(a) This Instagram Giveaway (Giveaway) is promoted by LGA Distribution Pty Ltd (ABN 33 421 161 002) (we, us or our).
(b) By entering this Giveaway, all entrants (you or your) will be deemed to have accepted and agreed to be bound by these terms and conditions (Terms) and our privacy policy. Any violation of these Terms or our privacy policy may result in disqualification from the Giveaway.
(c) To? the exten?t of any inconsistency between these Terms and any other reference to this Giveaway, these Terms will prevail.
(d) By entering this giveaway, you opt-in to receive marketing material from Love Luna and competition partners.
(e) The Giveaway:
(i) begins at 10am Australian Daylight Standard Time (AEDT) on Thursday 1st November 2018; and;
(ii) ends at 11.59pm Australian Daylight Standard Time (AEDT) on Friday 30th November 2018,
(Promotion Period).
2. Eligibility
(a) The Giveaway is open to Australian residents aged 18 years and over at the time of entry. Proof of age may be required prior to travel.
(b) Employees and contractors of LGA Distribution Pty Ltd (ABN 33 421 161 002), their related bodies corporate and the agencies associated with this Giveaway are ineligible to enter.
3. How to enter
(a) To register one valid single entry in the Giveaway, you must, during the Promotion Period:
(i) follow the @loveluna.australia Instagram page; and;
(ii) tag two besties in the comment section on the Giveaway image on the @loveluna.australia Instagram page (Giveaway Image): and;
(iii) sign up via link in bio on @loveluna.australia Instagram page
(b) To register two valid entries in the giveaway, you must, during the Promotion Period complete the single valid entry requirements and purchase either a Ready to Go, Sleep or Three and a Freebie bundle from LoveLuna.com
(c) To register three valid entries in the giveaway, you must, during the Promotion Period complete the single valid entry requirements and purchase a Love Luna Burger with the Lot bundle from LoveLuna.com
(d) Entries are only valid for online purchases made through LoveLuna.com. Purchases through associated retailers are not permitted.
(e) You need an Instagram account to enter the Giveaway.
(f) If you do not currently have an account, you can download the Instagram application on your mobile or tablet device or visit www.instagram.com and register for a free account.
(g) This Giveaway is in no way sponsored, endorsed or administered by, or associated with Instagram.
(h) Your profile settings on Instagram must be set to public. Any entry submitted using a private profile setting will be invalid.
(i) We will not accept any entries submitted after the end of the Promotion Period.
(j) The time of each entry will be the time the entry is received by our database, not the time of transmission.
(k) We reserve the right, at any time, to verify the validity of entries and entrants (including your identity, age and place of residence) and to disqualify any entrant whose entry is not in accordance with these Terms or who otherwise tampers or interferes with the entry process.
(k) Incomplete, indecipherable or illegible entries will be deemed invalid at our absolute discretion.
(l) We accept no responsibility for any incorrect, incomplete, lost, late or misdirected entries.
(m) If there is a dispute as to your identity or details, we reserve the right to determine your identity or details and our determination is final. We will not enter into any communication in relation to our determination or the associated process.
4. Determination
(a) There will be 1 winner.
(b) The winner will be selected randomly:
(i) at our office at 12 Lakeview Drive, Scoresby, Victoria, 3179, Australia; and
(ii) between 9am and 12pm AEDT on Monday 3rd November 2018.
(c) We reserve the right to select an additional valid reserve winner and record them in case an invalid entry or ineligible entrant is selected as a winner and we elect to replace this winner with the reserve winner.
5. Outcome
(a) The winner will be notified after 12pm AEDT on Monday 3rd December 2018 by:
(i) direct message on Instagram; and
(ii) announcement post will be posted on @LoveLuna.Australia Instagram page tagging the winner and two besties on Tuesday 4th December 2018.
(b) It is your responsibility to notify us in writing if your contact details change during the Promotion Period.
(c) The winner's name, entry and Instagram handle may be published on our Love Luna social channels, and in any other promotional material which we consider relevant. By entering the Giveaway, you consent to us publishing your details, including your social media handle.
(d) Our decision is final and we will not enter into any communication in relation to our decision or the associated process.
6. Prizes
(a) The total prize pool value for this Giveaway is valued at up to AUD $5,500 (inclusive of GST). The winner will receive:
(i) return economy-class airfares for 3 people from the Australian capital city nearest to the winner's address (as we determine in our sole discretion) to Denpasar, Bali and;
(iii) 5 night's accommodation at Fella Villas. Dates of accommodation are based solely on availability. Travel must occur between the 1st July 2019 and 15th December 2019, and;
(iii) $1,000 dollars AUD spending money
(b) We accept no responsibility for any change in prize value between this date and the date the prize is redeemed.
