Bakers Delight 'Take off with Brioche' Competition - Terms & Conditions
ACCEPTANCE OF CONDITIONS
1. These terms and conditions (“Terms”) govern the entry into by entrants (“Entrants”) and conduct of the Bakers Delight Take off with Brioche Competition (“Competition”).
2. Information regarding prizes and how to enter the Competition forms part of the Terms. By entering the Competition, Entrants accept the Terms.
3. The Entrant is responsible for ensuring his or her familiarity with the Terms at the time of participation.
4. The Promoter’s decision not to enforce a specific provision of the Terms (whether communicated to an Entrant or not) does not constitute a waiver of that provision or of the Terms generally. All Entrants acknowledge that the Promoter can rely on the Terms even if the Promoter learns of an Entrant’s ineligibility after the Promoter has awarded a prize to the ineligible person. Return of a prize to the Promoter may be required by the Promoter if this occurs.
5. The Promoter reserves the right to alter these Terms at any time.
RESTRICTIONS ON ENTRY
6. Entry to the Competition is open to all Australian residents and New Zealand residents who are aged 18 years or over who have fulfilled the requirements set out in clause 8 below (“Eligible Entrants”) except directors, management, officers, employees, franchisees and employees of franchisees (and the immediate family members of directors, management, officers, employees, franchisees and employees of franchisees) of the Promoter, of the Promoter’s related corporations, of the Promoter’s advertising and sales promotion agencies or of any other suppliers, agencies or entities associated with this Competition.
DURATION OF COMPETITION
7. The Competition begins at 7.00am (AEST) on Thursday 19 July 2018 and closes at 11.59pm (AEST) on Wednesday 5 September 2018 (the “Competition Period”).
METHOD OF ENTRY
8. To enter the Competition and be eligible to win, an Entrant must:
a. During the Competition Period, purchase any of the following “Brioche Delight” products from any Australian and New Zealand bakery:
a. Choc Jam Brioche Delight;
b. Biscuit Crunch Brioche Delight;
c. Lamington Brioche Delight; and/or
d. Lemon & Coconut Brioche Delight,
b. Retain the entry card featuring a unique code (“Entry Card”) which will be provided to the Entrant at the time of purchase of a Brioche Delight Product; and
c. Enter their details and unique code on the website listed on the card including, but not limited to first and last name, valid email address, valid phone number, date of birth, unique code, country of residence, and must agree to these Terms.
9. Entrants may only enter the Competition in their own name.
10. Incomprehensible, illegible, and/or incomplete entries may be deemed by the Promoter to be invalid.
11. The Promoter reserves the right at all times to verify the validity of entries and to disqualify any Entrant who the Promoter believes either has tampered with the entry process or has submitted an entry otherwise than in accordance with these Terms.
12. Each Entrant may only submit one entry per transaction in which the Entrant purchases Brioche Delight Products, provided that such entry complies with these Terms. For the avoidance of doubt, an Entrant may submit more than one entry to the Competition during the Competition Period if the Entrant purchases more than one Brioche Delight Product in more than one transaction.
13. The Promoter will issue or cause to be issued an Entry Card to each Entrant at the time of purchase of a Brioche Delight Product.
14. All entries must be received on the website listed on the Entry Card by the Promoter during the Competition Period. Entries are deemed to be received by the Promoter at the time they are received by the Promoter??s website database and not at the time of submission by the Entrant.
15. The Promoter is not liable for any late, lost, incomplete, incorrectly submitted, delayed, illegible, corrupted or misdirected entries or any claims due to error, omission, tampering, deletion, theft, communications failure or any other matter. All such entries will be deemed invalid.
16. The Promoter has no control over communications networks, including the Internet and the website, and is not liable for any problems associated with them due to traffic congestion, technical malfunction or otherwise. The Promoter is not liable for any consequences of user error including (without limitation) any costs incurred.
17. Entrants are responsible for their own costs associated with purchasing the Brioche Delight Product, accessing the website and entering the Competition.
DRAW DETAILS
18. This is a game of chance competition.
19. The Prize will be drawn at Bakers Delight Support Office, Level 1, 293 Camberwell Rd, Camberwell VIC 3124 at 2.00pm (AEST) on 12 September 2018 using an approved electronic random draw system in which each Entrant has an equal chance of winning the Prize.
20. The first valid entry to be randomly drawn by the Promoter from all eligible entries will win the Prize as detailed in clauses 21 (“the Winner”). A Justice of the Peace will witness the draw.
