Official Rules for the Expedia 'Kegs of Glory' Competition
This is a Skill-Based Competition. By Entering the Competition, You ("Entrant" or "You") Accept These Official Rules, Which Create a Contract So Read Them Carefully Before Entering.
Voting for your favorite brewery is not part of the winner selection process. You must vote for your favorite brewery in order to reach the Competition Entry page.
Information on how to enter, the prize and rules for redeeming the prize form part of the terms and conditions of entry for the Competition. Participation in the Competition is deemed to be acceptance of "Official Rules" ("Official Rules") and any other notices referenced herein.
1. Promoter: The promoter of this Competition is Expedia Australia Pty Limited ABN 12 101 694 946 of Level 18, No 1 Martin Place, Sydney, NSW 2000 ("Expedia") and the Sponsor of this Competition is Expedia, Inc., 333 108th Avenue NE, Bellevue, Washington 98004 USA. For the purpose of these Official Rules, all references to Promoter are deemed to apply to the Sponsor, and vice versa.
2. Eligibility: The Competition is open only to legal residents of Australia who are at least twenty-one (21) years old at the time of entry and who otherwise meet the requirements set out in these Official Rules.
Employees of the Promoter or Sponsor, their subsidiaries, affiliates, prize suppliers and advertising/promotion agencies as well as their respective immediate family (spouse, parents, siblings and children and each of their respective spouses, regardless of where they reside) and household members (whether or not related) of those employees are not eligible to enter.
3. Competition Period: The Competition begins at 12:01 am Australian Eastern Standard Time ("AEST") on Monday, 30 July 2018 and ends at 11:59pm AEST on Monday, 13 August 2018 (the "Competition Period"). Entries submitted before or after the Competition Period will not be eligible. Sponsor's computer is the official time-keeping device for the Competition.
4. How to Enter: This Competition is a game of skill; chance plays no part in the winner selection process. To enter the Competition, you must, at any time during the Competition Period, complete the following:
4.1) Visit http://expedia.com.au/explore/kegs/;
4.2) Vote for one of your favorite breweries from the list of available breweries to continue to the Competition Entry page ("Vote");
4.3) Answer each of the following questions in 25 words or less:
a) Does Melbourne or Brisbane have your favorite craft beer scene and why; and
b) Why should you be selected to win a trip to the "Beer Capital of the World"?; and
4.4) Provide all requested details, including your full name and email address and follow the instructions to submit your Entry. Your submission via the Competition Entry page, including your response to the two "25 words or less" questions will be referred to as your Entry ("Entry").
Limit: You may submit up to one (1) Entry/Vote per person and per email address during the Competition Period. Entries/Votes received from any person or email address in excess of the stated limit will be void. Entries/Votes generated by script, macro or other automated means are void. Released Parties (as defined below) are not responsible for lost, late, stolen, damaged, incomplete, invalid, un-intelligible, garbled, delayed or misdirected Entries/Votes; all of which will be void.
Please see the Submission Requirements for the posts below for additional details. Multiple entrants are not permitted to share the same email address. If You attempt to obtain Entry or Vote by using multiple/different email addresses, identities, registrations or logins, or through other methods, Sponsor may exclude you from participating in the Competition. When you enter/Vote, you are providing your information to Sponsor.
If a Vote does not proceed to a valid Entry in accordance with paragraph 4 above, the Sponsor reserves the right to deem that Vote void. Similarly, if an Entry does not relate to a valid Vote, that Entry may be void.
By entering, you agree that your Entry conforms to the Submission Requirements as defined below ("Submission Requirements") and that Sponsor, in its sole discretion, may disqualify you from the Competition if it believes that you and/or your Entry fails to conform to the Submission Requirements or any other term of these Official Rules.
IMPORTANT NOTE: Standard data and/or other rates apply to participants who submit an Entry via a wireless mobile device. Wireless service providers may charge for airtime and/or data. Please contact your service provider for pricing and service plan information and rates before mobile device participation.
5. Submission Requirements: BY SUBMITTING AN ENTRY, YOU AGREE THAT THE ENTRY COMPLIES WITH ALL CONDITIONS STATED IN THESE RULES. THE RELEASED PARTIES WILL BEAR NO LIABILITY WHATSOEVER REGARDING THE USE OF YOUR ENTRY. THE RELEASED PARTIES SHALL BE HELD HARMLESS BY YOU IN THE EVENT IT IS SUBSEQUENTLY DISCOVERED THAT YOU HAVE DEPARTED FROM OR NOT FULLY COMPLIED WITH ANY OF THESE RULES.
