The following Terms and Conditions apply to the E3 2017 Flyaway competition (the "Competition").

By submitting an entry into the Competition all entrants fully and unconditionally agree to and accept these Terms and Conditions and the decisions of the Promoter, which are final and binding on all matters pertaining to this Competition.
The Competition begins Friday 5th May 2017 at 12:00 p.m. AEST and ends Friday 26th May 2017 at 11:59 p.m. AEST (the "Competition Period").
NO PURCHASE OR PAYMENT IS NECESSARY TO ENTER OR WIN. A PURCHASE DOES NOT INCREASE YOUR CHANCES OF WINNING.
2. Eligibility
You are only eligible to enter the Competition if you meet all of the following conditions:
(a) You are an Australian citizen;
(b) You are aged twenty one (21) years of age or older at the time of the draw;
(c) You are available to fly to Los Angeles, California, USA and attend E3 on the dates required, Sunday 11th June – Friday 16th June;
(d) You say “yes” that you are willing to appear in videos shot at E3 and to be published on GameSpot website and Muselk’s YouTube channel.
(e) You register for the Competition on the GameSpot website (www.gamespot.com) during the Registration Period (as defined below);
(f) You have a valid passport, are legally permitted to travel to the USA and are eligible to apply via the Electronic System for Travel Authorization for a Travel Authorization under the Visa Waiver Program to enter the USA (or otherwise have a visa permitting you to travel to the USA) for the time outlined above;
A person must not enter the Competition and will be ineligible to participate in the Competition if that person is:
an employee or agent of the Promoter or anyone professionally connected with the Competition; or
an immediate family member of an employee of the Promoter.
The Promoter may require and reserves the right to require any entrant to produce evidence of their age and proof of their Australian citizenship.
3. How to Enter
To enter this game of skill, you must first register between Friday 5th May 2017 at 12:00 p.m. AEST and ends Friday 26th May 2017 at 11:59 p.m. AEST (the "Registration Period") by doing the following:
(a) Complete in full all the entry fields in the registration form on the competition page; and
(b) Enter a video URL ("video") in one of the available entry fields on the competition page telling us what you are most excited to see unboxed this year at E3? The video must be a max of 2 minutes in length and uploaded to YouTube.
(c) Accept the Terms and Conditions of this Competition.
All individuals who complete the registration process in full and match the eligibility criteria will be accepted as entrants in the competition ("Entrants").
The accepted Entrants will be automatically informed of their successful competition entry on screen once their submission has been successful. GameSpot is not responsible for any unsuccessful competition entries under any circumstances.
4. Participation and Competition Rules
If accepted as an Entrant, you accept that the following rules apply to the competition:
By entering and accepting the Terms and Conditions you agree to allow Samsung and GameSpot to use your video entry for promotional purposes of the competition and E3 program.
This competition will consist of one phase.
GameSpot audience members register their intent to win the E3 trip by successfully completing the competition entry form and all required fields on GameSpot. This phase will run during the following time period of Friday 5th May 2017 at 12:00 p.m. AEST and ends Friday 26th May 2017 at 11:59 p.m. AEST
The winner will be notified by email or by phone by 31st May at 5:00 p.m. AEST. If the winner does not respond by 5pm on 1st June, the Promoter holds the right to choose another winner to take their place.
As the winner of this competition you agree that you will help GameSpot and Samsung to create video content from the Los Angeles Convention Centre during the days of E3. These videos will be hosted on GameSpot and you assign all copyright ownership of this content to GameSpot and Samsung.
The Competition rules are subject to change at any time. If any changes to the rules occur, you will be notified through the Competition news page; a time stamp will be on any web pages that have been revised.
5. Entrant warranties and content restrictions:
The Entrant warrants that:
the Entrant has the sole and full authority to accept the Terms and Conditions and enter video in the Competition;
the Entrant has the sole and full ownership of all copyright in the video;
the Entrant has not breached the copyright of any third party in making and/or supplying the video to the Promoter;
the video has not, prior to the Competition Period, been made available to the public and/or entered in a competition other than this Competition whether local or global; and
the Entrant will not make the video accessible to the public and/or will not enter the video in a competition whether local or global other than this Competition during the Competition Period
If the Entrant breaches any of these warranties the video will not be eligible for consideration in the Competition.
Content Restrictions
Entrants must refrain from using offensive, racist, sexist, harassing, pornographic, negative, or profane language or content ("Restricted Content") at any time during their video entry to the competition. If an Entrant's video contains any Restricted Content or any other content that constitutes a violation of these Terms and Conditions, it will not be eligible for consideration in the Competition.
The Promoter reserves the right, as its sole discretion, to refuse entry, remove or take down any video from GameSpot at any time without providing Entrants with notice or reasons for the decision.
5. Winner’s List
The name of the prize winner can be obtained by sending a self-addressed stamped envelope by 10th June 2015 to 12th June 2015.