PRIZE DETAILS
21. There is one (1) Prize to be won in the Competition consisting of:
a. return economy flights for the Winner and a companion (two adults) from their closest capital city in Australia or New Zealand to Paris, France; and
b. 10 nights’ accommodation for the Winner and a companion at a 5 star hotel in Paris, France chosen by the Promoter (“Hotel”);
c. breakfast daily at the Hotel for the Winner and a companion;
d. return transfers from the airport to the hotel in Paris and from the hotel to the airport for two people;
e. a 6 day Paris pass for the Winner and a companion to over 60 attractions; and
f. full comprehensive travel insurance for the Winner and a companion with an insurer determined by the Promoter,(“the Prize”).
22. The Prize is subject to the terms and conditions specified by the Prize suppliers including as to validity.
23. If the Winner wishes to travel during “blackout” travel periods, such as school holidays or other blackout periods stipulated by the airline or Hotel, a surcharge may apply which depends on the season and the date of travel. The Winner will be responsible for bearing the costs of any such surcharge payable to the airline and/or Hotel. The winner has to book the trip within 12 months of winning.
24. As at the date of publication of these Terms, the total Prize pool is valued at approximately $15,000. The Promoter accepts no responsibility for any change in the Prize value after this date.
25. Prize inclusions are subject to variation and availability.
26. Travel arrangements will be made by Flight Centre Travel Group Ltd (ACN 003 377 188) trading as Flight Centre (“Flight Centre”), subject to booking availability.
27. The Winner and their one (1) travel companion must all be over the age of 18 years and comply with Flight Centre’s booking terms and conditions.
28. In the event the Winner does not take the Prize at the date stipulated by Bakers Delights, the entire Prize will be forfeited by the Winner and cash will not be awarded in lieu of the Prize.
29. The Winner is responsible for all costs and expenses incurred by the Winner and his/her travel companion in connection with or associated with the Prize, including but not limited to passports, any further transfer costs, visas, meals, drinks, transport from home to the airport and back, tours, luggage, activities, gratuities, service charges, telephone calls, laundry, room service, mini-bar, incidentals, spending money, transportation costs, taxes, insurance and other ancillary costs as incurred.
30. A credit card imprint and deposit is required from the Winner or their travel companion at check-in to the Hotel.
31. The Winner and their travel companion must ensure they are fit to travel and have received appropriate immunisations, health checks and visas prior to redeeming the Prize. Unless otherwise specified, the Winner and their travelling companion must depart and return at the same time using the same air carrier.
32. Any alterations or extensions to the Prize will be at the sole expense of the Winner and their travelling companion.
33. The Promoter shall not be responsible for the cancellation, delay or rescheduling of any part of the Prize and any resulting costs incurred by the Winner and/or their travelling companion (including accommodation costs).
34. The Winner must agree to comply with the airline’s and Hotel’s terms and conditions.
CHANGES IN PRIZE VALUE
35. The Prize is not transferable, refundable or exchangeable and cannot be redeemed for cash or other prizes.
36. The Promoter is not responsible for any variation in the value of the total Prize pool.
37. The Promoter may substitute the Prize for another prize (at its absolute discretion) if the substituted prize is similar to and is of the same value as or a greater value than the original Prize and the Promoter and the Winner agree, in writing, to the substitution of the original Prize for the other prize.
NOTIFICATION OF WINNER
38. The Winner of the Competition will be notified by the Promoter by email and telephone call by 2.00pm (AEST) on 14 September 2018.
39. The Winner’s name and State or Territory of residence will be published by the Promoter’s on the websites: https://www.bakersdelight.com.au/win and https://www.bakersdelight.co.nz/win and announced on the Bakers Delight Facebook page on 21 September.
UNCLAIMED PRIZE DRAW
40. The Prize must be claimed by the Winner by responding directly to the notification from the Promoter referred to in clause 38 above by no later than 5.00pm (AEST) on 14 December 2018.
41. Subject to clause 40 and clause 43, the Prize will be sent to the Winner by no later than 12 October 2018 or such other date agreed by the Winner (provided that the Promoter receives the Winner’s contact details, proof of identity and proof of age).
42. The Promoter reserves the right to determine in its absolute discretion the form of identification that is required to verify the Winner. The Promoter takes no responsibility for the Winner failing or neglecting to claim the Prize during the designated timeframe specified above and consequently forfeiting the Prize.
43. In the event of the Prize not being claimed by the Winner or not being able to be delivered to the Winner and reasonable efforts and inquiries have been made to identify and locate the Winner but have been unsuccessful by 5.00pm (AEST) on 14 December 2018, the Winner’s entry will be deemed invalid and the Winner will be deemed to have forfeited the Prize and the Promoter reserves the right to conduct a further draw of an additional Entrant’s entry into the Competition on 17 December 2018 at 2.00pm (AEST) at the same location and in the same manner as the original draw, determine the substitute Winner (“Substitute Winner”) and distribute the Prize to that Substitute Winner.