By participating in the Competition, each entrant hereby warrants and represents that any Entry he/she submits:
is original to him/her;
does not violate any law, statute, ordinance or regulation;
will not give rise to any claims whatsoever, including, without limitation, claims of infringement, invasion of privacy or publicity, or infringe on any rights and/or interests of any third party; and
is not defamatory, trade libelous, pornographic or obscene, and further that it will not contain, depict, include, discuss or involve, without limitation, any of the following: nudity; alcohol/drug consumption or smoking; explicit or graphic sexual activity, or sexual innuendo; crude, vulgar or offensive language and/or symbols; derogatory characterizations of any ethnic, racial, sexual, religious or other groups (including, without limitation, any competitors of Sponsor); personal information of individuals, including, without limitation, names, telephone numbers and addresses (physical or electronic); commercial messages, comparisons or solicitations for products or services other than products of Sponsor; any identifiable third party products, trade-marks, brands and/or logos, other than those of Sponsor); conduct or other activities in violation of these Rules; and/or any other comment that is or could be considered inappropriate, unsuitable or offensive, all as determined by the Sponsor in its sole and absolute discretion.
The Sponsor reserves the right, in its sole and absolute discretion, at any time and for any reason to screen any Entry(ies). Any Entry that the Sponsor deems, in its sole and absolute discretion, to violate the terms and conditions set forth in these Rules is subject to disqualification. The Sponsor reserves the right, in its sole and absolute discretion at any time and for any reason, to request an entrant to modify, edit and/or re-submit his or her Entry in order to ensure that the Entry complies with these Rules, or for any other reason. If such an action is necessary at any point during or after the Competition, then the Sponsor reserves the right, in its sole discretion, to take whatever action it deems necessary based on the circumstances - including, without limitation, disqualifying the Entry (and therefore the corresponding associated entrant).
6. Competition Judging: On or about 20 August 2018, a panel of judges determined by Sponsor in its sole discretion will review all eligible Entries submitted during the entire Competition Period and select one (1) provisional winner which is deemed the best, based on, among other things, relevance, uniqueness, creativity, originality and quality. The response to each question in paragraph 4 above will be scored separately, with the scores added together for a final score. The Entrant with the highest combined score based on the Judging Criteria will be deemed a potential winner. In the event of a tie, the entrant whose Entry received the highest combined score for overall quality, as determined by the qualified judges, in their sole discretion, will be deemed the potential winner. The Promoter will notify the winner within two (2) business days of the prize judging, via their email address used to enter the Competition.
7. Sponsor's Rights to Submissions: By entering, you grant Promoter, Sponsor, and their agents, licensees, and assigns an irrevocable, perpetual (non-exclusive) license and permission to reproduce, encode, store, copy, transmit, publish, post, broadcast, display, publicly perform, adapt, modify, create derivative works of, exhibit, and otherwise use your entry and all elements of such entry, including, without limitation, responses to the questions, as-is or as-edited (with or without using your name) in any media throughout the world, in perpetuity, for any purpose, without limitation, and without additional notification, review, compensation, or approval from you or any other party. You agree that the Promoter may use the aggregate information collected from the competition for related research and marketing purposes. Participants warrant that their entry is their own work. If requested, entrant will sign any documentation that may be required for Sponsor or its designees to make use of the non-exclusive rights entrant is granting to use the Entry.
8. Provisional Winner Requirements: The provisional winner may be required to submit to the Promoter and Sponsor any further specified details or proof of Entry in order to verify their Entry, as well as their first name, last name, and mailing address in order to redeem the Competition prize.
9. Prize: One (1) winner will receive a prize of one (1) trip for 2 (two) people aged 21 or over to Portland, Oregon, USA including round trip economy class airfare from the international airport in the Australian capital city nearest to the winner's home to Portland, Oregon, 7 nights' hotel accommodation and brewery tour passes (tour entry only). Approximate Retail Value ("ARV") of prize: up to $8,945 AUD (flight ARV is up to $5,324 AUD; hotel accommodation ARV is up to $2,733 AUD; tours and activities ARV is up to $888 AUD), although the actual retail value may vary depending on the point of departure, travel itinerary, and costs of air transportation at the time of award. Any difference between stated value and actual value will not be awarded.
