RIP CURL HAWAII COMPETITION
1. Instructions on how to enter and prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
2. Entry is open to residents of Australia aged 18 years and older who can travel to the Hawaii (United States of America) from the 21st January 2017 to July 2017. Employees of the Promoter, associated agencies and their immediate families, are not eligible to enter.
3. One entry per person will be permitted.
4. The promotion commences on the 1st September 2016 and closes at 11:59pm (AEDST) on the 15th October 2016. The judging will be done by a panel of judges appointed by the Promoter. The judging will take place at Bauer Media, Building 8, 658 Church Street, Richmond VIC, 3121 and will begin on the 17th October 2016. The winner will be notified by telephone and e-mail using the contact details given in their entry.
5. To enter, individuals must go to the www.cosmopolitan.com.au/ripcurl during the promotional period and follow the prompts to the competition page. Individuals must complete the entry form including their full name, mailing address, current email address, date of birth, daytime Telephone number and answer the competition question in 25 words or less “What is your favourite Rip Curl Bikini Style and why?” and submit the entry as instructed.
6. This is a game of skill, chance plays no part in determining the winner. Each entry will be individually judged based on its literary and creative merit of the answer to the question provided and suitability to the promotion. The judges’ decision in relation to any aspect of the competition will be final and binding on every person who enters. No correspondence will be entered into.
7. The Entrant warrants to the Promoter that the entry submitted is an original artistic work of the Entrant that does not infringe the rights of any third parties. If the entry or any part of the information provided to the Entrant in relation to the entry was provided by a third party, the Entrant warrants that they have obtained the relevant copyright permission to submit the entry for the purposes of this promotion. The entrant agrees to indemnify the promoter against all claims and costs by third parties arising from a breach of the warranty set out in this condition.
8. The Promoter is entitled to use any of the entries submitted in any manner and for any purpose at its absolute discretion, including using the entries for future promoter’s or their agents book publications, promotional, marketing and publicity purposes without any further reference or payment or other compensation to the entrant. The promoter is entitled to amend, edit, select, crop, retouch, add to or delete from any part of the submitted entry.
9. Entries must not be offensive, defamatory or racist. Any entry which the judges deem inappropriate will be invalid. The entrant agrees to indemnify the Promoter.
10. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions will be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
10. The best (1) valid entry as determined by the judges will be deemed the major prize winner and will win:
• Two (2) x adult economy return flights to Honolulu, Hawaii departing from the winner’s closest Australian state capital city valued at up to $4,600 (including taxes) (depending on point of departure).
• One way shared airport transfer for two people from airport to Modern Waikiki hotel, valued at up to $85.00
• Two (2) x nights’ accommodation at the Modern Waikiki, in a standard city scape room twin share, valued at up $1,275
• Return shared transfers for two people from the Modern Waikiki hotel to Turtle Bay Resort and Turtle Bay resort to Honolulu airport valued at up to $695
• Three (3) x nights’ accommodation at Turtle Bay North Shore hotel, in a standard partial ocean view room twin share, valued at up to $2,225
• Two (2) x $500 (USD) vouchers to any Rip Curl store in Waikiki
• $1,500 (AUD) spending money.
• In the event, the winner is over 21 years of age and has a full Australian driver’s license the winner will be awarded four (4) day car hire to be collected in Waikiki and returned to Honolulu airport in a compact Size car including GPS valued at up to AUD $490.00 instead of the transfers to Turtle Bay and return.
The total prize pool is valued at up to $11,380 (AUD) (including taxes) (depending on point of departure). If the winner chooses to the take the car hire option prize the total prize pool is valued at up to $12,169 (AUD) (as of 17 August 2016) (including taxes, depending on point of departure). Any ancillary costs associated with redeeming the prize are not included; these are the responsibility of the winner.
11. It is a condition of accepting the major prize, the winner agrees to be interviewed, photographed, filmed at a time and date or supply photographs and comments when redeeming the prize as determined by the Promoter to be used by the Promoter or their agents for a story or feature on this promotion to be developed and featured in COSMOPOLITAN magazine, COSMOPOLITAN website or COSMOPOLITAN social media pages (or any other form of media it deems suitable) without further remuneration or reference to the winner. The inclusion of any such feature (including but not limited to creative control of the feature) will remain with the Promoter at all times.