44. The Substitute Winner will be notified by the Promoter by email and telephone call by 5.00pm (AEST) on 18 December 2018 and will have their name and State/Territory of residence published on https://www.bakersdelight.com.au/win and https://www.bakersdelight.co.nz/win by 21 December 2018.
PUBLICITY
45. The Winner must, upon request by the Promoter, participate in all promotional activity required by the Promoter (including but not limited to publicity and photography including via any of the Promoter’s social media channels, Facebook, Instagram or websites or written or electronic publications) surrounding the winning of the Prize, at no cost to the Promoter.
46. The Winner consents to the Promoter using and publishing their name, their image, their State or Territory of residence, and the details of their purchase of the Brioche Delight Product in any such promotional material.
DISQUALIFICATION OF ENTRIES
47. If the Winner and/or his/her entry to the Competition is deemed by the Promoter not to comply with these Terms, the entry will be discarded and a new Winner of the Prize will be determined by drawing a further valid entry in accordance with clause 43.
48. The Promoter may, in its sole discretion, disqualify any entries from, and prohibit further participation in the Competition by, any person who tampers with or benefits from any tampering with the entry process or with the operation of the Competition or does not comply with any of these Terms or acts in a disruptive manner or acts with the intent or effect of annoying, abusing, threatening, harassing or infringing the rights of any other person in connection with the Competition or the Promoter or the Promoter’s websites and/or social media.
49. The Promoter may in its absolute discretion cancel the Prize or cease to provide the benefit of the Prize to the Winner if the Winner, in the opinion of the Promoter, behaves or has behaved aggressively, abusively or offensively in relation to the Promoter or other Entrants or any aspect of the Competition or behaves or has behaved in a manner which may diminish the good name or reputation of the Competition, the Promoter or any of its related bodies corporate or the agencies or companies associated with the Competition, or behaves or has behaved in connection with the Promoter, the Competition or any other Entrant in a manner that is contrary to law or is otherwise considered by the Promoter to be inappropriate.
EXCLUSION OF LIABILITY
50. The Promoter, the Promoter’s related entities (as that term is defined in the Corporations Act 2001 (Cth)) and all agencies and companies associated with the Competition, will not be liable for any loss, claim, action, demand, liability, cost, expense, damage (including damage to prizes), delay in receiving prizes, personal injury or death whatsoever which may be incurred, suffered or sustained (whether or not arising from any person’s negligence) (including, without limitation, any direct, indirect, special or consequential loss, loss of profits or economic loss) by any person or entity (including without limitation any Entrant or the Winner or the Winner’s travelling companion) in connection with, or arising from, the Competition or the acceptance or use of the Prize, except that which cannot be excluded by law (in which case that liability is limited to the maximum extent allowable by law).
51. The Promoter is not responsible for the conduct of any third party supplier in relation to the grant of the Prize or the use of the Prize.
PROBLEMS AFFECTING COMPETITION
52. If, for any reason, any aspect of the Competition is not capable of running or being determined by the Promoter as planned, including but not limited to by reason of computer virus, communications network failure, power failure, bugs, tampering, unauthorised intervention, fraud, technical failure, vandalism, tempests, natural disasters, acts of God, civil unrest or strikes, or any other cause beyond the control of the Promoter, the Promoter may in its sole discretion cancel, terminate, modify, suspend, delay or postpone the Competition, invalidate any affected entries or recommence the Competition afresh on the same conditions set out in these Terms subject to state legislation.
PRIVACY STATEMENT
53. All entries will be the property of the Promoter.
54. The information Entrants provide to the Promoter or in respect of the Competition will be used by the Promoter for the purpose of conducting the Competition and for the purposes set out in these Terms.
55. The Promoter may disclose any Entrants’ personal information to its contractors and agents to assist in conducting the Competition or communicating with Entrants.
56. The Promoter is bound by the National Privacy Principles in the Privacy Act 1988. All Entrants’ details are managed in accordance with the Bakers Delight Privacy Policy which can be found at https://www.bakersdelight.com.au/privacy-policy/.
57. Entrants can request access to the personal information the Promoter holds about them by contacting the Promoter at the below address.
FACEBOOK AND INSTAGRAM STATEMENT
58. The Competition is in no way sponsored, endorsed or administered by, or associated with, Facebook or Instagram. Each Entrant releases Facebook and Instagram from all liability in relation to the Competition. The Entrant is providing information to the Promoter and not to Facebook or Instagram.