Sponsor will work with winner to arrange travel. Winner's guest must be at least twenty-one (21) years of age. Travel must be completed by 1 September 2019 or the prize will be forfeited. All bookings for hotel and walking/brewery tours will be based on availability and dates requested. Blackout dates may apply. First choice of travel dates requested cannot be guaranteed. Travel must be booked with Travel Portland staff a minimum of 30 days prior to your actual travel dates. Travel is subject to certain terms and conditions as specified by prize providers (including behaviour requirements and applicable dress codes). Usual booking terms and conditions apply (see https://www.expedia.com.au/p/support/terms) and all bookings are subject to availability.
A major credit card will be required at check in to cover any incidental charges. No cancellation of reservation or transfer of reservation to another date after reservation has been made.
Winner and guest are responsible for obtaining any required necessary documentation (i.e., valid passport, visas, etc.) prior to travel. The prize is not transferable and cannot be redeemed for cash.
Travel restrictions may apply. Winners are responsible for paying any applicable federal, provincial, state, local, income and withholding taxes, if any, and any and all other costs and expenses not listed herein as being provided, including but not limited to any transportation to or from the departure airport, luggage fees, ground transportation in Oregon, meals, hotel incidentals, souvenirs and gratuities. In the event that any tax withholding is required by law for a prize, each winner authorizes Sponsor to make the corresponding deduction. Air travel is: Non Endorsement, Non Changeable and Non Refundable. Any prize details not specified above will be determined by Sponsor, in its sole discretion. Sponsor or prize provider will not be liable for any expenses incurred as a consequence of flight cancellations or delays. Sponsor or prize provider will not be liable for any airline and/or hotel fees incurred as a consequence of changing or cancelling flight and/or hotel reservations. Sponsor or prize provider will not replace any lost or stolen prizes or prize components. A winner may not transfer, assign or substitute a prize, or redeem a prize for cash, except at the sole discretion of the Sponsor, who reserves the right to substitute a prize (or portion thereof) with one of comparable or greater value and the Prize cannot be used in conjunction with any other vouchers, offers or discounts. No reward miles will be awarded for travel on the Promotion prize flights or hotel stay. The Sponsor reserves the right to substitute the prize (or any portion thereof) with one of comparable or greater value. Prizes are awarded "as is" without any warranty or guarantee, either express or implied by Sponsor. The prize is subject to and a winner must abide by the prize providers' terms and conditions of booking and of carriage for the flights.
As a condition of accepting the prize, winner is required to behave appropriately (to the Promoter's satisfaction) at all times while taking the prize. A winner is fully responsible for the behaviour and conduct of their guest at all times while taking the prize. If in the Promoter's opinion a winner or the winner's guest behaves in a way that is contrary to law, behaves inappropriately, aggressively or offensively, or behaves in a way which may damage the reputation of the Promoter or any of its related bodies corporate or the agencies or companies affiliated with this competition, the Promoter may in its absolute discretion, cancel or withdraw the prize and will offer no substitute prize or compensation.
Sponsor cannot guarantee that any particular product will be available at the time the winner would like to use their Prize. The price and availability of all products listed on the Expedia.com.au site are subject to change.
Enjoy alcohol responsibly. Your participation in some elements of the prize is subject to the liquor serving policy of the relevant prize venue/s.
10. Unclaimed Prizes: In the event a prize winner fails to claim his or her prize by 21 September 2018, the prize winner will be deemed to have forfeited the prize and will not be entitled to any supplementary prize or benefit. At that time, Promoter will select an alternate winner in accordance with the criteria set out in Paragraph 6 above. If the alternate winner fails to claim his or her prize by 25 October 2018, the alternate winner will be deemed to have forfeited the prize and will not be entitled to any supplementary prize or benefit. There will be no rejudging in the event that the prize is unclaimed by the alternate winner. Disposal of any unclaimed prize may be made subject to any written directions given by any government authority and pursuant to any relevant legislation.
11. General Conditions: In the event that the operation, security, or administration of the Competition is impaired in any way, the Promoter may, in its sole discretion, (a) suspend the Competition to address the impairment and then resume the Competition; or (b) award the prizes according to the criteria set forth above from among the eligible entries received up to the time of the impairment. Promoter reserves the right, in its sole discretion, to disqualify and seek damages from any individual who tampers with the operation of the Competition, violates these Official Rules, or acts in a disruptive or unsportsmanlike manner. If You or your Entry is deemed by the Promoter to breach these Official Rules, your Entry/ies may be discarded. Promoter's failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. Proof of sending any communication to the Promoter or the Sponsor by mail shall not be deemed proof of receipt of that communication by the Promoter or the Sponsor (as applicable). The Competition is subject to federal, state, and local laws and regulations, and is void where prohibited. Participants acknowledge that any information provided by them in connection with the promotion is provided to the Sponsor. Any questions or comments about the promotion should be directed to the Sponsor. The information you provide will only be used for the administration of this Competition and in accordance with the Sponsor's privacy policy (see below). The promoter expressly reserves the right to change or alter these Official Rules at any time subject to the approval of all relevant lottery departments if required.
