All entries become the property of the Promoter. Entrants consent to the Promoter and prize suppliers using the entrant's name, likeness, image and/or voice in the event they are the winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting the Promotion (including any outcome), and promoting any products or services manufactured, distributed and/or supplied by the Promoter or prize suppliers associated with the Promotion.
If the Promotion is interfered with in any way or is not capable of being conducted as anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) to modify, suspend, terminate or cancel the Promotion. The Promoter reserves the right to substitute a prize with a prize of equal or greater value if a prize is for some reason unavailable.
The details contained in your entry are protected by security safeguards as detailed in the Promoter’s Privacy Policy. Entrants’ personal information is collected to enable identification of the winners. Your personal information will only be disclosed to the Promoter and its related bodies corporate for these purposes. Your personal information will only be disclosed to any third party to the extent necessary to fulfil a prize and for no other reason without your consent.
With the major prize Winner’s express consent to do so, Delta Air Lines will handle all personal information collected in accordance with applicable privacy laws, as well as with DELTA'S PRIVACY POLICY which can be accessed at https://www.delta.com/content/www/en_US/privacy-and-security.html. Entrant’s registered personal information will not be used by any third parties other than those selected on Delta’s behalf, and their respective employees or agents
Should an entrant’s contact details change during the promotional period, it is the entrant’s responsibility to notify the Promoter. A request to access or modify any personal information should be directed to the Promoter.
Prize values are based upon the recommended retail prices at the opening date of the Promotion (inclusive of GST). The Promoter accepts no responsibility for changes in prize value between then and the prize redemption date.
In acceptance of the prize, the Winners acknowledge that they may incur ongoing costs associated with the prize which are the entire responsibility of the winners.
Winners should seek independent financial advice as tax implications may arise from accepting a prize.
Prizes are not transferable, exchangeable or redeemable for cash. If for any reason the winner does not take the prize or an element of the prize by the time stipulated by the Promoter, then the prize or that element of the prize will be forfeited. Prizes cannot be used in conjunction with any other special offer. Without limiting the foregoing, the Promoter may, at its absolute discretion, substitute cash for any prize (the amount of cash being equal to the prize value).
In order to participate in the Promotion and/or the activities which may be awarded as part of the prize, the winner (and their companion/s, as applicable) must comply with any applicable height, weight, health, fitness, skill, and any other requirements normally associated with the particular activity. It is the entrant’s responsibility to ensure that they (and their companion/s, as applicable) are sufficiently healthy and fit so as to safely participate in the Promotion and/or undertake the activities awarded as part of the prize. The Promoter and applicable prize supplier/s reserve the right to disallow the winner and/or their companion to take part in any or all aspects of the Prize, if the Promoter or supplier determines, in its absolute discretion, that the winner and/or their companion is not in the mental or physical condition necessary to safely participate in the Promotion or prize.
If the Promotion is communicated about or administered on Facebook® it is in no way sponsored, endorsed or administered by, or associated with, Facebook®. Entrant information is provided to the Promoter and not to Facebook®. Each entrant completely releases Facebook® from any liability in connection with this Promotion.
Entrants acknowledge that the prizes may be subject to additional terms and conditions imposed by third parties. The winner must become acquainted with any such additional terms and conditions prior to taking the prize.
The Promoter, its partners, agents and suppliers make no representations or warranties as to the quality, suitability or merchantability of any goods or services offered as prizes. To the extent permitted by law, the Promoter, its partners, agents and suppliers are not liable for any loss or damage suffered to person or property by reason of any act or omission, deliberate or negligent, by the Promoter or its partners, agents or suppliers or its or their employees, in connection with the supply of goods and services to the prize winner/s and, where applicable, to any persons accompanying the prize winner/s. This clause does not affect any rights a consumer may have which are unable to be excluded under Australian law. To the fullest extent permitted by law, any liability of the Promoter, its partners, agents and suppliers for breach of any such rights is limited to the payment of the costs of having the prize supplied again.
Flight and accommodation prizes are subject to availability and applicable hotel and airline standard terms and conditions.
All aspects of the prize must be taken together as a package. All travel arrangements are subject to availability. Travel, accommodation and associated activities cannot be changed or cancelled once any bookings have been made.
Any winner under the age of 18 must be accompanied by a parent or guardian for the duration of any travel prize.
As a condition of taking the Major Prize, the winner and/or their companion are required to obtain suitable travel insurance at their own expense.
Unless specified, the prize winner/s and their companion/s are responsible for all other expenses including food and beverages, spending money, meals, drinks, transfers, activities, taxes (excluding departure and any other flight associated taxes included within the prize), gratuities, service charges and all other costs.
Return economy airfares from Winners capital city to Sydney for two (2) people included in the Major Prize (as stated above) will only be supplied if the prize winner does not live in New South Wales. If the winner is from New South Wales they will forfeit the flight component of the prize and must make their own way to and from the departure airport.
Dates of travel within holiday periods are subject to availability. Blackout dates will apply unless specifically pre-arranged prior to the competition being run. Blackout dates include Christmas, Easter and School & Summer holidays. Travel is not permitted on Friday, Saturday and Sunday departures. Flights are subject to availability on T class and blackout dates apply. Blackout dates include Saturday 8 April 2017 to Tuesday 25 April 2017, Saturday 1 July 2017 to Monday 17 July 2017, Saturday 23 September 2017 to Sunday 8 October 2017, Saturday 16 December 2017 to Sunday 31 December 2017.
Travel is valid until Sunday 31 December 2017. Winners who do not travel within this period must forfeit all prize elements and the prize will become null and void and will no longer be entitled to their grand prize. The Major Prize Winner must advise The Promoter of their intended dates of travel on or before Friday 30 June 2017.
Air tickets are available on the regular scheduled services of each airline and are subject to seasonal embargos. The Promoter has the right to determine the airline carrier at its discretion. In the event that a winner requests a specific carrier, not offered by the Promoter, any subsequent or additional fees and taxes, if applicable will be the responsibility of the winner. Flight itinerary may have to be adjusted depending on the airlines departure city and their current flight schedule. Frequent Flyer points are not available from any airline. The Promoter is not responsible for the cancellation, delay or rescheduling of any part of a travel Prize and any costs incurred by the winner or any travelling companion(s) as a result (including accommodation costs) will be the responsibility of the Major Prize winner.
Once confirmed in writing, travel dates and names of those travelling are not changeable without incurring extra fees. The Promoter do not accept responsibility for any fees incurred as a result of any changes made and these costs will be borne by the Major Prize Winner and their companion.
The prize winner and their travelling companion must travel at the same time, depart from the same capital city and are responsible for transport between their place/s of residence and the departure/arrival airport in both directions.
It is the winner/s and their companion’s personal responsibility to ensure that they have valid documentation, including but not limited to valid passports and visas, which meet the requirements of immigration and other government authorities at every destination. Any fines or penalties incurred as a result of such documents not meeting the requirements of those authorities will be the sole responsibility of the travellers.
The Major Prize Winner, or their travelling companion, may be required to provide a credit card in order to check-in at the hotel for a security deposit, and to cover any incidental charges.
The Promoter, its partners, agents and suppliers make no representation as to the safety, conditions or other issues that may exist at any destination and the prize winner/s should satisfy themselves of the suitability of the travel destination prior to departure. The winner/s is advised to consult the website of the Australian Department of Foreign Affairs and Trade (www.dfat.gov.au) and make independent enquiries.