(c) The giveaway prize is non-transferable, non-refundable, non-changeable and subject to availability
7. Claiming the prize
(a) To claim the prize, the winner must respond to the Instagram direct message with their full name and Australian address. The full names and addresses of the additional two people travelling must be provided no later 21 days after the winner is announced.
(b) The prize must be claimed within 24 hours of the winner's announcement and is subject to all terms and conditions of this giveaway.
(c) If, for any reason, the specified prize (or any part of them) is unavailable, we reserve the right to replace them with something of similar value and/or specification.
(d) If a winner does not claim their prize within the prescribed time, they will forfeit their prize and it will be awarded to the next eligible reserve entry.
(e) You should seek independent financial advice, as implications (such as tax) may arise as a result of claiming the prize.
(f) To claim the prize, we may require the winner to sign a legal release in a form we determine in our absolute discretion.
(g) It is a condition of claiming a prize that the winner must comply with all the conditions of use of the prize and the prize supplier’s requirements and terms and conditions.
(h) Prizes, or any unused portion of a prize, or any part thereof, are not transferable or saleable and cannot be taken or redeemed as cash, credit or equivalent. Prizes must be claimed as offered and cannot be varied or exchanged.
8. Further terms for travel
(a) Flight tickets are available on the regular, scheduled services of each airline and are subject to seasonal embargoes. Flight itineraries may have to be adjusted depending on factors, such as the airline’s departure city and their current flight schedule.
(b) Frequent flyer points are not available from any airline.
(c) Accommodation is non-changeable and non-redeemable once they are issued. A credit card imprint or cash deposit may be required from the winner at check-in to the accommodation for any incidental charges (which are payable by the winner).
(e) Flight tickets are only valid for the date or period specified on the tickets or by the provider and are subject to any terms and conditions imposed by the provider.
(f) Once prizes are awarded, we are not liable for any flight ticket, including where it has been lost, stolen, forged, damaged or tampered with in any way.
(g) By entering this Giveaway and claiming the prize, the winner acknowledges and accepts that driving, travelling and any other activities comprising or associated with the prize are inherently dangerous and may result in death, injury, incapacity, damage to property or other losses. We are not responsible for any acts of God, such as adverse weather conditions or industrial action or civil commotion, that may occur while the winner is travelling. It is the winner's responsibility to enquire about local issues and conditions at any relevant destinations prior to travel. We do not guarantee that the winner will enjoy the prize or be suited to the type of travel offered in the prize.
(h) The winner and their nominated travelling companions are each responsible for all other expenses, including spending money, meals, drinks, transfers and transport costs, in-room charges, laundry charges, activities, incidentals, taxes (excluding departure and any other flight-associated taxes included in the prize), energy surcharges, gratuities, services charges, passports, visas, travel insurance, items of a personal nature and any other ancillary costs.
(i) Travel insurance is highly recommended to protect against the additional costs that may be incurred, including in the event of an unforeseen circumstance. The winner is responsible for ensuring that they, and their travelling companion, are fit to travel and have received appropriate health checks prior to travelling.
(j) The winner and their travelling companions must:
(i) travel at the same time;
(ii) depart from the same capital city on the same flight; and
(iii) arrange for their own transport from their residences to and from the relevant airport.
(k) If the winner is under the age of 18 on the date the winner is announced, a parent or guardian over the age of 21 must accompany the minor on any travel included in the prize instead of a nominated travel companion.
9. Submission
(a) We own all entries (including any intellectual property rights comprised in the entries).
(b) You agree that you are fully responsible for the entry you submit, including any entry content (such as text, images, photos and videos) and any accompanying comments (collectively, Submission).
(c) We will not be liable in any way for your Submission to the fullest extent permitted by law.
(d) We may remove any Submission without notice for any reason whatsoever.
(e) You warrant and agree that:
(i) you will not submit any Submission that is unlawful or fraudulent, or that we could reasonably consider to be in breach of any intellectual property, privacy, publicity or other rights, defamatory, obscene, derogatory, pornographic, sexually inappropriate, violent, abusive, harassing, threatening, objectionable with respect to race, religion, origin or gender, not suitable for children aged under 15, or otherwise unsuitable for publication;
(ii) you will obtain prior written consent from any person that appears or is identifiable in your Submission;
(iii) you will obtain prior written consent from any person who has jointly created or has any rights in your Submission to the uses and terms herein;
(iv) your Submission does not contain viruses and will not cause injury or harm to any person or entity; and
(v) you will comply with all applicable laws and regulations, including, without limitation, those governing copyright, content, defamation, privacy, publicity and the access or use of others' computer or communication systems.