If this Competition cannot run as planned for any reason beyond the Promoter's control, for example due to software, hardware or communications issues, unauthorised intervention, tampering, fraud or technical failure, the Promoter may end, change, suspend or cancel the competition or disqualify affected Entries/entrants.
The Promoter's decision in connection with all aspects of this Competition is final.
12. Entrant's Personal Information: The Sponsor may collect your personal information directly or through their agents or contractors. The Sponsor will use your personal information to conduct the Competition. The Sponsor may disclose your personal information to its related companies, agents and contractors to assist in conducting this competition. This may include disclosures to organisations outside Australia including in places such as the United States. The Sponsor's Privacy Policy (see https://www.expedia.com.au/p/support/privacy) includes information about: (a) how to seek access to the personal information the Sponsor hold about you and seek correction of the information; and (b) how to complain about a privacy breach and how the Sponsor will deal with such a complaint.
In the event of an inconsistency between these Official Rules and the Sponsor's Privacy Policy, these Official Rules shall prevail.
If you opt-in at the point of entry, you consent to: (a) your personal information being added to the Sponsor's email marketing list, keeping You up to date with regular offers and promotions, including contacting you by electronic messaging; and/or (b) your personal information being provided to the named third party supplier for the use as defined at the point of entry, subject to the third party supplier's privacy policy. https://www.travelportland.com/about-us/privacy/
A prize winner consents to the use of their name, place of residence, likeness, image and/or voice (including photograph, film and/or recording of the same) for promotional and marketing purposes in any media for an unlimited period without remuneration. A winner agrees to participate in reasonable promotional activities as requested by the Promoter.
13. Release and Limitations of Liability: By entering, you agree to release and hold harmless the Promoter and the Sponsor, their respective parents, subsidiaries, affiliates, and each of their respective officers, directors, employees, and agents (the "Released Parties") from and against any claim or cause of action arising out of participation in the Competition or receipt or use of any prize, including, but not limited to: (a) unauthorised human intervention in the Competition; (b) technical errors related to computers, servers, providers, or telephone, or network lines; (c) any errors on the Competition site that may impact entry; (d) printing errors; (e) lost, late, postage-due, misdirected, or undeliverable mail; (f) errors in the administration of the Competition; (g) injury or damage to persons or property; or (h) any loss (including indirect, special or consequential loss or loss of profits), expense, damage, personal injury, illness or death, except for any liability which under statute cannot be excluded (in which case that liability is limited to the greatest extent allowed by law). . You further agree that in any cause of action, in no event shall the Released Parties be liable for attorney's fees. You waive the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages. Nothing in these Terms and Conditions restricts, excludes or modifies any consumer rights under any statute including the Competition and Consumer Act 2010 (Cth).
The Promoter may communicate or advertise this Competition using Facebook or Instagram. However, the Competition is in no way sponsored, endorsed or administered by, or associated with, Facebook or Instagram. You provide your information to the Promoter and not to Facebook or Instagram. You completely release Facebook and Instagram from any and all liability.
The Promoter is not responsible for any tax implications arising from you winning a prize. You should seek independent financial advice. If for GST purposes this Competition results in any supply being made for non-monetary consideration, you must follow the Australian Taxation Office's stated view that where the parties are at arm's length, goods and services exchanged are of equal GST inclusive market values.
14. Disputes: Entrants agree that any and all disputes, claims and causes of action arising out of, or connected with, the Competition or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in New South Wales, Australia. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, your rights and obligations, or the rights and obligations of Promoter or the Sponsor in connection with the Competition, shall be governed by, and construed in accordance with, the laws of New South Wales, Australia, without giving effect to any choice of law or conflict of law rules (whether of NSW or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than New South Wales, Australia.
15. Results: The winner/alternate winner will be notified by email and announced on the following Expedia.com.au subdomain: Expedia.com.au/explore/kegs within 2 business days of determination.
