The Entrant is responsible for ensuring his or her familiarity with the Conditions of Entry at the time of participation. The Promoter’s decision not to enforce a specific restriction (whether communicated to an Entrant or not) does not constitute a waiver of that restriction or of the Conditions of Entry generally.
The Promoter is 100 Burgers, trading as Mr Burger, ABN : 97 158 847 762.
All Entrants acknowledge that the Promoter can rely on these Conditions of Entry even if the Promoter only learns of a person’s ineligibility after the Promoter has awarded the Prize to the ineligible person. Return of the Prize or payment of its equivalent value to the Promoter may be required by the Promoter if this occurs.
The Promoter’s decision in relation to any aspect of these Conditions of Entry and the Promotion is final and binding on every person who enters.
All Mr Burger stores and trucks trading in Victoria, Australia are considered part of the promotion as participating outlets ; Mr Burger Tasmania is not part of this promotion and is not covered by these conditions of entry.
Entrants under 18 years old must have parental/guardian approval to enter and further, the parent/guardian of the entrant must read and consent to these Terms and Conditions. Parents/guardians may be required by the Promoter to enter into a further agreement as evidence of consent to the minor entering this promotion. Employees (and their immediate families) of the Promoter and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
The promotion period for the "Texican" promotion is from 11:30am AEDT on 20 April 2016 until 11:59pm on 31 May 2016.
To enter and be eligible to win, Eligible Entrants must, during the Promotion Period, purchase one "Texican" burger from any participating outlet and gain a Mr Burger "Stamp Card", complete the card in according with these terms and conditions and then hand the completed card back to any participating outlet.
Each Qualifying Purchase of a burger from any participating outlet counts towards one (1) 'stamp' only.
Only one qualifying purchase can be obtained at each visit, with customers not able to receive multiple entries for each visit.
The "Stamp Card" must be fully completed, with complete contact details and handed to any participating outlet prior to the end of the promotion period.
Subsequent to the closure of the promotion period, 100 Burgers trading as Mr Burger will draw a prize winner at their discretion via a random lottery draw from successful entrants and make contact on the contact details provided, to request verification of identity.
Incomplete, illegible, indecipherable or incorrect Entries (as determined by the Promoter, at their absolute discretion) are not eligible to win.
If requested by the Promoter, prize winners must produce, within the time requested by the Promoter at its absolute discretion:
(a) Appropriate photo identification or other documentation required by the Promoter to verify their identity, age, eligibility to enter the Promotion and claim the Prize (if drawn) and compliance with these Conditions of
Entry.
If the items required by the Promoter are not received or an entrant has not been verified to the satisfaction of the Promoter within the time period required by the Promoter, the entry(s) submitted by the Eligible Entrant will be deemed invalid.
One 1 Eligible Entrant will win one major prize of a trip for 2 to the United States of America, comprising of:
• 2 Return International Flights to Los Angeles, United States of America from Melbourne, Australia in August 2016.
• 2 Return Internal Flights to Milwaukee, Wisconsin from Los Angeles, United States in August 2016.
• 4 Nights Accomodation for 2 people in Seymour, Wisconsin for 11 - 14 August 2016.
Dates for the above trip and details are to arranged between the prize winner and the promoter ; if the winner is not able to attend on the above dates, the promoter holds the right to re-draw the prize in accordance with the below provisions.
Flight itinerary may have to be adjusted depending on the airlines departure and their current flight schedule. Frequent Flyer points are not available from any airline. A credit card imprint or cash deposit may be required from the winner at check-in to the hotel, for all incidental charges. Once accommodation vouchers are issued they are non-changeable. Costs for changes made by the winner (or their companion) to the prize after it has been booked must be paid by the winner and/or companion as applicable. Travel insurance is highly recommended to protect against the additional costs incurred in the event of unforeseen circumstances. The major winner is responsible for ensuring that they and their travelling companion are fit to travel and have received appropriate immunisations and/or health checks prior to taking the prize. The major winner and his or her travel companion are responsible for complying with health and any other government requirements that may apply to the prize.