12. The Prize must be redeemed in full and as a package from commencing date 21st January 2017 to July 2017 and must be booked 60 days prior to travel. In the event that the winner is unable to redeem the prize on the dates stipulated by the Promoter, and the winner is unable to transfer the prize to a nominated person, then the prize will be forfeited by the winner and neither cash nor another prize will be awarded in lieu of the forfeited prize. In the event that the entire prize is forfeited by the winner, the Promoter will award the prize to the next best valid entry as determined by the judges.
13. The winner and their companion must be 18 years and over to redeem the prize.
14. Redemption of prize is subject to booking and availability at time of booking. Prize is a single event holiday and cannot be separated into different holiday vacations.
15. The winner (and their companion) are responsible for all other expenses including spending money, meals (unless specified), drinks, transfers (unless specified), laundry charges, activities (unless specified), incidentals, energy surcharges, gratuities, services charges, passports, visas, travel insurance and all other ancillary costs. Travel insurance is highly recommended to protect against the additional costs incurred in the event of unforeseen circumstances.
16. Unless expressly stated in these terms and conditions all other expenses (including travel to and from the departure point) become the responsibility of the winner.
17. It is a condition of accepting the prize that the winner may be requested to present their credit card upon arrival at any hotel to cover all incidentals they may incur including their stay at that hotel.
18. A valid passport is required for all international journeys. All passports must be valid for six (6) months prior to departure. It the responsibility of the winner and their travel companions to ensure they have all required travel documentation (including but not limited to passports & visas) as required for travel to the destination point. All costs associated with obtaining this travel documentation is the responsibility of the winner.
19. The winner and (their companion) are responsible to obtain all required documentation and visas to enter United States of America and Canada. If the winner should also be a U.S. citizens will require additional documentation to enter Canada. A Canadian visa may be required for Non-U.S. citizens; check your home country requirements for entering Canada. From 4 September 2010, the United States government will charge a US$14 as payment for the mandatory ESTA for all individuals proposing to travel to the United States under the Visa Waiver Program. The fee is payable by credit card and, it is very important to make payments through the official website. ESTA’s official website is https://esta.cbp.dhs.gov/esta/. This cost is the responsibility of the winner and their friend.
20. The Two (2) flights must be utilized at the same time, for the same travel dates, to the same destination.
21. Transport to and from Departure point including but not limited to additional Domestic airfares if required, any additional meals, any extra sightseeing or activities, any additional accommodation, personal spending money, and all other ancillary costs, as well as obtaining any of these, are the responsibility of the winner and their travel companions. Prize also excludes medical expenses, items of a personal nature, beverages, optional tours not outlined, laundry, telephone calls, additional nights, room upgrades or other ancillary costs associated with redeeming the prize other than those specified. These costs and expenses are the responsibility of the winner. Any extension to the duration of the prize is at the winner’s sole expense and subject to availability at the time of booking. For the removal of doubt, taxes for international travel are included in the prize winning international airfares provided by the Promoter.
22. All prize items are valued inclusive of GST, is valued as of 17th August 2016 and the Promoter takes no responsibility for any variations in item values. The components of the Prize may alter for reasons beyond the Promoter’s control. The Prize is not, nor any component thereof, transferable, exchangeable or redeemable for cash. No components of the Prize can be exchanged for other travel or accommodation at other destinations. In the event that any prize item is unavailable, the Promoter reserves the right to substitute a prize item of equal or greater value. Any taxes (other than GST, if any) which may be payable as a consequence of a winner receiving the prize are the sole responsibility of the Winner.
23. It is a condition of accepting the prize that the winner (and any traveling companion) must comply with all the conditions of use of the prize and prize supplier’s requirements
24. The winner (and any companion) must travel on the same dates, depart from and return to the same point of departure and travel together. Frequent flyer points will not form part of the prize. Standard conditions for tickets and accommodation apply. The Promoter’s decision is final and no correspondence will be entered into. It is the winner’s responsibility to ensure that they have all relevant documentation included but not limited to identification in order to travel. All elements of the prize must be taken together within the one trip. The winner will not be compensated for unused portions of the prize.
25. All prizes must be taken as offered. The prize, or any unused portion of the prize, is not transferable or exchangeable and cannot be redeemed as cash. The prize is not valid in conjunction with any other offer. The prize is valued in Australian dollars. The Promoter accepts no responsibility for any variation in the prize value. Prize winners are advised that tax implications may arise from their prize winnings and they should seek independent financial advice prior to acceptance of their prize. In the event that a portion of the prize is awarded to the winner in the form of a voucher / ticket / pass, redemption of that portion of the prize will be subject to the terms and conditions stipulated on the voucher / ticket / pass. The Promoter will not be liable for any voucher / ticket / pass that has been lost, stolen, forged, damaged or tampered with in any way.
