TERMS AND CONDITIONS
Information on how to enter and the prizes form part of these Terms and Conditions. Participation in this competition is deemed acceptance of these Terms and Conditions.
To enter the competition individuals must be:
a)        an Australian or New Zealand Citizen; and
b)        aged 18 years old or over at the time of entry.
Employees (and their immediate families) of the Promoter, Blue Illusion retailers, Evergreen (A division of Scenic Tours Pty Ltd ABN 85 002 715 602(“Evergreen Tours”) and agencies associated with this competition are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
The competition commences on 22nd October 2015 and ends at 11.59pm AEDST on 30th November 2015 (“Competition Period”).
To enter, individuals must visit www.blueillusion.com.au, follow the prompts to the competition page, answer all questions and provide any personal details requested, then input their answer to the What two favourite wardrobe pieces would you pack for your European River Cruise and why?” in 25 words or less, and submit the fully completed online entry form during the Competition Period.
The best valid entry, as determined by the judges will win a deluxe European River Cruise with a trip to Paris for two including return economy flights valued at AU$15,030. The Prize includes an 8 day deluxe Evergreen Tours European River Cruise from Nuremberg to Amsterdam in a Category C Balcony Suite, followed by a 4 day Paris Escape with return economy flights and airport transfers for two people.Any ancillary costs associated with redeeming the prize are not included.

TERMS & CONDITIONS
 The prize is one Emerald Balcony Suite (Category C) on an Evergreen Tours Emerald ‘Star Ship’ sailing between Nuremberg and Amsterday on May 5, 2016 or September 8, 2016 departures in either a twin share or a double room.
    Winners must advise Evergreen Tours of their preferred travel dates by Friday 18 December, 2015
    The Prize must be taken by 1st November 2016.
    The Prize is strictly non-transferable and non-negotiable, and may not be replaced or refunded.
    The Prize does not include any costs associated with travelling to and from the departure and arrival port(s) in Australia, flights, or airport transfers – these are at the winner’s own expense.
    Evergreen Tours is not responsible for any additional or incurred costs while winner is travelling.
    The Prize cannot be used towards flights only, travel insurance, items of a personal nature, meals (other than featured in the itinerary), laundry, telephone calls, additional nights or upgrades.
    The Prize can only be used towards new bookings only.
    Accepting the Prize is subject to any prevailing Terms and Conditions of Evergreen Tours. Please refer to the brochure of your travelling destination for more details.
    If applicable, a valid passport is required for all international journeys with at least 6 months validity from the date of return.
    If applicable, names as per passport and dates of birth for all travelers are required at the time of reservation.
 
    The judges may select additional reserve entries which they determine to be the next best, and record them in order, in case of an invalid entry or ineligible entrant.
    No purchase necessary to enter.
    Only one entry permitted per person.
    No responsibility can be accepted for entries that are lost or delayed, or which are not received for any reason.
    Incomplete or indecipherable entries will be deemed invalid.
    Incorrectly completed entries will be disqualified.
    If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
    The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions will be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
    This is a game of skill and chance plays no part in determining the winner. Each entry will be individually judged based on literary and creative merit of the answer provided to the promotional question.
    The judges’, Promoter’s and Evergreen Tours decisions will be final, and no correspondence will be entered into.
    If for any reason the winner does not take the prize by the time stipulated by the Promoter or Evergreen Tours, then the prize will be forfeited.
    If the prize is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize with a prize to the equal value and/or specification.
    Total prize pool value is AU$15,030.
    The prize, or any unused portion of the prize, is not transferable or exchangeable and cannot be taken as cash.
    All entries (which shall include photographs) submitted become the property of the Promoter and Evergreen Tours. Entries will not be returned to any entrant. Each entrant warrants to the Promoter and Evergreen Tours that each entry submitted is an original literary work of the entrant that does not infringe the rights of any third party.  Entrants agree to indemnify the Promoter and Evergreen Tours against all costs and claims by third parties arising from a breach of this warranty. Entrants consent to any use of their entry which may otherwise infringe their moral rights pursuant to the Copyright Act 1968 (Cth).
    Entrants consent to the Promoter and Evergreen Tours using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter and/or Evergreen Tours .
    If this competition is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter and/or and Evergreen Tours , including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter and/or Evergreen Tours  reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) to modify, suspend, terminate or cancel the competition, as appropriate.
    Any cost associated with accessing the competition website is the entrant’s responsibility and is dependent on the Internet service provider used.
    Evergreen Tours will endeavour to send the prize to the winner within a month of the competition end date but cannot guarantee this delivery time.
    The Promoter and Evergreen Tours  collects personal information in order to conduct the competition and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers and prize suppliers, including Evergreen Tours. Entry is conditional on providing this information and entrants can opt out at any time after the competition has ended. The Promoter and Evergreen Tours may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. Entrants should direct any request to access, update or correct information to the Promoter or Evergreen Tours .
    Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter and Evergreen Tours (including their respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the competition.
    Except for any liability that cannot by law be excluded, includingthe Non-Excludable Guarantees, the Promoter and Evergreen Tours  (including their respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s or Evergreen Tour’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter or Evergreen Tours ) due to any reason beyond the reasonable control of the Promoter or Evergreen Tours; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use of the prize.
    As a condition of accepting the prize, the winner must sign any legal documentation as and in the form required by the Promoter and/or Evergreen Tours in their absolute discretion, including but not limited to a legal release and indemnity form.
    The laws of Australia apply to this competition to the exclusion of any other law. Entrants submit to the exclusive jurisdiction of the courts of Australia.