The major prize must be taken to coincide with the Hamburger Festival in Seymour Wisconsin, which is scheduled for 12 - 13 August 2016(exact trip dates locked in once show date is set). The major prize winner will need to be available from 7 - 17 August, for travel dates. Accommodation, activities and flights are subject to booking and availability. All persons taking the major prize must depart and return at the same time. The major winner and their companion must make their own way from their residence to Melbourne for flight departure.
All prize travel will be subject to the carrier’s General Conditions of Carriage. It is the traveller’s personal responsibility to ensure that they have valid travel documentation, including valid passports and visas, which meet the requirements of government authorities at the relevant destinations. Any fines, penalties, payments or expenditures incurred as a result of such documents not meeting the requirements of those authorities will be the sole responsibility of the traveller/s. The Promoter makes no representation as to the safety, conditions or other issues that may exist at any destination. Entrants should obtain travel advice from independent sources, such as the web site of the Australian Department of Foreign Affairs and Trade.
All winners and companions are responsible for all other costs related to the relevant prize, including any (additional) travel costs,insurance (including excesses), spending money and additional taxes. All prizes are subject to any additional conditions imposed, including any conditions of entry into the relevant venue/s (including behaviour requirements and applicable dress codes). Once awarded, the Promoter is not liable for any ticket that has been lost, stolen, forged, damaged or tampered with in any way. The Promoter does not control entry to the relevant event location/s. The Promoter makes no representations or warranties about the attendance at the event of any individuals or groups involved in the marketing of the event.
The Promoter accepts no responsibility if the Hamburger Festival is abandoned, called off or postponed for any reason and the winner/s and companion/s will not be given any cash or alternative tickets as a substitute for attending the event. In respect of the major prize, the major prize winner will still receive all other components of the major prize as long as they are still taken on the original dates.
If the Prize is won by an Eligible Entrant and they do not claim the Prize by 12pm on 30 June 2016 (28 days after prize-draw), a random electronic re-draw will be conducted on that date and time at the Draw Location by a representative of the Promoter from all remaining Eligible Entries received in the Promotion, with the re-draw prize winner communicated with subsequently.
The Prize is not transferable or exchangeable. The Prize must be taken as offered and may not be varied.
The Promoter accepts no responsibility whatsoever for any variation in the value of the Prize from the time of printing Promotion materials.
If the Promoter is unable to provide the winner with the nominated Prize, the Promoter reserves the right to supply an alternative prize of similar monetary value to the nominated Prize, subject to any directions given by State and / or Territory Gaming Departments.
The Promoter accepts no responsibility whatsoever for any tax liabilities that may arise from winning or receiving the benefit of the Prize.
The Prize winner must, at the Promoter’s request, participate in any Promotion activity (such as publicity and photography) relating to the winning of the Prize, free of charge, and they consent to the Promoter using their name and image in any future promotional material.
All entries become the sole property of the Promoter.
Entrants can only enter once into this competition; multiple entries will not be considered past the first successful entry that complies with the above terms and conditions.
All information Entrants provide (Personal Information) will be used by the Promoter for the purpose of conducting this Promotion and may be entered into a database and the Promoter, the Promoter’s related entities, agencies engaged by the Promoter, or any other third party nominated by the Promoter, for the Promoter’s current and future promotional and marketing purposes without further reference or compensation to them.
Entrants can request access to update or correct their Personal Information held by the Promoter and may request that they not receive further Promotional or marketing communications from the Promoter by contacting the Promoter at the address above. Should an Entrant’s contact details change during the Promotion Period, it is the Entrant’s responsibility to notify the Promoter. All Personal Information will be securely stored by the Promoter.
The Promoter is bound by the National Privacy Principles in the Privacy Act 1988.