6. Selection and Notification of Winners
Judged by a GameSpot panel the winner will be announced and will win the prize of the trip to E3. The eligible runner up will be announced and will win the runner up prize of a Samsung Gaming Package.
The winner and runner up will be notified by e-mail at the e-mail address associated with their competition entry or by phone by the number they provided in their initial competition registration form.
The winner may be requested to provide the Promoter with proof that he/she is the Authorized Account Holder of the e-mail address that corresponds to the email address they provided with their initial competition entry.
In the event of a dispute regarding who submitted an entry, the entry will be deemed submitted by the Authorized Account Holder of such e-mail account. You are not a winner until your submission is validated and your documents are completed.
The decision of the Promoter regarding any aspect of the competition is final, binding and no correspondence will be entered into.
An "Authorized Account Holder" is defined as the natural person to whom an e-mail address is assigned by an Internet access provider, online service provider or other organization (e.g. business, educational institution, etc.) responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address.
7. Winner’s & Runner Up Prize
There are two prize opportunities for this competition.
The overall prize value is valued at $5,000 AUD. This prize is non-transferable. The Promoter agrees to issue the winner of the competition a trip to E3 that includes the below:
(1) 1 X hotel room in Los Angeles, California, USA for one person (5-night stay)
(2) 1 X return Economy flight from Sydney, Australia to Los Angeles, California, USA
(3) 1 X return Economy domestic flight to Sydney from the winner's nearest capital city (if required)
(4) 1 X entry badges to E3
(5) Return airport transfers for one person from LAX to Hotel in LA.
The Promoter is not providing any travel insurance as part of this prize. It is the winner's responsibility to take out appropriate coverage.
8. Release and Indemnity
To the extent permitted by law, all Entrants release from and indemnify the Promoter against all liability (including negligence), cost, loss or expense arising out of acceptance of any prizes or participation in the competition, including, but not limited to, loss of income, loss of opportunity and damage to property, including damage caused to any website or application of the Promoter, whether direct or indirect, special or consequential.
9. Limitation of Liability
Any cost associated with accessing the competition website for the purpose of entering or participating in the competition is the Entrant’s responsibility and is dependent on the Entrant's internet service provider.
The winner agrees that the Promoter is not responsible for any lost, damaged or stolen property that the winner owns while they are at or travelling to or from E3, or while attending E3.
Except for any liability that cannot be excluded by law, the Promoter (including their officers, employees and agents) exclude all liability, including liability for negligence, any personal injury, or any loss or damage (including, without limitation, loss of opportunity, loss of income or damage to property) whether direct or indirect, special or consequential, arising in any way out of an Entrant's participation in the Competition.
Any tax liability arising out of any prize is the responsibility of the winner.
10. Ownership and Grant of License
Each Entrant grants the Promoter and any affiliated company an irrevocable royalty-free licence to use, reproduce, communicate, edit and exploit any material submitted by the Entrant for the E3 Flyaway Competition (including, without limitation, reviews, comments, testimonials, recordings, videos, images and/or survey responses)("Material") in all formats and in all media now known or later devised throughout the world in perpetuity at the Promoter's sole discretion including a right to sub-licence these rights.
Each Entrant agrees not to assert any moral rights against the Promoter, its assigns, licensees and successors in title in respect of the Material.
11. Disclaimer
If for any reason the Competition is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures or force majeure that corrupt or affect the administration, security, fairness, integrity, or proper conduct of this competition, the Promoter reserves the right, at its sole discretion, to disqualify any individual who tampers with the competition and to cancel, terminate, modify or postpone the competition until a later date.
12. Privacy and use of Information
The Promoter collects personal information in order to conduct the Competition. If you do not want your information used in the manner set out in these Terms and Conditions including this section 12, do not enter this Competition.
Except where prohibited by law, each winner consents to the use of his/her name, city, likeness and entry in any manner by the Promoter, its designees and its advertising and promotion agencies without further compensation or notification. Acceptance of a prize constitutes each winner’s consent to have his or her name released in a winner’s list which may be made available to the public. All Entrants agree that the Promoter may use their personal information and disclose it to other organisations that may use it, in any media for future promotional, marketing and publicity purposes without any further reference, payment or other compensation to the Entrant.
Entrants consent to all personal information that is supplied by the Entrant when entering the Competition being collected, used, held and disclosed by the Promoter in accordance with these Terms and Conditions and the Promoter's Privacy Policy. A copy of the Promoter's Privacy Policy may be accessed at www.cbsinteractive.com.au.
A request to access, update or correct any information should be directed to the Promoter at apac-marketing@cbsinteractive.com.
13. Amendments to Terms and Conditions
The Promoter may change the Terms and Conditions, including the competition rules, and the Privacy Policy at any time. In the unlikely scenario this will happen the Promoter will notify each Entrant.