(f) You consent to us using any part of your Submission in any media for an unlimited period without remuneration for the purposes of promoting:
(i) this Giveaway (including any outcome); and
(ii) any products manufactured, distributed and/or supplied by us or our related bodies corporate.
10. Personal information
(a) All opt-in entries will be entered into a database. We may use your name, address, email address and telephone number for future promotional, marketing and publicity purposes in any media worldwide without notice and without any payment to you. By opting-in, you consent to your details being used for this purpose. If you no longer consent to your details being used for future marketing purposes, you should contact us via the contact details below.
(b) Your personal information may be disclosed to State and Territory lottery departments and the winner's name may be published as required under the relevant lottery legislation.
(c) If you wish to access, or for us to update, correct or delete, your details or any information in your entry, please contact us using our contact details below.
11. Liability
(a) To the fullest extent permitted by law, we make no warranties, representations or guarantees, express or implied, in fact or in law, regarding this Giveaway or the merchantability, quality or fitness for a particular purpose of any prize or component of any prize.
(b) We do not exclude any rights or remedies in respect of goods or services under Schedule 2 of the Giveaway and Consumer Act 2010 (Cth) which cannot be excluded, restricted or modified.
(c) Notwithstanding, we and our related bodies corporate (and the officers, directors, employees, contractors and agents of each of the foregoing) exclude all liability (including for negligence) to the winner, their travelling companion, or anyone else, for any personal injury or any loss or damage (including for loss of opportunity, business, goodwill or profits), whether direct, indirect, special or consequential, arising in any way out of the Giveaway, including where arising out of the following:
(i) any technical difficulties or equipment malfunction (whether or not under our control);
(ii) any theft, unauthorised access or third party interference;
(iii) any entry or prize claim that is cancelled, delayed, interrupted, diverted, late, lost, altered, damaged or misdirected (whether or not after their receipt by us or otherwise);
(iv) any variation in prize value or specification to that stated or referred to in these Terms;
(v) any tax liability or similar charge incurred by the winner or their travelling companion; or
(vi) use of (or inability to use) a prize by the winner or their travelling companion.
(d) We assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction, or unauthorised access to, or alteration of, entries or any other event beyond our control and, in these circumstances, we may, in our absolute discretion, cancel the Giveaway (without liability) and, if we elect to do so, recommence it from the start on the same conditions.
(e) We are not responsible for any problem or technical malfunction of any telephone network or lines, computer systems, servers, providers or equipment, software, traffic congestion on the internet or any website, or any combination thereof, including any injury or damage to participants or any other person’s computer related to or resulting from participating in or downloading any materials in this Giveaway.
(f) You are solely responsible for any costs associated with accessing the promotional websites on our Instagram page, as these costs depend on the internet service provider you use. We accept no responsibility for your use (or attempted use) of those websites.
(g) Without limiting any other terms, you indemnify us and our related bodies corporate (and the officers, directors, employees, contractors and agents of each of the foregoing) from and against any breach of these Terms by you, or otherwise arising from your act or omission (or an act or omission of your travelling companion).
12. Disruption to Giveaway
(a) If, for any reason, this Giveaway is interfered with in any way or is not capable of being conducted as planned due to any reason beyond our reasonable control (including as a result of infection by computer virus, bugs, tampering, unauthorised intervention, fraud or technical failures), which corrupt or affect the administration, security, fairness or integrity or proper conduct of this Giveaway, we reserve the right, in our absolute discretion and to the fullest extent permitted by law, to:
(i) disqualify any entrant who tampers or interferes with the entry process; or
(ii) subject to regulatory approval, cancel, terminate, modify, reschedule or suspend the Giveaway, as appropriate.
(b) Any entrant found to be using any form of software or third party application to enter multiple times (including scripting software) will have all entries invalidated and any claim to any prize will be invalidated. If you are awarded a prize and then found to have breached this clause, you must (at your cost) immediately return any awarded prize to us. We will determine whether you have breached this clause in our absolute discretion and may request any documentation we deem necessary to determine whether a breach has occurred. You must immediately provide, at your own cost, any requested documentation upon our request.
13. General
(a) We may accept any manifest errors and omissions at our absolute discretion.
(b) Any failure to enforce any of our rights at any stage does not constitute a waiver of those rights.

(d) This Giveaway and any issues relating to the construction, validity, interpretation and enforceability of these Terms shall be governed by the laws of Victoria, Australia.