26. In acceptance of the prize, the Winner acknowledges that they may incur ongoing costs associated with the prize which are the entire responsibility of the winner.
27. Prize is subject to the standard terms and conditions of individual prize and service providers.
28. As a condition of accepting the prize, the winner (and their companion) must sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.
29. The winner and their guest must not engage in any illegal or unsafe behaviour whilst participating in the prize. To the extent allowable by law, the Promoter and its partners exclude any legal liability or responsibility for legal or otherwise incidents or activities engaged in by the winner or their guest during participation in the prize.
30. In the event that for any reason whatsoever the Winner does not take the prize at the time stipulated by the Promoter, then the prize will be forfeited by the Winner and cash will not be awarded in lieu of the prize.
31. In the event that a prize, or part of a prize, is unavailable, the Promoter reserves the right to substitute the prize or part of the prize in its discretion with an alternative prize or part of the prize to the same and equal recommended retail value and/or specification.
32. The promoter is neither responsible nor liable for any late lost or misdirected mail (including but not limited to prizes).
33. The Promoter is not responsible nor liable for any prize damaged in transit in the delivery of their prize
34. Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used.
35. When an entrant submits any materials via the promotion including comments, recordings and images (“Content”), the entrant, unless the Promoter advises otherwise, licenses and grants the Promoter, its affiliates and sub-licensees a non-exclusive, royalty-free, perpetual, worldwide, irrevocable, and sub-licensable right to use, reproduce, modify, adapt, publish and display such Content for any purpose in any media, without compensation, restriction on use, attribution or liability. Entrants warrant that the Content is their original work and that it does not infringe the rights of any third party. Entrants agree not to assert any moral rights in relation to such use and warrant that they have the full authority to grant these rights.
36. Entrants agree that they are fully responsible for the Content they submit. The Promoter shall not be liable in any way for such Content to the full extent permitted by law. The Promoter may remove any Content without notice for any reason whatsoever. Entrants warrant and agree that: (a) they will not submit any Content that is unlawful or fraudulent, or that the Promoter may deem in breach of any intellectual property, privacy, publicity or other rights, defamatory, obscene, derogatory, pornographic, sexually inappropriate, violent, abusive, harassing, threatening, objectionable with respect to race, religion, origin or gender, not suitable for children aged under 15, or otherwise unsuitable for publication; (b) they will obtain prior consent from any person or property that appears in their Content; (c) they will obtain full prior consent from any person who has jointly created or has any rights in the Content, to the uses and terms herein; (d) their Content shall not contain viruses or cause injury or harm to any person or entity; and (e) they will comply with all applicable laws and regulations, including without limitation, those governing copyright, content, defamation, privacy, publicity and the access or use of others' computer or communication systems.
37. In the event of unforeseen circumstances, war, terrorism, state of emergency or disaster (including but not limited to natural disaster)the Promoter reserves the right to subject to reference to all relevant state and territory rules and regulations, to cancel, terminate, modify or suspend the promotion.
38. If a medical circumstance in some way restricts your ability to enter the competition through the required mechanic, you are still eligible to enter however you must briefly state your circumstances upon entry.
39. If your entry is selected as a winning entry, validation of your circumstances/ the validity of your entry will be undertaken by the Promoter. Method of validation (without limitation) will be determined by the Promoter in its complete discretion. If the winning entry is deemed to be a winner, the winner will be notified as per the terms and conditions herein. In the event that the Promoter requests the entrant to sign any legal documents relating to the verification of their medical circumstance, the legal documents will take the form determined by the Promoter. It is a condition of accepting the prize the winner sign any such legal documentation.
40. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
41. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use of the prize.
42. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
Privacy:
43. The Promoter collects personal information (“PI”) in order to conduct the promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this PI. The Promoter will also use and handle PI as set out in its privacy policy, which can be accessed by visiting http://www.bauer-media.com.au/privacy.htm. In addition to any use that may be outlined in the Promoter’s Privacy Policy, the Promoter may also, for an indefinite period, unless otherwise advised, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. Entrants should direct any request to opt out, access, update or correct PI to the Promoter and direct any complaints regarding treatment of their PI according to the Privacy Policy. All entries become the property of the Promoter.
